DECISION

On the List of State Secrets at Confidential Level in the Postal Sector,
Telecommunications and Information Technology Industry

 

THE MINISTER OF PUBLIC SECURITY

Pursuant to the Ordinance on Protection of State Secrets dated December 28, 2000.

Pursuant to the Decree No. 33/2002/NĐ-CP dated March 28, 2002 of the Government detailing the implementation of the Ordinance on Protection of State Secrets;

Pursuant to the Decree No. 136/2003/NĐ-CP dated November 14, 2003 of the Government stipulating functions, tasks, powers and organizational structure of the Ministry of Public Security;

After consultation with the Minister of Posts and Telecommunications;

DECIDES:

Article 1. The List of State Secrets at Confidential Level in the Postal Sector, Telecommunications and Information Technology Industry includes information within the following scope:

1. Technical design, diagrams, types, quantities of equipment for postal networks, telecommunications and information technology under System 1 post offices;

2. Information and documents on policies, strategies, planning, development plans in the Postal Sector, Telecommunications and Information Technology Industry that have not been disclosed;

3. Documents and data on frequencies, call signs, communication conventions of radio stations belonging to dedicated telecommunications networks directly serving special information for Party and State agencies, for defense and security purposes;

4. Policies and plans regarding negotiations and cooperation with foreign countries in the Postal Sector, Telecommunications and Information Technology Industry that have not been disclosed;

5. Information and documents provided by foreign partners to the Postal Sector, Telecommunications and Information Technology Industry which both parties agree not to disclose;

6. Information and documents on technology transfer contracts within the Postal Sector, Telecommunications and Information Technology Industry that have not been disclosed;

7. Pricing plans and price frameworks for postal, telecommunications and information technology services submitted to the Minister or Prime Minister for approval which have not been disclosed; personnel files of leaders at department level and equivalent positions; documents on internal political protection in the Postal Sector, Telecommunications and Information Technology Industry;

8. Complaint letters, inspection files, documents, and results of inspections and audits within the Postal Sector, Telecommunications and Information Technology Industry that have not been disclosed;

9. Documents regarding design, technical specifications, security regulations, conventions, passwords for internal computer networks in the Postal Sector, Telecommunications and Information Technology Industry;

10. Documents of the Postal Sector, Telecommunications and Information Technology Industry using information classified as State Secrets by other sectors.

11. Documents of the Posts and Telecommunications and Information Technology sector containing information classified as State secrets from other sectors.

This Decision shall take effect fifteen days after the date of publication in the Official Gazette. The competent authorities of the Ministry of Posts and Telecommunications and the Ministry of Public Security are responsible for inspecting the implementation of this Decision.

Article 3. Ministries, ministerial-level agencies, governmental agencies, People's Committees of provinces and centrally governed cities shall be responsible for implementing this Decision./.
