DECREE

Amending and supplementing certain articles of Decree No. 86/2009/NĐ-CP dated October 19

promulgating regulations on cultural activities and the operation of public cultural services of the Government detailing and guiding the implementation of

some clauses of the Ordinance on the Vietnam Coast Guard Force

Pursuant to the Law on the Organization of the Government dated December 25, 2001;

Pursuant to the Ordinance on the Vietnam Coast Guard Force dated January 26, 2006;

At the proposal of the Minister of National Defense,

The Government promulgates this Decree amending and supplementing certain articles of Decree No. 86/2009/NĐ-CP dated October 19, 2009 of the Government detailing and guiding the implementation of certain articles of the Ordinance on the Vietnam Coast Guard Force.

Article 1. Amending and supplementing certain articles of Decree No. 86/2009/NĐ-CP dated October 19, 2009 of the Government detailing and guiding the implementation of certain articles of the Ordinance on the Vietnam Coast Guard Force

1. Clause 2, Clause 3, Article 3 shall be amended and supplemented as follows:

"Article 3. Organization and activities of the Vietnam Coast Guard Force

2. The Vietnam Coast Guard Force is a specialized force of the State, operating in accordance with Vietnamese laws; respecting and complying with international treaties to which the Socialist Republic of Vietnam is a party.

3. The Minister of National Defense is responsible to the Prime Minister and the National Assembly for state management of the Vietnam Coast Guard Force, directly directing the activities of the Vietnam Coast Guard Force."

2. Clause 4 shall be amended and supplemented as follows:

"Article 4. International trade name

The Vietnam Coast Guard Force has an international trade name in English as Vietnam Coast Guard."

3. Article 6 shall be amended and supplemented as follows:

"Article 6. Command of the Coast Guard

1. The Command of the Coast Guard has legal personality, has a bank account and a seal bearing the national emblem, can open an account at the State Treasury, has its headquarters in Hanoi; operational funds are provided by the state budget and recorded separately in the total operational budget of the Ministry of National Defense.

2. The Commander, Political Commissar, Deputy Political Commissar, and Deputy Commanders of the Coast Guard are appointed by the Prime Minister upon the proposal of the Minister of National Defense."

4. Article 11 shall be amended as follows:

"Article 11. Uniforms of the Vietnam Coast Guard Force

The insignia, rank insignia, shoulder boards, duty uniforms, and ceremonial uniforms of the Vietnam Coast Guard Force shall be prescribed by the Prime Minister."

5. Clause 1, Article 21 shall be amended as follows:

"Article 21. Implementation organization

1. Annually, the Ministry of National Defense shall coordinate with the Ministry of Planning and Investment and the Ministry of Finance to prepare the budget to ensure funding for the operations of the Vietnam Coast Guard Force."

Article 2. Changes in Terminology

1. Replace the phrase "Coast Guard Bureau" with "Command of the Coast Guard" in Clause 2, Article 5.

2. Replace the phrase "Vietnam Marine Police" with "Vietnam Coast Guard" in Clause 3, Clause 4, Article 9.

3. Replace the phrase "Director of the Coast Guard Bureau" with "Commander of the Coast Guard" in Article 22.

Article 3. Effectiveness and Responsibility for Implementation

1. This Decree takes effect from October 12, 2013.

2. Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairpersons of provincial People's Committees, and the Commander of the Coast Guard are responsible for implementing this Decree./.
