THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT

Pursuant to Decree No. 86/2003/NĐ-CP dated July 18, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to Article 19 of Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

These regulations are hereby promulgated along with this Decision "Regulations on the Transfer, Rotation, and Temporary Assignment of Officials and Civil Servants of the Government Inspectorate."

DECISION:

Article 1. Position and Functions

The Cooperative and Rural Development Department is a subordinate agency under the Ministry of Agriculture and Rural Development, performing the function of specialized state management in cooperatives and agricultural production organization forms; synthesizing rural development policies and programs nationwide.

The Cooperative and Rural Development Department has legal personality, its own seal, operational funds, and is entitled to open accounts in accordance with the law.

The headquarters of the Cooperative and Rural Development Department is located in Hanoi City.

Article 2. Tasks and Powers

The Cooperative and Rural Development Department is assigned by the Minister to carry out the task of specialized state management over economic cooperation and agricultural cooperatives, household economy, farm economy, adjustment of population resettlement in agriculture and rural areas, synthesis of rural development policies and programs nationwide within the scope of the Ministry's management, specifically as follows:

1. Submitting to the Minister draft laws, draft ordinances, and draft regulatory legal documents within the specialized management scope of the Department.

2. Submitting to the Minister strategies, plans, policies, five-year and annual plans, programs, projects, and proposals on cooperatives and rural development within the specialized management scope of the Department according to the Minister’s assignment.

3. Issuing documents on management procedures; guiding on professional and technical matters within the specialized field according to the Minister’s classification.

4. Directing, guiding, inspecting, and being responsible for implementing regulatory legal documents; planning and programs; projects, standards, procedures, norms, and economic-technical quotas within the specialized field that have been approved, and disseminating, popularizing, and educating about laws within the specialized management field of the Department.

5. Regarding specialized management:

a) Building mechanisms and policies for developing agricultural and rural economic organizations and submitting them to the Minister:

- Leading the construction of mechanisms, policies, and laws for developing agricultural and rural economies;

- State management over household economy, farm economy, and cooperative economy in agriculture and rural areas;

- Uniformly managing policies for developing various types of cooperatives in rural areas; small and medium-sized agricultural enterprises; state-owned farms and forestry farms.

- Participating in managing policies, planning, and development plans for rural industries;

- Developing market development policies and product consumption; participating in forecasting markets for agricultural and forestry products; organizing and participating in fairs and exhibitions within the Department's management scope.

b) Regarding rural infrastructure development and urbanization:

- Participating in reviewing plans, projects, and proposals supporting investment in rural infrastructure;

- Uniformly managing support for investment in rural infrastructure (healthcare, transportation, electricity, schools);

- Participating in building plans and managing water resource exploitation and utilization in rural areas;

c) Uniformly managing community building and development work in agriculture and rural areas:

- Guiding and directing the implementation of planning and programs for resettlement, labor adjustment in agriculture and rural areas;

- Reviewing or participating in reviewing investment projects of sectors and localities regarding population resettlement planning.

d) Uniformly managing training and capacity enhancement for cooperative managers, farm managers; vocational training for farmers; enhancing the capabilities of forest and farm managers.

đ) Uniformly managing the reform and development of state-owned farms and forestry farms:

- Researching and summarizing the reorganization, reform, and development of state-owned farms and forestry farms;

- Participating in the reorganization, reform, and development of state-owned farms and forestry farms according to the Minister’s assignment;

e) Participating in managing agricultural extension, forestry extension, rice cultivation extension, and rural industries.

g) Building, directing, and implementing models within the specialized management scope of the Department.

6. Regarding science and technology:

a) Building programs, plans, and research topics on rural socio-economic development and managing and implementing scientific research results within the specialized management scope of the Department;

b) Organizing the collection and management of scientific and technological information within the Department's management scope.

7. Building international cooperation programs on cooperatives and rural development; participating in negotiations to sign and join international treaties and international organizations on cooperatives and rural development; implementing international treaties and international cooperation projects according to the Minister’s assignment.

8. Managing certain public service units and public services under the Ministry related to cooperatives and rural development according to the Minister’s assignment.

9. Participating in managing the activities of associations and non-governmental organizations in the fields of cooperatives and rural development according to the Minister’s assignment.

10. Inspecting, supervising, resolving complaints and denunciations; combating corruption and negative practices; handling violations within the Department's management scope according to authority.

11. Building and implementing the Department’s administrative reform program according to the Ministry’s goals and content.

12. Managing the organization, staffing, and establishment of the Department according to regulations; implementing salary systems and incentive policies, rewards, and disciplinary measures for civil servants and employees within the Department's management scope.

13. Managing finances, assets, and other resources allocated; organizing the implementation of the budget according to regulations.

14. Leading, guiding, and directing the implementation of projects according to the Minister’s assignment regarding the implementation of national target programs and key programs within the Department's specialized management scope.

15. Performing other tasks assigned by the Minister.

Article 3. Organizational Structure

1. Leadership of the Bureau:

The Bureau leadership consists of the Director and Deputy Directors appointed by the Minister of Agriculture and Rural Development in accordance with regulations.

The Director manages the activities of the Department, is responsible to the Minister of Agriculture and Rural Development and to the law for the activities of the Department and assigned tasks.

Deputy Directors assist the Director, are responsible to the Director and to the law for the implementation of assigned tasks. The number of Deputy Directors shall not exceed three; if exceeded, it must be reported to the Minister.

2. Management Structure of the Bureau:

Administrative-Integration Department (organization);

b) Planning-Finance Department (science, cooperation, international);

c) Cooperative, household economy and farm department;

Enterprise and Forestry-Rural Farm Department;

New Rural Development Department;

Planning and Population Adjustment Department;

h) Permanent office in Ho Chi Minh City.

3. Units subordinate to the Department:

These units are established and operate according to the decision of the Minister.

The Director of the Department of Cooperatives and Rural Development stipulates the functions and tasks of the departments and sections; establishes the Department's operational regulations to be submitted to the Minister for approval and implements them.

Article 4. Effectiveness

This Decision takes effect fifteen days from the date of publication in the Official Gazette; it abolishes previous documents issued by the Ministry that conflict with this Decision.

Article 5. Responsibility for Implementation

1. The Director of the Resettlement and New Economic Zone Department, the Head of the Agricultural Policy Department are responsible for transferring the Resettlement and New Economic Zone Department and the Agricultural Policy Department intact to the Director of the Department of Cooperatives and Rural Development.

2. The Director of the Department of Cooperatives and Rural Development, the Secretary of the Office, the Heads of Departments, the Directors of other Departments, the Inspector General, the Chairpersons of People's Committees of provinces and centrally governed cities, the Directors of Provincial Departments of Agriculture and Rural Development, and the Heads of relevant agencies and units under the Ministry are responsible for implementing this Decision./.
