THE GOVERNMENT

Pursuant to the Law on Organization dated December 25, 2001;

Pursuant to Resolution No. 02/2002/QH10 dated August 5, 2002 of the National Assembly of the Socialist Republic of Vietnam, Session XI, First Meeting, listing the Ministries and agencies equivalent to Ministries. and agencies equivalent to Ministries under the Government;

Pursuant to Resolution No. 11/2002/NQ-CP dated October 4, 2002 of the Government's regular meeting in September 2002;

Pursuant to Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;

Article 1Position and functions.

Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).The Population, Family, and Children Committee is an agency equivalent to a Ministry under the Government responsible for managing state affairs related to population, family, and children; managing state services in the fields of population, family, and children.

The Population, Family, and Children Committee is responsible for performing the duties and powers stipulated in Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government on the functions, duties, powers, and organizational structure of Ministries, agencies equivalent to Ministries, and the following specific duties and powers:

Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).1. Submit draft laws, ordinances, and other regulatory legal documents concerning population, family, and children to the Government;.

2. Submit to the Government strategies, plans for development, long-term plans, five-year plans, annual plans, national target programs, action programs, and important projects concerning population, family

and children. 3. Issue regulatory legal documents and standards concerning population, family, and children within its authority;

4. Organize and direct the implementation of regulatory legal documents, strategies, plans for development, long-term plans, five-year plans, annual plans after approval, and national target programs, action programs; promote, disseminate, educate about laws and information on population, family, and children both domestically and internationally,

5. Develop plans for coordinating activities among Ministries, agencies equivalent to Ministries, government agencies, provincial People's Committees, and political-social organizations, social organizations at

the central level in implementing tasks related to population, family planning, and children; Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).6. Lead and guide population registration work, compile and analyze population situations, collect and store information on population, family, and children; participate in coordinating with Ministries, agencies equivalent to Ministries, government agencies, and provincial People's Committees regarding population distribution among localities nationwide.

7. Lead, Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).coordinate with the Ministry of Labor, Invalids, and Social Affairs in protecting and caring for disabled, orphaned children, and with the Ministry of Health in caring for malnourished children;

the Committee;

14. Mobilize financial support and manage, use the Central Child Welfare Fund; direct and inspect management and use. Child Welfare Funds at all levels, sectors;

15. Manage state affairs concerning the activities of associations, non-governmental organizations in the field of population, family, and children according to the provisions of the law;

Decide and direct the implementation of the administrative reform program of the Committee according to the goals and contents of the State administrative reform program approved by the Prime Minister; 18. Manage organizational structures, staffing, direct the implementation of salary systems and incentive policies, rewards, and disciplinary measures for civil servants, public officials, and employees under the Committee's jurisdiction; train and enhance professional skills for civil servants, public officials, employees, and those working in population, family, and children affairs;
