DECREE
Article 24Regarding provincial reserve mobilization training bases
||| Pursuant to the Law on Organization of the Government dated June 19, 2015;
On the basis of the Law on Reserve Mobilization Forces dated November 26, 2019;
"Based on the proposal of the Minister of National Defense;"
The Government issues this Decree on provincial reserve mobilization training bases.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Decree stipulates the renovation, investment in construction, management, and utilization of provincial reserve mobilization training bases in provinces and centrally governed cities (hereinafter referred to collectively as provincial level).
Article 2. Applicability
This Decree applies to:
1. Provincial People's Committees (hereinafter referred to collectively as Provincial People's Committee).
2. Command of the Capital Military District of Hanoi, Command of the Ho Chi Minh City Military District, Military Command of the province (hereinafter referred to collectively as military agencies at the provincial level).
3. Agencies, organizations, and individuals related to provincial reserve mobilization training bases.
Article 3. Explanation of Terms
In this Decree, the following terms shall be understood as follows: A provincial reserve mobilization training base is a place organizing the training of reserve mobilization forces, self-defense militia, and armed forces within the province's territory, including facilities serving management, training, and exercises for reserve mobilization forces during concentrated training periods, such as: Barracks; shooting ranges, training fields, and other auxiliary facilities ensuring support.
Article 4. Principles of Renovation, Investment in Construction, and Management and Utilization of Training Bases
1. Each province shall renovate and invest in constructing one training base.
2. Utilize existing facilities in the locality that are suitable with economic and social conditions, land use planning, and requirements for training reserve mobilization forces, to renovate and invest in constructing a training base meeting the conditions for training, exercising, and readiness inspection for reserve mobilization forces, responding to both immediate and long-term tasks.
3. Management and utilization of provincial reserve mobilization training bases should leverage the multi-functionality of facilities for local military and defense tasks; closely integrate and ensure a solid continuity within the provincial defense area.
Article 5. Functions and Tasks of Training Bases
1. Train reserve mobilization forces within the province.
2. Conduct training and capacity building for self-defense militia forces; train and exercise the provincial defense area for armed forces within the province and provide national defense and security knowledge training for subjects organized by the provincial level.
3. Carry out tasks assigned by the Government, Prime Minister, Minister of National Defense, Chairman of the Provincial People's Committee.
Chapter II
RENOVATION, INVESTMENT IN CONSTRUCTION AND MANAGEMENT AND UTILIZATION OF PROVINCIAL RESERVE MOBILIZATION TRAINING BASES
Article 6. Renovation and Investment in Construction of Training Bases
1. The renovation and investment in construction of provincial reserve mobilization training bases include barracks, shooting ranges, training fields, and other auxiliary facilities appropriate to the approved planning by the Military Region and the Ministry of National Defense.
2. Locations for the renovation and investment in construction of provincial reserve mobilization training bases
a) The provincial reserve mobilization training center for provinces that already have one;
b) Barracks and other auxiliary facilities under the Infantry Regiment of the province;
c) Barracks and other auxiliary facilities under the Military Command School of the Hanoi Capital Military District Command, Ho Chi Minh City Military District Command;
d) Shooting ranges, training fields, and other auxiliary facilities under the management authority of the military agency at the provincial level.
Article 7. Authority to decide on renovation and construction investment for training facilities
1. The Chairman of the Provincial People's Committee decides on the renovation and construction investment for provincial reserve mobilization training facilities in accordance with Clause 2 of Article 6 of this Decree after obtaining the unified opinion of the Minister of National Defense.
2. The provincial military authority takes the lead and coordinates with relevant advisory agencies to prepare planning and investment construction files for provincial reserve mobilization training facilities based on the approved planning by the competent authority, and the Chairman of the Provincial People's Committee decides.
Article 8. Barracks within training facilities
Barracks of provincial reserve mobilization training facilities shall be renovated and constructed to ensure at least one infantry battalion (based on the model infantry battalion barracks design by the Ministry of National Defense).
Article 9. Shooting ranges and training fields of training facilities
1. Shooting ranges and training fields of provincial reserve mobilization training facilities shall be renovated and constructed, including:
a) Shooting range;
b) Training field for tactical exercises;
c) Training field for infantry combat engineering and local military operations;
d) Training field for specialized technical and tactical training;
e) Training area for drill, physical fitness, and sports activities; specialized classrooms.
2. The shooting ranges and training fields specified in Clause 1 of this Article must ensure continuity, fully utilize their functions, and meet the requirements for training reserve mobilization forces.
3. Training facilities shall use provincial shooting ranges (if available), regional shooting ranges, or national shooting ranges located within their territory.
4. For training facilities lacking components as stipulated in Article 8 and Clauses 1, 2, and 3 of this Article, the provincial military authority shall take the lead and coordinate with relevant departments and sectors of the locality to develop land use plans, renovation projects, and investment proposals to submit to the competent authority as prescribed in Article 7 of this Decree for consideration and decision.
Article 10. Budget for renovation and construction investment in training facilities
1. Local budget ensures funding for the renovation and construction of training fields, practice grounds, barracks, and auxiliary facilities serving the training of reserve mobilization units.
2. Central budget provides targeted support according to its financial capacity to localities receiving additional funding from the central budget.
Article 11. Management and utilization of training facilities
1. The Provincial People's Committee directs the provincial military authority to command, manage, and operate provincial reserve mobilization training facilities.
2. The provincial military authority directly manages, commands, and operates provincial reserve mobilization training facilities regarding military and defense tasks.
3. Ensure the functions and responsibilities of provincial reserve mobilization training facilities as prescribed in Article 5 of this Decree.
Chapter III
RESPONSIBILITIES OF MINISTRIES, SECTORS, AND LOCALITIES
Article 12. Ministry of National Defense
1. Directs military regions and provincial military authorities to take the lead and coordinate with local departments and sectors to advise the Provincial People's Committee on the renovation, construction investment, and management and utilization of reserve mobilization training facilities.
2. Provide opinions on the renovation and upgrading of provincial reserve mobilization training facilities as stipulated in Clause 2 of Article 6 of this Decree.
3. Guide, urge, inspect, audit, and manage and utilize reserve mobilization training facilities.
Article 13. Relevant Ministries and Sectors
1. The Ministry of Planning and Investment shall guide relevant ministries, sectors, and localities in preparing medium-term and annual public investment plans, including tasks for renovating and constructing provincial-level reserve training facilities.
2. The Ministry of Finance shall aggregate and submit to the competent authority for approval support to localities in receiving supplementary balance from the central budget to invest in, renovate, training fields, practice grounds, barracks, and auxiliary works serving reserve training in accordance with the State Budget Law and guiding documents.
3. Relevant ministries and sectors shall guide provincial People's Committees on renovating and constructing reserve training facilities according to their assigned functions and tasks.
Article 14. Provincial People's Committees
1. Direct the military agency at the same level to take the lead and coordinate with provincial departments, agencies, and sectors in developing a comprehensive plan for renovating and constructing reserve training facilities.
2. Allocate the budget to ensure funding for the renovation and construction of provincial-level reserve training facilities in accordance with the Public Investment Law.
3. Inspect and audit the renovation, construction, management, and utilization of reserve training facilities.
Chapter IV
IMPLEMENTING PROVISIONS
Article 15. Effective Date
This Decree takes effect from August 18, 2020.
Article 16. Responsibility for Implementation
The Minister, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial and centrally-administered city People's Committees, and related organizations and individuals are responsible for implementing this Decree./.
