CIRCULAR

OF THE MINISTRY OF LABOUR NUMBER 9-LD/TT ON AUGUST 5, 1985 GUIDING
IMPLEMENTATION OF RESOLUTION NO. 150-CT ON APRIL 26, 1985
OF THE CHAIRMAN OF THE COUNCIL OF MINISTERS REGARDING INITIAL SUPPLY
FOR PERSONS WHO ARE REASSIGNED AND HIRED TO WORK LONG-TERM AT ENTERPRISES, INDUSTRIES, AGRICULTURAL AND FORESTRY STATIONS IN MOUNTAINOUS REGIONS, ISLANDS, AND NEW ECONOMIC ZONES
On April 26, 1985, the Chairman of the Council of Ministers issued Resolution No. 150-CT on initial supply for persons reassigned and hired to work long-term at enterprises, industries, agricultural and forestry stations in mountainous regions, islands, and new economic zones, aiming to encourage workers to work in these areas, while also contributing to creating conditions for workers to quickly stabilize their lives and be committed to working long-term.
To implement this initial supply system uniformly, the Ministry of Labour guides as follows:

I. OBJECTS ELIGIBLE FOR INITIAL SUPPLY AND WORKING LOCATIONS

The objects eligible for the initial supply regime stipulated in Article 1 of Resolution No. 150-CT include:

 

a) Cadres, workers, civil servants, military officers, and police officers transferred entirely:

1. Recipients

- From cities and plains provinces to mountainous provinces.

- From towns and plains districts to mountainous towns and districts of provinces.

- From mainland to islands.

- From other places to new economic zones.

b) Workers recruited into the state's permanent workforce:

- Graduates from universities, colleges, vocational high schools, and technical training schools.

- Workers outside the state sector.

- Military personnel and volunteers who have changed careers.

2. Working Locations

Initial supply will only be provided to the aforementioned objects working at production units: enterprises, construction sites, agricultural stations, and forestry stations (referred to as using units) located in mountainous provinces, islands, and new economic zones managed by the central government and localities (provinces, districts).

1. Annually, based on the recruitment targets decided by the competent authority, the using unit shall prepare a plan to recruit workers and send it to the labour department where the workers are sourced, and prepare a list of goods for initial supply to be sent to the local commerce department where the workers are sourced to contract for purchasing goods.

The using unit is responsible for ensuring the quantity and type of goods according to the prescribed regulations and supplying them to workers before they depart for their workplace.

 

II. IMPLEMENTATION

The local labour department where the workers are sourced is responsible for inspecting the initial supply.

For individual workers who are reassigned or recruited within the plan, the using unit shall purchase goods locally to provide initial supply.

In cases where the trade sector does not have sufficient goods for sale or if workers request, the using unit may provide initial supply in cash according to the retail price.

2. To use initial supply effectively, when providing initial supply (either in kind or in cash), the using unit must issue a receipt detailing the material responsibility of the worker and obtain signatures from both parties.

Within 18 months, if a worker is dismissed or leaves voluntarily, they must compensate for the value of the supplied items according to Article 3 of Resolution No. 150-CT and the implementation guidance of the Ministry of Finance. 3. When providing initial supply to reassigned cadres and workers and newly recruited workers, the using unit should clearly explain the purpose, significance, and content of the initial supply system so that workers understand the state's concern for their living conditions, thereby encouraging them to work with high productivity and quality, contributing to the redistribution of labour nationwide.

During the implementation of Resolution No. 150-CT of the Chairman of the Council of Ministers and this Circular, if there are any difficulties, the relevant ministries and localities are requested to promptly report to the Ministry of Labour for research and resolution.

Within a period of eighteen months, if an employee is dismissed or voluntarily leaves their job, they must compensate for the value of the items provided according to Article 3 of Decision No. 150-CT and the implementation guidance issued by the Ministry of Finance. 3. When transferring the initial provision to workers and civil servants who are transferred and employees who are newly hired, the employer must clearly explain the purpose, significance, and content of this initial provision system so that employees can understand the State's concern for their living conditions, thereby allowing them to work with high productivity and quality, contributing to the redistribution of labor nationwide.

During the implementation of Decision No. 150-CT of the Chairman of the Council of Ministers and this Circular, if there are any difficulties, it is recommended that ministries and localities promptly report to the Ministry of Labor for research and resolution.
