Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Decree No. 36/CP dated April 24, 1997 of the Government promulgating the Regulations on Industrial Zones, Export Processing Zones, and High-Tech Zones;

Pursuant to Decision No. 72/2006/QĐ-TTg dated April 3, 2006 of the Prime Minister regarding the establishment and issuance of the Operational Regulations for the Vung Ang Economic Zone, Ha Tinh Province;

Considering the proposal of the Chairman of the People's Committee of Ha Tinh Province and the Minister of Home Affairs.

Article 1. Establish the Management Board of the Vung Ang Economic Zone based on the Management Board of Ha Tinh Industrial Zones.

The Management Board of the Vung Ang Economic Zone is a state management agency under the Ha Tinh Provincial People's Committee to implement the construction and development management of the Vung Ang Economic Zone and industrial zones within the province according to the operational regulations, planning, and implementation schedule approved by competent state authorities.

The Management Board of the Vung Ang Economic Zone has legal personality, bears a seal with the national emblem; has an office location, staffing, operating budget, and development capital provided annually from the state budget; it is the focal point for planning and budgeting, with development investment capital balanced separately from the central budget.

Article 2. The Management Board of the Vung Ang Economic Zone, Ha Tinh Province shall be responsible for performing the following tasks and powers:

1. Tasks and powers stipulated in Article 27 of the Regulations on Industrial Zones, Export Processing Zones, and High-Tech Zones issued together with Decree No. 36/CP dated April 24, 1997 of the Government;

2. Specific tasks and powers stipulated in Articles 28 and 29 of the Operational Regulations for the Vung Ang Economic Zone, Ha Tinh Province issued together with Decision No. 72/2006/QĐ-TTg dated April 3, 2006 of the Prime Minister;

3. Other duties and powers as prescribed by law.

Article 3. The organizational structure and staffing of the Management Board of the Vung Ang Economic Zone, Ha Tinh Province include:

1. Organizational Structure:

a) The Management Board of the Vung Ang Economic Zone, Ha Tinh Province has a Director appointed by the Prime Minister; several Deputy Directors and several Members appointed by the Chairman of the Ha Tinh Provincial People's Committee upon the recommendation of the Board Director.

b) The Management Board of the Vung Ang Economic Zone, Ha Tinh Province has an administrative apparatus as prescribed in Article 28 of the Regulations on Industrial Zones, Export Processing Zones, and High-Tech Zones issued together with Decree No. 36/CP dated April 24, 1997 of the Government, including:

- Office;

- Inspection;

- Specialized departments.

c) Affiliated public service units.

Depending on the requirements for developing the Vung Ang Economic Zone at each specific stage, the Director of the Management Board of the Vung Ang Economic Zone, Ha Tinh Province shall submit proposals on organizational structures to the Chairman of the Ha Tinh Provincial People's Committee for decision within their authority.

2. Staffing:

The staffing of the Management Board of the Vung Ang Economic Zone, Ha Tinh Province includes the Director, specialized Deputy Directors, and the staffing of the office, inspection department, and specialized departments, which are state management staffing.

The staffing of the Management Board of the Vung Ang Economic Zone, Ha Tinh Province shall be decided by the Chairman of the Ha Tinh Provincial People's Committee in accordance with the provisions of the law on decentralization of administrative and public service staffing management and the staffing management mechanism for state-affiliated public service units.

Article 4. The Director of the Management Board of the Vung Ang Economic Zone shall submit to the Chairman of the Ha Tinh Provincial People's Committee for detailed regulations on the functions, tasks, powers, and organizational structure of the Management Board of the Vung Ang Economic Zone in accordance with the law.

Article 5. This Decision shall take effect fifteen days after its publication in the Official Gazette.

This Decision replaces Decision No. 160/2002/QĐ-TTg dated November 15, 2002 of the Prime Minister regarding the establishment of the Management Board of Ha Tinh Industrial Zones.

Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, the Chairman of the Ha Tinh Provincial People's Committee, and the Director of the Management Board of the Vung Ang Economic Zone, Ha Tinh Province are responsible for implementing this Decision./.
