THE MINISTER OF FINANCE
Pursuant to the Posts and Telecommunications Ordinance dated May 25, 2002;
Pursuant to the Ordinance on Product Quality dated December 24, 1999;
In order to create a favorable environment for the issuance and trading of securities, ensuring that the securities market operates in an organized, safe, and effective manner, the Ministry of Finance guides the amendment and supplementation of Circular No. 110/2002/TT-BTC dated December 12, 2002 guiding the collection, payment, management, and use of fees and charges in the banking, securities, and insurance sectors (hereinafter referred to as Circular No. 110/2002/TT-BTC) as follows:
Pursuant to Decree No. 77/2003/NĐ-CP dated July 1, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
Pursuant to Decision No. 37/2002/QD-TTg dated March 14, 2002 of the Prime Minister regarding the Government's Action Program to implement Resolution No. 07-NQ/TW dated November 27, 2001 of the Politburo on international economic integration;
After receiving comments from the Ministry of Posts and Telecommunications (in Circular No. 1624/BBCVT-KHTC dated August 19, 2004 and Circular No. 1997/BBCVT-KHTC dated October 11, 2004);
At the request of the Director of the Tax Policy Department,
DECISION:
Article 1. This Decision promulgates the Schedule of Fees and Charges for Postal Quality Management and Telecommunications Services.
Article 2. Organizations and individuals subject to assessment and certification of postal quality by the competent state agency for postal and telecommunications shall pay fees and charges as prescribed in the Schedule of Fees attached hereto.
Article 3. No fees or charges for postal quality management and telecommunications services shall be collected from:
1. Dedicated telecommunication networks of the Ministry of Public Security, the Ministry of National Defense, and the Ministry of Foreign Affairs serving directly national security, defense, and diplomacy;
2. Emergency communication networks established during typhoons, floods, and other natural disasters;
3. Communication networks of international organizations in Vietnam enjoying diplomatic immunity (except for the collection of charges for issuing conformity certificates for postal and telecommunications equipment and materials).
Article 4. The revenue from fees and charges for postal quality management and telecommunications services stipulated in this Decision is a state budget revenue item, to be managed and utilized as follows:
1. The fee and charge collecting agency for postal quality management and telecommunications services (the fee and charge collecting agency) may retain 90% (ninety percent) of the collected fees and charges before remitting them to the state budget to cover expenses for postal quality management, telecommunications activities, and fee and charge collection according to prescribed regulations;
2. The fee and charge collecting agency is responsible for declaring, remitting, and settling accounts for the remaining 10% of the collected fees and charges into the state budget according to the corresponding chapters, types, items, sub-items of the current state budget classification.
Article 5.
This decision shall take effect fifteen days from the date of publication in the Official Gazette.
2. This Decision replaces Decision No. 150/2000/QD-BTC dated September 19, 2000 of the Minister of Finance on the Schedule of Charges for Postal Quality Management.
3. Matters related to the collection, payment, management, and utilization of revenue from fees and charges, collection receipts, publicizing fee and charge collection regulations... not addressed in this Decision shall be implemented in accordance with the guidance provided in Circular No. 63/2002/TT-BTC dated July 24, 2002 of the Ministry of Finance guiding the implementation of laws and regulations on fees and charges.
Article 6. Organizations and individuals subject to payment of fees and charges for postal quality management and telecommunications services, units assigned the task of collecting fees and charges for postal quality management and telecommunications services, and relevant agencies are responsible for implementing this Decision./.
