Based on the provisions of the amended and supplemented 2002 International Convention on Safety of Life at Sea accompanying the International Convention on Maritime Security and Port Security;

Based on Resolution No. 5 on promoting cooperation and technical assistance dated December 12, 2002 of the International Conference on Safety of Life at Sea;

Pursuant to the Ordinance on Fees and Charges dated August 28, 2001, and Decree No. 57/2002/ND-CP dated June 3, 2002, of the Government detailing the implementation of the Ordinance on Fees and Charges;

Pursuant to Decree No. 77/2003/NĐ-CP dated July 1, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

After receiving the opinion of the Ministry of Transport (in Circular No. 3643/GTVT-TC dated July 19, 2004);

At the request of the Director of the Tax Policy Department,

Where:

- Ships belonging to Type I group: including cargo ships with gross tonnage of 500 GT or more.

- Ships belonging to Type II group: including passenger ships, chemical tankers, oil tankers, liquefied gas carriers, mobile offshore drilling units.

2. The fee levels for approving maritime security plans and assessing, issuing certificates of maritime security systems stipulated in Clause 1 of this Decision already include value-added tax.

Article 2. Shipping companies with ships participating in international routes who request approval of maritime security plans, assessment, and issuance of certificates of maritime security in accordance with the International Convention on Maritime Security and Port Security and Decision No. 170/2004/QD-BGTVT dated January 16, 2004 of the Minister of Transport on the application of the amended and supplemented 2002 International Convention on Safety of Life at Sea (SOLAS 74) accompanying the International Convention on Maritime Security and Port Security must pay the fees for approving maritime security plans, assessing, and issuing certificates of maritime security systems according to the fee levels prescribed in Article 1 of this Decision.

Article 3. The Vietnam Register of Shipping, the entity assigned by the Ministry of Transport to approve maritime security plans and assess, issue certificates of maritime security, has the responsibility to organize the collection of fees for approving maritime security plans and assessing, issuing certificates of maritime security systems in accordance with this Decision.

Article 4. The revenue from collecting fees for approving maritime security plans and assessing, issuing certificates of maritime security systems is income from inspection activities, the Vietnam Register of Shipping is entitled to manage and utilize it in accordance with current laws on finance applicable to inspection activities.

Article 5. This Decision takes effect fifteen days from the date of publication in the Official Gazette.

Article 6. Organizations and individuals subject to payment of fees, agencies responsible for collecting fees for approving maritime security plans, assessing, and issuing certificates of maritime security, and related agencies are responsible for implementing this Decision.
