Decree No. 94/2021/NĐ-CP amends and supplements Article 14 of Decree No. 168/2017/NĐ-CP dated December 31, 2017 of the Government detailing certain provisions of the Tourism Law on the amount of deposit for travel agency services.

DECREE

AMENDING AND SUPPLEMENTING ARTICLE 14 OF THE DECREE NO. 168/2017/NĐ-CP OF DECEMBER 31, 2017 OF THE GOVERNMENT PROVIDING GUIDELINES FOR SOME PROVISIONS OF THE TOURISM LAW ON THE AMOUNT OF SECURITY DEPOSIT FOR OPERATING TRAVEL SERVICES

Pursuant to the Law on Organization of the Government dated June 19, 2015; the Law Amending and Supplementing Certain Provisions of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;

Pursuant to the Tourism Law dated June 19, 2017;

At the proposal of the Minister of Culture, Sports and Tourism;

The Government promulgates this Decree amending and supplementing Article 14 of Decree No. 168/2017/NĐ-CP of December 31, 2017 of the Government providing guidelines for some provisions of the Tourism Law on the amount of security deposit for operating travel services.

Article 1. Amending and supplementing Article 14 of Decree No. 168/2017/NĐ-CP of December 31, 2017 of the Government providing guidelines for some provisions of the Tourism Law on the amount of security deposit for operating travel services.

Amending and supplementing Clause 1 and Clause 2 of Article 14 as follows:
"1. The amount of security deposit for operating domestic travel services: 20,000,000 (twenty million) Vietnamese dong.
2. The amount of security deposit for operating international travel services:
a) Operating travel services for international tourists visiting Vietnam: 50,000,000 (fifty million) Vietnamese dong;
b) Operating travel services for tourists traveling abroad: 100,000,000 (one hundred million) Vietnamese dong;
c) Operating travel services for both international tourists visiting Vietnam and tourists traveling abroad: 100,000,000 (one hundred million) Vietnamese dong".

Article 2. Implementation

1. The Ministry of Culture, Sports and Tourism shall take the lead and coordinate with relevant ministries and agencies to guide and organize the implementation of this Decree.

2. Banks receiving security deposits for operating travel services shall have the following responsibilities:

a) Recover the Certificate of Security Deposit for Operating Travel Services issued to enterprises, issue new Certificates of Security Deposit according to the amounts specified in Article 1 of this Decree, and refund the difference between the amount of security deposit under Decree No. 168/2017/NĐ-CP of December 31, 2017 of the Government providing guidelines for some provisions of the Tourism Law and this Decree to enterprises from the date this Decree takes effect;

b) Send lists and information about enterprises that have changed their certificates of security deposit to the competent authority issuing travel service business licenses within thirty days from the date of changing the certificate of security deposit.

3. Enterprises operating travel services shall have the following responsibilities:

a) Enterprises that have been issued a Certificate of Security Deposit for Operating Travel Services according to Decree No. 168/2017/NĐ-CP of December 31, 2017 may change their Certificate of Security Deposit for Operating Travel Services according to the amounts specified in Article 1 of this Decree and send it to the competent authority issuing travel service business licenses within thirty days from the date of change;

b) From January 1, 2024, enterprises that operate travel services according to this Decree must change their Certificate of Security Deposit for Operating Travel Services according to the amounts specified in Clause 1 and Clause 2 of Article 14 of Decree No. 168/2017/NĐ-CP of December 31, 2017 and send it to the competent authority issuing travel service business licenses within thirty days from the date of change.

4. Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairpersons of provincial People's Committees directly under the central government, and related organizations and individuals are responsible for implementing this Decree.

Article 3. Implementation Provisions

1. This Decree takes effect from the date of issuance.

2. The amount of security deposit for operating travel services as stipulated in Article 1 of this Decree shall be implemented until December 31, 2023.

3. From January 1, 2024, the amount of security deposit for operating travel services shall be implemented according to the provisions of Clause 1 and Clause 2 of Article 14 of Decree No. 168/2017/NĐ-CP of December 31, 2017./.
