PRIME MINISTER
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the Labor Code of 1994; the Law Amending and Supplementing Certain Articles of the Labor Code dated April 2, 2002;
Pursuant to the Military Service Law of 1981; the Law Amending and Supplementing Certain Articles of the Military Service Law dated June 22, 1994;
Pursuant to the Officer Law of the Vietnam People's Army of 1999;
Pursuant to the Ordinances on Public Security Forces and the Ordinance on Police Forces of Vietnam;
At the proposal of the Minister of National Defense and the Minister of Public Security.
DECISION:
Article 1. Scope and Applicability
1. This Decision stipulates detailed implementation of certain regulations, policies, and steps to address employment for military personnel and public security officers who have completed their service obligations according to the law, are in good health, have a need for vocational training, and seek employment, including:
a) Officers and professional soldiers belonging to the Vietnam People's Army and the Vietnam People's Public Security;
b) Non-commissioned officers and soldiers of the Vietnam People's Army; non-commissioned officers and police officers of the Vietnam People's Public Security.
2. This Decision does not apply to the following individuals:
a) Military personnel and public security officers who have not fulfilled their service obligations;
b) Military personnel and public security officers who have been discharged from service for at least 12 months (counted from the date the competent authority decided to discharge them);
c) Individuals who are under criminal investigation or have been disciplined with the revocation of their military or public security titles.
Article 2. Management and Selection
The Ministry of National Defense and the Ministry of Public Security shall take the lead and coordinate with local authorities where military personnel and public security officers reside to select the correct subjects, meeting the requirements for vocational training and job placement as prescribed in this Decision.
Article 3. Requirements for Vocational Training
The vocational training provided for military personnel and public security officers who have completed their service obligations as stipulated in this Decision must be carried out according to plans approved by the competent authority, ensuring diversity in trades, meeting both immediate and long-term needs, and being suitable for the residential areas of military personnel and public security officers.
Article 4. Program and Duration of Vocational Training
1. The Ministry of National Defense and the Ministry of Public Security shall cooperate with the Ministry of Labor, Invalids, and Social Affairs, relevant ministries, sectors, and localities to develop a list of appropriate trades for vocational training for military personnel and public security officers who have completed their service obligations.
2. Depending on the trade or group of trades, the Ministry of National Defense and the Ministry of Public Security shall cooperate with the Ministry of Labor, Invalids, and Social Affairs to determine the program and duration of vocational training at military and public security training institutions, ensuring effectiveness and high quality.
Article 5. Rights of Military Personnel and Public Security Officers when Selected for Vocational Training
1. They shall enjoy separation allowances and job creation allowances as prescribed by the Government.
2. They shall be introduced to vocational training institutions and job placements within and outside the military and public security by the competent authority.
3. They shall study and train according to the objectives and requirements of the training plan or vocational training contract.
4. They shall use the facilities and equipment of the training institution for learning and training purposes according to the plan.
5. They shall be guaranteed workplace safety and hygiene as prescribed by law.
6. They shall directly or through their lawful representatives raise their wishes to the command or leadership of the training institution to resolve issues related to the learning process.
7. They shall be prioritized for job placement commensurate with their technical and professional qualifications obtained through training and further education.
8. When changing careers or returning to their former units upon discharge or changing careers at the request of authorized state agencies, they shall be arranged suitable jobs based on their professional qualifications or retrained in a new trade to meet job requirements.
9. They shall be prioritized for short-term overseas labor assignments.
10. Military personnel and public security officers who return to their place of origin within 12 months from the date the competent authority decides to discharge them and wish to undergo vocational training or job placement shall be introduced to vocational training institutions or job placements for study or job placement by the district (county) military authority where they reside.
11. They shall be awarded a diploma upon graduation or a vocational certificate upon completion of the course.
Article 6. Obligations of military personnel and public security officers when selected for vocational training
1. Strictly comply with state laws, respect local customs and traditions of the people in the area where the vocational training institution and job placement agency are located.
2. Fully implement vocational training contracts, supplementary vocational training contracts, and vocational skill enhancement contracts signed with the vocational training institution.
3. Strictly adhere to the regulations and internal rules of the vocational training institution and job placement agency.
4. Adhere to the labor safety and hygiene regulations of the vocational training institution.
5. Pay tuition fees fully and on time as stipulated or according to the vocational training contract.
Article 7. Job Placement
1. Military personnel and public security officers who graduate from vocational training institutions shall be given priority in being introduced and selected for employment in state agencies, organizations, enterprises, and other economic and social organizations.
2. The Ministry of National Defense, the Ministry of Public Security, and the Ministry of Labor, Invalids, and Social Affairs shall take the lead and coordinate with central ministries, departments, provincial people's councils, and other economic and social organizations to introduce jobs for military personnel and public security officers who have completed their service and graduated from vocational training institutions.
Article 8. System of Vocational Training Institutions and Job Placement Agencies under the Ministry of National Defense and the Ministry of Public Security
1. Vocational training institutions and job placement agencies under the Ministry of National Defense and the Ministry of Public Security are part of the national vocational school system, subject to state management over vocational training by the Ministry of Labor, Invalids, and Social Affairs; direct management by the Ministry of National Defense and the Ministry of Public Security.
2. The Ministry of National Defense and the Ministry of Public Security, based on their functions and tasks, shall cooperate with relevant ministries and departments to build a system of vocational training institutions and job placement agencies that meet the requirements of their tasks.
Article 9. Budget Ensuring Vocational Training and Job Placement
1. The state budget ensures the main funding sources for the operation of vocational training institutions and job placement agencies under the Ministry of National Defense and the Ministry of Public Security; ensuring subsidies for job creation for military personnel and public security officers upon discharge.
2. Annually, based on plans for the discharge of military personnel and public security officers, the Ministry of National Defense and the Ministry of Public Security shall prepare plans to support the state budget for the job program of the Ministry of National Defense and the Ministry of Public Security.
3. The Ministry of Finance and the Ministry of Planning and Investment, based on the proposed budget support plan for vocational training and job placement of the Ministry of National Defense and the Ministry of Public Security, shall allocate the budget to ensure the vocational training and job placement programs of the Ministry of National Defense and the Ministry of Public Security.
Article 10. Effective Date
This decision shall take effect fifteen days from the date of publication in the Official Gazette.
2. The Ministry of National Defense and the Ministry of Public Security shall take the lead and coordinate with the Ministry of Labor, Invalids, and Social Affairs and relevant ministries and departments to guide the implementation of this Decision.
The Ministers, Heads of ministerial-level agencies, Heads of government agencies, and Chairpersons of provincial People's Committees and municipal People's Committees directly under the Central Government are responsible for enforcing this Decision./.
