DECISION OF THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT

Regulations on functions, tasks, powers, and organizational structure of the Inspectorate

THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT

Pursuant to the Inspection Ordinance 1990;

Pursuant to Decree No. 86/2003/NĐ-CP dated July 18, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to Article 18 of the Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

These regulations are hereby promulgated along with this Decision "Regulations on the Transfer, Rotation, and Temporary Assignment of Officials and Civil Servants of the Government Inspectorate."

DECISION:

Article 1. Position and Functions

The Inspectorate is a subordinate agency under the Ministry of Agriculture and Rural Development, directly subject to the direction of the Minister of Agriculture and Rural Development in exercising inspection and supervision rights within the scope of state management of the Ministry to ensure legal compliance, strengthen administrative discipline in the agricultural and rural development sector according to the provisions of the law. The Inspectorate has its own seal in accordance with the law.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

The Inspectorate is assigned by the Minister to perform specific tasks and powers as follows:

1. Submit draft regulatory legal documents in the field assigned by the Minister to the Minister.

2. To compile and submit to the Minister the annual inspection program and plan of the Ministry; to take the lead and participate in drafting regulations on inspection, complaint resolution, and post-inspection organization implementation after approval by the Minister.

3. To inspect and supervise agencies, units under the sector; organizations and individuals related to the performance of assigned tasks and compliance with state policies and laws relevant to the agricultural and rural development sector within the scope of the Ministry's state management; to monitor, inspect, and urge post-inspection handling according to the conclusions and decisions of the Minister and the provisions of the law.

4. To inspect and supervise the evaluation and implementation of investment development projects; other programs and projects of agencies and units directly under the Ministry as assigned by the Minister.

Regarding the exercise of certain rights of the representative owner of the State for the State-owned capital at enterprises under the management of the Ministry:

a) To inspect and supervise the evaluation and implementation of investment development projects of state-owned enterprises under the management of the Ministry.

c) To participate with relevant agencies under the Ministry in evaluating and proposing measures to enhance enterprise management within the Ministry's jurisdiction according to the law to the Minister.

6. To compile and guide specialized inspection business for specialized inspectors and provincial Department of Agriculture and Rural Development inspectors within the Ministry's state management scope.

7. To guide the inspection of heads of agencies and units under the Ministry's state management regarding national regulations on inspection work and complaint and accusation resolution.

8. To guide the implementation of inspection plans and business for agencies and units directly under the Ministry; to coordinate with the Agricultural and Rural Development Trade Union in guiding inspection business for people's inspection organizations of agencies and units directly under the Ministry.

9. To submit to the Minister the resolution of complaints and accusations within the Minister's authority according to the law.

10. To participate in training and enhancing inspection business skills for cadres, civil servants, and employees of agencies and units under the sector.

11. To be in charge of the Ministry of Agriculture and Rural Development's citizen reception work; to be in charge of the Anti-Corruption and Negative Practices Steering Committee of the Ministry; to participate in appraisal, commendation, disciplinary councils, and other councils assigned by the Minister.

12. To compile and report periodically to the Minister and the National Inspector General on the results of inspections and complaint resolutions within the Ministry's jurisdiction; to notify relevant agencies and units under the Ministry about the conclusions of the inspection team, the Minister's conclusions on inspected cases, and resolutions according to the law.

13. To participate in implementing administrative reform contents according to the Ministry's program and plan.

14. To perform other tasks assigned by the Minister.

15. The powers of the Inspectorate shall be implemented according to the provisions of the Inspection Ordinance.

Article 3. Organizational Structure

Leadership of the Inspectorate:

The Inspectorate leadership consists of the Chief Inspector and Deputy Chief Inspectors.

The Chief Inspector is proposed by the Minister of Agriculture and Rural Development to the National Inspector General for nomination to the Prime Minister; he is responsible to the Minister of Agriculture and Rural Development, the National Inspector General, and the law for the activities of the Inspectorate and the tasks assigned.

The Deputy Chief Inspectors are appointed by the Minister of Agriculture and Rural Development; they assist the Chief Inspector, undertake specific tasks assigned by the Chief Inspector, and are responsible to the Chief Inspector and the law for the tasks assigned. The number of Deputy Chief Inspectors does not exceed three; if exceeded, it must be reported to the Minister.

2. Management structure of the Inspectorate:

Administrative-Comprehensive Department;

b) Inspectors, inspection officials, and staff are responsible to the Chief Inspector and the law for performing assigned tasks; they have obligations and rights according to the law. The Chief Inspector defines the functions and tasks of the Administrative-Comprehensive Department; establishes the Working Regulations to be approved by the Minister and组织实施。

Article 4. Effective date

This Decision shall take effect fifteen days after its publication in the Official Gazette of the Government; it replaces Decision No. 15/NN/TCCB-QĐ dated January 6, 1996, issued by the Minister of Agriculture and Rural Development on the functions, tasks, powers, and organizational structure of the Inspectorate of the Ministry and other provisions in previous documents of the Ministry that conflict with this Decision.

Article 5. Responsibilities for Implementation

The Inspector General, the Director of the Office, the Head of the Cadre and Civil Service Department, the Chairmen of the People's Committees of provinces and centrally governed cities, the Directors of Departments of Agriculture and Rural Development, and the Heads of relevant units under the Ministry are responsible for implementing this Decision./.
