REGARDING PERFORMANCES, PUBLICATIONS, AND DISTRIBUTION OF MUSIC

MINISTER OF CULTURE

WHEREAS Article 31 of the Law on the Organization of the Council of Ministers dated July 4, 1981;

Pursuant to Decree No. 88-HĐBT dated March 26, 1985 and Decision No. 94-HĐBT dated May 28, 1988 of the Council of Ministers on the organization and staffing of the cultural sector;

Pursuant to Resolution of the Fifth Session of the Eighth National Assembly;

WHEREAS the Directive of the Chairman of the Council of Ministers on urgent issues in the cultural sector;

To regulate the disorderly situation in performances, publications, and distribution of music currently existing, and to restore order in the spiritual cultural life of our people,

DECISION:

Article 1.- Strictly prohibit performances and all forms of dissemination such as circulating printed materials, playing tapes, showing films... at public places such as theaters, cultural houses, clubs, gathering spots, parks, offices, factories, schools, exhibition areas, residential complexes, hotels, shops, cafes, train stations, bus terminals, airports, and on public transportation vehicles, etc., of the following types of music:

- Music pieces that are reactionary and pornographic;

- Romantic ballads with negative content created in the occupied zone from 1946 to 1975;

- Songs, music tapes, and musical films from overseas that are reactionary, pornographic, and negative, illegally brought into the country;

- Music pieces by Vietnamese and foreign authors opposing the revolution.

Article 2.- Strictly prohibit the import and export, copying, storage, circulation, and trading of music pieces belonging to all four categories of music mentioned in Article 1 of this Decision.

Article 3.- All activities related to performances, publications, and distribution of music must strictly comply with this Decision and the regulations on music management issued by the Ministry of Culture.

Article 4.- The People's Committees of provinces, cities, and centrally governed municipalities shall be responsible for all music activities within their jurisdiction and develop plans to direct the Departments of Culture and Information, Public Security, Finance, Customs, and other units under their territory to mobilize the comprehensive strength of society to implement this Decision; conduct inspections and handle all violations, including prosecution before the law.

This Decision shall take effect nationwide from July 8, 1989.
