Regulations on training, examination, and issuance of military driving licenses.itself

Pursuant to the Law on Legislative Documents of 2008;
Based on the Vocational Training Law 2006;
BASED ON THE LAW ON TRAFFIC ON ROADS 2008;
Pursuant to Decree No. 35/2013/NĐ-CP dated April 22, 2013, of the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of National Defense;
the Minister of National Defense promulgates the technical safety inspection procedure applicable to machinery and equipment with strict requirements for labor safety within the Ministry of National Defense.
The Minister of National Defense issues this Circular to regulate training, examination, issuance of military driving licenses; revocation of the right to use military driving licenses within the Ministry of National Defense.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular regulates training, examination, issuance, replacement, and revocation of the right to use military driving licenses within the Ministry of National Defense.
Article 2. Applicability
This Circular applies to agencies, units managing training, examination, issuance, replacement, and revocation of the right to use military driving licenses; military driving training institutions within the Ministry of National Defense; agencies, units, organizations, and individuals related to training, examination, issuance, replacement, and revocation of the right to use military driving licenses.
Article 3. Explanation of Terms
1. Passenger cars, cargo vehicles, special-purpose vehicles, trailers, semi-trailers (tractor-trailers): These are types of vehicles classified according to the Vehicle-Machine Technical Work Regulations of the Vietnam People's Army.
2. Design load capacity of special-purpose vehicles: This is the design load capacity of cargo vehicles of the same type or equivalent.
3. Military driving training institution: This refers to academies, schools, training centers, and vocational training institutions within the Ministry of National Defense with the function of training military drivers.
4. Military driving license: This is a driving license issued by the Motor Vehicle Department under the General Technical Department of the Ministry of National Defense for military personnel, defense workers, civil servants working in the Ministry of National Defense, and contractual employees to legally operate one or more types of motor vehicles on public roads.
5. Civilian driving license: This is a driving license issued by the Transport Service Department, Public Security, or a driving license issued by foreign countries.
6. Driving time: This is the time recorded in the driving license that the holder has driven the vehicle type specified in the license.
7. Safe kilometers (km) driven: This is the number of kilometers driven by the holder of the driving license without causing accident types A or B.
Article 4. Storage of training, examination, issuance, and replacement of driving license records
1. The Motor Vehicle Department stores the following types of records:
a) Records as stipulated in Points a and b, Clause 1; Points a and b, Clause 4, Article 9 of this Circular;
b) Records as stipulated in Point b, Clause 1; Point b, Clause 2; Points a and e, Clause 3, Article 30 of this Circular;
c) Records as stipulated in Points a, b, c, and d, Clause 1, Article 43 of this Circular;
d) Records as stipulated in Points a and b, Clause 2, Article 44 of this Circular, including attached documents with the list of requests to replace driving licenses from the motor vehicle agency or the motor vehicle management agency of subordinate units of the Ministry of National Defense (hereinafter referred to collectively as the motor vehicle agency); individual application forms for replacing driving licenses;
đ) Records as stipulated in Point c, Clause 2, Article 44 of this Circular (excluding original records from civilian driving license training institutions);
e) Records as stipulated in Points a and b, Clause 2, Article 45 of this Circular.
2. The motor vehicle agency stores the following types of records:
a) Records as stipulated in Clauses 1, 3, and 4, Article 9 of this Circular;
b) Records as stipulated in Clause 3, Article 30 of this Circular;
c) Records as stipulated in Clause 2, Article 44 of this Circular;
d) Records as stipulated in Clause 2, Article 45 of this Circular.
3. Military driving training institutions store the following types of records:
a) Records as stipulated in Article 9 of this Circular;
b) Records as stipulated in Point b, Clause 1; Point b, Clause 2; Clause 3, Article 30 of this Circular.
Chapter II
MILITARY DRIVING TRAINING
Section 1
MANAGEMENT OF MILITARY DRIVING TRAINING
Article 5. Responsibilities of the Motorcycles Bureau
Assist the Minister of National Defense in performing state management functions regarding driver training within the Ministry of National Defense, with the following tasks:
1. Advise and propose to competent authorities on planning and organizing the system of military driver training facilities.
2. Annually compile and propose training quotas for military driver training facilities, report to competent authorities for consideration and decision.
3. Issue detailed programs, materials, and systems of documents and business records for managing military driver training.
4. Manage, direct, guide, and conduct specialized vocational training for military driver training facilities.
5. Regularly or urgently inspect and supervise military driver training facilities on the implementation of training programs, vocational management practices, and driver examination regulations.
6. Issue driving instructor permits, training vehicle permits, and practice license plates for qualified training vehicles according to regulations.
7. Organize examinations, issue, and renew military driving licenses.
Article 6. Responsibilities of motor vehicle agencies of units with military driver training facilities
1. Be subject to the professional guidance of the Motorcycles Bureau on military driver training.
2. Manage, direct, guide, and inspect their level's driver training facility on the implementation of training content, programs, and regulations; motor vehicle management practices, and compliance with prescribed systems.
3. Participate in inspection and supervision of driver training facilities according to plans.
4. Propose issuance of training vehicle permits, practice license plates, and driving instructor permits for driver training facilities when they meet the required conditions.
Article 7. Organization and Training Forms
1. Driver training for class A1, A2: Organized by motor vehicle agencies of subordinate units under the Ministry of National Defense at their units or at training facilities under their management.
2. Driver training for classes A3, B2, C, D, E, F: Conducted centrally at military driver training facilities according to legal provisions.
3. Driver training for classes D, E, F: Conducted through upgrading courses.
Article 8. Conditions for Military Driver Trainees
1. Must be military personnel, defense workers, defense civil servants, or contractual employees working in the Ministry of National Defense (contractual employees only eligible for upgrading driver’s license training for automobiles), meeting age, work experience, health, education, and political quality requirements as stipulated by the Ministry of National Defense.
2. For those upgrading their driver’s license, the following driving experience and safe mileage requirements apply:
a) From class B2 to C, from C to D, from D to E; from B2, D, E to F: At least three years of driving experience and over 50,000 kilometers of safe driving.
b) From C to Fc or Fx: At least two years of driving experience and over 30,000 kilometers of safe driving (except for transitional training from C to Fc or Fx according to the General Staff's quota).
c) From B2 to D, from C to E: At least five years of driving experience and over 100,000 kilometers of safe driving.
3. Specifically, for those upgrading to class D or E driver’s licenses, in addition to the provisions of Clause 1 and Clause 2 of this Article, must hold a secondary school diploma or higher.
Article 9. Driving Training Files
1. Categories A1, A2 include:
a) Military motorcycle driving training plan (accompanied by a list of trainees) of the agency or unit;
b) Individual application for training and examination to obtain a driver's license with confirmation from the head of the directly managing agency or unit at the level of regiment or higher (according to Form No. 01);
c) Copy of military identification card, worker, defense civil servant, military record card, or copy of one of the following documents: induction decision, recruitment decision, promotion decision, most recent salary increase decision still in effect;
d) Health certificate meeting the required conditions issued and confirmed by the competent authority (according to Form No. 02).
2. Categories A3, B2, C include:
a) Training plan (accompanied by a list of trainees) of the training institution;
b) Recruitment announcement of the General Department of Force;
c) Introduction letter accompanied by a list of trainees from the main agency or unit under the Ministry of National Defense;
d) Military personnel training file according to quota includes:
- Individual application for training and examination to obtain a driver's license with confirmation from the head of the directly managing agency or unit at the level of regiment or higher (according to Form No. 01);
- Health certificate meeting the required conditions issued and confirmed by the competent authority (according to Form No. 02);
- Military personnel evaluation form by the head of the directly managing agency or unit at the level of regiment or higher;
- Original or copy of induction order, military service record, military record card;
- Copy of secondary school or high school graduation certificate (with original for verification).
3. Upgrade driving license training: In addition to the files specified in Clause 2 of this Article, the following documents must be supplemented:
a) Declaration of driving time and safe kilometers driven for each category of vehicle with confirmation from the head of the directly managing agency or unit at the level of regiment or higher (according to Form No. 03);
b) Copy of current military driving license (present original when taking the examination).
4. Driving training submission files include:
a) Request for driving training document from the head of the main agency or unit under the Ministry of National Defense or higher;
b) Individual application for training and examination to obtain a driver's license with confirmation from the head of the directly managing agency or unit at the level of regiment or higher (according to Form No. 01);
c) Copy of military identification card, worker, defense civil servant, labor contract, military record card, or copy of one of the following documents: induction decision, recruitment decision, promotion decision, most recent salary increase decision still in effect;
d) Health certificate meeting the required conditions issued and confirmed by the competent authority (according to Form No. 02);
đ) For upgrade driving license training: In addition to the above regulations, all documents specified in Clause 3 of this Article must be supplemented.
Section 2
MILITARY DRIVING TRAINING INSTITUTIONS
Article 10. Tasks
1. Organize driving training for various categories in accordance with the framework curriculum prescribed in Articles 18, 19, and 20 of this Circular.
2. Organize examinations and issue vocational certificates, graduation certificates for trainees (except for Category A1, A2 driving training). Manage and store training files in accordance with regulations.
3. Continuously improve and upgrade facilities, equipment, technical means; enhance professional and technical skills and teaching qualifications of instructors to improve training quality.
4. Implement living arrangements, management, and training of trainees according to the Regulations on Management of Military Units and the Regulations on School Work of the Vietnam People's Army.
5. Implement mid-term and final reviews, report on business operations, and propose organization of examinations and issuance of driving licenses according to the guidance of superior business agencies.
Article 11. Infrastructure Standards
1. General Standards
Must have sufficient theoretical classrooms, specialized classrooms, workshops for practical maintenance and repair training, practice fields, training vehicles, and technical equipment as prescribed, suitable for each training category.
2. Specific Standards
a) Classroom system
- Theoretical classroom: Minimum area of 1.50 m² per trainee, fully equipped with desks, chairs, learning equipment, lighting, and environmental hygiene according to prescribed standards;2- Specialized classroom: Ensure sufficient models, charts, simulation devices, boards, and other teaching equipment as prescribed, suitable for the training program.
b) Workshop for practical maintenance and repair training
- Have sufficient space for trainees to study, minimum area ensuring 35 m² per training vehicle; ensure adequate lighting, ventilation, environmental hygiene, and safety according to prescribed standards;
- Have sufficient parts, assemblies, training vehicles, tools for trainees to practice; ensure 8 to 10 trainees per training vehicle, each vehicle having one set of tools;2- Have sufficient desks, chairs, disassembly tables (cold tables), boards for teaching and studying.
c) Practice driving field
- Have sufficient fields for training and examination driving;
- Driving practice field with minimum area to arrange the prescribed routes for each category of training vehicle;
- Comprehensive field with sufficient length and area to arrange continuous situations according to prescribed standards.
d) Training vehicles
- Belong to the group of training vehicles, allocated to the training institution, corresponding to each category of vehicle permitted for training, registered, and marked with military number plates;
- Have vehicle operation permit, inspection label, and auxiliary brake device for instructors to use according to regulations;
- Transport vehicles used for teaching driving: The cargo bed must have a rain and sun cover and secure seats for trainees;
- Have Training Vehicle Permit and Training Vehicle Sign issued by the Motor Transport Department according to regulations.
đ) Practice driving route is public traffic road, with sufficient traffic signs and basic traffic signals according to the Road Traffic Law, registered and recorded on the Training Vehicle Permit.
e) Textbooks, reference materials, business records
- Have sufficient textbooks and teaching materials for each subject according to the framework training program for each category of vehicle; materials for review, testing, examination, and driving assessment, and reference materials for teaching and learning;
- Have sufficient systems of records and forms for managing teaching and learning activities of instructors and trainees according to regulations.
- Having complete textbooks and teaching materials for each subject according to the training framework program for each category of vehicle; study guides for review, examination, testing, and driving license examinations; and reference materials serving teaching and learning activities;
- Having complete record books and form templates serving the management of teaching and learning activities of instructors and students as prescribed.
Article 12. Teacher Standards
1. General Standards
Must have good moral character and health, having completed secondary education or higher; having undergone training and supplementary knowledge in pedagogy and obtained a teaching certificate as prescribed (except for those who have graduated from colleges or universities of education; technical colleges or universities).
2. Specific Standards
a) Teachers teaching theoretical and practical courses on automobile maintenance and repair must meet the following additional standards in addition to the general standards:
- A diploma from a vocational college or higher, in a relevant field corresponding to the assigned teaching field;
- Teachers teaching traffic law must hold a valid military driving license that is still within its validity period.
b) Teachers teaching theoretical and practical driving courses must meet the following additional standards in addition to the general standards:
- Hold a valid military driving license equivalent to or higher than the category of vehicle permitted to be trained;
- Have at least three years of driving experience;
- Having attended training on practical driving instruction techniques and obtained a Driving Instructor License.
Article 13. Issuance of Training Vehicle Permits
1. Documents include:
a) The request for issuance of a training vehicle permit from the competent authority;
b) Design and modification documents for the main brake support equipment for teachers to use, copies of vehicle registration certificates, decisions on vehicle training groups (in the case of first-time issuance), vehicle operation permits.
2. Procedures for Implementation
a) When the training vehicles meet the criteria specified in Point d Clause 2 Article 11 of this Circular, the military driving school is responsible for preparing one set of documents according to Clause 1 of this Article and sending them directly or through military postal service to the vehicle-machinery department of the subordinate unit under the Ministry of National Defense;
b) From the date of receiving complete documents as prescribed, within five working days, the vehicle-machinery department of the subordinate unit under the Ministry of National Defense is responsible for verifying the legality of the documents, compiling a list of training vehicles, and submitting a request for issuance of a training vehicle permit to the Vehicle-Machinery Department; if the documents are not valid, the vehicle-machinery department of the subordinate unit under the Ministry of National Defense will notify the training institution in writing to complete the documents;
c) From the date of receiving complete documents as prescribed, within ten working days, the Vehicle-Machinery Department is responsible for reviewing and issuing the training vehicle permit (according to Form No. 05); if the conditions for issuing a training vehicle permit are not met, the Vehicle-Machinery Department will notify in writing and specify the reasons.
3. In cases where the training vehicle permit has expired or contains incorrect information or is damaged, the training institution will submit a request accompanied by a copy of the training vehicle permit to the vehicle-machinery department of the subordinate unit under the Ministry of National Defense for consolidation, reporting, and resolution according to Points b and c Clause 2 of this Article.
4. The validity period of the training vehicle permit is two years.
Article 14. Issuance of Driving Instructor Licenses
1. Documents include:
a) Copies of personal documents: Decision recognizing the teacher issued by the head of the training institution, high school diploma or higher, vocational teaching certificate (for initial issuance); valid military driving license;
b) Each individual provides two color photographs measuring 2 x 3 cm taken against a blue background: Military personnel wear regular uniforms as prescribed; civilian workers, defense officials, and contractual laborers wear collared shirts with name badges as prescribed, without hats.
2. Procedures for Implementation
a) Individuals meeting the criteria stipulated in Article 12 of this Circular prepare one set of documents according to Clause 1 of this Article and send it to the training institution;
b) From the date of receiving complete documents as prescribed, within five working days, the training institution is responsible for compiling a list and submitting a request along with the documents to the vehicle-machinery department of their own unit; if the documents are not valid, the training institution is responsible for guiding individuals to complete the documents according to regulations;
c) From the date of receiving complete documents as prescribed, within five working days, the vehicle-machinery department directly managing the training institution is responsible for verifying the legality of the documents and sending a report to the Vehicle-Machinery Department as prescribed;
d) From the date of receiving complete documents as prescribed, within ten working days, the Vehicle-Machinery Department is responsible for reviewing the documents and issuing a Driving Instructor License (according to Form No. 06); if the conditions for issuing a Driving Instructor License are not met, the Vehicle-Machinery Department will notify in writing and specify the reasons.
3. In cases where the Driving Instructor License has expired or contains incorrect information or is damaged, individuals submit a request for renewal of the Driving Instructor License with confirmation from the unit head, accompanied by the original or copy of the Driving Instructor License and two color photographs measuring 2 x 3 cm as prescribed in Point b, Clause 1 of this Article to the training institution. The procedures follow those stipulated in Clause 2 of this Article.
4. The Driving Instructor License is valid for one year.
Article 15. Issuance of Practice License Plates
1. Conditions and Documents for Issuing Practice License Plates
a) Conditions: The practice vehicles must meet the standards as stipulated in Point d, Clause 2, Article 11 of this Circular.
b) Documents include: A request letter for issuing practice license plates along with a list of vehicles requesting practice license plates; a copy of the practice vehicle permit issued by the Motor Vehicle Administration still in effect.
2. Procedures for Implementation
a) The training institution shall prepare one set of documents as specified in Point b, Clause 1 of this Article and submit it to the motor vehicle authority.
b) From the date of receiving complete documents as prescribed, within five working days, the motor vehicle authority directly managing the training institution shall be responsible for checking the legality of the documents and sending a written report to the Motor Vehicle Administration.
c) From the date of receiving complete documents as prescribed, within ten working days, the Motor Vehicle Administration shall be responsible for reviewing the documents and issuing practice license plates according to regulations; in cases where the conditions for issuing practice license plates are not met, the Motor Vehicle Administration shall notify in writing and specify the reasons.
Section 3
OBJECTIVES, REQUIREMENTS AND CURRICULUM
MILITARY DRIVING TRAINING
Article 16. Training Objectives
To train military personnel, defense workers, defense civil servants, and contractual employees who meet the age, work experience, health, cultural level, and political quality requirements as stipulated by the Ministry of National Defense to become qualified military drivers with good political qualities, moral integrity, and professional expertise meeting military mission requirements.
Article 17. Training Requirements
1. Political and Moral Aspects
a) Good political qualities, absolute loyalty to the Party and the Socialist Republic of Vietnam. Strictly abide by state laws and military discipline;
b) Live a clean, healthy, simple, honest life, have a spirit of good teamwork, love the profession, and fulfill their duties and tasks as military drivers.
2. Military and Physical Education
a) Adhere well to the Regulations on Managing Troops and Formation Regulations, maintain a regular style;
b) Have good health to meet assigned task requirements.
3. Professional Technical Skills
a) Understand the function, structure, and operating principles of major components and systems on common motorcycles and automobiles, and some provisions and procedures in the Regulations on Motor Vehicle Technical Work of the People's Army of Vietnam;
b) Master internal rules, procedures, and technical requirements for regular maintenance, understand some aspects of periodic maintenance, new vehicle maintenance, and military vehicle storage;
c) Fully understand and strictly comply with traffic laws and regulations;
d) Know how to handle certain situations during maneuvers and encampments.
4. Practical Skills
a) Control the categories of vehicles specified in the driver's license under various traffic conditions, ensuring safety and efficiency; perform vehicle protection and safe driving tasks in combat situations;
b) Proficient in regular maintenance and repair of common faults of various types of vehicles. Can perform some aspects of periodic maintenance and other types of maintenance as required.
Article 18. Framework Training Program for Motorcycle Driver Licenses Categories A1, A2, A3
1. Duration of Training
a) Category A1: 48 hours;
b) Category A2: 102 hours;
c) Category A3: 198 hours.

MILITARY DRIVING LICENSE EXAMINATION AND ISSUE
Section 1
MILITARY DRIVING LICENSE
Article 21. Classification of Driving Licenses
1. Category A1: Issued to individuals operating two-wheeled motorcycles with engine displacement from 50 cm³3 to less than 175 cm³3.
2. Category A2: Issued to individuals operating two-wheeled motorcycles with engine displacement from 175 cm³3 and above, and all types of vehicles specified for Category A1 driving licenses
3. Category A3: Issued to individuals operating three-wheeled motorcycles, all types of vehicles specified for Category A1 driving licenses, and similar structured vehicles
4. Category B2: Issued to individuals operating passenger cars up to 9 seats; trucks, including specialized trucks and tractors with a load capacity under 3500 kg;
5. Category C: Issued to individuals operating trucks, including specialized trucks and tractors with a load capacity of 3500 kg or more, and all types of vehicles specified for Category B2 driving licenses.
6. Category D: Issued to individuals operating passenger cars from 10 to 30 seats; all types of vehicles specified for Category B2 and C driving licenses.
7. Category E: Issued to individuals operating passenger cars over 30 seats and all types of vehicles specified for Category B2, C, and D driving licenses.
8. Category F
a) Category F Driving LicenseB2, FDomestic air passenger transport service on regular basic economy class, FE: Issued to individuals who already hold a corresponding Category B2, D, or E driving license to operate vehicles specified for this category when towing a trailer or articulated passenger vehicle;
b) Category Fc: Issued to individuals who already hold a Category C driving license to drive vehicles specified for Category C when towing a trailer or military weapons and equipment in trailer form; tractor units towing semi-trailers or military weapons and equipment in semi-trailer form;
c) Category Fx: Issued to individuals who already hold a Category C driving license to operate chain-drawn vehicles carrying military weapons and equipment.
9. Individuals holding Category B2, C, D, or E driving licenses may tow a trailer or military weapons and equipment in trailer form with a maximum load capacity of 750 kg when operating the corresponding vehicle.
Article 22. Model and Validity Period of Driving License
1. Model of Driving License
a) Driving licenses are implemented according to Model No. 08 and Model No. 09;
b) The Director of the Motor Vehicle Administration is responsible for issuing, guiding, and managing the use of driving licenses within the Ministry of National Defense.
2. Validity period of newly issued or renewed driving licenses based on age limit
a) Driving licenses for Categories A1, A2, and A3 have unlimited validity;
b) Driving licenses for Categories B2, C, D, E, and FB2, FC, FDomestic air passenger transport service on regular basic economy class, FE, Fx have a validity period of 05 years from the date of issuance.
3. In cases of renewal for other reasons: The validity period shall be as stated on the driving license.
Article 23. Use and Management of Driving Licenses
1. Individuals assigned the task of operating military vehicles (registration plates issued by the Motor Vehicle Administration) must possess a valid military driving license.
2. Individuals with a military driving license are permitted to operate the types of vehicles specified for each category listed on their driving license.
3. The driving license must be carried by the individual when operating a vehicle. Individuals with a driving license are responsible for preserving, maintaining, and using it for its intended purpose. Upon loss of the driving license or discovery of discrepancies in the information recorded on the driving license, timely reports must be made to relevant authorities for resolution in accordance with the law.
Section 2
MILITARY DRIVING LICENSE EXAMINATION AND ISSUE
Article 24. Examination Board for Issuing Driving Licenses
1. The Director of the Motor Vehicle Department decides to establish the Examination Board for Issuing Military Driving Licenses (hereinafter referred to as the Board). The Board operates on a part-time basis. The composition of the Board includes: Chairman of the Board, Vice-Chairman of the Board, and members.
2. The Board must have at least two-thirds of its members present to conduct business, decisions are made by majority vote, in case of equal opinions among members, the decision of the Chairman of the Board shall be implemented. The Chairman of the Board is responsible under the law for all activities of the Board and the results of the examination period.
3. Tasks and Authorities
a) Review and recognize the list of candidates meeting the conditions to participate in the examination; consider exemption from each examination content for candidates meeting the conditions as prescribed;
b) Decide on the composition of secretaries, examiners, service personnel, and ensure the examination period;
c) Decide on the plan and organize the implementation of the examination plan to ensure quality and effectiveness; direct, inspect, and require the completion of organizational conditions for the examination period;
d) Organize the opening ceremony;
đ) Examine and propose disciplinary measures against those who violate regulations and discipline during the examination;
e) Resolve requests, complaints, and accusations during the examination period (if any);
g) Examine and evaluate the examination results, report, and propose to the Director of the Motor Vehicle Department to approve the list of driving license issuance.
Article 25. Secretary of the Board
1. The Secretary of the Board is decided by the Chairman of the Board, with a number ranging from 01 to 03 persons suitable for each examination period.
2. Tasks
a) Prepare reports, files, lists of candidates participating in the examination, related documents, texts, forms serving the meetings of the Board and the examination period;
b) Chair and coordinate with assigned examiners to check the conditions ensuring the examination at each inspection content;
c) Monitor the implementation of plans, regulations, discipline, and aspects ensuring the examination period;
d) Summarize, report to the Board on the progress and results of the examination period, complete examination records and reports sent to the Motor Vehicle Department for review and issuance of driving licenses according to regulations.
Article 26. Examiner
1. The number and composition of examiners are decided by the Chairman of the Board, ensuring sufficient conditions suitable for each examination period.
2. Duties and powers
a) Check the conditions ensuring the examination according to the assigned tasks;
b) Strictly comply with regulations during the examination and military discipline;
c) Carry out examination tasks according to the plan, ensuring objectivity, honesty, and accuracy; evaluate the results of candidates and be responsible to the Board for the examination results;
d) Propose the Board to examine and handle disciplinary actions within their authority against candidates who violate regulations during the examination.
Article 27. Service Work and Assurance for the Examination Period
1. The military driving training institution is responsible for organizing service work and ensuring all aspects for the examination period according to the plan.
2. Requirements for service work
a) Fully and promptly meet the assurance requirements for each examination content as required by the Board;
b) Organize security, ensuring safety at each examination location.
Article 28. Conditions for Participating in the Examination for Issuing Driving Licenses
1. Categories A1, A2
a) Be a military personnel, defense worker, defense civil servant, or contractual laborer working in the Ministry of National Defense;
b) Have a complete set of valid documents as prescribed;
c) Complete the training content according to the prescribed program, proposed by the motor vehicle agency, training unit, or military driving training institution for the examination and issuance of driving licenses.
2. Other Categories
a) Be a military personnel, defense worker, or defense civil servant trained according to the quota of the General Staff or military personnel, defense workers, defense civil servants, or contractual laborers sent for training by subordinate agencies or units of the Ministry of National Defense;
b) Complete the military driving training program according to the regulations for each category of training, obtaining a vocational certificate or graduation certification;
c) Have a complete set of valid documents as prescribed, proposed by the military driving training institution for the examination and issuance of driving licenses.
Article 29. Examination for Reissuing Driving Licenses
1. Cases requiring theoretical examination
a) The driving license has exceeded its validity period from three to less than twelve months;
b) The driving license is still valid, has complete documentation as prescribed, not seized by competent authorities, and has been lost for three to less than twelve months.
2. Cases requiring both theoretical and practical driving examinations
a) The driving license has exceeded its validity period from twelve to less than thirty-six months;
b) The driving license is still valid, has complete documentation as prescribed, not seized by competent authorities, and has been lost for twelve months or more.
3. Cases requiring additional training before reexamination for issuing a driving license
a) The driving license has exceeded its validity period for thirty-six months or more; the driving license has been lost for twelve months or more and has exceeded its validity period, with complete documentation, not seized by competent authorities;
b) Individuals whose driving licenses have been revoked indefinitely, after twelve months or more (counting from the date the competent authority issued the decision to revoke the driving license), if there is a need to use them for driving duties.
Article 30. Examination Documentation
1. Initial Examination and Issuance of Driving License
One set of documentation as prescribed in Clause 1, 2, and 4, Article 9 of this Circular, supplemented with the following documents:
a) Vocational certificate or graduation certificate from a training course for driving classes A3, B2, C;
b) Report on training results (training) and proposal to establish the Examination Board from the military driving training institution (with a list of candidates attached).
2. Upgrade Examination
One set of documentation as prescribed in Clause 3 and 4, Article 9 of this Circular, supplemented with the following documents:
a) Vocational certificate or graduation certificate from an upgrade training course;
b) Report on training results and proposal to establish the Examination Board from the military driving training institution (with a list of candidates attached).
3. Examination and Reissuance of Driving License
One set of documentation including:
a) Request for examination and reissuance of driving license (with a list attached) from the vehicle-machinery agency;
b) Individual's application for examination and reissuance of driving license with confirmation from the head of the direct management unit at the brigade level or equivalent (according to Form No. 04);
c) Personal statement with confirmation from the police, local government, or the direct management unit at the brigade level or equivalent (in case of loss of driving license);
c) Health certificate meeting the requirements issued and confirmed by the competent authority (according to Form No. 02)
Original driving license (in case it has expired);
e) Report on training results and request for examination and reissuance of driving license from the vehicle-machinery agency or training institution (in case of required retraining).
Article 31. Content of Examination for Issuing Class A1, A2 Driving Licenses
1. Theory: Road Traffic Law, legal documents on road traffic safety regulations, and operational regulations of the Military Vehicle-Machinery Department for two-wheeled motorcycles.
2. Practical Driving: Driving in figure 8, figure 3, narrow width restriction, height restriction, and obstacle avoidance.
Article 32. Content of Examination for Issuing Class A3 Driving Licenses
1. Theory: Road Traffic Law, legal documents on road traffic safety regulations, and operational regulations of the Military Vehicle-Machinery Department for three-wheeled motorcycles.
2. Driving in a combined parking lot through scenarios such as: Narrow width restriction; height restriction; tunnel; roundabout on an elevated parking lot; strip bridge; underground passage; chi-shaped road; figure 8; bomb crater crossing; stopping and starting on a flat slope.
Article 33. Content of the driving license examination for category B2 and C
1. Theory: Road Traffic Law, legal documents on road traffic safety, automobile structure, vehicle usage and transportation business, driving techniques for categories B2 and C.
2. Maintenance and repair of automobiles applicable to the driving license examination for category C
a) Theoretical maintenance and repair;
b) Practical regular maintenance, some contents of level 1 scheduled maintenance, maintenance of certain components;
c) Practical repair of common faults.
3. Driving practice within restricted areas, one of the following routes:
a) Drive forward and reverse in a zigzag shape and turn around in a narrow yard, park into a garage;
b) Drive forward and reverse in an 8-shaped route and pass through tire tracks.
4. Driving practice on roads with moderate traffic density.
5. Driving practice on a combined field according to the examination route arranged with the following situations:
a) Basic operations when starting the vehicle;
b) Parallel parking;
c) Shifting gears up and down while descending;
d) Shifting gears down while ascending;
đ) Stopping at the target and starting on a slope;
e) Downshifting;
g) Passing a sharp turn;
h) Backing into a tunnel;
i) Passing an intersection controlled by traffic signals.
6. For category B2, the content specified in Point g, h, Clause 5 of this Article shall not be examined.
Article 34. Content of the driving license examination for category D and E
1. Theory: Road Traffic Law, legal documents on road traffic safety, automobile structure, vehicle usage and transportation business, driving techniques for categories D and E.
2. Driving practice within restricted areas, one of the following routes:
a) Drive forward and reverse in a circular route; park at a 90-degree angle (parallel parking) and pass through tire tracks;
b) Drive forward and reverse in a zigzag route; park parallel and pass through tire tracks.
3. Driving practice on roads with moderate traffic density.
Article 35. Content of the driving license examination for category FB2, FC, FDomestic air passenger transport service on regular basic economy class, FE
1. Theory: Road Traffic Law, legal documents on road traffic safety, automobile structure, vehicle usage and transportation business, driving techniques for category F.B2, FC, FDomestic air passenger transport service on regular basic economy class, FE
2. Driving practice within restricted areas through the following routes:
a) Drive a truck towing a trailer or military equipment trailer to maneuver between poles; enter a bunker, artillery position, two-door tunnel; detach the trailer (military equipment) from the truck and back into the tunnel to connect the trailer (military equipment) to the towing truck;
b) Drive a truck towing a semi-trailer or military equipment semi-trailer to move straight forward and backward within restricted areas;
c) Drive a truck towing a semi-trailer or military equipment semi-trailer to park at a 90-degree angle.
3. Driving practice towing a trailer, semi-trailer, or military equipment on roads with moderate traffic density.
Article 36. Content of the driving license examination for category FX
1. Theory: Road Traffic Law, legal documents on road traffic safety, tracked vehicle structure, vehicle usage and transportation business, tracked vehicle driving techniques.
2. Tracked vehicle driving practice with and without towing on a combined field
a) Drive a tracked vehicle without towing artillery or military equipment: Basic operations before starting the vehicle; drive over a trench; high pile; bomb crater; board and disembark trains; pass through a narrow road and back into an artillery tunnel;
b) Drive a tracked vehicle towing artillery or military equipment: Descend a hill; ascend a hill; stop and start on a slope; enter a two-door artillery tunnel; stop at the correct position in the artillery tunnel, cut off the artillery, exit the tunnel, back into the tunnel to connect the artillery; pass through a sloping road; underground road; narrow curved road.
Article 37. Examination Methods
1. Theoretical Examination
a) Conducting a multiple-choice examination on a computer or paper based on questions from the Motor Vehicle Department;
b) Exempting the theoretical examination content for cases of training to upgrade from category C to category FC or category FX.
2. Maintenance and Repair Examination
a) Arranging two examiners who independently score each candidate;
b) Oral theory on maintenance and repair;
c) Practicing maintenance or repair of common faults on the brand of vehicle studied;
d) Exempting the maintenance and repair examination content for candidates who have graduated or are students in the Military Motorcycle Training Program with at least 12 months of training.
3. Driving Examination in Restricted Size Course
a) Candidates independently drive in the designated course for each vehicle category;
b) The examination vehicle is of the same category as the trained vehicle; candidates are assigned to an examination vehicle among those registered with the Board;
c) Each course has two independent scorers.
4. Driving Examination in Combined Field
a) Candidates independently drive in the pre-structured examination course for each vehicle category, including all required scenarios;
b) The examination vehicle follows the provisions set out in Point b, Clause 3 of this Article;
c) At each examination scenario, one scorer is arranged to score independently.
5. Driving Examination on Public Roads
a) The examination vehicle must display an "Examination" sign at both front and rear;
b) Candidates independently practice examination content on a road section determined by the Board, suitable for actual conditions at the time of examination;
c) Two scorers are arranged on each vehicle, scoring independently, with one scorer responsible for safety during the examination.
Article 38. Evaluation Method
1. Theoretical Examination: Evaluating results as pass or fail based on the number of correct answers specified for each vehicle category.
2. Maintenance and Repair Examination
a) Evaluating on a scale of 10 points, the examination score by each scorer is the sum of the scores for the theoretical and practical parts (with coefficients applied to each content); the candidate's score is the average of the scores of the two scorers;
b) If the practical content of maintenance and repair does not meet requirements, the overall result is deemed not to meet requirements.
3. Practical Driving Examination
a) Evaluating on a scale of 100 points, a candidate achieving 80 points or more is considered to meet requirements, less than 80 points is considered not to meet requirements;
b) The practical driving examination score is the standard score minus the total points deducted for violations.
4. The Motor Vehicle Department provides specific marking methods for each examination content.
Article 39. Recognition of Results
1. The Board reviews and recognizes examination results, completes the file, and recommends the Director of the Motor Vehicle Department to issue a driver's license to candidates who meet the examination requirements as stipulated.
2. Candidates who do not meet requirements may retake the examination once, seven working days after the end of the examination period. Only the non-passed contents will be retaken, the results of passed contents are retained. A candidate can retain their results once, with a validity period not exceeding 12 months for the passed examination results.
Article 40. Examination Organization Procedure
1. The first meeting of the Board: Examine and recognize candidates eligible to participate in the examination, decide on the composition of the secretariat, examiners, examination plan, and assign tasks to Board members.
2. Meeting of the Examining Committee to disseminate the examination plan and assign examiners.
3. Inspect all preparatory work for the examination.
4. Open the examination period, announce decisions related to the examination period, and emphasize the requirements and tasks of participating components.
5. Conduct examinations according to the planned content.
6. Compile examination results.
7. The second meeting of the Board: Examine and recognize examination results and organize lessons learned from the examination period.
8. Complete files and propose competent authorities to examine and issue driving licenses in accordance with regulations.
Article 41. Tasks and Authorities of Agencies in the Examination Process
1. The Motor Vehicle Department
a) Develop a system of documents on examination management and issuance of military driving licenses, submit to competent authorities for promulgation; direct, guide, and ensure uniform implementation throughout the military in compliance with regulations;
b) Receive and inspect registration files for the examination, assess and confirm driving licenses that meet the conditions for participation in the examination;
c) Direct professional activities, guide and inspect equipment, facilities, material resources, and aspects ensuring the examination;
d) Direct training institutions to implement the examination and issuance of driving licenses; receive, train, examine, and reissue driving licenses;
đ) Coordinate with agencies and units to send officials to participate in the examination board and examiner teams;
e) Decide on the establishment of the Board;
g) Manage and store files in accordance with regulations;
h) Summarize and report on supervision content during the examination period. Study and propose measures to improve the effectiveness of examination supervision work.
2. Motor Vehicle Agency
a) Direct and guide training institutions to implement training programs, training, examination, and issuance of driving licenses in accordance with prescribed content;
b) Compile and complete registration files for the examination and issuance of Class A1, A2 driving licenses, registration files for the examination and reissuance of driving licenses; report to the Motor Vehicle Department on the organization of the examination; receive and issue driving licenses to units;
c) Assign officials to participate in the examination board and examiner teams.
Article 42. Tasks and Authorities of Training Institutions in Organizing the Examination Period and Issuing Driving Licenses
1. Prepare all technical infrastructure, classrooms, workshops, cars, parking areas, examination routes, equipment, and means as required by the Board and examiners.
2. Ensure safety in all aspects during the examination period.
3. Store examination files.
4. Assign officials to participate in the examination board and examiner teams.
Chapter IV
ISSUANCE, RENEWAL, REVOCATION OF MILITARY DRIVING LICENSES
Article 43. Issuance of New Driving Licenses
1. The new driving license application file shall be implemented in accordance with Article 30 of this Circular and supplemented with the following documents:
a) Decision establishing the Council;
b) Decision to establish the Secretariat, Examining Committee, and recognition of candidates eligible to participate in the examination;
c) Minutes of the Board's meetings;
d) Request for issuance of a driving license from the Board (attached with a list of successful examination results) and each individual must submit two 2x3 cm color photos in accordance with Point b, Clause 1, Article 14 of this Circular.
2. Procedures for Implementation
a) From the end date of the examination period, within five working days, the driving training institution shall prepare one set of files in accordance with Clause 1 of this Article and send it to the Motor Vehicle Department;
b) From the date of receiving complete files in accordance with regulations, within ten working days, the Motor Vehicle Department shall be responsible for reviewing and supplementing the files with necessary documents; approve the list and sign to issue driving licenses to candidates who have successfully passed the examination in accordance with regulations.
Article 44. Issuance of New Driving Licenses for Renewal
1. Conditions for Issuing New Driving Licenses for Renewal
a) A person holding a military driving license must submit an application to renew their driving license three months before its expiration date.
b) A person holding a driving license that has been expired for less than three months, a damaged driving license, or a driving license requiring information changes shall be eligible for renewal according to regulations.
c) Military personnel, defense workers, and contractual laborers with valid civilian driving licenses, still in effect, who are assigned to drive military vehicles must process the necessary documentation to exchange their civilian driving licenses for military driving licenses.
d) A person holding a valid military driving license, still within its validity period, who ceases service in the military (retirement, transfer to another profession, discharge, retirement due to disability, termination of employment), if they have the need and meet the health requirements, may exchange their military driving license for a civilian driving license according to the regulations of the Ministry of Public Security or the Ministry of Transport.
đ) No renewal of driving licenses in the following cases: driving licenses that have been erased, altered, or torn beyond recognition; driving licenses that have been tampered with without authorization; driving licenses that have exceeded their validity period according to regulations; driving licenses not issued by authorized agencies; driving licenses of individuals no longer serving in the Ministry of National Defense.
2. Documents Required for Renewal of Driving Licenses
a) Documents required for renewal of driving licenses at the expiration date or those that have been expired for less than three months include: a request for renewal of driving licenses (with attached list) from the vehicle-machinery department; an individual's application for renewal of driving licenses (according to Form No. 07); a certificate of fitness for operating motor vehicles (according to Form No. 02); a copy of the driving license (original driving license for cases exceeding the validity period); each individual must submit two 2x3 cm color photographs as stipulated in Point b, Clause 1, Article 14 of this Circular.
b) Documents required for renewal of driving licenses due to damage or incorrect information include: a request for renewal of driving licenses (with attached list) from the vehicle-machinery department; an individual's application for renewal of driving licenses (according to Form No. 07); original driving license; copies of documents proving incorrect information; each individual must submit two 2x3 cm color photographs as stipulated in Point b, Clause 1, Article 14 of this Circular.
c) Documents required for exchanging civilian driving licenses for military driving licenses include: a request for exchanging civilian driving licenses for military driving licenses (with attached list) from the vehicle-machinery department; an individual's application for renewal of driving licenses (according to Form No. 07); copies of labor contracts (for contractual employees); copies of identification cards for officers, professional soldiers, defense workers, or military identity cards, or copies of one of the following documents: induction decision, recruitment decision, recent promotion or rank award decision still in effect, assignment decision signed by a commander at the division level or higher, valid for no more than six months from the date of issuance (not applicable to officers applying for driving licenses for duty purposes); a certificate of completion of the program for converting civilian driving licenses to military driving licenses issued by a military driving school; a valid civilian driving license (if issued by a foreign country, it must be accompanied by a certified translation); original training records for civilian driving licenses; each individual must submit two 2x3 cm color photographs as stipulated in Point b, Clause 1, Article 14 of this Circular.
d) The process of exchanging military driving licenses for civilian driving licenses shall be carried out according to the regulations of the Ministry of Transport or the Ministry of Public Security.
3. Implementation Procedures
a) For cases where driving licenses are renewed at the expiration date or have been expired for less than three months: Individuals wishing to renew their driving licenses must submit the required documents as specified in Point a, Clause 2 of this Article to their unit's vehicle-machinery department. The vehicle-machinery departments of units, based on their authority, will review the documents, compile lists (attached to the documents), and submit them to the central vehicle-machinery department under the Ministry of National Defense for consolidation and reporting to the Vehicle-Machinery Department for examination, verification, and issuance of new driving licenses according to regulations. If the conditions for issuing new driving licenses are not met, the Vehicle-Machinery Department will notify in writing and specify the reasons. The time limit for issuing new driving licenses is no later than fifteen working days from the date the Vehicle-Machinery Department receives complete and valid documents.
b) For cases where driving licenses are renewed due to damage or incorrect information: Individuals holding damaged or incorrectly informed driving licenses must submit the required documents as specified in Point b, Clause 2 of this Article to their unit's vehicle-machinery department. The vehicle-machinery departments of units, based on their authority, will review the documents, compile lists (attached to the documents), and submit them to the central vehicle-machinery department under the Ministry of National Defense for consolidation and reporting to the Vehicle-Machinery Department for examination, verification, and issuance of new driving licenses according to regulations. If the conditions for issuing new driving licenses are not met, the Vehicle-Machinery Department will notify in writing and specify the reasons. The time limit for issuing new driving licenses is no later than fifteen working days from the date the Vehicle-Machinery Department receives complete and valid documents.
c) For cases where civilian driving licenses are exchanged for military driving licenses: Individuals holding civilian driving licenses wishing to exchange them for military driving licenses must submit the required documents as specified in Point c, Clause 2 of this Article to their unit's vehicle-machinery department. The vehicle-machinery departments of units, based on their authority, will review the documents, compile lists (attached to the documents), and submit them to the central vehicle-machinery department under the Ministry of National Defense for consolidation and reporting to the Vehicle-Machinery Department for examination, verification, and issuance of new driving licenses according to regulations. If the conditions for issuing new driving licenses are not met, the Vehicle-Machinery Department will notify in writing and specify the reasons. The time limit for issuing new driving licenses is no later than fifteen working days from the date the Vehicle-Machinery Department receives complete and valid documents.
Article 45. Reissuing Driving Licenses
1. Conditions for reissuing driving licenses
In cases where a driving license is lost for less than three months, if the driving license is still within its validity period, has complete documentation as prescribed, and has not been seized by an authorized agency, it shall be considered for reissuance of the driving license.
2. Documentation includes:
a) A request for reissuance of a driving license (with attached list) from the vehicle-motor unit;
b) An individual's application for reissuance of a driving license (in Form No. 07);
c) A certificate of fitness for health conditions as prescribed by the competent authority (in Form No. 02);
d) A copy of the driving license (if available);
đ) A personal statement with confirmation (signed and stamped) by the police, local authorities, or the agency/unit where the individual lost the driving license and confirmed by the Vehicle-Motor Unit that it was not seized;
e) Each individual must submit two color photographs measuring 2 x 3 cm as specified in Point b, Clause 1, Article 14 of this Circular.
3. Implementation Procedures
Individuals who have lost military driving licenses and meet the conditions stipulated in Clause 1 of this Article must submit the documentation as prescribed in Points b, c, d, đ, e of Clause 2 of this Article to their respective vehicle-motor units. The vehicle-motor unit will check the documentation, compile a list, and send a report (along with the documentation) to the central vehicle-motor unit under the Ministry of National Defense for review, assessment, and issuance of the driving license according to regulations. If the conditions for reissuance of the driving license are not met, the Vehicle-Motor Unit will notify in writing and specify the reasons. The reissuance of the driving license must be completed no later than ten working days from the date when the Vehicle-Motor Unit receives all valid documentation as prescribed.
Article 46. Suspension of the Right to Use a Driving License
1. Cases of suspension of the right to use a driving license
a) Military drivers who violate administrative regulations in the field of road traffic shall be subject to penalties as prescribed by law.
b) Military drivers who violate regulations of the Ministry of National Defense regarding any of the following behaviors: operating a vehicle without a registration certificate, without a vehicle operation permit, without a safety technical inspection label or those that have expired for more than thirty days; driving a vehicle without a suitable driving license; failing to comply with the instructions of enforcement agencies shall have their right to use a driving license suspended for thirty days and may face further penalties according to the degree of violation as prescribed by law;
c) In cases where the vehicle number plate does not match the registration certificate or the number plate, registration certificate, or safety technical inspection label were not issued by an authorized agency, the right to use a driving license shall be suspended for sixty days, the number plate, registration certificate, and improperly used safety technical inspection label shall be confiscated, and further penalties may be imposed according to the degree of violation as prescribed by law.
2. Procedure and Authority for Suspending the Right to Use a Driving License
a) Military vehicle inspection teams, when performing their duties, have the authority to correct violations as specified in Point a, Clause 1 of this Article; to issue reports and suspend the right to use a driving license for violations as specified in Points b and c of Clause 1 of this Article; they must report in writing, along with seized documents, to the vehicle-motor unit under the Ministry of National Defense for handling within one working day;
b) The head of the vehicle-motor unit has the authority to handle violations as specified in Points b and c of Clause 1 of this Article; they must report in writing to the Vehicle-Motor Unit and promptly inform the relevant agencies or units about the violations within one working day;
c) The Vehicle-Motor Unit has the authority to handle violations as specified in this Circular; they must notify the relevant agencies or units of the violations handled by themselves or subordinate units within two working days.
Chapter V
IMPLEMENTING PROVISIONS
Article 47. Effective Date
This Circular takes effect from August 10, 2016, and replaces Circular No. 32/2010/TT-BQP dated April 8, 2010, issued by the Minister of National Defense on training, examination, issuance, and replacement of military driving licenses, and Circular No. 141/2014/TT-BQP dated October 20, 2014, issued by the Minister of National Defense amending Article 21 of Circular No. 32/2010/TT-BQP dated April 8, 2010.
Article 48. Responsibility for Implementation
1. The Chief of the General Department of Technical Services, heads of agencies and units, organizations, and related individuals are responsible for implementing this Circular.
2. The Director of the Vehicle-Motor Unit is responsible for guiding and implementing this Circular./.
