REGARDING THE IMPLEMENTATION OF DECREE 299-HĐBT

Pursuant to Decree No. 153-CP dated October 5, 1961 of the Council of Ministers on the tasks and powers of the Ministry of Health, and Decree No. 196-HĐBT dated December 11, 1989 of the Council of Ministers on the functions and responsibilities for state management of ministries;
Pursuant to Decree No. 299-HĐBT dated August 15, 1992 of the Council of Ministers on the issuance of the Social Health Insurance Regulations;
At the proposal of the Director of the Labor Organization Department of the Ministry of Health,

Article 1. Now implement Decree No. 299-HĐBT dated August 15, 1992 of the Council of Ministers on the issuance of the Social Health Insurance Regulations.

Article 2. The name of the Social Health Insurance Organization from central to local levels and sectors:

1. Central level: Named as Vietnam Social Health Insurance.

2. Local level: Named as Provincial/City Social Health Insurance. In districts and urban districts, it is called District Branch of Social Health Insurance.

3. Sectors: Named as Sectoral Social Health Insurance.

Article 3. The Social Health Insurance Organization at each level shall be subordinate to that level.

- Vietnam Social Health Insurance, subordinate to the Ministry of Health.

- Provincial/City Social Health Insurance, subordinate to the Director of the Provincial/City Health Department.

- District Branch of Social Health Insurance, subordinate to the Director of Provincial/City Social Health Insurance under the central level.

- Sectoral Social Health Insurance, subordinate to the leadership of that sector.

- All provincial and sectoral Social Health Insurances are subordinate to Vietnam Social Health Insurance.

Article 4. Organizational structure and staffing:

1. Leadership:

+ There is one director and 1-2 deputy directors assisting the director.

+ There is one chief accountant.

2. Supporting department: There is one office department.

3. Staffing: Proposed by the Director of Social Health Insurance based on the content of work, subject to approval by the competent authority.

Article 5. The activities of Social Health Insurance at all levels are business organizations operating on a self-accounting basis without profit-making, aimed at serving health protection and social equity in medical examinations and treatments. Vietnam Social Health Insurance has legal personality, its own seal, and separate accounts.

Article 6. The organization of tasks and operational regulations of Social Health Insurance at all levels, the Minister of Health entrusts the Director of Vietnam Social Health Insurance with the responsibility to study, propose, and guide the implementation by localities and sectors after approval by the Minister of Health.

Article 7. This Decision takes effect from the date of issuance.

Article 8. The Heads of the Office, Directors of Departments within the Ministry of Health's agencies, Heads of related units, Directors of Provincial/City Health Departments directly under the central government are responsible for implementing this Decision.
