Guidelines for Implementing Certain Provisions of Decision No. 1405/QD-TTg
dated October 16, 2007 of the Prime Minister
on Conditions for Incubating Poultry Eggs and Raising Aquatic Birds

Pursuant to Decision No. 1405/QD-TTg dated October 16, 2007 of the Prime Minister on Conditions for Incubating Poultry Eggs and Raising Aquatic Birds.
The Ministry of Agriculture and Rural Development guides the implementation of certain provisions of this Decision as follows:
1. Conditions for Incubating Poultry Eggs
a) Registration of Incubation Facilities
Incubation facilities that fall under the business registration category shall carry out business registration for incubation at the competent authority as prescribed in Decree No. 88/2006/ND-CP dated August 29, 2006 of the Government on Business Registration.
b) Declaration of Incubation Facilities
All incubation facilities must declare themselves to be monitored for disease control and veterinary hygiene conditions.
- Incubation facilities that fall under the business registration category shall declare to the district veterinary office. Incubation facilities not falling under the business registration category shall declare to the village veterinary office; if there is no village veterinary office, they shall declare to the People's Committee of the village.
The declaration content includes:
Name of the incubation facility owner, address of the incubation facility, scale of incubation;
c) Scale of Incubation Facilities
Incubation facilities must have a minimum scale of 2,000 eggs/incubation batch.
d) Location of Incubation Facilities
- Incubation facilities, regardless of scale, must be located outside urban areas;
- Incubation facilities, regardless of scale, must be at least 500 meters away from schools, hospitals, markets, public offices, and other public places, and must have walls or fences isolating them from surrounding areas and residential areas.
e) Regarding Control of the Origin of Incubated Eggs
- Incubated eggs must have a certificate of origin from poultry breeding flocks that have been vaccinated and are still immune, issued by the local veterinary office;
- Eggs must be disinfected before being placed in incubators.
f) Regarding Quarantine for Transport of Poultry
Poultry chicks sold and transported from incubation facilities outside the district, province, or city must have a transport quarantine certificate issued by the local veterinary office.
g) Regarding Record Keeping for Incubation and Sale of Poultry Chicks
Incubation facilities, regardless of scale, must maintain records and record each incubation batch regarding the following contents: origin of incubated eggs; number of sold poultry chicks; number of dead poultry chicks (if any); date of sale; name and address of the organization or individual purchasing the chicks.
2. Conditions for Raising Aquatic Birds (excluding seasonal ducks and temporary ducks)
a) Registration of Raising Aquatic Birds
Aquatic bird raising facilities that fall under the business registration category shall carry out business registration for raising aquatic birds at the competent authority as prescribed in Decree No. 88/2006/ND-CP dated August 29, 2006 of the Government on Business Registration.
b) Declaration of Raising Aquatic Birds
All aquatic bird raising facilities, whether under the business registration category or not, must declare themselves to be monitored for disease control and veterinary hygiene conditions, and for disease prevention.
- Aquatic bird raising facilities that fall under the business registration category shall declare to the district veterinary office.
- Aquatic bird raising facilities not falling under the business registration category shall declare to the village veterinary office; if there is no village veterinary office, they shall declare to the People's Committee of the village.
The declaration content includes:
Name of the aquatic bird raising facility owner, address of the aquatic bird raising facility, scale of raising aquatic birds, type of aquatic birds (egg-laying ducks, meat ducks, geese...), method of raising (raising in households, farms, industrial...).
c) Location of Raising Aquatic Birds
- Aquatic bird raising facilities, regardless of scale, must be located outside urban areas;
- In household aquatic bird raising facilities, aquatic birds must be raised separately from living quarters and separate from other livestock and poultry;
- In farm or industrial aquatic bird raising facilities, they must be at least 500 meters away from schools, hospitals, markets, public offices, and other public places, and must have walls or fences isolating them from surrounding areas.
3. Conditions for Raising Seasonal Ducks (including timely ducks)
a) Declaration and Issuance of Duck Farming Registers
For raising seasonal ducks including timely ducks, duck farmers must declare to the People's Committee of the village where the duck flock is raised according to the Duck Farming Register model issued by the People's Committee of the village and signed to confirm;
In the Duck Farming Register, the date of avian influenza vaccine injection must be confirmed by the village veterinary office or the People's Committee of the village without a veterinary office;
The model of the Duck Farming Register is stipulated by the Ministry of Agriculture and Rural Development;
The cost of printing the Duck Farming Register is funded from the local budget;
b) Management of Seasonal Ducks
- Raising within the province (understood to include centrally-administered cities);
When seasonal ducks move to another village within the same district, the farmer does not need to declare to the People's Committee of the destination village, but when moving the duck flock to a new district, the farmer must present the Duck Farming Register to the People's Committee of the destination village for confirmation.
c) Implementation of Vaccination
The first dose of vaccination should be given when ducks are 14 days old, and the second dose should be given 28 days after the first dose. For breeding ducks, a booster vaccination should be given every four months;
After the first dose of vaccination, the duck flock can only be moved out of the village. A seasonal duck flock can only be moved to another province after receiving the required avian influenza vaccinations (two doses per vaccination round);
When moving the duck flock to another province, the farmer must present the Duck Farming Register to the People's Committee of the destination village for confirmation;
d) Management Authority for Seasonal Ducks
The People's Committee of the village and the village veterinary office manage seasonal ducks in their jurisdiction, including those from other villages. Management work includes: weekly tracking of current flocks, checking the Duck Farming Register, organizing vaccinations according to regulations, and monitoring diseases.
4. Implementation organization
a) Department of Agriculture and Rural Development
- Advising the Provincial People's Committee to approve the plan to implement Decision No. 1405/QD-TTg of the Prime Minister on Conditions for Incubating Poultry Eggs and Raising Aquatic Birds and this Circular;
- Cooperating with the information and communication sector and mass organizations to disseminate Decision No. 1405/QD-TTg of the Prime Minister and this Circular to organizations and individuals involved in incubating poultry eggs and raising aquatic birds;
- Printing the Duck Farming Register, handing it over to the People's Committee of the village or the district veterinary station to distribute to duck farmers raising seasonal ducks.
- Inspect and urge counties and communes to effectively manage and supervise poultry egg incubation facilities and aquatic animal breeding within their jurisdictions;
- Take the lead in coordinating with relevant departments to organize regular and spot inspections of poultry egg incubation facilities and aquatic animal breeding facilities. Firmly handle violations and cases of intentional non-compliance with this Circular's regulations;
- For localities that have planned areas for breeding and poultry egg incubation, develop plans to relocate poultry egg incubation facilities that do not meet requirements to designated locations. For localities that have not yet completed planning work, urgently establish plans for breeding and poultry egg incubation areas ensuring biosafety;
b) The Livestock Breeding Department
- Organize inspections and urge provinces and centrally administered cities to effectively implement Decision No. 1405/QĐ-TTg of the Prime Minister and this Circular;
- Coordinate with provincial Departments of Agriculture and Rural Development to regularly and spot-check the implementation of Decision No. 1405/QĐ-TTg of the Prime Minister and this Circular, promptly identifying issues and inadequacies in management, and proposing timely solutions to the Ministry of Agriculture and Rural Development and provincial People's Committees;
- Organize reviews, supplements, amendments, and development of standards, technical procedures, and regulatory documents on conditions for safe biological aquatic animal breeding to guide localities in implementation;
c) The Animal Health Department
- Review, amend, and supplement guidance documents on veterinary hygiene conditions for poultry egg incubation facilities and aquatic animal breeding facilities to ensure disease safety;
- Direct provincial Animal Health Sub-departments to regularly inspect veterinary hygiene conditions at poultry egg incubation facilities and aquatic animal breeding facilities;
- Direct the issuance of quarantine certificates for poultry egg incubation facilities and aquatic animal breeding facilities, and certificates for disease-safe poultry breeding facilities;
d) The National Agricultural Extension Center
- Lead and coordinate with the Livestock Breeding Department and localities to build models of poultry egg incubation and aquatic animal breeding ensuring biosafety;
- Coordinate with the Livestock Breeding Department to summarize and expand some effective economic and social duck farming management models while ensuring disease control;
1. This Circular takes effect from May 15, 2013.
This Circular takes effect fifteen days after its publication in the Official Gazette;
The Heads of the Ministry’s Office, Provincial Departments of Agriculture and Rural Development, the Director of the Livestock Breeding Department, the Director of the Animal Health Department, and the Heads of related units are responsible for implementing this Circular;
During implementation, if any issues arise or difficulties occur, please report them in writing to the Ministry of Agriculture and Rural Development for timely adjustment and supplementation./.
