DECREE
Regulations on the Functions, Duties, Authorities, and Organizational Structure of the Tourism Administration

THE GOVERNMENT
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Based on the Tourism Ordinance dated February 8, 1999;
Pursuant to Decree No. 30/2003/NĐ-CP dated April 1, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of agencies under the Government;
At the proposal of the Director of the Tourism Administration and the Minister of Home Affairs,
DECREE
The Tourism Administration is an agency under the Government that performs certain tasks and authorities to manage state affairs in the tourism sector nationwide; manages state affairs for public services within the tourism field and implements specific tasks and authorities regarding representing the state's ownership interest in enterprises with state capital under the Tourism Administration according to the provisions of the law.
b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;
The Tourism Administration is responsible for performing the tasks and authorities of an agency under the Government managing state affairs in the industry and sector as stipulated in Decree No. 30/2003/NĐ-CP dated April 1, 2003 of the Government on the functions, duties, authorities, and organizational structure of agencies under the Government and the following specific tasks and authorities:
1. To take the lead or participate in drafting draft laws, ordinances, and draft regulatory legal documents on tourism and other regulatory legal documents related to tourism as assigned by the Government,
2. To submit to the Government,
3. Submitting to the Government,
4. To submit to the Minister who is authorized,
5. To review or participate in reviewing development plans for tourism in provinces and centrally-administered cities, national tourist areas, and projects related to tourism upon request of the Government,
6. To decide on investment and construction projects within its authority as prescribed by law;
7. To submit to the Government,
8. To direct, organize, and inspect the implementation of regulatory legal documents on tourism; to promote, disseminate, educate on, and provide information about tourism laws;
9. To decide and direct the implementation of the administrative reform program of the Tourism Administration according to the objectives and contents of the State administrative reform program that has been approved;
10. To guide, inspect, and be responsible for organizing the provision of public services in the tourism field according to the provisions of the law;
11. To organize and manage state affairs for domestic and international tourism promotion activities; to issue permits and manage state affairs for foreign tourism representative offices located in Vietnam;
12. To implement scientific research and apply technological advancements in the tourism field; to direct the implementation of surveys and assessments to classify tourism resources; to direct and guide measures to protect tourism resources and the tourism environment;
13. To coordinate with relevant ministries and sectors to direct and guide the implementation of human resource training and development programs in the tourism field; to build and submit to competent state agencies for promulgation the job titles, standards for cadres, civil servants, and employees in the tourism sector;
14. To implement state management over travel business operations, tour guiding, tourism accommodation facilities, tourist transportation, and other tourism services according to the provisions of the law; to issue and revoke international travel agency licenses, tour guide cards, certificates for classified and ranked tourism accommodation facilities, and other certificates and certifications as prescribed by law;
15. To perform specific tasks and authorities of the representative of the state's ownership interest in enterprises with state capital under the Tourism Administration according to the provisions of the law;
16. To inspect, investigate, resolve complaints, accusations, anti-corruption, thrift, and handle violations of law and administrative offenses in the tourism field within its authority as prescribed by law;
17. To manage state affairs for associations and non-governmental organizations in the tourism field according to the provisions of the law;
18. To manage organizational structures and staffing; to direct the implementation of salary systems and incentive policies, rewards, and disciplinary actions for cadres, civil servants, and employees under the management of the Tourism Administration;
19. To manage financial resources and assets allocated and to organize the implementation of budgets allocated according to the provisions of the law;
20. To implement reporting requirements to the Government,
Article 3. The organizational structure of the Tourism Administration
a) Organizations assisting the Director General in performing duties and exercising powers:
1. Travel Department;
2. Hotel Department;
3. Planning and Finance Department;
4. Department of International Cooperation;
5. Organization and Cadre Department;
6. Legal Affairs Department;
8. Office;
8. Tourism Promotion Agency;
9. Office.
b) Public service organizations under the Tourism Administration:
1. Institute for Tourism Development Research;
2. Information Technology Center;
3. Tourism Magazine;
4. Tourism Newspaper. The Director General of the Tourism Administration shall take the lead and coordinate with the Minister of Home Affairs to develop a plan for restructuring other public service organizations currently under the Tourism Administration, to be submitted for approval.
Article 4. Effective date
This Decree takes effect fifteen days after its publication in the Official Gazette and replaces Government Decree No. 20/CP dated December 27, 1992 on the functions, tasks, powers, and organizational structure of the Tourism Administration, Government Decree No. 53/CP dated August 7, 1995 on the organizational structure of the Tourism Administration, and previous regulations that conflict with this Decree.
Article 5. Responsibilities for Implementation
The Director General of the Tourism Administration, Ministers, Heads of ministerial-level agencies, Heads of central government agencies, and Chairpersons of provincial and municipal People's Committees directly under the Central Government are responsible for implementing this Decree.
