RESOLUTION
ESTABLISHING THE PEOPLE'S PROSECUTION HIGH INSTITUTE
THE STANDING COMMITTEE OF THE NATIONAL ASSEMBLY
On the basis of the Constitution of the Socialist Republic of Vietnam;
On the basis of the Law on the Organization of the People's Prosecutor Office No. 63/2014/QH13;
Pursuant to Resolution No. 82/2014/QH13 dated November 24, 2014 of the National Assembly on the implementation of the Law on the Organization of the People's Procuracy;
Considering the proposal of the Prosecutor General of the Supreme People's Procuracy,
RESOLUTION:
Article 1.
1. Establish three People's High Prosecution Institutes:
a) The People's High Prosecution Institute in Hanoi;
b) The People's High Prosecution Institute in Da Nang;
c) The People's High Prosecution Institute in Ho Chi Minh City.
2. Each People's High Prosecution Institute shall have a Prosecutor General and Deputy Prosecutor Generals. The number of Deputy Prosecutor Generals of each People's High Prosecution Institute shall not exceed four persons.
3. The organizational structure of each People's High Prosecution Institute includes the Supervisory Committee, Office, Institutes, and equivalents. The Office, Institutes, and equivalents may have Departments and equivalents.
a) The number of deputy positions in the Office, Institutes, and equivalents shall not exceed three persons;
b) The number of deputy positions in each department and equivalent shall not exceed two persons;
c) The Prosecutor General of the Supreme People's Prosecution Institute shall specify in detail the organizational structure, duties, powers, and working relationships of units within the organizational structure of each People's High Prosecution Institute.
Article 2.
1. The People's High Prosecution Institute in Hanoi shall exercise public prosecution rights and supervise judicial activities for cases and matters under the jurisdiction of the High People's Court in Hanoi.
2. The People's High Prosecution Institute in Da Nang shall exercise public prosecution rights and supervise judicial activities for cases and matters under the jurisdiction of the High People's Court in Da Nang.
3. The People's High Prosecution Institute in Ho Chi Minh City shall exercise public prosecution rights and supervise judicial activities for cases and matters under the jurisdiction of the High People's Court in Ho Chi Minh City.
Article 3.
Based on the total establishment quota, the number, and the ratio structure of the ranks of Prosecutors of the People's Prosecution Institutes already decided by the Standing Committee of the National Assembly, the Prosecutor General of the Supreme People's Prosecution Institute shall decide the establishment quota, the number of Prosecutors, Inspectors, other civil servants, and other workers of each People's High Prosecution Institute.
Article 4.
1. This Resolution takes effect from June 1, 2015.
2. The Government and the Prosecutor General of the Supreme People's Prosecution Institute shall be responsible for implementing this Resolution within their respective functions and powers./.
