CIRCULAR

Amending and supplementing Circular No. 03/2003/TT-BTC dated January 10, 2003 of the Ministry of Finance on the regime for collection, payment, and management and use of inspection fees and certification fees for issuing certificates ensuring quality and technical safety for machinery, equipment, materials, and substances with strict requirements for safety.

Pursuant to Clause 22, Article 1 of the Law Amending and Supplementing Certain Provisions of the Labor Code (No. 35/2002/QH10 dated April 2, 2002);

Pursuant to Ordinance No. 38/2001/PL-UBTVQH10 dated August 28, 2001 on Fees and Charges and Decree No. 57/2002/NĐ-CP dated June 3, 2002 of the Government detailing the implementation of the Ordinance on Fees and Charges, the Ministry of Finance issued Circular No. 03/2003/TT-BTC dated January 10, 2003 stipulating the regime for collection, payment, and management and use of inspection fees and certification fees for issuing certificates ensuring quality and technical safety for machinery, equipment, materials, and substances with strict requirements for safety.

After a period of implementation and upon the proposal of the Ministry of Labor, Invalids and Social Affairs, the Ministry of Industry, the Ministry of Agriculture and Rural Development, the Ministry of Finance guides the amendment and supplementation of some points in Circular No. 03/2003/TT-BTC mentioned above as follows:

1. Abolishing the collection of certification fees for issuing certificates ensuring quality and technical safety for machinery, equipment, materials, and substances with strict requirements for safety as stipulated in Circular No. 03/2003/TT-BTC mentioned above.

2. Amending Point 2, Section II of Circular No. 03/2003/TT-BTC regarding the percentage of inspection fees retained by the Technical Safety Inspection Authority as follows:

The Technical Safety Inspection Authority not yet funded by the State Budget for inspection activities shall retain 90% (ninety percent) of the total actual inspection fee revenue before remitting it to the State Budget to serve the collection of technical safety inspection fees according to the expenditure provisions at Point 2, Section II of Circular No. 03/2003/TT-BTC mentioned above.

This Circular takes effect 15 days from the date of publication in the Official Gazette. For the amount of inspection fees and certification fees collected by the Technical Safety Inspection Authorities before this Circular takes effect, such amounts shall be included in the revenue of the units and settled and utilized according to the provisions of this Circular.

In the course of implementation, if there are any difficulties, please promptly report them to the Ministry of Finance for supplementary guidance./.
