CIRCULAR OF THE JOINT MINISTRIES

EDUCATION - LABOR - WAR INVALIDS AND SOCIAL AFFAIRS - FINANCE - AGRICULTURE AND FOOD INDUSTRY
GUIDELINES FOR IMPLEMENTING REGULATIONS AND POLICIES FOR KINDERGARTEN TEACHERS AND NURSES IN COMMUNES AND WARD

Implementing Directive No. 241-CT dated September 4, 1988 of the Chairman of the Council of Ministers on addressing urgent issues in education and training; after receiving opinions from relevant departments and ministries, the Inter-Ministerial Committee for Education - Labor - War Invalids and Social Affairs - Finance - Agriculture and Food Industry hereby provides guidelines for implementing regulations and policies for kindergarten teachers and nurses outside state staff in communes and wards as follows:

- Kindergarten teachers and nurses who have not graduated from kindergarten teacher training schools shall be entitled to living allowances at 90% of the level of living allowances for teachers with the same educational qualifications (at the initial level).

- The living allowance stipulated above is the minimum level that teachers can enjoy. Localities with the ability to provide higher than the prescribed level may decide accordingly.

I - REGULATIONS FOR KINDERGARTEN TEACHERS AND NURSES

1. Living Allowance.

- Kindergarten teachers and nurses who have been trained at kindergarten teacher training schools according to the unified curriculum of the Ministry of Education and the Committee for Mothers and Children Protection (previously) shall be entitled to living allowances equivalent to the salary system (including base salary and additional allowances such as incentives, seniority, overtime, region, etc.) of state staff teachers with the same professional qualifications and years of service as stipulated in Decree No. 235-HĐBT dated September 18, 1985 and Decision No. 203-HĐBT dated December 28, 1988 of the Council of Ministers. The living allowance will be recalculated as follows:

2. Ration.

a) Kindergarten teachers and nurses are entitled to purchase 20 kilograms of rice (or 13 kilograms of rice) per month at the price sold to commune and ward cadres and health workers.

b) Female teachers are entitled to receive contracted land (or be allocated land or forest). The minimum land allocation is equal to the average per capita of the cooperative. Dependents such as parents and children of the female teacher are considered as cooperative members and also receive contracted land. Cooperative services for the family's contracted land are applied similarly to those for cooperative members' land.

For families of teachers facing difficulties, cooperatives may allocate additional assistance funds, or if there is a shortage of food supply each month, the cooperative may sell directly to them at the same price as for cooperative members.

3. Social Insurance.

In the meantime, implement the guidelines set forth in Circular No. 9-LĐTBXH/TT dated April 18, 1989 of the Ministry of Labor - War Invalids and Social Affairs.

4. Source of Funding.

The funding for living allowances, additional allowances, and subsidies for kindergarten teachers and nurses is sourced from the commune and ward budgets and partially from contributions by the people. People's Committees of provinces, cities, and centrally governed municipalities shall base their guidance on the actual situation of each locality to determine appropriate levels of people's contributions (from 30% to 70% of the funding for teachers) to ensure sufficient resources to meet the regulations for kindergarten teachers and nurses as stipulated in this Circular.

For mountainous, remote island, border, and newly economic zones where the commune budget and people's contributions are insufficient to cover educational expenses, the county, provincial, or city budget shall subsidize based on specific conditions to ensure the implementation of regulations and policies for teachers as specified in this Circular.

II - IMPLEMENTATION PROVISIONS

1. Commune and Ward People's Committees and County, District, and City Education Departments must develop plans to maintain and expand kindergarten and nursery schools in their localities. Where parents have a need to send their children and the commune and ward have facilities and classrooms to ensure proper care and education, the Commune and Ward People's Committees shall cooperate with the Education Department to select teachers to teach the children. Teachers who have been trained and performed well shall be given priority in selection. Based on the number of teachers working from the beginning of the academic year, the Commune and Ward People's Committees shall prepare organizational documents, policies, and other costs to ensure the operation of the kindergarten and nursery school in their locality and include the budget estimate in the annual commune and ward financial plan.

2. Commune and Ward People's Committees are responsible for ensuring facilities, classrooms, and timely provision of all policies and benefits for teachers. Teachers are accountable to the Commune and Ward People's Committees and the parents regarding the quality of childcare and education.
