CIRCULAR
DIRECTIVE OF THE MINISTRY OF FINANCE NUMBER 92-TC/ĐT DATED NOVEMBER 7, 1994 GUIDING THE MANAGEMENT AND USE OF EXPENSES FOR REVIEWING THE RESULTS OF BIDDING FOR INVESTMENT PROJECTS BY THE NATIONAL BID EVALUATION BOARD
Pursuant to Decision No. 183-TTg dated April 16, 1994 of the Prime Minister on the establishment of the National Bid Evaluation Board.
After reaching consensus with the State Planning Committee and relevant agencies, the Ministry of Finance guides the management and use of expenses for reviewing the results of bidding for investment projects evaluated by the National Bid Evaluation Board as follows:
I. GENERAL PROVISIONS
1. All large-scale investment projects funded by the State (as stipulated in Article 1 of Decision No. 183-TTg) with an investment capital of at least 100 billion Vietnamese dong equivalent to 10 million US dollars; or projects with lower value, when decided by the Prime Minister, must undergo review of bidding results with the National Bid Evaluation Board (HDBE).
2. The expenses for reviewing the bidding results of projects shall be calculated at a rate of 0.01% of the total value of each project (or each part such as consulting, equipment procurement, construction) but not exceeding 200 million dong and not less than 20 million dong. This cost does not include the cost of hiring foreign experts, which is determined separately by the Prime Minister's approval.
3. Expenses for reviewing the bidding results shall be used to review the bidding results of the entire project or for related tasks such as selecting consultants, purchasing equipment, and construction.
4. The management and use of expenses for reviewing the bidding results of projects shall be carried out according to the current financial management system and the provisions of this Circular.
II- SPECIFIC PROVISIONS
1. Expenses for reviewing the bidding results of projects shall be used for the following purposes:
- Costs for organizations and individuals participating in researching, evaluating, commenting... on bidding documents for projects, according to economic contracts signed between these organizations and individuals and the National Bid Evaluation Board.
- Costs for the working days of the National Bid Evaluation Board (HDBE) of the secretariat with experts and organizations researching and evaluating national bidding results.
- Costs for inspection and review work of HDBE staff and the secretariat including food, accommodation, and travel expenses to the locations of advisory meetings.
- Costs for renting or purchasing working tools, buying information and documents for review.
- Training and guidance costs.
- Printing and translation costs.
- Office supply and office equipment costs serving the bidding process.
2. The Project Owner (Project Leader) is responsible for transferring the expenses for reviewing the bidding results to the HDBE (into the account of the National Bidding Secretariat established under Decree No. 86-CP dated August 12, 1994 of the Government on the functions, tasks, authorities, and organizational structure of the State Planning Committee) together with the time of submitting bidding documents to the HDBE.
3. Annually, based on the list of projects implemented as recorded in the state plan, the Project Owner prepares a budget for the expenses for reviewing the bidding results and sends it to the managing agency. The managing agency reviews and consolidates the budget for reviewing the bidding results in the implementation investment capital plan and sends it to the State Planning Committee and the Ministry of Finance for approval and inclusion in the annual investment capital plan.
4. Based on the approved budget for reviewing the bidding results, the Project Owner implements the transfer of the expenses for reviewing the bidding results to the HDBE as stipulated above.
5. The Chairman of the HDBE is responsible for preparing, managing the budget for reviewing the bidding results and settling accounts for these expenses with the directly managing financial agency according to the current regulations.
6. The budget for reviewing the bidding results is prepared and used according to the current standards, price lists (if any), and invoices as prescribed by the state.
7. The expenses for reviewing the bidding results are considered as state budget funds. At the end of the year, if not fully utilized, they must be promptly and fully returned to the state budget.
8. The total costs for reviewing the bidding results submitted by the Project Owner to the HDBE shall be settled into the project value, included in the other construction items during the implementation phase.
III- IMPLEMENTATION PROVISIONS
This Circular takes effect from the date of issuance. During the implementation period, please report any difficulties to the Ministry of Finance in a timely manner for appropriate amendments.
