Regulations on functions, tasks, powers, and organizational structure
of the General Statistics Office under the Ministry of Planning and Investment
THE GOVERNMENT
Pursuant to the Law on Organization of the Government dated December 25, 2001;
WHEREAS the Law on Statistics dated June 17, 2003;
WHEREAS Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government stipulates the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;
WHEREAS Decree No. 01/NĐ-CP dated January 4, 2007 of the Government regarding the transfer of the General Statistics Office to the Ministry of Planning and Investment;
CONSIDERING the proposal of the Minister of Planning and Investment.
DECREE:
Article 1. Position and Functions
1. The General Statistics Office is an organization under the Ministry of Planning and Investment, responsible for assisting the Minister of Planning and Investment in state management of statistics; organizing statistical activities and providing economic and social statistical information to agencies, organizations, and individuals in accordance with the law.
2. The General Statistics Office is an entity with legal personality, has a seal bearing the National Emblem, and is entitled to open an account at the State Treasury; its operational budget is provided by the state budget and recorded separately in the total operational budget of the Ministry of Planning and Investment.
Article 2. Tasks and Powers
The General Statistics Office shall perform the following specific tasks and powers:
1. Drafting and submitting to the Minister of Planning and Investment projects of laws, ordinances, and other regulatory legal documents on statistics according to the division of labor by the Minister of Planning and Investment;
2. Submitting to the Minister of Planning and Investment strategies, plans, long-term, five-year, and annual plans on statistics, and important projects of the General Statistics Office;
3. Submitting to the Minister of Planning and Investment for submission to the Government to define the authority to issue statistical classification tables (except those belonging to the Judiciary and Prosecution sectors);
4. Submitting to the Minister of Planning and Investment for submission to the Prime Minister to issue the national statistical indicators system, basic statistical reporting regulations, comprehensive statistical reporting regulations, long-term and annual national statistical survey programs, and major national census surveys in accordance with the law;
5. Implementing regulatory legal documents that have been issued, strategies, plans, and the national statistical indicator system after approval; promoting, disseminating, and educating the law;
6. Providing professional guidance to ministries, ministerial-level agencies, government agencies, Supreme People's Court, Supreme People's Procuracy, and provincial-level People's Committees on statistical reporting, statistical surveys, and statistical classification;
7. Compiling and processing statistical reports and results of statistical surveys from ministries, ministerial-level agencies, government agencies, Supreme People's Court, Supreme People's Procuracy, and provincial-level People's Committees;
8. Collecting information on economic and social statistics, building and managing the national database on economic and social statistical information;
9. Producing monthly, quarterly, and annual comprehensive statistical reports on the socio-economic situation, implementation of national target programs, achievement of national plan targets, and statistical analysis and forecasting reports on socio-economic development annually;
10. Assisting the Minister of Planning and Investment in uniformly managing the publication of economic and social statistical information in accordance with the law;
11. Publishing information within the national statistical indicator system; providing economic and social statistical information to agencies, organizations, and individuals in accordance with the law; being responsible for the reliability of published and provided data;
12. Compiling and publishing statistical yearbooks and other statistical products of the Socialist Republic of Vietnam and foreign statistical data; conducting international comparisons in statistics;
13. Managing investment and construction projects assigned in accordance with the law and the delegation of the Minister of Planning and Investment;
14. Implementing international cooperation in the field of statistics in accordance with the law and the delegation of the Minister of Planning and Investment;
15. Organizing and directing the implementation of scientific research plans in statistics, applying scientific and technological progress in the centralized statistical organization system;
16. Deciding on measures, organizing, and directing statistical public service supply activities in accordance with the law and the delegation of the Minister of Planning and Investment; state management over affiliated organizations operating under self-management and self-responsibility systems prescribed by the Government;
17. Assisting the Minister of Planning and Investment in managing existing enterprises under the General Statistics Office in accordance with the law;
18. Inspecting, investigating complaints and denunciations, combating corruption and negative practices, and handling violations in statistics within its jurisdiction;
19. Implementing administrative reform in accordance with the goals and content of the General Statistics Office's administrative reform program approved by the Minister of Planning and Investment;
20. Managing organizational structures and staffing; directing the implementation of salary systems and policies, incentives, rewards, and disciplinary actions; training and professional development for statistical staff under the General Statistics Office's jurisdiction in accordance with the law and the delegation of the Minister of Planning and Investment;
21. Managing financial resources and assets assigned in accordance with the law and the delegation of the Minister of Planning and Investment;
22. Performing other tasks and powers as prescribed by law or delegated by the Minister of Planning and Investment.
Article 3. The organizational structure of the General Statistics Office
The General Statistics Office is organized vertically and consists of:
1. At the central level, there is the General Statistics Office directly under the Ministry of Planning and Investment;
2. At the provincial level, there are Provincial Statistics Offices directly under the General Statistics Office;
3. At the district level, there are District Statistics Offices directly under the Provincial Statistics Offices.
The Director of the General Statistics Office shall define the functions, tasks, powers, and organizational structure of subordinate units in accordance with the law.
Article 4. The organizational structure and staffing of the General Statistics Office
1. Administrative advisory bodies assisting the Director of the General Statistics Office:
a) Department of National Account Systems;
b) Department of Statistical Methodology and Information Technology;
c) Department of Integrated Statistics;
d) Department of Industrial and Construction Statistics;
đ) Department of Agriculture, Forestry, and Fisheries Statistics;
e) Department of Trade, Services, and Price Statistics;
g) Department of Population and Labor Statistics;
h) Department of Social and Environmental Statistics;
i) Bureau of International Cooperation;
k) Cadre and Civil Service Organization Department;
l) Financial Planning Department;
Inspectorate;
Office.
2. State-owned scientific and technological units directly under the General Statistics Office:
a) Institute for Statistical Science Research;
b) Statistical Documentation Center;
c) Number and Event Magazine;
d) Statistical Computing Center;
đ) Statistical Computing Center Region II;
e) Statistical Computing Center Region III.
Article 5. Staffing
1. The administrative staffing of the General Statistics Office shall be decided by the Minister of Planning and Investment within the total staffing quota of the Ministry of Planning and Investment.
2. The scientific and technological staffing of the General Statistics Office shall be decided by the Minister of Planning and Investment in accordance with the provisions of the law.
Article 6. Leadership of the General Statistics Office
1. The General Statistics Office shall have a Director-General and not more than three Deputy Directors-General.
2. The Director-General of the General Statistics Office shall be appointed and relieved of duty by the Prime Minister upon the proposal of the Minister of Planning and Investment, and shall be responsible to the Minister of Planning and Investment and to the law for all activities of the General Statistics Office, and shall be guaranteed independence in professional and statistical matters. The Director-General of the General Statistics Office may concurrently hold the position of Deputy Minister of Planning and Investment.
3. The Deputy Directors-General of the General Statistics Office shall be appointed and relieved of duty by the Minister of Planning and Investment upon the proposal of the Director-General of the General Statistics Office, and shall be responsible to the Director-General of the General Statistics Office for the areas of work assigned to them.
Article 7. Effectiveness and Responsibility for Implementation
1. This Decree shall take effect fifteen days from the date of publication in the Official Gazette.
Article 2. Abolish previous provisions that conflict with this Decree.
3. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial People's Committees under central cities, Director-General of the General Statistics Office, relevant agencies, organizations, and individuals shall be responsible for implementing this Decree./.
