DATE OF JULY 22, 1982 GUIDING IMPLEMENTATION OF THE RESOLUTION
NO. 106/HĐBT OF JUNE 28, 1982 OF THE STATE COUNCIL SUPPLEMENTING THE RETIREMENT AND DISABILITY BENEFITS REGIME FOR THE PEOPLE'S POLICE
On June 28, 1982, the State Council issued Decision No. 106-HĐBT supplementing the retirement and disability benefits regime for the People's Police.
According to Article 1 and Article 2 of Decision No. 106-HĐBT, officers, soldiers of the People's Security Force and Public Security Force who retire or stop working due to disability, in addition to the current benefits, shall receive a monthly allowance equal to 10% to 20% of their basic salary before retirement or stopping work due to disability. The duration of receiving this allowance is half the time served in the People's Police.
Those retiring or stopping work due to disability from January 1, 1975 onwards will also receive the aforementioned allowance from the date of this decision.
After reaching consensus with the Ministry of Interior, the Ministry of Labor and Social Affairs provides detailed guidance on implementation as follows:
1. Recipients of the Allowance.
Officers, non-commissioned officers, and soldiers belonging to the People's Security Force and Public Security Force within the establishment of the People's Police who retire or stop working due to disability shall receive a monthly allowance from February 21, 1975 onwards (the date of issuance of Decision No. 47-CP stipulating that the People's Police implement the retirement and disability benefits regime similar to the People's Army).
2. Benefit Regime.
Officers, non-commissioned officers, and soldiers of the People's Police mentioned above, with a period of service in the establishment of the People's Police (including time serving in the People's Army, excluding time serving in village police) from five to ten years shall receive an allowance equal to 10% of their basic salary before retirement or stopping work due to disability; from the eleventh year onwards, each additional year (full twelve months) adds 1%, but not exceeding 20%; if they have served in difficult and arduous battlefields for less than five years in the establishment of the People's Police, they shall also receive an allowance equal to 10% of their basic salary, and the duration of receiving the allowance is two and a half years (thirty months).
Procedures and Documentation.
- The procedures for preparing retirement and disability documentation for officers, non-commissioned officers, and soldiers of the People's Police are the same as those for military personnel (no need to record the allowance from 10% to 20% mentioned above).
The social welfare agency, when establishing the subsidy book, will record the allowance according to Decision No. 106-HĐBT (code 106/178) on a separate page in the subsidy book and payment voucher (10TRC) as with military personnel receiving the 21/178 allowance.
For officers, non-commissioned officers, and soldiers of the People's Police who retired or stopped working due to disability from January 1, 1975 to the date of issuance of Decision No. 106-HĐBT, the Department of Social Welfare and Rehabilitation will base adjustments on the application forms already filed and currently stored at the Department (will not process applications for resubmission) to make adjustments and grant this allowance from July 1, 1982.
The Departments will guide the Social Welfare and Rehabilitation Committees at the commune level to compile lists and collect subsidy books and payment vouchers (10TRC) of those eligible for adjustment and submit them to the Departments for processing.
