APPROVING THE DECISION OF THE PROSECUTOR GENERAL ON THE ORGANIZATIONAL STRUCTURE OF THE SUPREME PEOPLE'S PROSECUTORATE

THE STANDING COMMITTEE OF THE NATIONAL ASSEMBLY

On the basis of the Constitution of the Socialist Republic of Vietnam;

On the basis of the Law on the Organization of the People's Prosecutor Office No. 63/2014/QH13;

Pursuant to Resolution No. 82/2014/QH13 dated November 24, 2014 of the National Assembly on the implementation of the Law on the Organization of the People's Procuracy;

Considering the proposal of the Prosecutor General of the Supreme People's Procuracy,

RESOLUTION:

Article 1.

Approving the proposal of the Prosecutor General on the organizational structure of the Supreme People's Prosecutorate, specifically including the following units:

1. The Inspection Committee of the Supreme People's Prosecutorate.

2. The Office of the Supreme People's Prosecutorate.

3. The Department for Prosecution and Supervision of Criminal Investigations in Security Cases.

4. The Department for Prosecution and Supervision of Criminal Investigations in Social Order Cases.

5. The Department for Prosecution and Supervision of Criminal Investigations in Economic Cases.

6. The Department for Prosecution and Supervision of Criminal Investigations in Drug Cases.

7. The Department for Prosecution and Supervision of Criminal Investigations in Corruption and Official Misconduct Cases.

8. The Department for Prosecution and Supervision of Criminal Investigations in Crimes Against Judicial Activities, Corruption, and Official Misconduct Occurring in Judicial Activities.

9. The Investigation Agency of the Supreme People's Prosecutorate.

10. The Department for Prosecution and Supervision of Criminal Trials.

11. The Department for Supervision of Pre-Trial Detention, Execution of Criminal Sentences.

12. The Department for Supervision of Civil Dispute Resolution, Marriage and Family Cases.

Article 2

1. The number of Deputy Procurators of the Supreme People's Prosecutorate shall not exceed five persons.

In special cases due to the requirements of personnel transfer by authorized agencies, the Prosecutor General of the Supreme People's Prosecutorate shall submit to the Standing Committee of the National Assembly for a decision on increasing the number of Deputy Procurators of the Supreme People's Prosecutorate.

2. The number of deputy heads of each unit at the level of Bureau, Department, and equivalent within the organizational structure of the Supreme People's Prosecutorate shall not exceed three persons.

3. For units that organize Divisions and equivalent, the number of Deputy Division Heads and equivalent shall not exceed two persons.

Article 3

1. The Prosecutor General of the Supreme People's Prosecutorate shall stipulate the organizational structure, tasks, powers, and working relationships of the units within the organizational structure of the Supreme People's Prosecutorate.

2. Based on the total establishment, quantity, and ratio structure of the ranks of Prosecutors decided by the Standing Committee of the National Assembly, the Prosecutor General of the Supreme People's Prosecutorate shall decide the establishment, number of Prosecutors, other civil servants, staff members, and other workers of the units within the organizational structure of the Supreme People's Prosecutorate.

Article 4

1. This Resolution takes effect from June 1, 2015.

2. The Government and the Prosecutor General of the Supreme People's Prosecutorate shall be responsible for implementing this Resolution within their respective functions and powers./.
