THE MINISTER OF INDUSTRY

Pursuant to the Law on Science and Technology dated June 9, 2000;

Pursuant to Decree No. 55/2003/NĐ-CP dated May 28, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry;

Pursuant to Decision No. 56/2002/QĐ-BCN dated December 18, 2002 of the Ministry of Industry regarding the transfer of the Institute of Industrial Machinery and Equipment from being a unit member of the State-owned Industrial Machinery and Equipment Corporation to becoming a science and technology operating enterprise directly under the Ministry of Industry and restructuring into a state-owned holding company, piloting the establishment according to the parent company - subsidiary model;

Pursuant to Decision No. 12/2004/QĐ-BCN dated February 24, 2004 of the Ministry of Industry approving the Charter of Organization and Operation of the Institute of Industrial Machinery and Equipment, a science and technology operating enterprise, piloting the establishment according to the parent company - subsidiary model;

Considering the proposal of the Director of the Institute of Industrial Machinery and Equipment (Letter No. 1196/CV-KHTH dated August 19, 2004);

At the suggestion of the Director of the Department of Organization and Cadres,

DECISION:

Article 1. Re-establishing the Industrial Machinery and Equipment Branch (hereinafter referred to as the Branch) as a research and technology transfer unit in the field of industrial machinery and equipment under the Institute of Industrial Machinery and Equipment.

International name: INDUSTRIAL MACHINERY AND INSTRUMENTS HOLDING BRANCH IN HOCHIMINH CITY;

Abbreviation: IMI HOLDING'S BRANCH.

The main office is located at No. 275 Hung Vuong Street, District 6, Ho Chi Minh City.

Article 2. The Branch is a scientific research and technology transfer unit, dependent accounting entity of the Institute of Industrial Machinery and Equipment, entitled to open accounts at banks and state treasuries, and has its own seal for operation and transactions in accordance with the regulations of the Director of the Institute of Industrial Machinery and Equipment and the provisions of the law.

Article 3. The Branch shall have the following main tasks:

1. Implementing research and deployment of science and technology in the field of industrial machinery and equipment within national, ministerial, and local projects.

2. Researching and applying scientific and technological advancements and transferring technology into production; designing, manufacturing, supplying, installing, and operating various types of industrial machinery, electronic equipment, automatic control systems, automation equipment, industrial electronics equipment, new production technology chains, and application software.

3. Consulting services for investment, import and export of specialized industrial materials and equipment in accordance with the law.

4. Implementing cooperation, joint ventures, associations, application, and transfer of technology in the fields of industrial machinery and equipment and environmental protection with organizations and individuals both domestically and internationally.

5. Participating in training and providing high-level human resources in the field of electromechanical engineering for agencies and enterprises in need.

6. Managing organizational structure, personnel, and assets assigned in accordance with the regulations of the Director.

7. Implementing other scientific, technological, and environmental tasks assigned by the Director.

Article 4. The organizational structure of the Branch includes:

1. Leadership:

a) Branch Director;

b) Deputy Branch Directors;

2. Specialized and operational departments.

3. Production and service departments.

The Branch is allocated certain material facilities, assets, and capital to carry out research and deployment of science and technology tasks in accordance with the regulations of the Institute of Industrial Machinery and Equipment; it is responsible for maintaining, preserving, and developing the assigned capital in accordance with the law.

The Director of the Institute of Industrial Machinery and Equipment appoints and dismisses the Branch Director and Deputy Branch Directors; promulgates the Regulations on Organization and Operation of the Branch and related regulations in accordance with the Charter of Organization and Operation of the Institute of Industrial Machinery and Equipment and current legal provisions.

Article 5. This Decision takes effect fifteen days after its publication in the Official Gazette and replaces Decision No. 64/1998/QĐ-BCN dated October 3, 1998 of the Minister of Industry regarding the conversion of the Science and Technology Exploitation and Application Center into the Industrial Machinery and Equipment Branch.

The Head of the Ministry's Office, the Inspector General of the Ministry, Department Heads, Bureau Chiefs under the Ministry, the Director of the Institute of Industrial Machinery and Equipment, and the Branch Director are responsible for implementing this Decision./.
