Guidelines for the disbursement and management of funds
Action Program on Prevention and Control of Narcotics from 1998 to 2000
Pursuant to Resolution No. 06/CP dated January 29, 1993 of the Government: on strengthening guidance for work on prevention and control of narcotics
Pursuant to Decision No. 743/TTg dated November 14, 1995 of the Prime Minister: approving the overall plan for prevention and control of narcotics
Pursuant to Decision No. 139/1998/QĐ-TTg dated July 31, 1998 of the Prime Minister: approving the Action Program on Prevention and Control of Narcotics from 1998 to 2000 and Circular No. 04/CP-VX dated January 4, 1999 of the Government: On the mechanism for managing targets and tasks of previous national programs

The Ministry of Finance and the Ministry of Public Security issue guidelines for the management and use of funds for the Action Program on Prevention and Control of Narcotics as follows:
This technical regulation sets out technical requirements, testing methods, sampling procedures; management requirements; responsibilities of organizations and individuals producing, trading, and importing cigarettes.
1. Funds for implementing the Action Program on Prevention and Control of Narcotics are allocated in the annual state budget estimate and assigned to ministries, central agencies, provinces, and centrally-administered cities (hereinafter referred to as localities) for implementation.
2. In addition to the funds provided by the central budget for ministries, central agencies, and localities to carry out anti-narcotics tasks, local authorities at all levels and heads of agencies and units may mobilize additional funding sources such as voluntary contributions from individuals and economic and social organizations both domestically and internationally (in cash and in kind) supplemented from local budgets to implement anti-narcotics tasks in accordance with the provisions of the law.
3. Funds for the Action Program on Prevention and Control of Narcotics shall be issued, managed, settled, and audited in accordance with current regulations of the State Budget Law. Ministries, central agencies, the National Committee for Prevention and Control of Narcotics, and Anti-Narcotics Steering Committees at local levels have the responsibility to coordinate with financial authorities at all levels to strictly manage program funds, inspect expenditures in accordance with the objectives, contents, and prescribed regimes.
II. SPECIFIC PROVISIONS
1. Funds for implementing the Action Program on Prevention and Control of Narcotics allocated from the central budget to ministries, central agencies, and localities shall be used for the following purposes:
1.1. Funding for information dissemination, propaganda, education, training, seminars, specialized vocational training, and mobilizing mass movements among the people to prevent and control narcotics.
1.2. Funding for the eradication of wild or illegally planted narcotic plants, including:
- Assistance to households facing difficulties in their livelihood due to the eradication of narcotic plant cultivation. The maximum level of support shall not exceed VND 500,000 per household per year.
- Support for seedlings and livestock for ethnic groups that eradicate narcotic plants and shift to alternative production. The maximum level of support shall not exceed VND 1,000,000 per household per year.
- Funding for forces participating in the eradication of wild or illegally planted narcotic plants. Costs shall be calculated based on the actual number of people and days worked in the eradication of narcotic plants.
1.3. Funding for the prevention and control of drug-related crimes, including:
- Funding to dismantle drug trafficking hubs, groups, and routes.
- Funding for testing, forensic examination, and detection of drugs.
- Funding to support investigative activities related to drug crimes.
- Funding to support prosecution and trial of drug criminals in mobile court cases.
- Funding for purchasing, repairing special equipment and tools for the prevention and control of drug-related crimes.
1.4. Funding for rewards.
Regarding the form, recipients, criteria, procedures, and content of rewards: implemented in accordance with Decree No. 56/CP dated July 30, 1998 of the Government: Regulations on forms, recipients, and criteria for rewards; Circular No. 24/1999/BTC-TT dated March 4, 1999 of the Ministry of Finance: Guidelines for financial management in implementing the system of rewards for outstanding achievements in economic and social tasks and national defense.
Individuals who have made significant contributions in detecting, reporting drug crimes, seizing large quantities of drugs, or directly participating in apprehending drug criminals, as well as collectives and individuals with outstanding achievements, will be eligible for immediate rewards, with the amount of reward determined by the Chairman of the People's Committee of the province or centrally-administered city, and the Chairman of the National Committee for Prevention and Control of Narcotics.
1.5. Funding for central-level management and guidance on the prevention and control of narcotics, including:
- Funding for office supplies, purchase and repair of office equipment, electricity, water, postal fees, and communication charges.
- Funding for conferences, seminars, training sessions, scientific research, investigations, surveys, mid-term reviews, final evaluations, compilation, printing, and distribution of materials.
- Funding for consultants and hiring experts.
- Other expenses;
These expenses shall be carried out in accordance with current regulations.
Domestic conferences shall be implemented in accordance with Circular No. 93/1998/TT-BTC dated June 30, 1998 of the Ministry of Finance: Regulations on conference expenditure.
Payment for meals, accommodation, transportation tickets, travel allowances... shall be implemented in accordance with Circular No. 94/1998/TT-BTC dated June 30, 1998 of the Ministry of Finance: Regulations on travel allowances for civil servants and public officials traveling within the country.
For international conferences involving ASEAN member countries, they shall be implemented in accordance with Circular No. 149/TT-BTC dated November 17, 1998 of the Ministry of Finance: Regulations on expenditure for organizing ASEAN international conferences in Vietnam. For conferences where the Socialist Republic of Vietnam is a member and has signed agreements or treaties with other countries or international organizations, they shall be implemented in accordance with current regulations.
1.6. Funding for counterpart capital for cooperation projects, aid, and enhanced international cooperation in the prevention, control, and supervision of narcotics, shall be implemented in accordance with current regulations.
1.7. Funding for organizing drug rehabilitation for prisoners addicted to narcotics being rehabilitated in detention centers under the management of the Ministry of Public Security.
1.8. To support the upgrading, repair, and purchase of equipment and labor tools at detoxification centers, treatment facilities, and vocational training centers for concentrated detoxification subjects under local management.
2. The local budget shall be allocated to the anti-drug action program:
In addition to the portion of funds provided by the central budget as authorized under current regulations, the local budget may allocate certain contents for drug prevention and control work as follows:
- For education work, information, and communication activities to prevent and combat drug-related crimes.
- For the operation of detoxification centers, treatment facilities, and vocational training centers for detoxification subjects.
- For construction, repair, upgrade, and purchase of labor tools at detoxification centers, treatment facilities, and vocational training centers for detoxification subjects.
- For the removal of wild and illegally planted drug-producing plants when central budget support is insufficient.
- To provide living allowances, medical expenses, and vocational training fees for detoxification subjects according to Decision No. 167/TTg dated April 8, 1994 of the Government.
- To support the construction of drug-free model communes, wards, and schools: free from drug addiction-related crimes, effectively implementing detoxification and relapse prevention programs, and creating employment opportunities for those who have completed detoxification. The maximum support amount does not exceed five million dong per commune or ward per year.
3. Funds donated or contributed by individuals and organizations both domestically and internationally, and support from various levels of budget for the anti-drug action program shall be allocated according to the provisions set forth in Point 1 and 2, Part II of this Circular and managed in accordance with current regulations.
III. PROCEDURES FOR ESTABLISHING BUDGET PROJECTIONS, ALLOCATION, DISTRIBUTION, MANAGEMENT, AND SETTLEMENT OF DRUG PREVENTION AND CONTROL FUNDS
The procedures for establishing budget projections, allocation, distribution, management, and settlement of funds for the National Drug Prevention and Control Program shall be carried out strictly in accordance with the provisions of Circular No. 103/1998/TT-BTC dated July 18, 1998 of the Ministry of Finance: Guidelines on the delegation, preparation, implementation, and settlement of state budget; Circular No. 06/TT-LB dated April 29, 1997 of the Joint Ministry of Planning and Investment - Ministry of Finance: On the allocation, distribution, management, and utilization of funds for national programs and goals, and current regulations. Additionally, it should be noted that:
1. For ministries and central agencies: Annually, based on the announced budget projection, allocate the budget projection according to the expenditure items and the current budget classification, sign a "Responsibility Contract" regarding the implementation of tasks within the year with the National Committee for Drug Prevention and Control. The Ministry of Finance will distribute funds directly to ministries and central agencies within the scope of the annual budget projection announced by the State, based on the budget projection, progress, and the content of the work to be implemented as stipulated in the "Responsibility Contract".
2. For localities assigned targets for the implementation of the National Drug Prevention and Control Program, the Ministry of Finance will allocate funds through the "Delegated Budget" method to the provincial Departments of Finance and Prices in accordance with current regulations.
Local steering committees for drug prevention and control, based on the budget targets, requirements, and tasks assigned, standards, and expenditure regulations, guide participating agencies and units in the locality to prepare expenditure budgets, sign a "Responsibility Contract" with the local steering committee for drug prevention and control, consolidate, and submit to the Provincial People's Council for approval. After approval by the Provincial People's Council, send to the provincial Department of Finance and Prices to directly distribute funds to the units using the funds to implement drug prevention and control tasks.
The settlement of funds for the anti-drug action program shall be carried out in accordance with the provisions of the State Budget Law and current regulations. Ministries, central agencies, and localities must attach the liquidation report of the "Responsibility Contract" regarding the implementation of tasks within the year with the National Committee for Drug Prevention and Control (for ministries and central agencies) and the local steering committee for drug prevention and control (for localities) when submitting final reports to the Ministry of Finance.
3. Reporting system: Ministries, central agencies, and localities shall prepare semi-annual and annual reports on the implementation of tasks and funds for the anti-drug action program (including funds from the central budget and other sources) and submit them to the National Committee for Drug Prevention and Control (Office of the National Committee for Drug Prevention and Control) for consolidation and reporting to the Government.
IV. IMPLEMENTATION PROVISIONS
This Circular takes effect fifteen days from the date of signature and replaces Circular No. 78/TT-LB dated September 11, 1993 of the Joint Ministry of Finance - Ethnic Affairs - Mountainous Areas: Guidelines on the distribution, management, and use of funds for drug prevention, control, and supervision.
During implementation, if there are any difficulties, please reflect them to the Joint Ministry of Finance - Public Security for research and resolution.
