DECREE

Detailed provisions for certain articles of the Vocational Education Law

 

Based on Decree No. 63/2025/QH15 on Government Organization;

Based on Decree No. 124/2025/QH15 on Vocational Education;

In accordance with the proposal of the Minister of Education and Training;

The Government promulgates this Decree to provide detailed provisions for certain articles of the Vocational Education Law.

 

CHAPTER I

GENERAL PROVISIONS

 

Article 1. Scope of application

This Decree provides detailed provisions for certain articles of the Vocational Education Law, including:

1. Clause 5 of Article 7 on naming and renaming vocational education institutions, the organization under different names of secondary vocational schools.

2. Clause 4 of Article 15 on conditions, procedures, authority for establishment, licensing, cessation of enrollment, suspension of operations, and dissolution of branch offices of vocational education institutions.

3. Clause 5 of Article 24 on policies for rewarding and honoring vocational teachers who have made outstanding contributions to teaching, research, practical guidance, and integration of training with enterprises.

4. Clause 5 of Article 41 on conditions, procedures, authority, mechanisms for supervision and inspection related to cooperation and joint training activities with foreign countries.

Article 2. Applicability

1. This Decree applies to vocational education institutions and relevant agencies, organizations, and individuals involved in vocational education activities.

2. Provisions on cooperation and joint training with foreign countries do not apply to vocational education institutions of the People's Armed Forces.

CHAPTER II

NAMING AND RENAMING OF VOCATIONAL EDUCATION INSTITUTIONS

 

Article 3. Naming of vocational education institutions

1. Principles for naming

a) Reflecting the legal nature, authority to issue certificates, and level of training as prescribed by law;

b) Avoiding confusion regarding the model, scope of operations, supervisory body, quality of training, or status of the vocational education institution; not using names different from the main office in naming; not using terms or phrases indicating titles, rankings;

c) Not using words, phrases, or symbols that may cause confusion with the name of a state organ, military unit, political-social organization, or other educational institutions;

d) Not using terms, phrases, or symbols that violate the historical, cultural, moral, and traditional values of the nation;

e) Not using foreign language terms to determine the Vietnamese name of the vocational education institution except where such terms are associated with regional, international, or national names in an agreement between the Government of the Socialist Republic of Vietnam and a foreign government.

f) Not using the terms "general", "base" to determine the specific name of secondary vocational schools.

2. The Vietnamese name of the vocational education institution is determined by two parts in the following order:

a) Part determining the model of the vocational education institution, expressed as a phrase such as “Secondary Vocational School”, “Higher Secondary Vocational School”, or “Vocational High School”;

b) Part determining the specific name of secondary vocational schools, higher secondary vocational schools, which is composed of one or more phrases: phrases indicating the field or group of majors being trained; phrases indicating the local area associated with the location of the main office; phrases linked to regional, international, or national names in cases where established under an agreement between the Government of the Socialist Republic of Vietnam and a foreign government;

c) Part determining the specific name of secondary vocational schools is composed of one or more phrases as specified in paragraph 2, clause 1. In case a secondary vocational school only uses local area names associated with the location of its main office, it must use the word “vocational” immediately after the phrase “Secondary Vocational School”.

3. The foreign language or international trading name of the vocational education institution must be translated equivalently from the Vietnamese name and ensure consistency; use terms appropriate to international practice; not increasing the status or changing the nature compared to the Vietnamese name.

Internet domain names, trade names, abbreviated names used in transactions must be consistent with the Vietnamese name or foreign language name. In case using abbreviations, they must ensure that no confusion arises regarding other vocational education institutions within the country or foreign educational institutions.

The vocational education institution is responsible for registering and publicly disclosing its domain name to serve training activities, ensuring unified management and transparency.

4. When a vocational education institution establishes a branch office, the naming of the branch must comply with the provisions in paragraphs 1, 2, and 3 of this Article and the following provisions:

a) The name of a Vietnamese vocational education institution's branch includes the following elements: "branch"; the name of the vocational education institution and the local area where the branch is located. In cases where multiple branches are in the same administrative region, they should be named sequentially after the province or city name or the corresponding local administrative district;

b) The name of a foreign vocational education institution's branch includes the following elements: "branch"; the name of the foreign vocational education institution in Vietnamese and the local area where the branch is located;

c) A branch office of a vocational education institution may change its name when there is a change in the name of the vocational education institution or changes in administrative boundaries that directly affect the name of the branch. The renaming of the branch office of the vocational education institution shall be carried out in accordance with the provisions of Article 4 of this Decree.

Article 4. Changing the Name of Vocational Education Institution

1. Principles for Changing the Name

a) The name of the vocational education institution shall ensure stability, continuity, and long-term recognizability, not changing due to fluctuations in investors, ownership structure, or changes in shareholders;

b) The change of name must comply with the naming provisions stipulated in Article 3 of this Decree;

c) The change of name of the vocational education institution shall be considered only under the following circumstances: a change in legal form as decided by the competent authority; division, separation, or merger of the vocational education institution; the name violates the naming regulations or is determined to cause confusion.

2. The dossier for changing the name of the vocational education institution consists of one set, including: the request document from the superior administrative body for public vocational education institutions or the organization/person owning private vocational education institutions according to Form No. 04 in Appendix I attached to this Decree.

3. Procedures, procedures, and authority for changing the name of the vocational education institution

a) The entity, organization, or individual requesting the change of the name of the vocational education institution submits the dossier as per the provisions of paragraph 2 of this Article to the National E-Government Portal or through postal services or directly at the one-stop service counter of the competent authority specified in Paragraph 15 of Article 1 of the Decree Amending and Supplementing Certain Articles of the Education Law;

b) Within three working days from the date of receipt of the request to change the name of the vocational education institution, the competent authority as specified in Paragraph 15 of Article 1 of the Decree Amending and Supplementing Certain Articles of the Education Law decides on the name change, allowing the change of the name of the vocational education institution. In case it does not decide on the name change or allow the name change, a written response is provided with reasons stated;

c) The authority responsible for establishing and approving the establishment of the vocational education institution has the right to decide on the name change and approve the name change;

d) Within two working days from the issuance of the decision on the name change, the competent authority is responsible for publicizing and sending the decision on the name change, approval of the name change of the vocational education institution to relevant agencies and units for monitoring and management;

d) After changing the name, the vocational education institution shall be responsible for publicly displaying the official name, foreign language name or international trading name, or other names on its website; updating the name information in the national database of vocational education according to regulations and continue training groups of majors, trades already approved by the competent authority in the educational activity license.

 

Chapter III

CONDITIONS, PROCEDURES, AUTHORITY FOR ESTABLISHMENT, APPROVAL OF OPERATIONS, STOPPING ENROLLMENTS, DISSOLUTION OF VOCATIONAL EDUCATION INSTITUTIONS

 

Section 1

CONDITIONS, PROCEDURES, AUTHORITY FOR ESTABLISHMENT AND DISSOLUTION OF SUB-CAMPUS OF VOCATIONAL EDUCATION INSTITUTION

Article 5. Conditions for Establishing and Approving the Establishment of a Sub-campus of a Vocational Education Institution

 

A vocational education institution may establish a sub-campus when it meets the following conditions:

1. Has a construction site with physical infrastructure that ensures an area of use at least 25% of the minimum land use area required for the vocational education institution, ensuring compliance with land law, planning, construction laws and related laws.

2. Has capital or operational funds at least 25% of the minimum investment capital required to establish a vocational education institution.

2. Has a capital or operating fund of at least 25% of the minimum investment required to establish an vocational education institution.

Article 6. Establishment File and Approval of Branch of Vocational Education Institution

The establishment file and approval of branch of vocational education institution consist of one set, including:

1. A request document for establishing a branch submitted by the competent authority at the higher level to the public vocational education institution or the organization/person submitting it to the private vocational education institution, specifying details about the proposed branch, intended training programs and trades according to Form No. 01 in Appendix I attached to this Decree.

2. A proposal for establishing a branch of the vocational education institution, detailing the necessity, educational objectives, organizational structure, conditions ensuring operation, implementation plan, and socio-economic benefits according to Form No. 02 in Appendix I attached to this Decree.

3. An approval document from the People's Committee of the province or city where the proposed branch is to be located.

4. A copy of a lease contract for premises attached with land, valid for at least five years as of the date of submission, in case of leasing such premises and land.

5. A copy of an approval document from the competent authority on the investment project, investment decision, or documents approving, assigning investment plan, or finalizing financial settlement of the construction project of a public vocational education institution branch.

6. A confirmation document from the competent authority, organization, or entity regarding the financial capability to invest in establishing a private vocational education institution branch.

7. A copy of documents proving ownership rights over assets if contributed as capital, with an asset valuation report attached. Entities, organizations, and individuals are not required to submit copies of land use right certificates or certificates of immovable property ownership where such information can be accessed from the national land database.

Article 7. Authority for Establishing and Approving Branches of Vocational Education Institutions

1. The person authorized to establish or approve a vocational education institution according to paragraph 15, clause 1 of the Law on Amending and Supplementing Certain Articles of the Education Law has the authority to decide on the establishment or approval of branches of such institutions.

2. The person with authority to establish or approve branches of a vocational education institution also has the authority to decide on the dissolution of such branches.

Article 8. Procedures and Formalities for Establishing and Approving Branches of Vocational Education Institutions

1. The competent authority at the higher level for public vocational education institutions or the organization/person owning private vocational education institutions submit the establishment request through the National E-Government Service Portal, postal services, or directly to the one-stop service counter of the authority specified in Article 7 of this Decree.

2. Within five working days from receipt of the application, the person with authority as stipulated in Article 7 of this Decree shall review the file and decide on the establishment or approval of branches of vocational education institutions according to Form No. 03 in Appendix I attached to this Decree.

In case of refusal to establish or approve a branch, a written response with reasons will be provided.

3. The decision on establishing or approving branches of vocational education institutions shall be publicly disclosed on the website of the competent authority as specified in Article 7 of this Decree and sent to the higher-level management body of the vocational education institution and the People's Committee of the province or city where the branch is located for monitoring and management.

Article 9. Dissolution of Branch of Vocational Education Institution

1. The branch of a vocational education institution shall be dissolved upon the request of an organ, organization, or individual as provided in Clause 1 of Article 8 of this Decree.

2. The dissolution file of the branch of a vocational education institution consists of one set and includes:

a) A document requesting the dissolution of the branch from the organ, organization, or individual as provided in Clause 1 of Article 8 of this Decree, which specifies information about the branch to be dissolved; reasons for dissolution; and a dissolution plan according to Form No. 01 attached hereto;

b) A plan for the dissolution of the branch of a vocational education institution, which specifies information about the current status of the branch of the vocational education institution; dissolution plans; and implementation organization according to Form No. 02 attached hereto. 3. Procedures, authority, and approval for the dissolution or permission to dissolve the branch of a vocational education institution

a) The organ, organization, or individual requesting the dissolution of the branch of a vocational education institution shall submit the file in accordance with the provisions of Clause 2 of this Article through the National E-Government Portal, postal service, or directly at the one-stop service counter of the competent authority as provided in Article 7 of this Decree;

b) Within ten working days from the date of receipt of the file, the organ or organization specified in Article 7 of this Decree shall examine the file and decide on the dissolution of the branch of a vocational education institution according to Form No. 03 attached hereto. In case no decision is made to dissolve or permit dissolution, a written response with reasons shall be provided.

Decision on the dissolution or permission to dissolve the branch of a vocational education institution must specify the reasons for dissolution, measures to ensure the rights and interests of students, teachers, lecturers, management staff, employees, and workers; financial obligations; and a plan for handling the assets of the branch. The decision on dissolution or permission to dissolve shall be notified to relevant agencies for coordination in implementation and published publicly through mass media;

c) The decision on the dissolution of the branch of a vocational education institution shall be made public on the electronic information platform of the competent authority as provided in Article 7 of this Decree, and sent to the higher-level management body of the vocational education institution, the People's Committee of the province or city where the branch is located for monitoring and management.

Section 2

 

AUTHORIZATION FOR VOCATIONAL EDUCATION ACTIVITIES AT

Article 10. Conditions for Authorization of Vocational Education Activities at the Branch of a Vocational Education Institution

1. The branch of a vocational education institution may be authorized to conduct vocational education activities in groups of majors and trades when it meets the conditions as stipulated by the Government regarding investment and operations in the field of education.

2. A secondary vocational school or higher vocational college that has been authorized to conduct vocational education activities for a group of majors and trades at one level may admit students and organize training at a lower level within the same group of majors and trades as approved.

3. The organization of training in majors and trades belonging to groups of majors and trades already authorized for vocational education activities at the branch is decided by the Principal of the vocational education institution based on meeting the operational conditions as stipulated.

2. A branch of a secondary vocational school, higher secondary vocational school that has been granted permission to conduct vocational education for a group of trades or professions at one level may recruit students and organize training at a lower level than the level already permitted within the same group of trades or professions.

3. The organization of training in trades or professions belonging to a group of trades or professions that have been granted permission to conduct vocational education activities at the branch shall be decided by the principal of the vocational education institution based on meeting the operational conditions as prescribed.

Article 11. Application File for Operation Permit of Vocational Education at Branch of Vocational Education Institution

The application file for operation permit of vocational education is one set, including:

1. A document requesting the issuance of an operation permit for vocational education at the branch, specifying information on the field(s) and occupation(s), proposed scale, and training level to be permitted according to Model No. 01 in Appendix III attached hereto.

2. A report on conditions ensuring the operation of vocational education, detailing information on the vocational education institution, its branch, conditions for operating at the branch with supporting documents according to Model No. 02 in Appendix III attached hereto.

Article 12. Authority to Issue Operation Permit of Vocational Education at Branch of Vocational Education Institution

1. The Ministry of Education and Training shall issue an operation permit for vocational education at the branch of a higher vocational school.

2. People's Committee of the province or city shall issue an operation permit for vocational education at the branch of a secondary vocational school, upper-secondary vocational school within its jurisdiction.

Article 13. Procedure and Process for Issuing Operation Permit of Vocational Education at Branch of Vocational Education Institution

1. The vocational education institution shall submit one set of application file for operation permit of vocational education at the branch through the National E-Government Service Portal or postal service or directly to the single window department of the authority specified in Article 12 of this Decree.

2. Within seven working days from receipt of the application, the authority specified in Article 12 of this Decree shall examine the file and issue an operation permit for vocational education at the branch to the vocational education institution according to Model No. 03 in Appendix III attached hereto. In case of refusal, a written response with reasons shall be provided.

3. The authority specified in Article 12 of this Decree shall publicly disclose the decision on issuance of operation permit for vocational education at the branch of the vocational education institution on its official website and update data on issuance of operation permits according to regulations.

 

Section 3

STOPPING OPERATIONS AND ENROLLMENT AT

BRANCH OF VOCATIONAL EDUCATION INSTITUTION

Article 14. Suspension of Vocational Education Operations at Branch of Vocational Education Institution

The branch of the vocational education institution shall be suspended from operations in accordance with the provisions on administrative penalties for violations in the field of vocational education.

Article 15. Suspension of Enrollment at Branch of Vocational Education Institution

The branch of the vocational education institution shall suspend enrollment when ordered to cease operations by an authority with jurisdiction or under other circumstances as provided by law.

 

Chapter IV

POLICY OF HONORING AND VENERATING VOCATIONAL TEACHERS WHO HAVE MADE SIGNIFICANT CONTRIBUTIONS TO TEACHING, RESEARCH, PRACTICAL GUIDANCE, AND LINKING EDUCATION WITH BUSINESSES

 

Article 16. Significant Contributions of Vocational Teachers Honored and Venerated

1. Teaching, guiding, or preparing candidates for at least two students to achieve a bronze medal or higher in a national vocational skills competition or higher, or in cultural arts, sports competitions at the national level.

2. Teaching, guiding, or preparing candidates for at least one student to win an award or be recognized as having exceptional vocational skills in a regional or international vocational skills competition, or directing, choreographing, staging, or training at least one artistic or sports production that is performed, presented, or published according to regulations.

3. Participating in applied research, being the primary author of at least two scientific papers relevant to the field and occupation taught, which are published in a scientific journal with an international standard serial number (ISSN) or contributing to the development of at least three training programs or curricula that are incorporated into vocational education institutions.

4. Initiating and developing at least two cooperative training models between vocational education institutions and businesses that have been adopted by at least four other vocational education institutions, confirmed to enhance the quality of training or increase employment rates for graduates.

5. Transferring technology or production processes to a business that has confirmed their use in practice.

6. Teaching, guiding, or preparing candidates for at least fifty students to achieve national vocational skill certification level three or higher according to the National Vocational Skill Framework within one year.

Article 17. Commendation and Honoring of Vocational Trainers

Principles, forms, procedures, and approval processes for the commendation and honoring of vocational trainers shall be carried out in accordance with laws on competition and commendation.

 

Chapter V
COOPERATION AND LINKAGE WITH FOREIGN COUNTRIES IN VOCATIONAL EDUCATION
IN VOCATIONAL EDUCATION

 

Section 1

COOPERATION WITH FOREIGN COUNTRIES IN VOCATIONAL EDUCATION

Article 18. Principles for Implementing Cooperation with Foreign Countries

1. Ensuring compliance with the Constitution and laws of the Socialist Republic of Vietnam, the laws of the partner country, and international treaties to which the Socialist Republic of Vietnam is a party.

2. Being consistent with the functions and tasks of vocational education institutions; ensuring voluntariness, equality, respect for self-determination linked with accountability.

3. Ensuring quality in training, transparency in information, and lawful rights and interests of all relevant parties.

4. Not engaging in activities that harm the national interest, security, public order and safety, customs, ethics, or cultural identity of Vietnam.

Article 19. Parties to Cooperation, Content, and Forms of Cooperation with Foreign Countries

1. Parties to Cooperation

Vocational education institutions may cooperate with foreign organizations including: educational institutions, state agencies, research institutes, enterprises, social-vocational organizations, international organizations, and technology organizations.

2. Content of cooperation with foreign countries must be consistent with the functions and tasks of vocational education institutions, including:

a) Cooperation in implementing training activities, developing training programs;

b) Cooperation in applying scientific research, transferring technology, innovation for training purposes, enhancing skill development, improving human resource quality; cooperating in implementing creative or transferring creative products related to culture, arts, and sports in vocational education;

c) Cooperation in organizing practical training and internships;

d) Cooperation in implementing learning models in vocational education.

3. Cooperation with foreign countries shall be carried out through written cooperation agreements under the following forms: joint program, memorandum of understanding, or a cooperation agreement appropriate to the content and scope of cooperation as stipulated by law.

Article 20. Requirements for Implementing Cooperation with Foreign Countries

1. For foreign organizations participating in cooperation

Foreign organizations specified in paragraph 1 of Article 19 of this Decree must ensure:

a) Legally established according to the laws of their country;

b) Functions and scope of activities consistent with the content of cooperation, meeting operational conditions under relevant laws of their country; having valid legal establishment documents, permits, or other legal operation authorization documents;

c) Not belonging to cases where competent authorities of their country or Vietnam have notified suspension, dissolution, bankruptcy, or prohibition from participating in cooperative activities in the corresponding field.

2. For content specified at point a of paragraph 2 of Article 19 of this Decree

a) The parties to cooperation ensure updating new knowledge and applying advanced teaching methods consistent with training activities and program development of vocational education institutions. In cases where cooperation involves organizing training for foreign diplomas or certificates, it must be linked with foreign cooperation as stipulated in Section 2, Chapter V of this Decree;

b) The parties to cooperation issue completion certificates or learning results for students according to the content agreed upon in the cooperation agreement, ensuring compliance with relevant legal provisions.

3. For content specified at point b of paragraph 2 of Article 19 of this Decree

a) The parties to cooperation ensure that the content of cooperation is consistent with each party's capability;

b) The cooperation agreement must include contents on intellectual property rights, confidentiality, and exploitation and use of research results (if any). Technology transfer must comply with Vietnamese legal provisions.

4. For content specified at point c of paragraph 2 of Article 19 of this Decree

a) The parties to cooperation have detailed training plans according to the requirements of the training program issued in accordance with regulations; the cooperation agreement must clearly define learning objectives, time, and location for practical training; commitments regarding insurance, occupational safety, and cost support (if any);

b) Not exploiting practical training activities to send individuals abroad in violation of legal provisions. The parties to cooperation are responsible for managing and protecting the lawful rights and interests of students during their practical training abroad.

5. For content specified at point d of paragraph 2 of Article 19 of this Decree, implementing learning models must have a proposal approved by the Scientific and Training Council of the vocational education institution based on scientific grounds, practical requirements, and development orientation of the vocational education institution, ensuring no change in vocational education objectives.

6. Vocational education institutions are responsible for maintaining records related to cooperation activities with foreign countries and providing them upon request by competent authorities.

Article 21. Autonomy in Cooperation with Foreign Countries

1. Vocational education institutions may autonomously determine the content of cooperation with foreign organizations when meeting the requirements specified in Article 20 of this Decree and are responsible for explaining according to regulations.

2. Vocational education institutions shall be legally responsible for their decisions on cooperation, the results of implementation, training quality, use of resources, and other related matters as stipulated by current laws when engaging in foreign cooperation activities.

3. In cases where the content of cooperation involves specialized fields or professions, vocational education institutions shall comply with the provisions of this Decree and relevant sectoral laws.

4. Vocational education institutions are responsible for publicly disclosing information on foreign cooperation on their official websites within ten working days from the date of signing the cooperation agreement; they must also update such information in the vocational education specialized database according to Article 31 of this Decree or as required by competent authorities.

 

Section 2

LINKING TRAINING WITH FOREIGN COUNTRIES IN VOCATIONAL EDUCATION

Article 22. Linking Training with Foreign Countries for Establishing Departments, Centers, or Specialized Training Units at Vocational Education Institutions

1. Vocational education institutions may link up with foreign educational organizations, vocational education institutions, and enterprises to establish departments, centers, or specialized training units within Vietnamese vocational education institutions.

2. The content of linking training with foreign countries for establishing departments, centers, or specialized training units at vocational education institutions includes:

a) Implementing the linked training programs that have been approved by competent authorities in accordance with this Decree;

b) Conducting training and continuing education as stipulated in Clause 1 of Article 6 and Clause 2 of Article 7 of the Vocational Education Law;

c) Research, development, and transfer of training programs except those related to politics, security, defense, or religion;

d) Research, application of science, technology transfer in accordance with relevant laws.

e) Investment in physical infrastructure and equipment for training and practical work.

Article 23. Requirements for Implementing Linking Training with Foreign Countries to Establish Departments, Centers, or Specialized Training Units at Vocational Education Institutions

1. Vietnamese vocational education institutions must ensure the following requirements:

a) Safeguard national interests and not harm security, politics, defense;

b) Comply with regulations on establishing subordinate units of vocational education institutions under current laws;

c) Ensure compliance with financial management, asset management, intellectual property rights regulations as stipulated by law.

2. Foreign educational organizations, vocational education institutions, and enterprises must ensure the following requirements:

a) Have been recognized as legal entities by the competent authority of their home country and have been provided international linked training programs in Vietnam;

b) Hold valid quality assurance certificates issued by foreign accreditation bodies or have certification or recognition documents from competent authorities according to the regulations of their home country.

3. Before implementing the content of cooperation as specified in Clause 2, Paragraph 2, Article 22 of this Decree, vocational education institutions must register information with the specialized database for vocational education.

4. They shall comply with reporting requirements as stipulated in Article 31 of this Decree and be subject to government supervision and management according to Article 32 of this Decree.

Article 24. Joint Training with Foreign Countries for Degree and Certificate Programs

1. Joint training with foreign countries for degree and certificate programs is the cooperation in education between a vocational education institution established in Vietnam and a foreign educational organization, educational institution, or enterprise to implement a training program as specified in points (a), (b), (c) and (d) of Clause 2, Article 6 of the Vocational Education Law for the issuance of degrees and certificates.

2. Joint training with foreign countries shall not be conducted for professions and trades within the fields of politics, security, defense, or religion.

3. Joint training with foreign countries may be carried out according to the following training programs:

a) Foreign training program; issuance of foreign degrees and certificates;

b) Jointly developed training program; issuance of foreign degrees and certificates or joint issuance of foreign and Vietnamese degrees and certificates.

4. Joint training with foreign countries may be conducted entirely in Vietnam, partially in Vietnam and partially abroad as determined by the parties involved in the joint training.

5. Organizational forms of training

a) Direct training;

b) Distance education;

c) Blended training combining direct and distance education.

Article 25. Autonomous Decision on Joint Training with Foreign Countries

1. A vocational education institution may autonomously decide to conduct joint training with foreign countries for the training programs specified in point (d) of Clause 2, Article 6 of the Vocational Education Law and point (b) of Clause 3 of this Decree when it ensures the following conditions:

a) Ensuring the conditions for joint training with foreign countries as stipulated in Article 26 of this Decree;

b) Being recognized by an authorized agency or organization as meeting the standards for quality assessment of vocational education institutions;

c) For programs at the college and secondary vocational levels, those conducting joint training with foreign countries must be listed in the directory of professions and trades; the profession, trade, and location of training that autonomously decide on joint training with foreign countries must belong to a group or category of professions and trades, locations already approved by an authorized agency for vocational education activities;

d) Publicizing the conditions ensuring the operation of joint training with foreign countries, quality assessment results of vocational education, legal validity of degrees and certificates issued to students, other information on the institution's website before organizing recruitment for the joint training program;

d) Within a period of 24 months from the date of decision on autonomous joint training, the vocational education institution has not been subject to administrative penalties resulting in suspension of vocational education activities; has not had its enrollment or training suspended or organized; has not had its right to use the operation permit for vocational education revoked and is not in a situation where it is ordered to cease operations by an authorized agency or a court decision with legal effect.

2. A vocational education institution shall not autonomously decide on joint training with foreign countries under any of the following circumstances:

a) Training program specified in point (a) of Clause 3, Article 24 of this Decree;

b) Training program specified in point (b) of Clause 3, Article 24 of this Decree but not listed in the directory of professions and trades in vocational education;

c) Training program for a profession or trade belonging to an unapproved group or category of professions and trades by an authorized agency;

d) Training program in the field of teacher training, health care, or law.

3. Methods of implementing autonomous decision on joint training with foreign countries

a) A vocational education institution shall develop a Plan for Autonomous Joint Training according to the contents specified in Article 26 of this Decree;

b) The head of the vocational education institution shall issue a decision on autonomous joint training using the Model No. 01 attached as Appendix IV to this Decree;

c) Thirty days before organizing recruitment, the vocational education institution must register information with the specialized database for vocational education and report the implementation of autonomous joint training according to the Model No. 02 attached as Appendix IV to this Decree and the Plan for Autonomous Joint Training to the competent authority specified in Clause 1, Article 28 of this Decree for monitoring and management.

Article 26. Conditions for Joint Training with Foreign Countries

1. Fields of Study, Qualification Levels and Training Standards

Vocational education institutions shall implement joint training with foreign countries in accordance with the provisions of Clause 1, Article 24 of this Decree for fields of study belonging to sectors as specified by Vietnam and foreign countries.

2. Admission Objectives

a) Where foreign diplomas or certificates are issued, admission objectives shall be conducted in accordance with the laws of the issuing country;

b) Where both foreign and Vietnamese diplomas or certificates are issued, admission objectives shall be conducted in accordance with the laws of Vietnam and the laws of the issuing country.

3. Training Facilities and Equipment

a) Possess training facilities and equipment that meet the requirements of the training program; the laws of the country issuing the diploma or certificate, and corresponding to the scale of training;

b) Have classrooms; laboratories; workshops for practical and internship training; production test facilities that meet the requirements according to the training program.

The area of theory classrooms and practical workshops shall be in accordance with the provisions issued by the competent authority. Where no such provisions have been issued, it must comply with the provisions of the training program;

c) Where joint training is implemented partially in Vietnam and partially abroad, the training facilities and equipment during implementation abroad shall comply with the laws of the foreign country.

4. Training Programs, Textbooks, and Educational Materials

a) Have sufficient training programs, textbooks, learning materials, and teaching aids to meet the requirements of the joint training program;

b) The training program shall not contain content that is detrimental to national defense, national security, community interests; shall not promote religion or distort history; and shall not have a negative impact on Vietnamese culture, ethics, customs, and traditions.

5. Teaching Staff

a) Possess teaching staff who meet the standards in terms of professional knowledge and skills, sufficient in number, to meet the requirements of the training program and the laws of the country issuing the diploma or certificate;

b) Teaching staff conducting classes in foreign languages under the joint training program must have a language proficiency level that meets the requirements of the program as agreed by all parties. Foreign teaching staff who teach foreign languages at vocational education institutions must hold a bachelor's degree or higher and possess an appropriate teaching foreign language certificate;

c) Foreign teaching staff conducting joint training programs must meet the conditions specified in the laws on foreign labor working in Vietnam.

6. Language of Instruction and Learning

a) The language used for instruction and learning of specialized subjects under the joint training program to issue Vietnamese or foreign diplomas is Vietnamese, a foreign language, or through interpretation;

b) Based on the needs of students, all parties may organize language training and enhancement courses to help students achieve the required language proficiency to meet the admission requirements for the joint training program as specified by both parties.

7. Educational Institutions and Foreign Enterprises Implementing Joint Training Shall Comply with the Provisions of Clause 2, Article 23 of this Decree.

8. All parties shall determine the scale of training based on the conditions for facilities and equipment, training programs, and teaching staff as specified in Clauses 3, 4, and 5 of this Article.

9. Evaluation of Learning Outcomes, Examinations, Certification, and Issuance of Diplomas or Certificates.

The evaluation of learning outcomes, examinations, certification, completion of the training program, graduation recognition, and issuance of diplomas or certificates shall be conducted in accordance with the laws of the country where the training program is implemented as specified in Point a, Clause 3, Article 24 of this Decree; and in accordance with the laws of Vietnam and the laws of the country where the training program is implemented as specified in Point b, Clause 3, Article 24 of this Decree.

Article 27. Application File for Approval of Joint Training Activities with Foreign Countries in Vocational Education

The application file for approval of joint training activities with foreign countries in vocational education consists of one set, including:

1. A registration document for joint training activities with foreign countries, which reports on the conditions ensuring the organization of joint training activities with foreign countries according to Form No. 03 attached as Annex IV to this Decree.

2. An agreement or cooperation contract among the parties involved, specifying information about the parties, their responsibilities regarding the commitments related to the program, learning materials and teaching, teachers, facilities, training equipment, examinations, tests, evaluations, issuance of certificates, qualifications, financial information, and other matters.

3. Documentation proving the legal status of the parties: copies of decisions on establishment or approval of vocational education institutions in Vietnam, educational organizations, vocational schools, foreign enterprises, or equivalent documents.

4. A copy of the document from the competent authority of the host country authorizing the provision of international joint training programs in Vietnam;

5. A copy of an effective quality assessment certificate issued by a foreign accreditation body or a document recognizing educational quality issued by a competent authority according to the regulations of the host country.

Article 28. Authority, Procedure, and Process for Approving Joint Training Activities with Foreign Countries

1. Authority for approving joint training activities with foreign countries

a) People's Committee of the province or city where the joint training activities with foreign countries are conducted as specified in Paragraph 1, Article 15 of the Vocational Education Law grants approval for joint training activities with foreign countries for secondary vocational schools and technical schools;

b) Ministry of Education and Training grants approval for joint training activities with foreign countries for higher vocational colleges.

2. The vocational education institution submits the application file for approving joint training activities with foreign countries as specified in Article 27 of this Decree through the National E-Government Portal or postal services, or directly to the one-stop service window of the competent authority as specified in Paragraph 1 of this article.

3. Within ten working days from the date of receipt of the application file, the competent authority as specified in Paragraph 1 of this Article shall conduct a review of the application and decide on the approval for joint training activities with foreign countries according to Form No. 04 attached as Annex IV to this Decree.

For application files requesting approval for training programs in teacher education, health care, law, the competent authority approving vocational education activities must seek the opinion of the specialized management agency at the appropriate level before granting permission. In case of refusal, a written response and reasons shall be provided.

4. Publicizing and updating the professional database and issuing the approval for joint training activities with foreign countries

a) The competent authority approving joint training activities with foreign countries shall publicly disclose the decision on granting such approval on the agency's electronic information portal;

b) Within two working days from the date of being granted permission to conduct joint training activities with foreign countries, the vocational education institution that has been approved must update the professional database and publicize it on its electronic platform;

c) Within two working days from the date of granting approval for joint training activities with foreign countries for higher vocational colleges, the Ministry of Education and Training shall send the decision to the People's Committee of the province or city where the higher vocational college conducts such activities for monitoring and management;

d) Within two working days from the date of granting approval for joint training activities with foreign countries for secondary vocational schools and technical schools, the People's Committee of the province or city shall send the decision to the Ministry of Education and Training for monitoring and management.

5. In case there is a change in the scale or location of training by the vocational education institution compared to the approval decision, the vocational education institution shall:

a) Request supplementary approval according to Form No. 03 attached as Annex IV to this Decree and submit it to the competent authority approving joint training activities with foreign countries as specified in Paragraph 1 of this Article;

b) The competent authority approving joint training activities with foreign countries shall proceed in accordance with the provisions of Paragraph 3 of this Article.

Article 29. Suspension and Termination of Joint Training Activities with Foreign Countries

1. A vocational education institution shall have its joint training activities with foreign countries suspended in the following cases:

a) Failing to meet the requirements for ensuring joint training activities with foreign countries as stipulated in Clauses 1, 3, 4 and 5 of Article 26 of this Decree;

b) Engaging in fraudulent behavior to obtain permission for joint training activities with foreign countries but not reaching the level warranting criminal liability investigation;

c) Organizing recruitment or training without ensuring the conditions for self-governance in joint training activities with foreign countries;

d) Conducting joint training activities with foreign countries according to a decision granting such permission that was issued beyond the authority of the issuing body;

e) Other cases as provided by law.

2. A vocational education institution shall terminate its joint training activities with foreign countries in the following cases:

a) At the request of one of the joint training partners;

b) Failing to organize any training activities for more than 24 months from the date of obtaining permission for joint training activities with foreign countries;

c) One of the documents or papers in the application for permission to conduct joint training activities with foreign countries as provided by Article 27 of this Decree has been revoked, canceled, or no longer meets legal requirements that ensure the conditions for conducting such joint training activities;

d) Other cases as provided by law.

3. Authority to suspend and terminate joint training activities with foreign countries

The authority that issued permission for joint training activities with foreign countries has the authority to suspend or terminate such activities.

4. Procedure for suspending joint training activities with foreign countries

a) Conducting an inspection and evaluation of the extent of violation, determining the reasons for suspending joint training activities with foreign countries;

b) Based on the results of the inspection and evaluation of the extent of violation, the authority specified in Clause 3 of this Article shall examine and decide to suspend joint training activities with foreign countries.

The decision to suspend joint training activities with foreign countries shall be publicly announced on the website of the institution that has been suspended, the website of the authority that made the decision, and communicated to relevant agencies for coordination in implementation;

c) After the duration of suspension of joint training activities with foreign countries, if the cause leading to the suspension is remedied, the authority specified in Clause 3 of this Article shall decide to allow continued organization of joint training activities with foreign countries.

5. Documentation for terminating joint training activities with foreign countries

a) The documentation for terminating joint training activities with foreign countries as provided in Point a of Clause 2 of this Article consists of one copy, including:

A request to terminate joint training activities, specifying the reasons for requesting termination of such activities according to Form No. 09 attached hereto.

A report on terminating joint training activities according to Form No. 10 attached hereto, detailing the reasons, content of termination, measures to address the lawful rights and interests of students, teachers, managers, staff, and workers; settlement of tax debts and other outstanding payments (if any).

b) The documentation for terminating joint training activities with foreign countries as provided in Point b of Clause 2 of this Article consists of one copy, including:

A report on terminating joint training activities according to Form No. 10 attached hereto, detailing the reasons for not conducting any training activities; inspection record by the authority that issued permission for joint training activities with foreign countries;

c) The documentation for terminating joint training activities with foreign countries as provided in Point c of Clause 2 of this Article consists of one copy, including:

A report on terminating joint training activities according to Form No. 10 attached hereto, detailing the reasons due to revoked, canceled documents or papers that no longer meet legal requirements for ensuring conditions for conducting such joint training activities; inspection record by the authority that issued permission for joint training activities with foreign countries.

6. Procedure and process for terminating joint training activities with foreign countries

a) A vocational education institution shall submit the documentation as specified in Point a of Clause 5 of this Article through the National E-Government Portal, postal service, or directly to the authority specified in Paragraph 1 of Article 28 of this Decree;

b) Within ten working days from the date of receipt of the documentation, the authority specified in Paragraph 1 of Article 28 of this Decree shall examine and decide on terminating joint training activities with foreign countries. In case no decision is made, a written response specifying the reasons will be provided;

c) Within five working days from the date of issuance of the inspection record as specified in Points b and c of Clause 5 of this Article, the authority specified in Paragraph 1 of Article 28 of this Decree shall examine and decide on terminating joint training activities with foreign countries.

The decision to terminate joint training activities with foreign countries shall be publicly announced on the website of the vocational education institution, the website of the authority that made the decision, and communicated to relevant agencies for coordination in implementation.

7. Decision to suspend or terminate joint training activities with foreign countries as per Form No. 05 attached hereto.

Article 30. Revocation of Decision Granting Permission for Joint Training with Foreign Countries

1. An vocational education institution shall have its decision granting permission for joint training with foreign countries revoked if any of the following circumstances apply:

a) Violation of regulations on organizing joint training activities with foreign countries resulting in serious consequences;

b) Exceeding the period of suspension of joint training activities with foreign countries due to violation of the provisions at Clause 1, Article 29 of this Decree and failing to rectify the cause leading to such suspension;

c) Violation of regulations on vocational education resulting in administrative penalties that necessitate revocation;

d) Other circumstances as provided by law.

2. The authority granting permission for joint training activities with foreign countries as specified at Clause 1, Article 28 of this Decree has the authority to revoke such decisions.

3. Revocation of the decision granting permission for joint training activities with foreign countries shall be carried out as follows:

a) Organize an inspection and evaluation to determine the extent of violation and identify the reasons for revoking the decision;

b) Based on the results of the inspection and evaluation, the authority specified at Article 28 of this Decree shall examine and decide on the revocation of the decision granting permission for joint training activities with foreign countries.

Decision to revoke shall be publicly announced through mass media, the website of the revoked institution, and the website of the decision-making authority, and communicated to relevant agencies for coordination in implementation;

c) The vocational education institution must terminate all joint training activities with foreign countries and return the decision granting permission for such activities to the authority specified at Clause 2 of this Article within five working days from the date of receipt of the revocation decision.

 

Section 3

REPORTING AND INSPECTION, SUPERVISION REGIME IN JOINT TRAINING WITH FOREIGN COUNTRIES

Article 31. Reporting System

1. Entities required to report:

a) People's Committee of provinces and cities shall report on the implementation of joint training activities with foreign countries in vocational education within their jurisdictions;

b) Vocational education institutions engaged in joint training activities with foreign countries shall submit reports on such activities as per relevant provisions at this Article.

2. Content of the report:

a) General situation regarding implementation of joint training activities with foreign countries in vocational education; scale, form, and content of cooperation and joint training;

b) Implementation of rights and obligations by all parties involved in the cooperation and joint training;

c) Teacher and trainer teams participating, including specifying the number of teachers and trainers from foreign countries and implementation of regulations on managing foreigners;

d) Difficulties and obstacles encountered during implementation;

e) Suggestions and proposals (if any).

3. Entities sending and receiving reports:

a) People's Committee of provinces and cities shall send the report to the Ministry of Education and Training;

b) Vocational education institutions shall submit their reports to the People's Committee of provinces and cities.

4. Reporting periods, timeframes, and deadlines:

a) Regular annual reporting or ad hoc, thematic reports as required;

b) Data cutoff date for reporting: From December 1st of the previous year to November 30th of the reporting year;

c) Reporting deadline: Vocational education institutions shall submit their reports by December 15th each year; People's Committees of provinces and cities shall submit their reports by December 30th each year.

5. Report formats and submission methods:

a) Reports on the general situation of joint training activities with foreign countries as per paragraph (a) at Clause 1 of this Article are to be submitted using Form No. 06, Appendix IV attached to this Decree;

b) Reports on vocational education joint training activities as per paragraph (b) at Clause 1 of this Article shall be submitted using Forms Nos. 07 and 08, Appendix IV attached to this Decree;

c) Submission methods: Reports may be submitted directly, online, or through postal services.

Article 32. State Management Inspection and Supervision of Vocational Education Cooperation and Training Activities with Foreign Countries

1. The activities of vocational education institutions engaging in cooperation and training with foreign countries are subject to inspection and supervision by the competent state management agency as provided for by law; they also remain subject to monitoring by students and participation from relevant organizations or individuals as provided for by law.

2. Specialized inspections of cooperation and training activities with foreign countries shall be conducted in accordance with the provisions of Decree No. 217/2025/NĐ-CP dated August 5, 2025, issued by the Government on specialized inspection activities and related legal provisions.

3. Monitoring of cooperation and training activities with foreign countries shall be carried out through oversight and evaluation to ensure compliance with conditions and content approved by competent authorities, implementation of reporting systems, transparency in information disclosure, and handling of violations (if any) as provided for by law.

Article 33. Strengthening Capacity for Vocational Education Cooperation and Training Activities with Foreign Countries

1. Annually, the Ministry of Education and Training organizes training and capacity building on cooperation and training activities with foreign countries to enhance the capabilities of vocational education institutions and local vocational education management agencies.

2. The content of training and capacity building includes updating legal provisions related to cooperation and training activities with foreign countries; managing such cooperation, mitigating risks associated with implementing international training programs, and governance.

3. Vocational education institutions must regularly review, self-assess all cooperative and training agreements with foreign entities to prevent risks and improve the quality of cooperation and training.

4. Vocational education institutions are responsible before the law, students, and society for their cooperation and training activities; they shall establish and implement internal regulations to manage related activities.

 

Chapter VI

CONDITIONS FOR IMPLEMENTATION

Article 34. Effective Date of Implementation

1. This Decree takes effect from the date of issuance.

2. From the effective date of this Decree, the provisions on conditions, authority, and procedures for issuing certificates of registration for foreign training cooperation activities in Chapter IV of Decree No. 15/2019/NĐ-CP dated February 1, 2019, issued by the Government to implement certain articles and measures of the Vocational Education Law, which were amended and supplemented by Decree No. 24/2022/NĐ-CP dated April 6, 2022, amending and supplementing various decrees on conditions for investment and operation in the field of vocational education, shall cease to have effect.

3. The Minister, heads of agencies at the same level as ministries, heads of agencies under the Government, chairpersons of people's committees of provinces and cities, and relevant agencies are responsible for implementing this Decree.

Article 35. Transitional Provisions

1. Vocational education institutions, vocational training centers, dual-purpose vocational training and general education centers, enterprises that have been issued certificates of registration for foreign training cooperation activities before the effective date of this Decree may continue to conduct such activities according to the issued certificate. Within twelve months from the effective date of this Decree, these entities shall undertake the following responsibilities:

a) Review, adjust, and supplement conditions related to foreign training cooperation in accordance with provisions of the Vocational Education Law and this Decree;

b) Update information on foreign training cooperation into the vocational education specialized database as provided for by Article 20 of the Vocational Education Law.

2. Applications for administrative procedures concerning registration of foreign training cooperation activities submitted in compliance with regulations before the effective date of this Decree shall continue to be processed according to the provisions of Decree No. 15/2019/NĐ-CP dated February 1, 2019, issued by the Government to implement certain articles and measures of the Vocational Education Law (amended and supplemented by Decree No. 24/2022/NĐ-CP dated April 6, 2022, amending and supplementing various decrees on conditions for investment and operation in the field of vocational education) and according to the provisions set forth in paragraph 1 of this Article.

3. Applications for administrative procedures concerning name changes, establishment, approval of establishment, cessation of operations at branch offices submitted in compliance with regulations before the effective date of this Decree shall continue to be processed according to the provisions of Decree No. 143/2016/NĐ-CP dated October 14, 2016, issued by the Government on conditions for investment and operation in the field of vocational education (amended and supplemented by Decree No. 140/2018/NĐ-CP dated October 8, 2018, amending and supplementing various decrees related to business licensing and administrative procedures under the management scope of the Ministry of Labour, Invalids and Social Affairs; and Decree No. 24/2022/NĐ-CP dated April 6, 2022, amending and supplementing various decrees on conditions for investment and operation in the field of vocational education).

4. The issuance of permits for vocational education activities at branch offices of vocational education institutions shall continue to be conducted according to the provisions of Decree No. 143/2016/NĐ-CP dated October 14, 2016, issued by the Government on conditions for investment and operation in the field of vocational education (amended and supplemented by Decree No. 140/2018/NĐ-CP dated October 8, 2018, amending and supplementing various decrees related to business licensing and administrative procedures under the management scope of the Ministry of Labour, Invalids and Social Affairs; and Decree No. 24/2022/NĐ-CP dated April 6, 2022, amending and supplementing various decrees on conditions for investment and operation in the field of vocational education) until the Government issues a Decree on conditions for investment and operation in the field of education.

5. Conditions for the issuance of a vocational education branch registration certificate or supplementary registration certificate for branches as provided in Decree No. 143/2016/ND-CP dated October 14, 2016 by the Government on investment and operations in the field of vocational education (amended and supplemented by Decree No. 140/2018/ND-CP dated October 8, 2018 by the Government amending and supplementing Decrees related to investment and business conditions and administrative procedures under the management scope of the Ministry of Labour - Invalids and Social Affairs; Decree No. 24/2022/ND-CP dated April 6, 2022 by the Government amending and supplementing Decrees on investment and operations in the field of vocational education) shall continue to be implemented until the Government issues a decree on investment and operations in the field of education.

- Appointment decision or employment contract or labor contract for full-time teaching staff; contract for part-time teaching staff.

- Academic degree, professional qualification, and skill proficiency certificate.

The maximum student-to-teacher ratio is 25 students per teacher.
