DECREE
Detailed Implementation of Certain Provisions of the Law on Security Guarding
Pursuant to the Law on Competition and Rewards dated December 26,, amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CP ficer Ch"b) In addition to the lists of public services issued according to the provisions of Clause 2, Article 4 of this Decree, specialized agencies under provincial People's Committees shall report to the provincial People's Committee for decision-making on amending, supplementing, or issuing the list of public services funded by the state budget within their jurisdiction and consistent with the local budget capacity within the approved budget by the Provincial People's Assembly, and send it to the Ministry of Finance and relevant ministries and sectors for supervision during implementation."36/2016/NĐ-CP dated May 15, 2016 of the Government on medical equipment management.
1. The Deputy Minister of Public Security responsible for the traffic police force shall be the head of the Criminal Police Investigation Department under the Ministry of Public Security.
Pursuant to the Security Guard Law dated June 20, 2017;
At the proposal of the Minister of Public Security;ngthe Government promulgates this Decree detailing the implementation of certain provisions of the Law on Security Guarding.
h"b) In addition to the lists of public services issued according to the provisions of Clause 2, Article 4 of this Decree, specialized agencies under provincial People's Committees shall report to the provincial People's Committee for decision-making on amending, supplementing, or issuing the list of public services funded by the state budget within their jurisdiction and consistent with the local budget capacity within the approved budget by the Provincial People's Assembly, and send it to the Ministry of Finance and relevant ministries and sectors for supervision during implementation."This Decree stipulates special allowances, subsidies, and support for security guards and the funding to ensure the implementation of policies for security guards.i Article 2. Principles of Application and Assurance of Policies for Security Guards
Article 1. Scope of Regulation
1. The special allowances, subsidies, and support prescribed in this Decree shall be paid together with monthly salaries and shall not be used to calculate contributions or benefits under social insurance and health insurance schemes.
2. The application of policies must be timely and accurate for eligible recipients.
3. Other policies for security guards not specified in this Decree shall be implemented according to the Law on Public Security Organs, the Law on Officers of the Vietnam People's Army, and other relevant laws.
4. When changing job positions or salary grades, corresponding special allowances shall be applied from that month onwards; when ceasing to perform security guarding duties, such allowances shall cease from the following month after the decision takes effect.
Article 3. Special Allowances
Security guards shall receive special allowances ranging from 15% to 30% of their current salary grade or rank allowance (if applicable), specifically as follows:
1. A 30% allowance applies to:
a) Security guards performing tasks: close protection; protecting international guests visiting or working in Vietnam; patrolling and guarding critical areas, important events;
b) Leaders and commanders;
c) Security guards without leadership positions at the rank of Lieutenant or equivalent salary level, and soldiers receiving rank allowances.
2. A 25% allowance applies to:
a) Security guards performing tasks: driving for close protection, driving for specialized purposes, guiding, escorting; inspecting explosives, flammable materials, radioactive substances, or other dangerous items, testing toxic substances; combat operations; reconnaissance; communication services for protective work; special forces; mobility;
b) Security guards without leadership positions at the rank of Senior Lieutenant or Major or equivalent salary level, except as provided in Clause 1 of this Article.
3. A 20% allowance applies to:
a) Security guards directly serving Party, State, and Central Committee of the Vietnam Fatherland Front leaders;
b) Security guards without leadership positions at the rank of Captain or equivalent salary level, except as provided in Clauses 1 and 2 of this Article.
4. A 15% allowance applies to security guards not falling within the categories specified in Clauses 1, 2, and 3 of this Article.
Article 4. Support for Security Guards
1. Security guards shall receive housing allowances, social housing support policies, and be guaranteed official housing according to the Law on Public Security Organs and other relevant regulations.
2. For non-commissioned officers and conscripts who complete their service term in the security guard force, they shall be provided vocational training subsidies or employment creation subsidies and given priority in admission to public security and military schools, as well as other policies according to the Law on Public Security Organs, the Law on Professional Military Personnel, Civil Servants, and Defense Employees, and other relevant regulations.
1. Officers and soldiers of the protective service shall be entitled to housing allowances, social housing support policies, and guaranteed official accommodation in accordance with the Law on People's Police and other relevant regulatory legal documents.
2. For non-commissioned officers and conscript soldiers who complete their term of service in the protective force, they shall be provided with vocational training subsidies or job creation subsidies, and shall be given priority in admission examinations for public security schools, military schools, and other systems and policies as stipulated in the Law on People's Police, the Law on Professional Military Personnel, Workers, and Defense Civil Servants, and other relevant regulatory legal documents.
Article 5. Treatment and policies for security guards' officers and soldiers who die, get injured while on duty
Security guards' officers and soldiers, officers and soldiers participating in or cooperating in security guard work who die, are killed, get injured, or fall ill shall enjoy treatment and policies in accordance with the Law on People's Police, the Law on Officers of the Vietnam People's Army, the Law on Professional Military Personnel, Civilian Workers, and Defense Employees, and current laws.
Article 6. Funding to ensure implementation of treatment and policies for security guards' officers and soldiers
1. The funding to implement the treatment and policies under this Decree shall be used within the regular state budget expenditure plan of the Ministry of National Defense and the Ministry of Public Security according to the current state budget classification.
2. Management and utilization of funding from the state budget shall be carried out in accordance with the State Budget Law and guiding documents for its implementation.
Article 7. Effective Date
1. This Decree takes effect from August 10, 2018.
2. Decree No. 128/2006/NĐ-CP dated October 27, 2006 of the Government detailing the implementation of certain provisions of the Security Guard Ordinance ceases to be effective from July 1, 2018.
3. The treatment and policies stipulated in this Decree shall be implemented from July 1, 2018.
Article 8. Responsibility for Implementation
Ministers, heads of ministerial-level agencies, heads of government-affiliated agencies, Chairpersons of provincial and centrally-administered city People's Committees are responsible for implementing this Decree./
