DIRECTIVE
OF THE MINISTER OF CONSTRUCTION
Regarding the implementation of construction practice registration work under the new regulation
Implementing Directive No. 171/TTg dated December 16, 1992 of the Prime Minister on anti-corruption, waste, and loss in basic construction; based on the Law on the Organization of the Government which defines the functions of Ministries and ministerial-level agencies approved by the National Assembly on September 30, 1992; the Ministry of Construction has issued the Construction Practice Registration Regulation attached to Decision No. 22/BXD-QLXD dated January 26, 1993. This regulation shall be uniformly implemented throughout the country from March 1, 1993.
The Ministry of Construction requests the Departments of Construction to promptly implement the new Construction Practice Registration Regulation and pay attention to the following points:
1. All construction enterprises established according to Decree No. 388/HĐBT dated November 20, 1991 and other enterprise laws shall obtain construction practice licenses in accordance with the new Regulation. The Departments of Construction must establish a Board to examine and issue construction practice licenses for these enterprises. Old construction practice registration certificates of enterprises that have been established but have not yet completed the necessary procedures shall continue to be valid until June 30, 1993.
2. Enterprises engaged in design that were recognized and established before Directive No. 171/TTg dated December 16, 1992 and Decision No. 22/BXD-QLXD dated January 26, 1993 shall be granted licenses according to Article 8 of the Regulation, depending on their capacity.
The Departments of Construction need to strengthen their affiliated design organizations and review other economic sector design organizations to ensure the quality of design work and consulting services in compliance with the law without undertaking construction project contracts. Experimental construction activities of consulting and design enterprises will be considered for approval based on specific research topics and the capabilities of the enterprises.
3. Construction enterprises shall only engage in installation work. General Construction Corporations, Construction Enterprise Associations, and Departments may organize independent survey and design enterprises to undertake survey and design work. Designs carried out by these organizations must be reviewed and approved by competent design examination authorities in accordance with current regulations.
The Ministry of Construction requests the Departments of Construction to coordinate with relevant departments and agencies at the local level to report to the Chairman of the People's Committee of provinces and centrally-administered cities on the plan to implement this work in the first quarter of 1993.
