THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT

Pursuant to Decree No. 86/2003/NĐ-CP dated July 18, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to Decree No. 153/2005/NĐ-CP dated December 15, 2005 of the Government on the organization and operation of Agricultural and Rural Development Inspectors;

Considering the proposal of the Director of the Plant Protection Agency, the Chief Inspector of the Ministry, and the Head of the Cadre and Civil Servant Department.

Article 1. Position and Function

The Plant Protection Agency Inspectorate is an agency under the Plant Protection Agency, part of the Agricultural and Rural Development Inspectorate system, performing administrative inspection and specialized inspection functions within the scope of state management of the Plant Protection Agency as prescribed by law.

The Plant Protection Agency Inspectorate is directly managed and directed by the Director of the Plant Protection Agency, while also being directed and guided on work, organization, and administrative and specialized inspection procedures by the Inspectorate of the Ministry of Agriculture and Rural Development.

The Plant Protection Agency Inspectorate has its own seal and is allowed to open an account at the State Treasury according to the provisions of the law.

Article 2. Tasks and Powers of the Plant Protection Agency Inspectorate

The Plant Protection Agency Inspectorate performs tasks and powers as prescribed in Article 9 of Decree No. 153/2005/NĐ-CP dated December 15, 2005 of the Government on the organization and operation of Agricultural and Rural Development Inspectors, other legal regulations, and specific tasks and powers as follows:

1. Participating in drafting legal documents on plant protection and quarantine; on inspection, complaint resolution, and anti-corruption.

2. Reviewing and proposing amendments and supplements to policies and laws on plant protection and quarantine.

3. Inspecting compliance with legal regulations on plant protection and quarantine.

4. Deciding on administrative penalties in the field of plant protection and quarantine according to the provisions of the law.

5. Guiding and training specialized inspection skills for plant protection and quarantine inspectors in provinces and centrally-administered cities; disseminating and popularizing relevant state legal documents related to plant protection and quarantine work.

6. Regularly handling citizen reception work and anti-corruption activities of the Agency as prescribed.

7. Inspecting other cases assigned by the Director; performing other tasks and powers as prescribed by law.

Article 3. Tasks and Powers of the Chief Inspector of the Plant Protection Agency

The Chief Inspector of the Plant Protection Agency performs tasks and powers as prescribed in Article 10 of Decree No. 153/2005/NĐ-CP dated December 15, 2005 of the Government on the organization and operation of Agricultural and Rural Development Inspectors, other legal regulations, and specific tasks and powers as follows:

1. Proposing the Director of the Plant Protection Agency to consider temporarily suspending or recommending competent authorities to suspend illegal acts concerning plant protection and quarantine against agencies, organizations, and individuals according to the law when there is sufficient evidence to determine that such acts cause damage to national interests, citizens' rights and legitimate interests, or obstruct inspection work.

2. Concluding on the content of inspections after receiving reports from inspection teams, submitting to the Director for post-inspection decision-making.

3. Assisting the Director in monitoring, inspecting, and urging the implementation of conclusions, recommendations, and decisions on inspections made by the Plant Protection Agency Inspectorate and other relevant agencies.

4. Deciding on administrative penalties in the field of plant protection and quarantine according to the provisions of the law.

5. Proposing the Director of the Plant Protection Agency to resolve issues related to inspection work. Reporting to the Chief Inspector of the Ministry about inspection work, complaint resolution, and anti-corruption within their scope of responsibility.

6. Performing other tasks and powers as prescribed by law.

Article 4. Organizational Structure

1. The Plant Protection Agency Inspectorate has a Chief Inspector, Deputy Chief Inspector, and Inspection Officers.

a) The appointment, dismissal, and removal of the Chief Inspector and Deputy Chief Inspector of the Plant Protection Agency Inspectorate shall be carried out in accordance with Clause 2 of Article 8 of Decree No. 153/2005/NĐ-CP dated December 15, 2005 of the Government on the organization and operation of Agricultural and Rural Development Inspectors.

The Chief Inspector of the Plant Protection Agency Inspectorate is responsible before the Director of the Plant Protection Agency and the law for the activities of the Plant Protection Agency Inspectorate and the performance of assigned tasks.

The Deputy Chief Inspector assists the Chief Inspector, is assigned to oversee specific areas by the Chief Inspector; is responsible before the Chief Inspector and the law for the performance of assigned tasks.

b) The appointment and dismissal of Inspection Officers of the Plant Protection Agency shall be carried out in accordance with the law.

Inspection Officers, civil servants, and employees engaged in inspection: are responsible before the Chief Inspector and the law for the performance of assigned tasks; have obligations and rights as prescribed by the law.

2. The staffing of the Plant Protection Agency Inspectorate belongs to the administrative staffing of the Plant Protection Agency, decided by the Minister of Agriculture and Rural Development.

Article 5. Work Relations of the Inspection Bureau

1. The Inspection Bureau shall coordinate with the Ministry of Agriculture and Rural Development's Inspection Department to guide and train specialized inspection business for the Provincial Departments of Agriculture and Rural Development’s Inspection Departments and plant protection and quarantine inspection departments at provincial level cities directly under the central government.

2. Coordinate with units under the Bureau, inspection agencies of various sectors, and authorities at all levels in the process of inspecting cases and in preventing and stopping violations of laws within the scope of plant protection and quarantine.

3. Exchange professional and business information on the specialized field of plant protection and quarantine with the Provincial Departments of Agriculture and Rural Development’s Inspection Departments of provinces and provincial level cities directly under the central government.

Article 6. Effectiveness

This Decision takes effect fifteen days from the date of publication in the Official Gazette. Previous regulations contrary to this Decision are abolished.

Article 7. Responsibility for Implementation

The Director of the Ministry's Office, the Head of the Ministry's Inspection Department, the Director of the Cadre and Civil Servant Department, the Director of the Plant Protection Bureau, heads of agencies, organizations, and individuals related to this matter are responsible for implementing this Decision./.
