DECISION OF THE MINISTER OF TRADE

Regarding the establishment of a permanent working group to cooperate with the United States on combating trade fraud

during the implementation of the Vietnam-U.S. Textile Agreement

THE MINISTER OF TRADE

Pursuant to Decree No. 95/CP dated December 4, 1993 of the Government stipulating the functions, tasks, authorities, and organizational structure of the Ministry of Trade;

Implementing the guidance of the Prime Minister as stated in Official Letter No. 669/CP-KTTH dated May 21, 2003 of the Office of the Government regarding the implementation of the Vietnam-U.S. Textile Agreement and Circular Joint No. 02/2003/TTLT/BTM-KHĐT-CN dated May 27, 2003 of the Ministry of Trade, the Ministry of Planning and Investment, and the Ministry of Industry guiding the allocation and implementation of textile export quotas to the U.S. market for the year 2003.

At the proposal of the Director of the Import-Export Department;

 

DECISION: 

Article 1. Establish a Permanent Working Group to cooperate with the United States on combating trade fraud during the implementation of the Vietnam-U.S. Textile Agreement (hereinafter referred to as the Permanent Working Group) comprising:

- Mr. Le Van Thang - Deputy Director of the Import-Export Department (Group Leader)

- Mr. Nguyen Duc Thinh - Deputy Director of the Market Management Department

- Mr. Nguyen Van Binh - Deputy Director of the Europe-America Department

- Mr. Nguyen Thanh Hung - Deputy Director of the Legal Affairs Department

- Mr. Nguyen Tien Dat - Specialist of the Market Management Department

- Mr. Tran Viet - Specialist of the Europe-America Department

- Mr. Nguyen Viet Hung - Specialist of the Legal Affairs Department

- Ms. Le Thi My Hanh - Specialist of the Import-Export Department

- Ms. Hoang Hoai Hanh - Specialist of the Import-Export Department

- Mr. Duong Ngoc Dung - Specialist of the Import-Export Department

Article 2. Tasks of the Permanent Working Group

1. Coordinate with competent authorities of Vietnam and the U.S. Customs Service to propose solutions to issues arising during the implementation of the Vietnam-U.S. Textile Agreement.

2. Conduct inspections at production facilities and actual export capacity upon request of the U.S. Customs Service. After each inspection period, a report and recommendations must be submitted to the leadership of the Ministry of Trade.

3. Study policies and measures against trade fraud in the United States and other countries to recommend their application in Vietnam.

4. Propose solutions to combat trade fraud and measures to address violations of laws related to the implementation of the Vietnam-U.S. Textile Agreement.

Article 3. Operating Budget

The operating expenses of the Permanent Working Group shall be funded from the revenue of textile export quota fees to the U.S. market as prescribed by the Ministry of Finance.

Article 4. Implementation Provisions

1. This Decision takes effect fifteen days after its publication in the Official Gazette.

2. The Heads of the General Office, the Organizational Cadre Department, the Import-Export Department, and the members listed in Article 1 are responsible for implementing this Decision./.
