PRIME MINISTER

Pursuant to the Government Organization Law dated September 30, 1992;

Based on Decision No. 651/TTg dated October 10, 1995 of the Prime Minister establishing the National Coordination Committee for Vietnam's Activities in ASEAN;

Considering the proposal of the Minister, Head of the Government Office,

DECISION:

Article 1. Attached to this Decision is the Regulation on the Organization and Operation of the National Coordination Committee for Vietnam's Activities in ASEAN (hereinafter referred to as the National Committee on ASEAN).

Article 2. This Decision takes effect from the date of signature. Previous provisions contrary to this Decision are abolished.

Article 3. The Chairman, members, and Secretary-General of the National Committee on ASEAN, Ministers, Heads of Ministries equivalent to ministries, Heads of government agencies, Chairmen of Provincial People's Committees under the Central Government are responsible for implementing this Decision.

REGULATIONS

ORGANIZATION AND OPERATION OF THE NATIONAL COORDINATION COMMITTEE FOR VIETNAM'S ACTIVITIES IN ASEAN

(Issued together with Decision No. 96/TTg dated February 8, 1996)

Article 1. The National Coordination Committee for Vietnam's Activities in ASEAN (hereinafter referred to as the National Committee on ASEAN) established pursuant to Decision No. 651/TTg dated October 10, 1995 is an agency assisting the Prime Minister in directing central ministries and departments, provincial people's committees under the Central Government, and people's organizations and associations (hereinafter referred to as agencies) to participate in activities within the Association of Southeast Asian Nations (ASEAN) in areas of security, politics, economy, culture, society, science and technology, and foreign affairs.

Article 2. The National Committee on ASEAN has the following tasks:

1. To compile and review proposals regarding policies, plans (long-term and annual) for Vietnam's participation in ASEAN activities submitted by agencies to the Government,

2. To assign and direct agencies to fulfill their obligations and participate in ASEAN activities and cooperation programs. Direct agencies in organizing staff and training specialized personnel on ASEAN matters.

3. To organize mid-term reviews, final summaries, prepare regular reports (monthly and annually) and ad hoc reports on the situation of ASEAN activities and Vietnam's participation in ASEAN to be submitted to the Government and

Article 3. Powers of the National Committee on ASEAN

1. To request agencies to provide data and report issues related to ASEAN and activities within ASEAN.

2. To inspect the implementation of obligations, programs, and projects of cooperation with ASEAN by agencies.

3. To direct the management and utilization of financial assistance from foreign governments and international organizations for Vietnam's activities in ASEAN.

Article 4. Organization and working regime of the National Committee on ASEAN.

The duties and powers of the members of the National Committee on ASEAN are as follows: Members of the Committee and the Secretary-General of the Committee are responsible for performing tasks assigned by the Chairman and regularly reporting results to the Chairman; fully participating in all meetings of the Committee and effectively contributing to the Committee's overall guidance work. Committee members may invite relevant agencies to discuss issues related to their responsibilities in the Committee as stipulated below: The Minister, Head of the Government Office assists the Chairman in organizing the implementation of all tasks of the National Committee on ASEAN; the Minister of Foreign Affairs participates in ASEAN Ministerial Meetings (AMM), ASEAN Joint Ministerial Meetings (JMM) and organizes guidance for relevant agencies to implement decisions of the meetings, after reporting and obtaining approval

Article 5. The Economic Cooperation Sub-committee and the Sectoral Cooperation Sub-committee (hereinafter referred to as the Sub-committees)

1. The Economic Cooperation Sub-committee shall advise the Commission on issues related to Vietnam's economic activities within ASEAN. Each agency of the Government Office, Ministry of Foreign Affairs, Ministry of Planning and Investment, Ministry of Trade, Ministry of Finance, Ministry of Science and Technology and Environment, Ministry of Agriculture and Rural Development, Ministry of Industry, Ministry of Transport, Ministry of Fisheries, State Bank, General Department of Customs, Tourism Administration, Post and Telecommunications General Department, and other agencies (if necessary) shall appoint one Deputy Director-General and one specialist to participate in the Sub-committee on a part-time basis. The Chairperson of the Sub-committee is the Head of the SEOM Delegation (ASEAN Senior Officials Meeting on Economic Matters) appointed by the Ministry of Trade.

2. The Sectoral Cooperation Sub-committee shall advise the Commission on issues related to Vietnam's activities in various specialized sectors within ASEAN. Each agency of the Government Office, Ministry of Foreign Affairs, Ministry of Planning and Investment, Ministry of Science and Technology and Environment, Ministry of Culture and Information, Ministry of Labor, Invalids and Social Affairs, Ministry of Education and Training, Ministry of Health, National Committee for Ethnic Minorities and Mountainous Areas, and other agencies (if necessary) shall appoint one Deputy Director-General and one specialist to participate in the Sub-committee on a part-time basis. The Chairperson of the Sub-committee is the Director-General in charge of the National Secretariat of ASEAN at the Ministry of Foreign Affairs.

3. The Sub-committees are responsible for reviewing the participation of agencies in ASEAN cooperation activities to propose recommendations to the Commission to enhance the effectiveness of ASEAN work.

4. Members of the Sub-committees are responsible for fully participating in all meetings of the Sub-committees. Members representing their agencies at the level of Deputy Director-General report on ASEAN work, opinions, and proposals from their agencies to the Sub-committees and convey the opinions and results of the Sub-committee meetings to their agencies.

5. Members of the Sub-committees represent their agencies in inter-ministerial and sectoral activities in ASEAN (including ASEAN meetings) at corresponding levels; they require staff participating in ASEAN meetings in their respective fields to report on the outcomes of these meetings and provide comprehensive materials to the Sub-committees for consolidation and presentation to the Commission.

6. Working regime of the Sub-committees: The Sub-committees meet regularly every two months. When necessary, the Chairperson may convene extraordinary meetings. Recommendations of the Sub-committees submitted to the Commission are adopted based on consensus. Prior to each regular meeting of the Commission, the two Sub-committees jointly hold a preparatory meeting to set the agenda for the Commission's meeting. The Commission's Office may convene extraordinary joint meetings when necessary.

Article 6. The Office of the National Commission for ASEAN.

1. The Office of the National Commission for ASEAN is the assisting body of the Commission. The National Commission for ASEAN Office consists of dedicated staff with positions under the Government Office, headed by a Director-General.

2. The Office of the National Commission for ASEAN has the function of assisting the Chairman and members of the Commission in organizing and coordinating agencies participating in ASEAN activities.

3. The Office of the National Commission for ASEAN has the following tasks: Preparing the content and organizing meetings of the National Commission for ASEAN according to plans approved by the National Commission, working sessions of the Chairman and members of the Commission. Coordinating, guiding, and supervising the specialized ASEAN units of participating agencies in activities, cooperation, and fulfilling obligations in ASEAN. Monitoring the implementation of conclusions from the National Commission for ASEAN meetings. Compiling plans for participation in ASEAN activities prepared by agencies for approval and decision by the National Commission for ASEAN. Monitoring ASEAN research programs and topics; Organizing special reports to the National Commission for ASEAN on issues necessary for the Commission's work. Monitoring training of personnel and provision of working equipment for specialized ASEAN units of agencies to effectively serve Vietnam's activities in ASEAN.

Article 7. The operating funds of the National Committee for ASEAN shall be provided by the Ministry of Finance from the state budget through the Government Office. The Government Office ensures the provision of funds and working facilities to support the activities of the National Committee for ASEAN.
