Decree on Administrative Sanctions for Violations Relating to Food Safety

BASED ON THE Food Safety Law on 1JUNE 7, 2010;
BASED ON THE Ordinance on Administrative Offense Handling dated July 2, 2002; AMENDMENTS AND SUPPLEMENTS TO CERTAIN PROVISIONS OF THE Ordinance on Administrative Offense Handling dated April 2, 2008; lTHIS DECREE REGULATES VIOLATIONS, FORMS AND LEVELS OF FINES, MEASURES TO REMEDY CONSEQUENCES, AND AUTHORITY TO IMPOSE ADMINISTRATIVE SANCTIONS FOR VIOLATIONS OF FOOD SAFETY.
Pursuant to the proposal of the Minister of Health;
The Government promulgates this Decree on Administrative Sanctions for Violations Relating to Food Safety,
Article 1. Scope of Regulation
1. VIOLATIONS OF ADMINISTRATIVE LAW REGARDING FOOD SAFETY ARE ACTIONS BY ORGANIZATIONS AND INDIVIDUALS THAT VIOLATE FOOD SAFETY LAWS INTENTIONALLY OR UNINTENTIONALLY, WHICH ARE NOT CRIMES AND MUST BE SUBJECT TO ADMINISTRATIVE SANCTIONS AS PROVIDED IN THIS DECREE.
2. VIOLATIONS OF ADMINISTRATIVE LAW REGARDING FOOD SAFETY AS DEFINED IN THIS DECREE INCLUDE:No. VIOLATIONS OF PROVISIONS ON ENSURING FOOD SAFETY FOR FOOD PRODUCTS;
3. b) VIOLATIONS OF PROVISIONS ON CONDITIONS FOR ENSURING FOOD SAFETY IN FOOD PRODUCTION AND DISTRIBUTION;
a) VIOLATIONS OF PROVISIONS ON CONDITIONS FOR ENSURING FOOD SAFETY FOR IMPORTED FOODS AND EXPORTED FOODS;
VIOLATIONS OF PROVISIONS ON FOOD ADVERTISING; INFORMATION, EDUCATION, AND COMMUNICATION ON FOOD SAFETY; LABELING OF FOODS;đ) VIOLATIONS OF PROVISIONS ON FOOD TESTING, RISK ANALYSIS, PREVENTION, CONTROL, AND REMEDIATION OF FOOD SAFETY ISSUES; TRACING THE SOURCE, RECALLING, AND HANDLING UNSAFE FOODS; OBSTRUCTING STATE MANAGEMENT ACTIVITIES REGARDING FOOD SAFETY.
c) VIOLATIONS OF ADMINISTRATIVE LAW REGARDING FOOD SAFETY DEFINED IN THIS DECREE THAT ARE ALSO DEFINED IN OTHER DECREES SHALL BE ENFORCED ACCORDING TO THIS DECREE.No.THIS DECREE APPLIES TO INDIVIDUALS AND ORGANIZATIONS ENGAGING IN VIOLATIONS OF ADMINISTRATIVE LAW REGARDING FOOD SAFETY, EXCEPT WHERE INTERNATIONAL AGREEMENTS TO WHICH VIETNAM IS A PARTY PROVIDE OTHERWISE.rime Minister cIF AN INDIVIDUAL WHO IS A GOVERNMENT OFFICIAL, PUBLIC SERVANT, OR CIVIL SERVICER PERFORMS ACTIONS AS DEFINED IN THIS DECREE WHILE PERFORMING THEIR DUTIES, THEY WILL NOT BE SUBJECT TO ADMINISTRATIVE SANCTIONS BUT WILL FACE DISCIPLINARY ACTION ACCORDING TO LAWS ON GOVERNMENT OFFICIALS, PUBLIC SERVANTS, AND CIVIL SERVICERS.
d) Article 3. Forms of administrative sanctions and measures to remedy consequencesrime Minister c;
FOR EACH VIOLATION OF ADMINISTRATIVE LAW REGARDING FOOD SAFETY, THE VIOLATING ORGANIZATION OR INDIVIDUAL MUST BE SUBJECTED TO ONE OF THE FOLLOWING PRIMARY FORMS OF SANCTION:amendTHE MAXIMUM AMOUNT OF FINES FOR A SINGLE VIOLATION OF ADMINISTRATIVE LAW REGARDING FOOD SAFETY IS 100,000,000 VND.ắDEPENDING ON THE NATURE AND GRAVITY OF THE VIOLATION, THE VIOLATING ORGANIZATION OR INDIVIDUAL MAY ALSO BE SUBJECTED TO ONE OR MORE OF THE FOLLOWING ADDITIONAL FORMS OF SANCTION:No. BB 1.1on REVOKING THE RIGHT TO USE: CERTIFICATE OF FOOD SAFETY COMPLIANCE; CERTIFICATE OF QUALIFIED PRODUCT ANNOUNCEMENT; CERTIFICATE OF FITNESS ANNOUNCEMENT FOR FOOD SAFETY REGULATIONS; CERTIFICATE OF ADVERTISEMENT CONTENT CONFIRMATION;rime Minister cSEIZURE OF EVIDENCE AND TOOLS USED IN VIOLATIONS OF ADMINISTRATIVE LAW REGARDING FOOD SAFETY, INCLUDING MODIFIED, ERASED, OR FAKE DOCUMENTS OR LICENSES ISSUED IN ERROR.of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Home AffairsIN ADDITION TO THE SANCTIONS LISTED IN CLAUSE 1 AND CLAUSE 2 OF THIS ARTICLE, VIOLATING ORGANIZATIONS OR INDIVIDUALS MAY ALSO BE SUBJECTED TO ONE OR MORE OF THE FOLLOWING MEASURES TO REMEDY CONSEQUENCES:No.RESTORING THE ORIGINAL CONDITION ALTERED BY THE VIOLATION;on REMOVING GOODS FROM VIETNAMESE TERRITORY OR REEXPORTING THEM;
4. RECALLING, DESTROYING, OR RECYCLING VIOLATING FOODS, RAW MATERIALS, ADDITIVES, PROCESSING AIDS, UTENSILS, AND CONTAINERS; RECALLING AND DESTROYING VIOLATING DOCUMENTS AND TOOLS, EXCEPT WHEN THEY NEED TO BE RETAINED AS EVIDENCE FOR FURTHER PROCEEDINGS.đượ đ) OTHER REMEDIAL MEASURES SPECIFIED IN PART II OF THIS DECREE;development Remedial measures:
1. VIOLATING INDIVIDUALS AND ORGANIZATIONS MUST COVER ALL COSTS AS REQUIRED BY LAW FOR IMPLEMENTING REMEDIAL MEASURES.ton food, except where international treaties to which Vietnam is a party provide otherwise, shall be implemented according to such treaties.on2. Individuals who are civil servants, public officials, or employees committing acts prescribed in this Decree while performing their duties or assigned tasks shall not be subject to administrative penalties but shall be subject to disciplinary responsibility in accordance with the provisions of the law on civil servants, public officials, and employees.đổ Article 3. Forms of Administrative Penalties and Measures to Mitigate Consequences
For each act of administrative violation concerning food safety, the violator organization or individual must bear one of the following main forms of administrative penalty:
1. The maximum fine for a single act of administrative violation concerning food safety is 100,000,000 VND.
a) Warning;
b) Fine.
Depending on the nature and degree of the violation, organizations or individuals committing administrative violations concerning food safety may also be subject to one or more supplementary forms of administrative penalty as follows:
2. Revocation of: Food Safety Condition Certificate; Notification of Registration of Compliance Declaration; Confirmation of Compliance Declaration with Food Safety Regulations; Advertisement Content Confirmation Certificate;
a) Seizure of items and means used to commit administrative violations concerning food safety, including documents and materials that have been altered, erased, or falsified or issued in violation of regulations.of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Home Affairsy Accepting the notification of conformity assessment; The Confirmation Certificate for food safety compliance; The Advertisement Content Confirmation Certificate;
b) Seizing the objects and means used to commit administrative violations concerning food safety, including those documents and materials that have been altered, erased, or falsified or issued incorrectly;of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Home Affairsy papers, documents that have been altered, erased, or falsified or issued incorrectly;rime Minister cy papers, documents that have been altered, erased, or falsified or issued incorrectly.
3. In addition to the forms of punishment specified in Clause 1 and Clause 2 of this Article, violators may also be subject to one or several measures to mitigate consequences as follows:ắRestoring the original state that was changed due to the administrative violation;
a) Compelling the removal of food products or means from the territory of Vietnam or re-exporting them;ầCompelling the recall, destruction, or recycling of food products, raw materials, food additives, processing aids, packaging materials, and containers that violate regulations; compelling the recall and destruction of violating documents and means, except when they need to be retained as evidence for further handling;
b) Compel implementation of measures to mitigate environmental pollution and disease spread caused by administrative violations;
c) d) Other measures to mitigate consequences specifically provided for in Chapter II of this Decree;
d) Individuals and organizations committing administrative violations must bear all costs as stipulated by law for implementing measures to mitigate consequences.ồi, destroying the violating documents and means, except when they must be retained as evidence for further handling;policiesp;

Article 4. Application of legal provisions on administrative violations penalties
1. Principle of punishment; handling persons under the age of eighteen who commit administrative violations; mitigating circumstances, aggravating circumstances; statute of limitations and time limit for punishment; period considered as not yet punished; calculation of time limits and statutes of limitation; application of forms of administrative violation penalties and measures to remedy consequences; determination of authority to impose administrative violation penalties; recording of administrative violation acts; issuing decisions on administrative violation penalties; procedures for imposing fines, collecting fines; procedures for confiscation and disposal of evidence and means of transportation involved in administrative violations; enforcement of administrative violation penalty decisions, suspension of execution of fine decisions, forced enforcement of administrative violation penalty decisions and transfer of administrative violation penalty decisions related to food safety for enforcement; transfer of case files of administrative violations with signs of criminal offenses for criminal prosecution shall be carried out in accordance with the relevant laws on handling administrative violations.đổ punishment; handling administrative violations committed by minors; mitigating circumstances, aggravating circumstances; statute of limitations and time limit for punishment; period considered as not yet punished; calculation of time limits and statutes of limitation; application of forms of administrative punishment and measures to mitigate consequences; determination of administrative punishment authority; recording of administrative violation records; issuing decisions on administrative punishment; procedures for imposing fines and collecting fines; procedures for seizing and disposing of items and means used in administrative violations; enforcement of administrative punishment decisions, suspension of execution of fine decisions, forced enforcement of administrative punishment decisions, and transferring administrative punishment decisions on food safety for enforcement; transfer of case files of administrative violations suspected of criminal offenses for criminal prosecution shall be carried out in accordance with the provisions of the law on administrative violations.đổ Handling minors who commit administrative violations; mitigating circumstances, aggravating circumstances; statute of limitations and time limit for punishment; time limit considered as not yet punished; calculation of time limits and statutes of limitation; application of forms of administrative penalties and remedial measures;"b) In addition to the lists of public services issued according to the provisions of Clause 2, Article 4 of this Decree, specialized agencies under provincial People's Committees shall report to the provincial People's Committee for decision-making on amending, supplementing, or issuing the list of public services funded by the state budget within their jurisdiction and consistent with the local budget capacity within the approved budget by the Provincial People's Assembly, and send it to the Ministry of Finance and relevant ministries and sectors for supervision during implementation."c for consequences;ắc for consequences;ANNEX I.A[31] c for administrative violations; drafting administrative violation records; issuing decisions on administrative penalties; procedures for imposing fines, collecting fines; procedures for confiscation and disposal of objects and means used in administrative violations; enforcement of administrative penalty decisions, suspension of execution of fine decisions, forced enforcement of administrative penalty decisions and transferring administrative penalty decisions related to food safety for enforcement;|||c for administrative violations; transferring case files of violations suspected of criminal offenses for criminal prosecution shall be carried out in accordance with the provisions of the law on handling administrative violations;development c for administrative violations;of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Home Affairsc for administrative violations, suspending the execution of fine decisions, enforcing administrative penalty decisions and transferring administrative penalty decisions related to food safety for enforcement;policies c for administrative violations for enforcement;development c for administrative violations;ệc for administrative violations to be transferred for criminal prosecution shall be carried out in accordance with the provisions of the law on handling administrative violations;on c for administrative violations;

Briefly describe technical improvements, production processes, raw materials, designs; new technology applications such as automation, digitalization, clean technology; management, marketing, distribution solutions; products winning awards or certifications related to innovation…):…FUNCTIONS, DUTIES, POWERS, ORGANIZATIONAL STRUCTURE, OPERATIONAL REGULATIONS, AND RELATIONSHIPS OF MANAGEMENT BOARDS; DUTIES, POWERS OF THE CHAIRPERSON, VICE CHAIRPERSON (IF ANY), SECRETARY, AND MEMBERS OF MANAGEMENT BOARDSThe format of inspection records and penalty decisions for administrative violations concerning food safety shall be implemented in accordance with the annex attached to this Decree. trWithin the scope of administrative punishment for food safety violations, the provisions set forth in the Appendix attached to this Decree shall apply.

ADMINISTRATIVE VIOLATIONS, FORMS AND AMOUNTS OF FINES
PART I. VIOLATIONS OF PROVISIONS ON CONDITIONS TO ENSURE FOOD SAFETY FOR FOOD PRODUCTS
Article 5. Violations of provisions on the use of food ingredients
1. A fine of from three million to five million Vietnamese dong shall be imposed for using meat or products made from meat that has not been inspected for veterinary hygiene or has been inspected but does not meet the requirements to process food.n Using animal-derived products that have not undergone veterinary health inspection or have undergone inspection but do not meet the requirements for food production.rime Minister cm shall be used.
2. A fine of from five million to ten million Vietnamese dong shall be imposed for one of the following acts:policiesUsing food ingredients that have exceeded their shelf life or have no shelf life to produce or process food;
a) Using animal products that are under quarantine observation to produce or process food.
b) Using animal-derived products during quarantine observation periods for disease control or death of unknown cause to produce food.
3. A fine of from ten million to fifteen million Vietnamese dong shall be imposed for using food ingredients that do not ensure food safety or whose origin and source are unclear to produce or process food.policies ịch disease or unexplained death, must be destroyed according to the requirement of the competent authority;
4. A fine of from fifteen million to twenty million Vietnamese dong shall be imposed for one of the following acts:
a) Using non-food ingredients to produce or process food;
b) Provincial People's Committees set specific pricesđổ For coal-fired thermal power plants where the enterprise holds 100% of the registered capital and uses 100% of its own capital to invest in the project approved by the competent authority, E is determined as 100%;|||management|||Dead animals due to disease, epidemic, or unknown cause, required to be destroyed according to the requirements of the competent authority, to produce or process food. 5. 6. Remedial measures:
a) Suspension of the right to use the certificate of food safety conditions for six to nine months in case of repeated offense for the act stipulated in Clause 2 and Clause 3 of this Article.June 2024;imprisonment from six months to nine months in cases of repeat offenses under Clauses 2 and 3 of this Article.onFrom VND 1,000,000 to VND 2,000,000 for bringing unauthorized materials, information, or items into the examination room or grading area;

7. Compel students to be transferred to locations where they have been authorized to operate for violations stipulated in Clause 2 of this Article;

c) Compelling the removal of impurities in accordance with the regulations of competent state agencies for raw materials containing impurities but not required to be destroyed as prescribed in Point c of Clause 4 of this Article;êOrder to remove impurities in accordance with the regulations of the competent state agency for raw materials containing impurities but not required to be destroyed for the act stipulated in Point c, Clause 4 of this Article.to000,000 VND to 3,000,000 VND for a violator entity having from 500 people or more directly engaged in producing and trading food without a confirmation certificate of training on food safety knowledge;
d) Order to destroy raw materials containing harmful impurities, impurities with unclear composition, required to be destroyed for the act stipulated in Point c, Clause 4 of this Article.ng000,000 VND to 3,000,000 VND for a violator entity having from 500 people or more directly engaged in producing and trading food without a confirmation certificate of training on food safety knowledge;onthis.
Article 6. Violations concerning the use of food additives and processing aids in food production and processing
1. 5. 6. Remedial measures:
a) Revoking the food safety condition certificate for six to nine months in cases of repeat offenses under Clauses 2 and 3 of this Article;
b) Revoking the food safety condition certificate for nine to twelve months in cases of repeat offenses under Clause 4 of this Article.No.000,000 VND to 3,000,000 VND for a violator entity having from 500 people or more directly engaged in producing and trading food without a confirmation certificate of training on food safety knowledge;
7. Compel students to be transferred to locations where they have been authorized to operate for violations stipulated in Clause 2 of this Article;
a) Order to comply with the relevant laws for the act stipulated in Clause 1 of this Article.
b) Compelling the destruction of violating items under Clauses 2, 3, and 4 of this Article.No.000,000 VND to 3,000,000 VND for a violator entity having from 500 people or more directly engaged in producing and trading food without a confirmation certificate of training on food safety knowledge;
Article 7. Violations concerning the use of chemicals in food production and processing
1. a) A fine of VND 1,000,000 to VND 2,000,000 shall be imposed on the violating entity having fewer than 20 people who do not conduct regular health check-ups;
b) A fine from VND 20,000,000 to VND 25,000,000 shall be imposed for supporting enrollment or collecting enrollment application files for foreign educational programs without permission to operate on Vietnamese territory..A fine of VND 2,000,000 to VND 5,000,000 shall be imposed on the violating entity having from 20 to less than 100 people who do not conduct regular health check-ups;
c) A fine of VND 5,000,000 to VND 10,000,000 shall be imposed on the violating entity having from 100 to less than 500 people who do not conduct regular health check-ups;
d) A fine of VND 10,000,000 to VND 20,000,000 shall be imposed on the violating entity having 500 or more people who do not conduct regular health check-ups.
3. A fine of VND 3.000,000 to VND 5,000,000 shall be imposed on the violating entity for forging, altering, or erasing Health Certificates;
4. a) Not complying with storage regulations set forth by organizations and individuals producing and processing food;

Article 26. Violations of regulations on food advertising

Article 38. Responsibilities for guidance and implementation
1. The Minister of Health shall be responsible for guiding, organizing, and inspecting the implementation of this Decree.
2. Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairmen ||People's Committees at all levelsof the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Home Affairsand relevant agencies, organizations, and individuals shall be responsible for implementing this Decree, amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CP Organizations and individuals concerned are responsible for implementing this Decree./.
