Guidelines for amending and supplementing Circular No. 44/2006/TT-BTC dated May 24, 2006 of the Ministry of Finance on financial regulations for prevention and control of foot-and-mouth disease in livestockto prevent and control foot-and-mouth disease in livestock

Based on Decree No. 221/2013/NĐ-CP dated December 30, 2013 of the Government stipulating the system of applying administrative handling measures for placement in compulsory drug rehabilitation facilities (hereinafter referred to as Decree No. 221/2013/NĐ-CP);

Pursuant to Decree No. 77/2003/NĐ-CP dated July 1, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

Pursuant to Decision No. 738/QĐ-TTg dated May 18, 2006 of the Prime Minister on providing financial support for the prevention and control of foot-and-mouth disease in livestock;

To be consistent with the actual situation where localities have paid expenses for the prevention and control of foot-and-mouth disease in livestock, after reaching consensus with the Ministry of Agriculture and Rural Development, the Ministry of Finance hereby issues guidelines for amending and supplementing Circular No. 44/2006/TT-BTC dated May 24, 2006 on financial regulations for the prevention and control of foot-and-mouth disease in livestock as follows:

1\. Amend and supplement Point 1.4 Clause 1 Section II as follows:

"1.4. Expenses for the destruction of livestock at an average rate of VND 150,000 per buffalo or cow destroyed and VND 50,000 per pig, goat, sheep, deer, or elk destroyed during the period of the epidemic according to the regulations of the Ministry of Agriculture and Rural Development to implement the following tasks:

a\. Purchase of various disinfectants for sterilization, decontamination, and cleaning of animal shelters and the environment; purchase of protective clothing for personnel involved in the destruction of livestock according to the guidance of the Ministry of Agriculture and Rural Development.

b\. Allowance for personnel directly involved in the destruction of livestock at a maximum rate of VND 50,000 per person per working day and VND 100,000 per person per non-working day or holiday.

Based on the allowance provisions set forth in Points 1.2, 1.3, and Subpoint b of Point 1.4 Clause 2 of Circular No. 44/2006/TT-BTC and the actual situation of the locality (scope and severity of the epidemic, travel area, size of the livestock herd, number of staff participating in prevention and control,...), the Chairman of the People's Committee of the province or centrally governed city (hereinafter referred to as the Chairman of the People's Committee of the province) shall decide specifically on the allowance for personnel participating in the prevention and control of foot-and-mouth disease in the locality.

For the expenses for the destruction of buffaloes and cows, based on the actual situation in the locality, the Chairman of the People's Committee of the province may decide on a higher expense rate than the average rate mentioned above."

2\. Amend and supplement Point 2.2 Clause 2 Section II as follows:

"2.2. Based on the average support rate specified in Point 2.1 Clause 2 Section II of Circular No. 44/2006/TT-BTC dated May 24, 2006 and based on the actual value of the livestock that must be destroyed (breed, weight, purpose of use,...), the Chairman of the People's Committee of the province shall decide specifically on the direct support amount for households, individuals, farms, and cooperatives raising livestock in accordance with the actual situation of the locality.

For the support amount for the destruction of buffaloes, cows, goats, sheep, deer, and elk that must be destroyed, the Chairman of the People's Committee of the province may decide on a higher support amount than the average rate specified in Item 2 of Point 2.1 Clause 2 Section II of Circular No. 44/2006/TT-BTC."

3\. Supplement Subpoint c Point 3.3 Clause 3 Part II as follows:

"c\. Support additional funds for households, individuals, farms, and cooperatives with livestock that must be destroyed and the costs for the destruction work specified in Point 1.4 Clause 1 and Point 2.2 Clause 2 above."

4\. Effective date:

This Circular takes effect 15 days from the date of publication in the Official Gazette. The provisions in Circular No. 44/2006/TT-BTC dated May 24, 2006 of the Ministry of Finance that are not amended or supplemented in this Circular remain in effect.

In the course of implementation, if any difficulties arise, please promptly report them to the Ministry of Finance for study and resolution.
