NUMBER 47/2001/QD-BTC DATED MAY 25, 2001 ON CRITERIA FOR MONITORING STATE ENTERPRISES WITH LARGE DEBTS
State enterprises with large debts listed in the top 200 state enterprises with large debts shall be responsible for submitting reports on their debt situation according to form number 01/GSN as stipulated in Decision No. 47/2001/QD-BTC dated May 25, 2001 of the Minister of Finance.

Pursuant to Decree No. 15/CP dated March 2, 1993 of the Government on the tasks, powers, and responsibilities for state management of Ministries and ministerial-level agencies;
BASED ON DECREE NO. 178/CP DATED OCTOBER 28, 1994 OF THE GOVERNMENT ON THE TASKS, POWERS AND ORGANIZATIONAL STRUCTURE OF THE MINISTRY OF FINANCE;
On the basis of Decree No. 84/1999/ND-CP dated August 28, 1999 of the Government on restructuring the General Department of State Capital and Asset Management at enterprises under the Ministry of Finance;
On the basis of the guidance of the Prime Minister in Circular No. 1138/CP-QHQT dated October 29, 1999 regarding the establishment of a monitoring system for state enterprises with large debts;

Article 1. Amending and supplementing some Articles of Decision No. 47/2001/QD-BTC dated May 25, 2001 of the Minister of Finance as follows:
1. Market management agencies at all levels include: the Department of Domestic Market Management and Development under the Ministry of Industry and Trade; the Market Management Business Unit under the Department of Domestic Market Management and Development; the Market Management Sub-department under the Department of Industry and Trade of provinces and centrally-administered cities; and the Market Management Team under the Market Management Sub-department.
- State enterprises included in the list of 200 state enterprises with large debts shall be responsible for submitting reports on the enterprise's debt situation according to form number 01/GSN as stipulated in Decision No. 47/2001/QD-BTC dated May 25, 2001 of the Minister of Finance.
The deadline for submitting quarterly reports is no later than 20 days from the end of the quarter, and the annual report (quarter IV) is no later than 30 days from December 31.

+ State enterprises established by ministries, sectors, agencies equivalent to ministries, and government agencies (referred to as central enterprises) shall submit reports to:

+ State enterprises established by provincial People's Committees and municipal People's Committees directly under the Central Government (referred to as local enterprises) shall submit reports to the Department of Finance and Price of the province or municipality directly under the Central Government.
The Department of Finance and Price of the province or municipality directly under the Central Government shall be responsible for:
+ Urging local enterprises to submit reports on the debt situation according to form number 01/GSN within the prescribed time limit;
+ Monitoring the debt situation and changes in debt of local enterprises to promptly identify difficulties in debt repayment capability of the enterprises and provide comments back to the enterprises in writing...
+ Copying and sending reports on the debt situation of local enterprises to the Ministry of Finance (Department of Enterprise Finance), including a report on the assessment of changes in debt of these enterprises, no later than 25 days from the end of the quarter (for quarterly reports) and no later than 40 days from December 31 (for annual reports - Quarter IV).
2. Supplement Article 3 (new) as follows:
Article 3 (new): Enterprises that submit reports on their debt situation late compared to the prescribed time will be subject to administrative penalties as if they had submitted financial statements late, in accordance with Article 8 of Decree No. 49/1999/ND-CP dated July 8, 1999 of the Government on administrative penalties for violations in the field of accounting; Circular No. 89/2000/TT-BTC dated August 28, 2000 of the Ministry of Finance guiding Decree No. 49/1999/ND-CP.
3. Transfer Article 3 (old) to Article 4.
Article 2. The Director of the Department of Enterprise Finance, the Inspector General of Finance, the Director of the Department of Finance and Price of provinces and municipalities directly under the Central Government, and the General Directors (Directors) of state enterprises listed in the attached decision No. 47/2001/QD-BTC are responsible for implementing this Decision.
