Pursuant to Decree No. 86/2003/ND-CP dated July 18, 2003 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to Decree No. 153/2005/ND-CP dated December 15, 2005 of the Government on the organization and operation of Agricultural and Rural Development Inspectors;

Considering the proposal of the Director of the Animal Health Department, the Head of the Inspectorate of the Ministry, and the Director of the Personnel Department.

Article 1. Position and Functions

The Animal Health Inspection Department is an organ of the Animal Health Department, belonging to the system of Agricultural and Rural Development Inspectors, performing administrative inspection and specialized inspection functions within the scope of state management of the Animal Health Department as prescribed by law.

The Animal Health Inspection Department is under the direct management and direction of the Director of the Animal Health Department, while also being subject to guidance and direction regarding work, organization, and administrative and specialized inspection procedures from the Inspectorate of the Ministry of Agriculture and Rural Development.

The Animal Health Inspection Department has its own seal and is entitled to open an account at the State Treasury in accordance with the provisions of the law.

Article 2. Tasks and Powers of the Animal Health Inspection Department

The Animal Health Inspection Department performs tasks and powers as stipulated in Article 9 of Decree No. 153/2005/ND-CP dated December 15, 2005 of the Government on the organization and operation of Agricultural and Rural Development Inspectors, other legal regulations, and specific tasks and powers as follows:

1. Participating in drafting legal documents on animal health; on inspections, complaints, and anti-corruption.

2. Inspecting compliance with legal regulations on animal health concerning:

a) Disease prevention, treatment, and control for animals.

b) Animal quarantine, animal product quarantine; slaughterhouse supervision; veterinary hygiene inspection.

c) Veterinary drug management.

d) Veterinary practice.

3. Reviewing and recommending amendments and supplements to policies and laws related to the specialized field of animal health.

4. Deciding on administrative penalties in the field of animal health according to the provisions of the law.

5. Guiding and training specialized inspection skills in animal health for provincial specialized inspectors; disseminating and popularizing national legal documents related to the field of animal health.

6. Continuously handling citizen reception work; anti-corruption activities of the Department as prescribed.

7. Inspecting other cases assigned by the Director; performing other tasks and powers as prescribed by law.

Article 3. Tasks and Powers of the Head of the Animal Health Inspection Department

The Head of the Animal Health Inspection Department performs tasks and powers as stipulated in Article 10 of Decree No. 153/2005/ND-CP dated December 15, 2005 of the Government on the organization and operation of Agricultural and Rural Development Inspectors, other legal regulations, and specific tasks and powers as follows:

1. Recommending the Director of the Animal Health Department to consider suspending or requesting competent authorities to suspend illegal acts concerning animal health against agencies, organizations, or individuals when there is sufficient evidence that such acts cause damage to national interests, citizens' rights and legitimate interests, or hinder inspection work.

2. Concluding on the content of inspections after receiving reports from inspection teams, and submitting them to the Director for post-inspection decision-making.

3. Assisting the Director in monitoring, inspecting, and urging the implementation of conclusions, recommendations, and decisions on inspections made by the Animal Health Inspection Department and relevant agencies.

4. Deciding on administrative penalties in the field of animal health according to the provisions of the law.

5. Recommending the Director of the Animal Health Department to resolve issues related to inspection work. Reporting to the Head of the Inspectorate of the Ministry about inspection work, complaint resolution, and anti-corruption efforts within their scope of responsibility.

6. Performing other tasks and powers as prescribed by law.

Article 4. Organizational Structure

1. The Animal Health Inspection Department has a Head of Inspection, Deputy Head of Inspection, and Inspection Officers.

a) The appointment, dismissal, and removal of the Head and Deputy Head of Inspection of the Animal Health Department shall be carried out in accordance with Clause 2, Article 8 of Decree No. 153/2005/ND-CP dated December 15, 2005 of the Government on the organization and operation of Agricultural and Rural Development Inspectors.

The Head of the Animal Health Inspection Department is responsible before the Director of the Animal Health Department and the law for the activities of the Inspection Department and the tasks assigned.

The Deputy Head assists the Head of Inspection, is assigned to oversee specific areas, and is responsible before the Head of Inspection and the law for the tasks assigned.

b) The appointment and dismissal of Inspection Officers of the Animal Health Department shall be carried out in accordance with the law.

Inspection Officers, civil servants, and inspection staff: Are responsible before the Head of Inspection and the law for the performance of their assigned tasks; have obligations and rights as prescribed by law.

2. The staffing of the Animal Health Inspection Department belongs to the administrative staffing of the Animal Health Department, decided by the Minister of Agriculture and Rural Development.

Article 5. Work relations of the Inspection Bureau

1. The Inspection Bureau shall coordinate with the Inspection Department of the Ministry of Agriculture and Rural Development to guide and train specialized inspection business for the Inspection Departments of Provincial Departments of Agriculture and Rural Development and veterinary inspection departments at provincial level cities directly under the central government.

2. Coordinate with units under the Bureau, inspection agencies of various sectors, and authorities at all levels during the inspection process of cases and in preventing and stopping violations of laws in the field of veterinary science.

3. Exchange professional and business information on veterinary science with the Inspection Departments of Provincial Departments of Agriculture and Rural Development of provinces and provincial level cities directly under the central government.

Article 6. Effectiveness

This Decision takes effect fifteen days from the date of publication in the Official Gazette. Decree No. 36 NN-TY/QD dated January 25, 1994 issued by the Minister of the Ministry of Agriculture and Food Industry (now the Ministry of Agriculture and Rural Development) on the organizational structure and operation regulations of specialized inspection concerning veterinary work and previous provisions contrary to this Decision are hereby abolished.

Article 7. Responsibility for Implementation

The Director of the Ministry's Office, the Head of the Ministry's Inspection Department, the Director of the Cadre and Civil Servant Department, the Director of the Animal Health Bureau, the Heads of agencies, organizations, and individuals related to this Decision are responsible for its implementation./.
