Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the National Archives Law dated April 4, 2001;
Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;
Pursuant to Decree No. 48/2008/NĐ-CP dated April 17, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;
Considering the proposal of the Minister of Home Affairs,
DECISION:
Article 1. Position and Functions
1. The State Records and Archives Administration is an agency directly under the Ministry of Home Affairs, performing the function of advising and assisting the Minister of Home Affairs in managing state affairs on records and archives throughout the country; managing national archival materials and implementing public services as prescribed by law.
2. The State Records and Archives Administration has legal personality, a seal with the State Emblem, a separate account as prescribed by law, and its office is located in Hanoi City.
b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;
The State Records and Archives Administration performs the following tasks and powers:
1. Submit to the Minister of Home Affairs for submission to the Government and the Prime Minister for consideration and decision:
a) Drafting laws, ordinances, draft resolutions of the National Assembly, the Standing Committee of the National Assembly; drafting decrees of the Government, draft decisions of the Prime Minister regarding records and archives;
b) Strategies, plans, national target programs, projects, and proposals on records and archives.
2. Submitting to the Minister of Home Affairs for decision and issuance:
a) Draft circulars and other management documents on records and archives;
b) Long-term, five-year, and annual plans on record and archive work;
c) Standards, procedures, regulations, and economic-technical norms on records and archives;
d) Other programs, projects, and proposals on records and archives.
3. Organizing propaganda, dissemination, and education on laws related to records and archives.
4. Implementing legal regulatory documents, strategies, plans, programs, projects, and proposals after they have been issued or approved by competent authorities.
5. Issuing guidance documents on record and archive business operations as prescribed by law.
6. Conducting the collection, acquisition, supplementation of archival materials; organizing the appraisal, determination of value, protection, statistics, preservation, restoration, and insurance of archival materials; organizing declassification, publication, introduction, exhibition, display, and serving the exploitation and utilization of archival materials preserved at National Archive Centers.
7. Storing digital information in state agencies.
8. Uniformly managing national statistics on records and archives.
9. Organizing the implementation of scientific research, development, application, and transfer of technology in records and archives; modernizing material and technical infrastructure in record and archive activities.
10. Training and professional development in records and archives.
11. Building and implementing a program for administrative reform according to the goals and content of the state administrative reform program already approved by competent authorities.
12. Inspecting and supervising the implementation of laws on records and archives; handling complaints, accusations, and violations of laws on records and archives.
13. Managing the organizational structure, cadres, civil servants, and staff members and using the authorized establishment as prescribed; implementing salary systems and policies, rewards, and disciplinary measures for cadres, civil servants, and staff members under the administration of the Bureau as prescribed by law and delegated by the Minister of Home Affairs.
14. Managing financial resources and assets assigned and organizing the implementation of the budget allocated as prescribed by law.
15. International cooperation on records and archives according to the delegation of the Minister of Home Affairs.
16. Performing other tasks assigned by the Minister of Home Affairs.
Article 3. Organizational Structure
1. Organizations assisting the Director in managing state affairs:
a) Central Record and Archive Business Unit.
b) Local Record and Archive Business Unit.
c) Planning and Finance Department.
d) International Cooperation Department.
đ) Record and Archive Inspection.
e) Organization and Cadre Department.
g) Office.
2. Service organizations under the Bureau:
a) Center for Science and Technology in Records and Archives.
b) Information Technology Center.
c) National Archive Center I.
d) National Archive Center II.
đ) National Archive Center III.
e) National Archive Center IV.
g) National Archive Material Insurance Center.
h) National Archive Material Restoration and Reproduction Center.
i) Vietnam Records and Archives Magazine.
k) Central Records and Archives Secondary School (with a branch in Da Lat City).
The establishment, merger, dissolution of other service organizations under the State Records and Archives Administration shall be decided by the Minister of Home Affairs.
Article 4. Leadership of the Department
1. The State Records and Archives Administration has a Director and not more than three Deputy Directors.
2. The Director is appointed and relieved of duty by the Minister of Home Affairs and is responsible to the Minister of Home Affairs for all activities of the State Records and Archives Administration.
The Director specifies in detail the functions, tasks, powers, and organization of units under the Bureau; appoints and relieves of duty leaders and managers under the Bureau as prescribed by law and delegated by the Minister of Home Affairs.
3. Deputy Directors are appointed and relieved of duty by the Minister of Home Affairs upon the recommendation of the Director and are responsible to the Director for the areas of work they are assigned to manage.
Article 5. Effectiveness and Responsibility for Implementation
1. This Decision takes effect from August 12, 2009, and replaces Decision No. 177/2003/QĐ-TTg dated September 1, 2003 of the Prime Minister stipulating the functions, tasks, powers, and organizational structure of the State Records and Archives Administration.
2. The Minister of Home Affairs, Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairmen of People's Committees of provinces and centrally governed cities, and the Director of the State Records and Archives Administration are responsible for implementing this Decision./.
