Regarding the establishment of the Management Board of Nghi Son Economic Zone, Thanh Hoa Province

PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to Decree No. 36/CP dated April 24, 1997 of the Government promulgating the Regulations on Industrial Zones, Export Processing Zones, and High-Tech Zones;

Pursuant to Decision No. 102/2006/QĐ-TTg dated May 15, 2006 of the Prime Minister regarding the establishment and issuance of the Operation Regulations of the Nghi Son Economic Zone, Thanh Hoa Province;

Considering the proposal of the Chairman of the People's Committee of Thanh Hoa Province and the Minister of Home Affairs.

Article 1. Establish the Management Board of the Nghi Son Economic Zone, Thanh Hoa Province, and merge the Management Board of industrial zones of Thanh Hoa Province into the Management Board of the Nghi Son Economic Zone.

The Management Board of the Nghi Son Economic Zone is a state management agency under the People's Committee of Thanh Hoa Province responsible for managing the construction and development of the Nghi Son Economic Zone and industrial zones within the province according to the operation regulations, planning, plans, and implementation schedules approved by competent state agencies.

The Management Board of the Nghi Son Economic Zone has legal personality, bank accounts, office premises, and a seal with the national emblem; it serves as the planning and budget focal point of the People's Committee of Thanh Hoa Province, and is allocated separate development investment capital from the central government budget. Operating expenses of the Management Board shall be funded by the state budget.

Article 2. The Management Board of the Nghi Son Economic Zone, Thanh Hoa Province, shall have the following responsibilities and authorities:

1. Responsibilities and authorities stipulated in Article 27 of the Regulations on Industrial Zones, Export Processing Zones, and High-Tech Zones issued together with Decree No. 36/CP dated April 24, 1997 of the Government;

2. Responsibilities and authorities stipulated in Article 29 of the Operation Regulations of the Nghi Son Economic Zone, Thanh Hoa Province issued together with Decision No. 102/2006/QĐ-TTg dated May 15, 2006 of the Prime Minister;

3. Other duties and powers as prescribed by law.

Article 3. Organizational structure and staffing of the Management Board of the Nghi Son Economic Zone, Thanh Hoa Province:

1. Organizational structure:

a) The Management Board of the Nghi Son Economic Zone, Thanh Hoa Province shall have a Director appointed by the Prime Minister; several Deputy Directors and several members appointed by the Chairman of the People's Committee of Thanh Hoa Province upon the recommendation of the Director.

b) The Management Board of the Nghi Son Economic Zone, Thanh Hoa Province shall have an administrative support staff including an office, specialized departments, and a representative office in Hanoi.

c) Affiliated units.

Depending on the requirements for the development of the Nghi Son Economic Zone and industrial zones of Thanh Hoa Province at each specific stage, the Director of the Management Board of the Nghi Son Economic Zone shall submit organizational structures for approval by the Chairman of the People's Committee of Thanh Hoa Province within their authority.

2. Staffing:

The staffing of the Management Board of the Nghi Son Economic Zone includes the Director, specialized Deputy Directors, and the staffing of the office and specialized departments are civil service positions.

The staffing of the Management Board of the Nghi Son Economic Zone, Thanh Hoa Province shall be decided by the Chairman of the People's Committee of Thanh Hoa Province in accordance with the provisions of the law on the delegation of personnel management authority for administrative and public service units and the personnel management mechanism for state-owned public service units.

Article 4.The Director of the Management Board of the Nghi Son Economic Zone shall submit to the Chairman of the People's Committee of Thanh Hoa Province for detailed regulations on the functions, tasks, authorities, and organizational structure of the Management Board of the Nghi Son Economic Zone in accordance with the law.

Article 5. This Decision shall take effect fifteen days after its publication in the Official Gazette.

This Decision replaces Decision No. 39/1999/QĐ-TTg dated March 6, 1999 of the Prime Minister regarding the establishment of the Management Board of industrial zones directly under the People's Committee of Thanh Hoa Province.

The Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, the Chairman of the People's Committee of Thanh Hoa Province, and the Director of the Management Board of the Nghi Son Economic Zone, Thanh Hoa Province are responsible for implementing this Decision ./.
