CIRCULAR
Supplementing the provisions set forth in Circular No. 121/2000/TT-BTC dated December 29, 2000 of the Ministry of Finance guiding the implementation of bidding for procurement of office supplies, materials, equipment, and working tools for state agencies, armed forces, social organizations, and state-owned enterprises using state budget funds.
CPursuant to Decree No. 88/1999/NĐ-CP dated September 1, 1999 of the Government on the issuance of the Bidding Regulations; Decree No. 14/2000/NĐ-CP dated May 5, 2000 of the Government amending and supplementing certain articles of the Bidding Regulations issued together with Decree No. 88/1999/NĐ-CP dated September 1, 1999. The Ministry of Finance has issued Circular No. 121/2000/TT-BTC dated December 29, 2000 guiding the implementation of bidding for procurement of office supplies, materials, equipment, and working tools for state agencies, armed forces, social organizations, and state-owned enterprises using state budget funds.
After a period of implementation, the Ministry of Finance supplements and amends the provisions at Point 1-Part I of Circular No. 121/2000/TT-BTC dated December 29, 2000 as follows:
1. Scope of application:
a- When procuring goods specified in point 2 below with unit price or total value of VND 100 (one hundred) million or more in a single procurement (one tender package) of similar or compatible goods, the procurement shall be carried out according to the provisions of this circular including:
+ State agencies, political organizations, political-social organizations, social-professional organizations, and armed forces (hereinafter referred to as agencies and units) using state budget funds or funds originating from the state budget for procurement.
+ State-owned enterprises when using state budget funds allocated for the procurement of office supplies, materials, equipment, and working tools. For procurement from business capital of enterprises not falling under the scope of this circular.
b- For procurement of goods with a value less than VND 100 million, the heads of central agencies and units decide on the appropriate procurement method (which may include direct purchase or designated tender without the need to meet the conditions stipulated in points 2 and 3 of Section III of this circular) and bear responsibility for their decision. For agencies and units managed by localities, procurement shall be carried out in accordance with the regulations of the People's Committee of the province or centrally-administered city or authorized agency. It is encouraged that agencies and units apply the provisions of this circular.."
This circular takes effect fifteen days from the date of signature. Other contents not addressed in this circular shall continue to be implemented in accordance with Circular No. 121/2000/TT-BTC dated December 29, 2000 of the Ministry of Finance. Any issues arising during implementation should be reported to the Ministry of Finance for consideration and resolution./.
