CIRCULAR

Regulations on organizing propaganda, dissemination, education, training, and capacity building for laws related to self-defense militia.

MINISTER OF NATIONAL DEFENSE

Based on the Law on Self-Defense Militia dated November 23, 2009;

Based on Decree No. 58/2010/NĐ-CP dated June 1, 2010 of the Government detailing and guiding the implementation of certain provisions of the Law on Self-Defense Militia;

Based on Decision No. 289/QĐ-TTg dated February 26, 2010 of the Prime Minister approving the plan to implement the Law on Self-Defense Militia;

Pursuant to Decree No. 104/2008/NĐ-CP dated September 16, 2008 of the Government on the Functions, Tasks, Authorities, and Organizational Structure of the Ministry of National Defense;

The Ministry of National Defense stipulates the organization of propaganda, dissemination, education, training, and capacity building for laws related to self-defense militia as follows:

Article 1. Scope of Regulation

This Circular specifies the principles, contents, tasks, and coordination in activities related to organizing propaganda, dissemination, education, training, and capacity building for laws related to self-defense militia; the tasks of agencies and units of the People's Army, Military Command Departments under Ministries, agencies at the level of ministries, central Party Committees, Office of the National Assembly, Office of the President, State Audit Agency, Supreme People's Procuracy, Supreme People's Court, central agencies of political-social organizations, economic groups, and corporations established by the Prime Minister's decision (hereinafter referred to collectively as Military Command Departments of Central Ministries and Agencies), Military Command Departments of state agencies, political organizations, political-social organizations, public institutions, and economic organizations (hereinafter referred to collectively as Military Command Departments of Local Agencies and Organizations); Military Command Departments of communes, wards, and towns (hereinafter referred to collectively as Military Command Departments of Communes) shall carry out propaganda, dissemination, education, training, and capacity building for laws related to self-defense militia.

Article 2. Applicability

1. Cadres, party members, civil servants, and officials belonging to state agencies from central to local levels.

Managers of enterprises, workers in foreign enterprises legally operating long-term in Vietnam related to the organization and operation of self-defense militia.

2. Cadres of Military Command Departments of Central Ministries and Agencies, Military Command Departments of Local Agencies and Organizations, Military Command Departments of Communes; relevant agencies and units under the Ministry of National Defense related to the organization and operation of self-defense militia forces.

3. Citizens nationwide, teachers, students, and university, college, vocational college, specialized secondary, vocational secondary, and high school students.

Article 3. Principles of Propaganda, Dissemination, Education, Training, and Capacity Building for Laws Related to Self-Defense Militia

1. Propaganda, dissemination, education, training, and capacity building for laws related to self-defense militia shall be under the leadership and guidance of the Party committees, authorities, and heads of agencies and organizations; military departments at all levels shall coordinate with judicial organs, propaganda departments at the same level to provide advisory services, radio, television, and press organs shall serve as the core, mobilizing the strength of the entire political system in the work of propaganda, dissemination, education, training, and capacity building for laws related to self-defense militia.

2. Organized tightly, with plans, ensuring unity and effectiveness.

3. To thoroughly disseminate and popularize the viewpoints, policies, and guidelines of the Party and the state's policies and laws on building a people's national defense and self-defense militia forces according to the law on self-defense militia.

4. To be carried out regularly, comprehensively, with focus; constantly innovating in form and method, suitable for each target group, economic, political, and cultural conditions of each region, locality, and local customs and traditions.

5. To combine and integrate propaganda, dissemination, education, training, and capacity building for laws related to self-defense militia with other legal education programs; to highlight exemplary models, commend good individuals and deeds, promptly rectify and handle organizations and individuals who fail to strictly comply with laws related to self-defense militia.

6. To closely integrate propaganda, dissemination, education, training, and capacity building for laws with the enforcement of laws related to self-defense militia.

Article 4. Content of propaganda, dissemination, education, training, and capacity building on the law regarding civilian self-defense militia

1. Propaganda and disseminate legal provisions on the civilian self-defense militia; citizens' rights and obligations to fulfill their duty to participate in the civilian self-defense militia during peacetime; institutional regulations on organization, training, activities, and policies for the civilian self-defense militia force; the State management responsibility of the Government, Ministries, sectors, and local authorities at all levels.

2. Study and compile materials serving propaganda, dissemination, education, training, and capacity building on the law regarding the civilian self-defense militia suitable for different target groups.

3. Train and instruct officers of the Military Command Board of Ministries and Central Sectors, Military Command Boards of agencies and organizations at the grassroots level, Military Command Boards of communes, village militia leaders, hamlet militia leaders, village militia leaders, phum militia leaders, sóc militia leaders, khóm militia leaders, neighborhood militia team leaders, and relevant officers from agencies under the Ministry of National Defense, heads of People's Committees at all levels, legal propagandists, and legal educators on the civilian self-defense militia, and implementation measures.

4. Widely propagate among the people the basic contents of the law on the civilian self-defense militia through mass media, linking with traditional festival activities and community life in each locality.

Article 5. Tasks of Ministries, Sectors, Localities, Mechanism, and Content of Coordination in Activities of Propaganda, Dissemination, Education, Training, and Capacity Building on the Law Regarding the Civilian Self-Defense Militia

1. The tasks of Ministries, Sectors, and Provincial People's Committees (hereinafter referred to as provincial level) shall be implemented according to the provisions at point a and b clause 2 Section A Part II Implementation Plan for the Enforcement of the Law on the Civilian Self-Defense Militia (annexed to Decision No. 289/QD-TTg dated February 26, 2010 of the Prime Minister approving the Implementation Plan for the Enforcement of the Law on the Civilian Self-Defense Militia).

2. The mechanism and content of coordination in activities of propaganda, dissemination, education, training, and capacity building on the law regarding the civilian self-defense militia shall be carried out as follows:

a) The Ministry of National Defense is the leading agency assisting the Prime Minister in directing and organizing the implementation of propaganda, dissemination, education, training, and capacity building on the law regarding the civilian self-defense militia as stipulated in Decision No. 289/QD-TTg dated February 26, 2010 of the Prime Minister approving the Implementation Plan for the Enforcement of the Law on the Civilian Self-Defense Militia, implementing the following contents:

- Leading and coordinating with related Ministries and Sectors to develop and implement plans for organizing propaganda, dissemination, education, training, and capacity building on the law regarding the civilian self-defense militia;

- Leading and coordinating with the Ministry of Justice, the Ministry of Information and Communications, and the Ministry of Education and Training to compile a system of materials and textbooks for dissemination, education, training, and capacity building; organizing nationwide contests to understand the law on the civilian self-defense militia;

- Assisting the Prime Minister in guiding, urging, inspecting, summarizing, and evaluating the results of implementing projects and contents, tasks of propaganda, dissemination, education, training, and capacity building on the law regarding the civilian self-defense militia;

b) Requesting the Ministry of Justice to direct judicial agencies at all levels to advise the Council for Coordinating Propaganda, Dissemination, and Legal Education at the same level to organize the integration and combination of the content and methods of organizing the dissemination and education of the law on the civilian self-defense militia with other legal education programs; coordinating with the Ministry of National Defense to develop the content of propaganda, dissemination, education, training, and capacity building, and organizing nationwide contests to understand the law on the civilian self-defense militia;

c) Requesting the Ministry of Information and Communications to lead and coordinate with the Ministry of National Defense to direct news agencies and press to allocate time for news, columns, and special pages on the contents of propaganda, dissemination, and education of the law on the civilian self-defense militia; directing the organization of training knowledge on legal propaganda on the civilian self-defense militia for journalists and editors of news agencies and press;

d) Requesting Vietnam Television, Voice of Vietnam Radio, and Vietnam News Agency to develop plans to implement coordinated contents with the Ministry of National Defense to promote propaganda and dissemination of the legal system on the civilian self-defense militia, the position, role, functions, and tasks of the civilian self-defense militia in the cause of building and defending the Socialist Republic of Vietnam;

đ) Requesting other central Ministries and Sectors related to take the initiative in developing plans, programs, contents, and organizing propaganda, training, and dissemination of the law on the civilian self-defense militia according to the division of authority;

e) Provincial People's Committees cooperate with the Ministry of National Defense and Military Region Command to build commune-level models for the dissemination of the law on the civilian self-defense militia as a basis for drawing lessons and expanding widely; directing the Provincial Military Command and the Military Command of Hanoi Capital to cooperate with functional agencies to assist the People's Committee at the same level in developing plans, programs, contents, and organizing propaganda, training, and dissemination of the law on the civilian self-defense militia according to the division of authority; directing local radio and television agencies to focus on innovating the content and form of propaganda, increasing broadcasting time on local mass media to disseminate and educate the law on the civilian self-defense militia.

Article 6. Tasks of agencies and units of the Vietnam People's Army

1. The General Staff Department:

Shall take the lead and coordinate with the Political General Department to advise the Ministry of National Defense on directing and organizing the implementation of dissemination, education, training, and popularization of laws related to self-defense forces; coordinate and cooperate with the Central Propaganda Department, the Ministry of Justice, the Ministry of Interior, the Ministry of Information and Communications, Vietnam Television, Voice of Vietnam, news agencies, press organizations, relevant agencies inside and outside the military, provincial People's Committees to direct, guide, and organize the implementation of propaganda, dissemination, education, training, and popularization of laws related to self-defense forces.

a) The Self-Defense Forces Department shall be the permanent agency assisting the General Staff Department and the Ministry of National Defense in drafting plans for organizing propaganda, dissemination, education, training, and popularization of laws related to self-defense forces to submit to the Prime Minister for approval; organizing the implementation of tasks related to propaganda, dissemination, education, training, and popularization of laws related to self-defense forces:

- Shall take the lead and coordinate with the Training Department of the Political General Department and other relevant agencies in drafting plans for implementing the organization of propaganda, dissemination, education, training, and popularization of laws related to self-defense forces;

- Shall take the lead and coordinate with relevant agencies to assist the General Staff Department and the Ministry of National Defense in drafting plans, contents, programs, and organizing nationwide training on laws related to self-defense forces; guiding military regions, military corps, military units, localities, central ministries and sectors to organize training on laws related to self-defense forces within their respective jurisdictions.

- Shall take the lead and coordinate with relevant agencies to assist the General Staff Department and the Ministry of National Defense in directing and guiding military regions and localities to implement pilot models for propaganda, dissemination, and education on laws related to self-defense forces;

- Shall take the lead and coordinate with relevant agencies to assist the General Staff Department and the Ministry of National Defense in organizing exams to test knowledge of laws related to self-defense forces for the Heads of Military District Commanders at the commune level, Military District Commanders at the district level, Provincial Military Commanders, and the Commander of the Hanoi Capital Military Command;

- Shall take the lead and coordinate with relevant functional agencies in compiling, printing, and distributing materials to ensure the work of propaganda, dissemination, education, training, and popularization of laws related to self-defense forces;

- Shall take the lead and coordinate with the Financial Department of the Ministry of National Defense to prepare budgets to ensure funding for tasks related to propaganda, dissemination, education, training, and popularization of laws related to self-defense forces and exams to test knowledge of these laws for Provincial Military Commanders, District Military Commanders, and Commune Military Commanders, and submit them for approval by competent authorities.

- Shall coordinate with the Military Cinema to produce documentary films about the history, traditions, organization, training, and activities of self-defense forces;

- Shall coordinate with the Training Department of the Political General Department, the People's Army Newspaper, the People's Army Television, the People's Army Radio, and other central and local media outlets to open special pages, columns, and broadcasting time for propaganda and dissemination of laws related to self-defense forces;

- Shall coordinate with relevant agencies within the military to urge inspections, participate in audits, and compile results of the implementation of tasks related to propaganda, dissemination, education, training, and popularization of laws related to self-defense forces.

b) The Education Department:

- Shall take the lead and coordinate with the Self-Defense Forces Department to guide academies and schools under the Ministry of National Defense in collaborating to compile materials and textbooks on laws related to self-defense forces to be included in the curriculum suitable for different training targets.

- Shall coordinate with the Self-Defense Forces Department to direct the implementation of plans for organizing propaganda, dissemination, education, training, and popularization of laws related to self-defense forces in academies and schools within the military, and train teaching staff and speakers on the content of propaganda, dissemination, education, training, and popularization of laws related to self-defense forces.

2. The Political General Department:

a) Shall take the lead and coordinate with the General Staff Department to assist the Ministry of National Defense in directing news agencies, press organizations, and publishers within the military, and relevant agencies responsible for Party work and political work to draft plans for propaganda, dissemination, education, training, and popularization of laws related to self-defense forces for targets managed by the Ministry of National Defense.

b) Shall coordinate with the General Staff Department to cooperate with the Central Propaganda Department, the Ministry of Justice, the Ministry of Interior, the Ministry of Information and Communications, Vietnam Television, Voice of Vietnam, central news agencies, press organizations, and provincial People's Committees to assist the Ministry of National Defense in directing, organizing, and implementing propaganda, dissemination, education, training, and popularization of laws related to self-defense forces.

c) Shall direct the Training Department:

- Shall take the lead and coordinate with relevant agencies under the Ministry of National Defense to direct agencies and units to implement political and ideological education, enhance awareness of responsibility among officers and soldiers in the military and self-defense forces, and reserve forces regarding propaganda, dissemination, education, training, and popularization of laws related to self-defense forces;

- Shall take the lead and coordinate with the Self-Defense Forces Department to develop content and programs for propaganda and dissemination of laws related to self-defense forces in the People's Army Television and People's Army Radio programs;

- Shall coordinate with the Self-Defense Forces Department to participate in developing and implementing plans for organizing propaganda, dissemination, education, training, and popularization of laws related to self-defense forces;

- Shall coordinate with relevant agencies to assist the Political General Department and the Ministry of National Defense in guiding localities to implement pilot models for propaganda, dissemination, and education on laws related to self-defense forces;

- Shall coordinate with the Ministry of National Defense Office, the Self-Defense Forces Department, the People's Army Newspaper, and relevant agencies to organize exams to test knowledge for cadres and competitions to understand laws related to self-defense forces across the country.

3. The Science and Technology Information Center of the Ministry of National Defense:

a) Coordinate with the Department of Militia Self-Defense, the Military Cinema, the Department of Propaganda and Training of the Political General Department, and other relevant agencies to participate in making documentary films about the history and traditions of the militia self-defense force;

b) Open a column on the Misten network regarding the activities of the militia self-defense force, aiming to strengthen propaganda, dissemination, and education on militia self-defense laws widely through electronic information networks.

4. The Finance Department of the Ministry of National Defense:

Take the lead and coordinate with the Department of Militia Self-Defense to ensure the annual budget for implementing tasks related to propaganda, dissemination, education, and training on militia self-defense laws; guide military agencies and units in preparing budgets, using funds, and settling accounts.

5. Commanders of Military Regions:

a) Direct the Provincial Military Commands to advise provincial People's Committees on building plans, programs, contents, and organizing the implementation of propaganda, dissemination, education, training, and enhancing knowledge on militia self-defense laws; direct each province to establish one model commune for disseminating and educating on militia self-defense laws;

b) Direct functional agencies under the Military Region to carry out propaganda, dissemination, and education on militia self-defense laws through mass media;

c) Organize competitions to test and understand militia self-defense laws at the Military Region level for participants including the Commanders of Provincial Military Commands, Commanders of County Military Commands, Commanders of Commune Military Commands, and Commanders of Military Commands at grassroots levels and organizations; select some Commanders of Provincial Military Commands, Commanders of County Military Commands, and Commanders of Commune Military Commands who have won high awards in the competition at the Military Region level to participate in the competition organized by the Ministry of National Defense to test their understanding of militia self-defense laws.

6. Commanders of the Hanoi Capital Military Region, Provincial Military Commands:

a) Take the lead and coordinate with relevant agencies to advise the Hanoi City People's Committee on building plans, programs, contents, and organizing the implementation of propaganda, dissemination, education, training, and enhancing knowledge on militia self-defense laws; implement the establishment of one model commune for organizing propaganda, dissemination, and education on militia self-defense laws;

b) Direct functional agencies under their command to carry out propaganda, dissemination, and education on militia self-defense laws through mass media;

c) Organize competitions to test understanding of militia self-defense laws at the provincial level for participants including Commanders of County Military Commands and Commanders of Commune Military Commands; select some Commanders of County Military Commands and Commanders of Commune Military Commands who have won high awards to participate in the competition organized by the Military Region to test their understanding of militia self-defense laws. Specifically, the Commander of the Hanoi Capital Military Region will send representatives to participate in the competition organized by the Ministry of National Defense to test their understanding of militia self-defense laws.

7. County Military Commands:

a) Take the lead and coordinate with relevant agencies to advise county-level People's Committees on building plans for propaganda, dissemination, and education on militia self-defense laws; coordinate with judicial agencies and the Interagency Coordination Board for Propaganda, Dissemination, and Education on Laws at the same level to prepare programs and contents for propaganda, dissemination, and education on laws and organize the implementation of such work;

b) Direct Commune Military Commands and Military Commands at grassroots levels to perform their functions and tasks in propaganda, dissemination, and education on militia self-defense laws;

c) Select and train Commanders of Commune Military Commands who have won high awards in the competition at the county level to participate in the competition organized by the Provincial Military Command and the Hanoi Capital Military Region to test their understanding of militia self-defense laws.

8. Commune Military Commands:

a) Take the lead and coordinate with relevant departments and agencies to advise commune-level People's Committees and the Interagency Coordination Board for Propaganda, Dissemination, and Education on Laws to direct the building of plans, programs, contents, and organizing the implementation of propaganda, dissemination, education, and training on militia self-defense laws for cadres, people, and local armed forces within their jurisdiction;

b) Annually, disseminate militia self-defense laws to 100% of core militiamen under their command, guiding and training them to mobilize the masses to implement the Party's policies and State laws on militia self-defense;

c) Participate in competitions to test their understanding of militia self-defense laws at the county level.

9. Military Commands of Central Ministries and Departments, Military Commands at grassroots levels:

Take the lead and coordinate with relevant agencies at the same level to advise Party committees and heads of agencies and organizations to lead and direct the building of plans, programs, contents, and organizing the implementation of propaganda, dissemination, education, training, and enhancing knowledge on militia self-defense laws.

10. In 2010 and subsequent years, Academies and schools under the Ministry of National Defense, Military Schools of Military Regions, and Provincial Military Schools must update and supplement the inclusion of contents on militia self-defense laws into their curricula and teaching materials suitable for different training targets.

11. All agencies and units directly under the Ministry of National Defense must organize for 100% of officers, professional soldiers, non-commissioned officers, soldiers, and defense workers to study and participate in competitions to understand militia self-defense laws, grasp and understand the position, functions, and tasks of the militia self-defense force; the responsibilities of military agencies and units in assisting localities in building, training, and coordinating activities with the militia self-defense force.

12. Based on the situation and tasks, units from regiment level and above must build and implement plans for propaganda, dissemination, and education on militia self-defense laws; organize summaries or evaluations of results.

Article 7. Ensuring Funding

1. The funding for implementing tasks related to propaganda, dissemination, education, training, and capacity building shall be budgeted and consolidated annually by ministries, sectors, and localities in accordance with the Law on Militia and Self-Defense and the State Budget Law.

2. The central budget shall ensure the contents within the expenditure responsibilities of ministries and sectors regarding information and propaganda as stipulated in Clause 7, Article 53 and Point d, Clause 1, Article 55 of the Law on Militia and Self-Defense; it shall also ensure the implementation of the Propaganda, Dissemination, Education, and Training Program on Militia and Self-Defense Law as prescribed in Decision No. 289/QD-TTg dated February 26, 2010 of the Prime Minister and other Decisions of the Prime Minister approving programs to implement the Militia and Self-Defense Law during the period from 2010 to 2012.

3. The local budget shall ensure the contents within the expenditure responsibilities of localities regarding information and propaganda as stipulated in Point k, Clause 1, Article 54 of the Law on Militia and Self-Defense.

Article 8. Effective Date

1. This Circular shall take effect 45 days from the date of signature.

2. Heads of ministries, agencies at the ministerial level, heads of government agencies, Chairpersons of People's Committees of provinces and centrally governed cities, and relevant agencies have the responsibility to direct, implement, and guide subordinate units in carrying out this Circular.

3. In the process of organizing and implementing, if there are any difficulties, ministries, sectors, localities, and relevant agencies are requested to report them to the Ministry of National Defense for consideration and resolution./.
