CIRCULAR

Regulations on the management and utilization of funds for the activities of the Steering Committees

 of the Campaign "Vietnamese People Preferentially Use Vietnamese Goods"

The Minister of Finance issues this Circular regulating the preparation of budgets, management, use, and settlement of funds supported by the State budget for organizations assigned or authorized by the Ministry of Foreign Affairs to perform tasks of selecting, introducing, and managing Vietnamese workers working for foreign organizations and individuals in Vietnam.

Pursuant to Decree No. 118/2008/NĐ-CP dated November 27, 2008, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

Implementing the Conclusion Notice No. 264-TB/TW dated July 31, 2009 of the Politburo on organizing the Campaign "Vietnamese People Preferentially Use Vietnamese Goods"; Decision No. 255-QĐ/TW dated September 4, 2010 of the Central Committee of the Communist Party of Vietnam on establishing the Central Steering Committee of the Campaign "Vietnamese People Preferentially Use Vietnamese Goods";

Considering the proposal of the Director of the Administrative and Public Finance Department;

The Minister of Finance promulgates this Circular regulating the management and utilization of funds for the activities of the Steering Committees of the Campaign "Vietnamese People Preferentially Use Vietnamese Goods" (hereinafter referred to as the Steering Committee of the Campaign) as follows:

Article 1. Scope of Regulation and Applicability

This Circular stipulates the preparation of budgets, allocation, management, and utilization of funds for the activities of the Steering Committees at all levels, including:

1. The Central Steering Committee.

2. The Permanent Office of the Campaign at the Central level.

3. The Steering Committees of provinces and centrally-administered cities (referred to collectively as provincial Steering Committees).

Article 2. Sources of Funds

1. The sources of funds for the activities of the Steering Committees at all levels shall be guaranteed by the State budget, allocated according to the current分级处理此文本时,最后一个段落的翻译如下:

a) The funding to ensure the operation of the Central Steering Committee and the Central Executive Board of the Campaign shall be guaranteed from the central budget and allocated in the annual budget estimate of the Central Committee of the Vietnam Fatherland Front.

b) The funding to ensure the operation of the provincial Steering Committee shall be guaranteed from the local budget and allocated in the annual budget estimate of the provincial Committee of the Vietnam Fatherland Front.

2. Voluntary contributions from organizations and individuals both within and outside the country, in accordance with the provisions of the law, for organizing the awarding of honors and prizes to business leaders and enterprises, and increasing the funding for the Campaign.

3. Other lawful sources of funds.

Article 3. Contents of expenditures for activities of the Steering Committees

1. Contents of expenditures for the activities of the Central Steering Committee and the Central Executive Board:

a) Expenditures for travel expenses and fuel costs serving activities such as surveying, inspecting, urging, directing the implementation of the Campaign; participating in organizing trade fairs and exhibitions to introduce Vietnamese products, goods, and services annually;

b) Expenditures for organizing specialized conferences, mid-year reviews, and year-end summaries;

c) Expenditures for translating publications and materials (if any) serving the Campaign (from foreign languages or ethnic minority languages to Vietnamese or vice versa);

d) Expenditures for information dissemination, propaganda, and mobilization to implement the Campaign;

đ) Expenditures for purchasing and printing publications and materials serving the Campaign;

e) Expenditures for rewards including:

- Expenditures for organizing the recognition of honors and awarding prizes to business leaders and enterprises;

- Expenditures for rewarding individuals and groups with outstanding achievements in mobilizing and implementing the Campaign;

g) Expenditures for office supplies and overtime work;

h) Other expenditures directly related to the activities of the Steering Committee.

2. Contents of expenditures for the activities of the Steering Committees of the Campaign at the provincial and centrally-administered city levels:

a) Expenditures for travel expenses and fuel costs serving activities such as surveying, inspecting, urging, and directing the Campaign;

b) Expenditures for organizing specialized conferences, meetings to convey instructions, commendation meetings, guidance sessions on specific topics of the Campaign, mid-year reviews, year-end summaries, and other meetings;

c) Expenditures for purchasing and printing publications and materials serving the Campaign;

d) Expenditures for information dissemination, propaganda, and mobilization to implement the Campaign (limited to slogans, posters, and promotional banners at districts, towns, communes, and wards);

đ) Expenditures for implementing the Campaign at districts, towns, communes, wards, and residential areas; fuel and vehicle costs for officials and civil servants traveling to mobilize individuals and organizations to participate in the Campaign; expenditures for supporting travel expenses for individuals not receiving salaries from the State Budget who participate in implementing the Campaign;

e) Expenditures for rewards including:

- Expenditures for organizing the recognition of honors and awarding prizes to business leaders and enterprises;

- Expenditures for rewarding individuals and groups with outstanding achievements in mobilizing and implementing the Campaign;

g) Expenditures for office supplies and overtime work;

h) Other expenditures directly related to the activities of the Steering Committee.

b) Expenditures for organizing specialized conferences, mid-year reviews, and year-end summaries;

h) Other expenditures directly related to the activities of the Steering Committee.

d) Expenditures for information dissemination, propaganda, and mobilization to implement the Campaign (limited to slogans, posters, and promotional banners at districts, towns, communes, and wards);

h) Other expenditures directly related to the activities of the Steering Committee.

Article 4. Levels of expenditure

The expenditure standards for the activities of the Steering Committees of the Campaign at all levels shall be applied according to the current financial expenditure standards and norms as follows:

1. Expenditures for travel expenses for directing, surveying, and inspecting activities; expenditures for mid-year review and specialized summary conferences, and year-end summary conferences to draw lessons from the implementation of the Campaign shall be implemented in accordance with Circular No. 97/2010/TT-BTC dated July 6, 2010, issued by the Ministry of Finance, which stipulates the travel expense system and the system of expenditures for organizing conferences for state agencies and public service units (including expenditures for supporting travel expenses for individuals not receiving salaries from the State Budget who participate in implementing the Campaign).

2. Expenditures for organizing meetings of the Steering Committees at various levels to discuss the content and plans for the Campaign's activities for the year; discussing measures to implement the Campaign.

4. Expenditure for information dissemination and propaganda about the Campaign: Implemented in accordance with Circular Jointly Issued No. 14/2014/TTLT-BTC-BTP dated January 27, 2014 of the Ministry of Finance and the Ministry of Justice on the preparation, management, use, and settlement of state budget funds to ensure the work of popularizing laws and standard access to laws for people at the grassroots level.

5. Reward expenditure:

3. Expenditures for translating publications and materials (if any) serving the Campaign (from foreign languages or ethnic minority languages to Vietnamese or vice versa): Shall be implemented according to the translation expenditure standards stipulated in Circular No. 01/2010/TT-BTC dated January 6, 2010, issued by the Ministry of Finance, which stipulates the reception and hosting standards for foreign guests working in Vietnam, and the standards for organizing international conferences and seminars in Vietnam.

4. Expenditures for purchasing and printing educational works and materials; disseminating information and propaganda through mass media to serve the Campaign shall be implemented according to the standards, quotas, and unit prices applicable in the locality and must be approved by the competent authority before implementation.

6. Survey expenditure serving the Campaign: Applied according to the expenditure regulations stipulated in Circular No. 109/2016/TT-BTC dated June 30, 2016 of the Ministry of Finance on the preparation, management, use, and settlement of funds for conducting surveys and national censuses.

a) Expenditures for organizing the recognition of honors and awarding prizes to business leaders and enterprises: Shall be implemented in accordance with Decision No. 51/2010/QĐ-TTg of Prime Minister regarding the issuance of the Regulation on Management and Organization of Honoring Titles and Awarding Prizes to Business Leaders and Enterprises. The amount of the prize at each level is determined by the Steering Committee based on voluntary contributions from organizations and individuals both within and outside the country, but shall not exceed the maximum expenditure limit: - At the central level: the highest prize shall not exceed 2,000,000 VND per prize; organizations and individuals both within and outside the country, but not exceeding the maximum expenditure limitas follows:

- Central level: the highest prize not exceeding 2,000,000 VND per prize;

- Provincial level: the highest prize does not exceed 1,000,000 VND/prize;

- Basic level: the highest prize does not exceed 500,000 VND/prize.

b) Rewards for units and individuals with outstanding achievements during mid-term and final reviews: The establishment, management, and utilization of the Competition and Reward Fund shall be carried out in accordance with Circular No. 71/2011/TT-BTC dated May 24, 2011, issued by the Ministry of Finance guiding the establishment, management, and utilization of the Competition and Reward Fund pursuant to Decree No. 42/2010/NĐ-CP dated April 15, 2010, of the Government detailing the implementation of certain provisions of the Law on Competition and Reward.

6. When new regulations amend, supplement, or replace the provisions referred to in this Article, they shall be applied according to the new regulations.

7. Other expenditures: In accordance with valid invoices and supporting documents and within the budget approved by the competent authority.

Article 5. Budget preparation, management, and settlement

The preparation of the budget, management, and settlement of accounts shall be conducted in accordance with the provisions of the State Budget Law and related guiding documents. This Circular specifies additional details on the following matters:

1. The annual operating budget of the Steering Committee at all levels must be prepared based on the annual tasks of the Steering Committee and the guidance documents for implementing the Campaign, ensuring effective integration in the use of financial resources to serve the implementation of the Campaign.

2. For the Central Steering Committee and the Permanent Office of the Campaign: Annually, based on assigned tasks, the Steering Committee of the Campaign shall develop the content of the activity plan and the budget, which shall be submitted to the finance department of the agency for consolidation into the budget of the Vietnam Fatherland Front Central Committee for submission to the competent authority as prescribed.

3. For the Steering Committees of the Campaign at provincial level: Annually, based on assigned tasks, they shall be responsible for developing the content of the activity plan and the budget, which shall be submitted to the Permanent Office of the Vietnam Fatherland Front Provincial Committee for review and approval, to be consolidated into the budget of the Vietnam Fatherland Front Provincial Committee, and then submitted to the Department of Finance for consolidation and submission to the competent authority as prescribed.

4. For central ministries and sectors: They may use the annual regular expenditure budget allocated to them to support activities of the "Vietnamese People Preferentially Use Vietnamese Goods" Campaign within their respective ministries and sectors in accordance with current regulations.

Article 6. Implementation Organization

This Circular takes effect from July 20, 2012. For the year 2012, ministries, sectors, and localities shall proactively arrange within the 2012 state budget already allocated by the competent authority to implement it.

During the implementation process, if there are difficulties or obstacles, units at the central level and localities are requested to promptly report to the Central Steering Committee of the Campaign, the Permanent Office of the Vietnam Fatherland Front Central Committee, and the Ministry of Finance for consideration and appropriate amendments and supplements./.
