Detailed regulations on implementing certain provisions of the Law on Competition and Rewards

Pursuant to the Law on Organization of the Government dated June 19, 2015; the Law Amending and Supplementing Certain Provisions of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;

Pursuant to the Law on Encouragement and Reward dated June 15, 2022;

The Government promulgates this Decree to provide detailed regulations on implementing certain provisions of the Law on Competition and Rewards.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Decree provides detailed regulations on implementing Clause 5 Article 11; Clause 2 Article 12; Clause 2 Article 14; Clause 4 Article 25; Clause 7 Article 34; Clause 6 Article 35; Clause 5 Article 36; Clause 5 Article 37; Clause 5 Article 38; Clause 4 Article 39; Clause 4 Article 40; Clause 4 Article 41; Clause 7 Article 42; Clause 7 Article 43; Clause 7 Article 44; Clause 3 Article 45; Clause 3 Article 46; Clause 3 Article 47; Clause 2 Article 51; Clause 2 Article 53; Clause 5 Article 79; Clause 3 Article 81; Clause 3 Article 82; Clause 7 Article 83; Clause 7 Article 84; Clause 2 Article 85; Clause 5 Article 90; Clause 9 Article 93 of the Law on Competition and Rewards (hereinafter referred to as this Decree).

Article 2. Applicability

This Decree applies to individuals who are Vietnamese citizens, state agencies, political organizations, socio-political organizations, socio-professional organizations, social organizations, enterprises, other economic organizations, people's armed forces units, households; Vietnamese individuals and groups residing abroad; foreign individuals and groups; foreign agencies and organizations, and international organizations in Vietnam.

Article 3. Explanation of Terms

In this Decree, the following terms are understood as follows:

1. National reward forms include: Orders, Medals, State Honorary Titles, "Ho Chi Minh Prize", "State Prize", "Prime Minister's Commendation".

2. National competition titles include: "Government Flag of Competition", "National Model Competitor".

3. Outstanding achievements are those achieved outside the program, plan, tasks that individuals or groups must undertake or be assigned.

4. Extraordinary outstanding achievements are outstanding achievements reached at an extraordinarily excellent level when courageously rescuing people or property of the people or the State, or during combat or service support for combat, or achieving extraordinary outstanding results in economic, cultural, sports fields and other fields within the country or regionally and globally.

5. Other economic organizations are economic organizations legally registered according to the law, engaged in production and business activities with the purpose of developing the economy; having clear charters and organizational structures, specific addresses, assets for operation; possessing legal personality.

Article 4. Principles for awarding competition titles and reward forms

1. Rewards must be based on conditions, criteria, and achievements obtained, not necessarily requiring lower-level rewards before higher-level rewards can be given.

2. Authorities with the right to grant rewards or propose higher authorities to grant competition titles and reward forms for cases meeting the prescribed conditions, criteria, procedures, and files.

3. Results from rewarding outstanding achievements or thematic competitions shall not serve as grounds for proposing higher authorities to grant honors.

4. Rewards or proposals for higher authorities to grant rewards shall not be made to individuals or groups during the period when competent authorities are examining disciplinary actions or investigating, auditing, inspecting suspected violations, or dealing with complaints and denunciations involving corruption or negative issues reported by the press and being verified.

In cases where individuals or groups have been disciplined and, after completing the disciplinary period, achieve new accomplishments, such achievements will be considered for rewards starting from the completion of the disciplinary period.

5. Maternity leave time for individuals as stipulated shall be counted towards consideration for competition titles and reward forms.

6. When multiple individuals or groups meet the conditions and criteria, preference shall be given to selecting female individuals or groups with a female ratio of 70% or more for rewards.

7. The tenure required for considering contributions for rewards for female leaders and managers is reduced by one-third compared to the general requirement. For female leaders and managers who fall under the category of higher retirement age, the tenure for considering contributions for rewards follows the general requirement.

Chapter II

COMPETITION TITLES; OBJECTS, CRITERIA, AND REWARD FORMS

Mục 1. LIST OF FLAGS OF MERIT OF THE GOVERNMENT

Article 5. "Flag of Merit of the Government"

1. The title "Flag of Merit of the Government" shall be awarded to collectives meeting the standards prescribed in Clause 1 of Article 25 of the Law on Encouragement and Reward, which have been evaluated, compared, and recommended for outstanding excellence within their clusters or groups of competition organized by ministries, sectors, agencies, or provinces through trust votes from members of such clusters or groups.

The number of collectives eligible for recommendation to receive the "Flag of Merit of the Government" as stipulated in Clause 1 of this Article shall not exceed 20% of the total number of leading collectives in clusters or groups of competition that meet the flag award criteria set by ministries, sectors, agencies, or provinces.

2. Collectives eligible for the award of the title "Flag of Merit of the Government" as prescribed in Clause 2 of Article 25 of the Law on Encouragement and Reward must meet the following standards:

a) Outstanding achievements in economic and social development, ensuring national defense and security;

b) Effective implementation of Party policies and State laws; building a clean and strong political system;

c) Effective performance of tasks related to encouragement and reward activities.

Collectives specified in Clause 2 of this Article shall be evaluated, compared, and recommended for outstanding leadership within their clusters or groups of competition organized by the Central Steering Committee for Encouragement and Reward through trust votes from members of such clusters or groups.

3. The title "Flag of Merit of the Government" shall be awarded to collectives meeting the standards prescribed in Clause 3 of Article 25 of the Law on Encouragement and Reward:

a) For central-level bodies: Advising the Government and the Prime Minister on the establishment of institutional frameworks, improving mechanisms and policies to promote economic and social development; innovating the content and form of encouragement movements and campaigns to actively engage members;

b) For provincial-level bodies: Achieving significant accomplishments in economic and social development, maintaining social stability; having new models and creative approaches with high effectiveness; being exemplary and outstanding among provinces in clusters of competition organized by the Central Steering Committee for Encouragement and Reward.

Collectives meeting the standards prescribed in Clause 3 of this Article shall be selected and proposed for rewards by ministries, sectors, agencies, or provinces; the Ministry of Home Affairs shall receive, compile, and review the files before submitting them to the Prime Minister for consideration and decision. The proposal for rewards shall comply with the provisions of Article 35 of this Decree.

Mục 2. OBJECTS, STANDARDS FOR REWARDS DURING THE COURSE OF CONTRIBUTION AND FOR OUTSTANDING ACHIEVEMENTS

Article 6. General Provisions on Rewards During the Course of Contribution

1. The period of service for considering rewards during the course of contribution is defined as follows:

a) Cadres participating in revolutionary activities before 1945 are those who participated in revolutionary activities before January 1, 1945, individuals admitted to the Indochinese Communist Party or re-admitted before August 19, 1945, recognized by competent authorities;

b) Pre-revolutionary cadres are those who participated in revolutionary activities from January 1, 1945, to the August Revolution in 1945, recognized by competent authorities;

c) Cadres continuously working in two anti-colonial wars against France and the United States are those who worked continuously from after the August Revolution in 1945 to April 30, 1975;

d) Cadres working during the anti-French colonial war are those who worked continuously from after the August Revolution in 1945 to July 20, 1954;

đ) Cadres working during the anti-American war are those who worked continuously from July 20, 1954, to April 30, 1975;

e) Individuals continuously working in southern battlefields are those who worked continuously for at least ten years in southern battlefields, Laos, and Cambodia. In cases where they worked continuously in battlefields before 1960, the continuous work period is counted up to January 1973. In cases where they entered battlefields in 1964, the continuous work period is counted up to April 30, 1975;

g) Cadres working during the period of building and defending the country are those who worked from after April 30, 1975.

2. Time and position for rewards:

a) Ministries, sectors, and provinces shall submit to the Prime Minister for consideration and to the President for rewards during the course of contribution for individuals meeting the conditions and standards upon notification of retirement or retirement decision without prior rewards during the course of contribution (including cases of sacrifice or death). If an individual has already received rewards during the course of contribution and continues to work thereafter, holding leadership positions within the scope of rewards during the course of contribution, they may continue to be considered for rewards during the course of contribution for subsequent periods of work and positions, and may be recommended for other commendation titles and forms of reward if they meet the conditions and standards;

b) Individuals holding positions but not meeting the time requirement for rewards according to the standards for such positions may have their time in lower positions added to meet the standards for rewards for lower positions (if such lower positions fall under the standards for rewards during the course of contribution);

c) Individuals holding multiple positions simultaneously shall be assessed based on the highest position held;

d) Individuals whose positions were reduced due to rotation, transfer, or organizational restructuring before rotation, transfer, or restructuring, shall be assessed based on their previous positions and the continuous time in those positions shall be considered for rewards;

đ) Cases where individuals have already received rewards during the course of contribution shall not be adjusted according to new regulations on equivalent positions. Cases where individuals have not yet received rewards during the course of contribution, if they meet the criteria and standards, shall be recommended for rewards during the course of contribution.

3. Conditions for application of rewards:

a) No award shall be given to individuals who have been disciplined with expulsion from the Party, forced resignation, revocation of military or police titles, rank, or professional insignia. For individuals who have been expelled from the Party but later corrected their mistakes, strived, and were readmitted into the Party and meet the prescribed standards, the time and position after readmission may be considered for awards.

b) The level of award for individuals who have been expelled from the Party and then readmitted, and those who have been removed from office, demoted in rank or grade, reduced in pay grade, reprimanded, or warned shall be reduced by one level. Each disciplinary form shall only be considered once for an award (subsequent reviews for awards shall not be based on the previous disciplinary form).

4. The Ministry of Home Affairs shall seek opinions from the Central Organization Committee and the Central Inspection Commission regarding cadres managed by the Politburo and the Secretariat before submitting to the Prime Minister for review and to the President for awarding.

Article 7. Provisions on equivalent positions for consideration in awarding contributions

1. Positions of Minister and equivalents: Full member of the Central Committee of the Communist Party (a full member candidate serving in a certain position shall be determined at the corresponding level and enjoy benefits and policies according to the current position held); Head of central party bodies; Director of the Ho Chi Minh National Political Academy; Editor-in-Chief of the People's Newspaper, Editor-in-Chief of the Communist Review; Member of the Standing Committee of the National Assembly (Secretary-General, Director of the National Assembly Office; Chairman of the Ethnic Council, Director of various Committees of the National Assembly; Head of the Delegation Work Department, Head of the Petitions Department under the Standing Committee of the National Assembly); Minister, Head of ministries at the ministerial level; Director of the President's Office; State Auditor General; Heads of central political-social organizations; Vice Chairperson - Secretary-General of the Vietnam Fatherland Front Central Committee; Secretary of provincial or municipal Party Committees, Party Committees directly under the Central Committee; Deputy Secretary of the Hanoi Municipal Party Committee, Deputy Secretary of the Ho Chi Minh City Municipal Party Committee; Chairman of the People's Council, People's Committee of Hanoi and Ho Chi Minh Cities; Deputy Director of the Central Inspection Commission; Chairman of the Vietnam Academy of Social Sciences; Chairman of the Vietnam Academy of Science and Technology; Chairman of the State Capital Management Corporation; General Director of the Vietnam News Agency; General Director of the Voice of Vietnam Radio; General Director of the Vietnam Television.

2. Positions of Deputy Minister and equivalents: Deputy Head of central party bodies; Deputy Director of the Ho Chi Minh National Political Academy; Deputy Editor-in-Chief of the People's Newspaper, Deputy Editor-in-Chief of the Communist Review; Deputy Chairperson of the Vietnam Fatherland Front Central Committee; Deputy Chairman of the Ethnic Council; Deputy Director of various Committees of the National Assembly; Deputy Director of the National Assembly Office; Deputy Chief Justice of the Supreme People's Court; Deputy Prosecutor of the Supreme People's Procuracy; Deputy Minister, Deputy Head of ministries at the ministerial level; Deputy Director of the President's Office; Deputy State Auditor General; Deputy Heads of central political-social organizations; Permanent Secretary of the Central Youth Union; Deputy Secretary of provincial or municipal Party Committees, Party Committees directly under the Central Committee; Chairman of the People's Council, People's Committee of provinces and centrally-administered cities; Member of the Central Inspection Commission; Director of the National Political Publishing House; Chairman of mass organizations assigned tasks by the Party and State at the central level (for organizations with Party groups); Assistants to key leaders of the Party and State; Permanent Assistant to the Secretary of the Secretariat; Director of the Legislative Research Institute under the Standing Committee of the National Assembly; Director of the Hanoi National University, Director of the Ho Chi Minh City National University; General Director of the Vietnam Social Security; Director of the Ho Chi Minh Mausoleum Management Board; Chairman of the National Financial Supervisory Council; Deputy Chairman of the State Capital Management Corporation; Supreme Court Judge, Supreme People's Procuracy Inspector.

3. Positions of General Director and equivalents: General Director, Deputy Head of the Delegation Work Department, Deputy Head of the Petitions Department under the Standing Committee of the National Assembly; Deputy Chairman of the Vietnam Academy of Social Sciences; Deputy Chairman of the Vietnam Academy of Science and Technology; Deputy General Director of the Vietnam News Agency; Deputy General Director of the Voice of Vietnam Radio; Deputy General Director of the Vietnam Television; Secretary of the Central Youth Union; Standing Member of the Ethnic Council, Standing Member of various Committees of the National Assembly; Standing Member of the Central Internal Political Protection Sub-Committee; Member of the Standing Committee of the Hanoi Municipal Party Committee, Ho Chi Minh City Municipal Party Committee; Special Representative of the National Assembly Delegation for centrally-administered provinces and cities; Deputy Chairman of the People's Council, People's Committee of Hanoi and Ho Chi Minh Cities; Member of the Editorial Board of the People's Newspaper; Member of the Editorial Board of the Communist Review; Special Deputy Head or Special Member of central steering committees; steering committees chaired by the Prime Minister, Deputy Prime Minister; Assistants to high-level leaders of the Party and State; Editor-in-Chief of the Communist Party of Vietnam Electronic Newspaper; Editor-in-Chief of the People's Representative Newspaper; Director of the National Assembly Television; General Director of the Government Information Portal; Deputy Director of the Hanoi National University, Deputy Director of the Ho Chi Minh City National University; Deputy General Director of the Vietnam Social Security; Deputy Director of the Party Cadre Office of the Government, Deputy Director of the Party Group Office of the National Assembly; Special Deputy Secretary responsible for Party work in the Party Committees: Central Party Office, Government Office, National Assembly Office, Ministry of Foreign Affairs, Ho Chi Minh National Political Academy and other equivalent positions as specified by the Party Committee, Party organization, agency, unit with specific authority to concretize equivalent positions and posts according to the cadre management hierarchy.

4. The title of Deputy General Director and equivalent positions: Deputy General Director; Deputy Director of the National Political Publishing House; Deputy Director of the Legislative Research Institute under the Standing Committee of the National Assembly; Deputy Director of the Ho Chi Minh Mausoleum Management Board; Full-time Member of the Ethnic Council and Committees of the National Assembly; Member of the Provincial Party Committee, Municipal Party Committee, and Party Committees directly under the Central Committee; Chairman of the Vietnam Fatherland Front Committee at the provincial and centrally-administered city level; Deputy Chairperson of the People's Council and People's Committee at the provincial and centrally-administered city level; Deputy Chairperson of the National Financial Supervisory Commission; Deputy Head of the Delegation of the National Assembly at the provincial and centrally-administered city level; Deputy Chairperson of mass organizations assigned tasks by the Party and State at the central level (for organizations with party groups); Chairman of mass organizations assigned tasks by the Party and State at the central level (for organizations without party groups); Deputy Editor-in-Chief of the Communist Party of Vietnam Electronic Newspaper; Deputy Editor-in-Chief of the People's Representative Newspaper; Deputy Director of the National Assembly Television; Deputy General Director of the Government Electronic Portal; Chief Judge of the High People's Court; Director of the High People's Procuracy; Director of academies under the Ho Chi Minh National Academy of Politics and equivalent positions as specified by the respective party committees, organizations, agencies, and units authorized to concretize equivalent titles and positions according to the cadre management hierarchy.

5. The title of Department Director and equivalent positions: Department Director, Bureau Chief, Institute Director, Branch Chief, and equivalent positions within the Party's bodies; Ministries, ministerial-level agencies; the Vietnam Fatherland Front and political-social organizations at the central level; Branch Secretary, agency heads under the Provincial Party Committee, Municipal Party Committee; Member of the Editorial Board of the National Political Publishing House; President of the Central United Association; Secretary to leading cadres of the Party and State; Department Director, head of units and equivalent positions within government agencies; Member of the Provincial Party Committee, Municipal Party Committee, and Party Committees directly under the Central Committee; Department Director and equivalent positions of the National Political Publishing House, head of units of the Hanoi National University, Ho Chi Minh City National University; Deputy Chief Judge of the High People's Court; Deputy Director of the High People's Procuracy; Deputy Director of academies under the Ho Chi Minh National Academy of Politics; Department Director, Bureau Chief, head of units and equivalent positions within general directorates and equivalent general directorates; Director of provincial departments, head of units, political-social organizations and equivalent positions at the provincial level; District, County, Town, City Party Secretary, district, county, town, city party committee secretary under the provincial party committee; Deputy Secretary-General of the Central United Association; head of branches, units of mass organizations assigned tasks by the Party and State at the central level (for organizations with party groups); Deputy Chairperson of mass organizations assigned tasks by the Party and State at the central level (for organizations without party groups) and equivalent positions as specified by the respective party committees, organizations, agencies, and units authorized to concretize equivalent titles and positions according to the cadre management hierarchy.

6. The title of Deputy Department Director and equivalent positions: Deputy Department Director, Deputy Bureau Chief, Deputy Institute Director, Deputy Branch Chief, and equivalent positions within the Party's bodies; Ministries, ministerial-level agencies; the Vietnam Fatherland Front and political-social organizations at the central level; Deputy Branch Chief, agency heads under the Provincial Party Committee, Municipal Party Committee; Deputy Chairman of the Vietnam Fatherland Front Committee at the provincial and municipal level; Secretary to members of the Central Committee of the Party, ministers and equivalents, provincial party secretaries, municipal party secretaries, and party secretaries directly under the Central Committee; Deputy Department Director, deputy head of units and equivalent positions within government agencies; Deputy Director of provincial departments, deputy head of units, departments, and political-social organizations and equivalent positions at the provincial level; Deputy Secretary of district, county, town, city party committees under the provincial party committee, municipal party committee; Chairman of the People's Council and People's Committee at the district level; Member of the Inspection Committee of the Provincial Party Committee, Municipal Party Committee directly under the Central Committee; Deputy Department Director and equivalent positions of the National Political Publishing House, deputy head of units of the Hanoi National University, Ho Chi Minh City National University; Deputy Department Director, deputy head of units within general directorates and equivalent general directorates; Deputy head of branches, units of mass organizations with party groups assigned tasks by the Party and State at the central level (for organizations with party groups); Head of provincial-level associations allocated staffing.

7. Equivalent positions to County Committee Member before April 30, 1975 include: Department Head at the county level; Deputy County Military Commander; Deputy Secretary, Deputy Chairperson of provincial-level mass organizations; Member of the provincial committee, member of the provincial military command, member of the provincial security committee.

8. Equivalent positions in the People's Army and Public Security Forces shall be implemented in accordance with the Conclusion of the Politburo on the list of leadership, management, and command positions in the People's Army and Public Security Forces.

Article 8. "Gold Star Medal"

The "Gold Star Medal" shall be awarded or posthumously awarded to individuals in accordance with point a, Clause 2, Article 34 of the Law on Encouragement of Competition and Rewards, who have made great contributions, particularly outstanding achievements in the revolutionary cause of the Party and the nation, without major faults, and meet one of the following criteria:

1. Participating in the revolution from before 1935, continuously active, having held one of the following positions: General Secretary of the Central Committee of the Communist Party of Vietnam, President of the State, Chairman of the National Assembly, Prime Minister, Member of the Politburo, Central Committee Secretary, Vice President of the State, Vice Chairman of the National Assembly, Deputy Prime Minister, Chairman of the Central Committee of the Vietnam Fatherland Front, Deputy Central Bureau Secretary, Standing Committee of the Provincial Committee, District Committee Secretary, Head of the Party at the central level, Minister, or equivalent positions, or being conferred the rank of Senior General in the People's Armed Forces.

2. Engaging in revolutionary activities before 1945, continuously active, having held one of the following positions: General Secretary of the Central Committee of the Communist Party of Vietnam, President of the State, Chairman of the National Assembly, Prime Minister, Member of the Politburo, Central Committee Secretary, Vice President of the State, Vice Chairman of the National Assembly, Deputy Prime Minister, Chairman of the Central Committee of the Vietnam Fatherland Front, or being conferred the rank of General in the People's Armed Forces.

3. Having continuously participated in both anti-French colonial and anti-American wars, holding one of the following positions: General Secretary of the Central Committee of the Communist Party of Vietnam, President of the State, Chairman of the National Assembly, Prime Minister, or being conferred the rank of General in the People's Armed Forces before April 30, 1975.

4. Having continuously worked in the anti-American war or during the period of national construction and defense, holding one of the following positions: General Secretary; President of the State; Prime Minister; Chairman of the National Assembly for two terms from eight to ten years.

Article 9. "Ho Chi Minh Medal"

The "Ho Chi Minh Medal" shall be awarded or posthumously awarded to individuals in accordance with point a, Clause 1, Article 35 of the Law on Encouragement of Competition and Rewards, who have made great contributions, particularly outstanding achievements in the revolutionary cause of the Party and the nation, without major faults, and meet one of the following criteria:

1. Engaging in revolutionary activities from before 1935, continuously active, having held one of the following positions: Secretary, Deputy Secretary of the Provincial Committee, Deputy Head of the Party at the central level, Deputy Minister, or equivalent positions, or being conferred the rank of Lieutenant General in the People's Armed Forces.

2. Engaging in revolutionary activities before 1945, continuously active, having held one of the following positions: Head of the Party at the central level, Regional Committee member, District Committee member, Minister, or equivalent positions, or being conferred the rank of Senior General in the People's Armed Forces.

3. Having continuously participated in both anti-French colonial and anti-American wars, holding one of the following positions: Member of the Politburo, Central Committee Secretary, Vice President of the State, Vice Chairman of the National Assembly, Deputy Prime Minister, Chairman of the Central Committee of the Vietnam Fatherland Front, or equivalent positions for one term from three to five years, or being conferred the rank of General in the People's Armed Forces.

4. Having continuously worked in the anti-American war or during the period of national construction and defense, holding one of the following positions:

General Secretary; President of the State; Prime Minister; Chairman of the National Assembly for one term from three to five years.

Permanent Secretary of the Secretariat; Member of the Politburo; Member of the Secretariat; Chairman of the Central Committee of the Vietnam Fatherland Front; Chief Justice of the Supreme People's Court; Procurator General of the Supreme People's Procuracy; Vice President of the State; Deputy Prime Minister; Vice Chairman of the National Assembly for two consecutive terms from eight to ten years, or being conferred the rank of General in the People's Armed Forces for ten years or more.

Article 10. "Independence Order" First Class

The "Independence Order" First Class is awarded to individuals, in accordance with point a, Clause 1, Article 36 of the Law on Encouragement of Competition and Rewards, who have made long-term contributions in agencies, organizations, units, or in the People's Armed Forces, and have met one of the following criteria:

1. Participated in revolutionary activities before 1945, continuously engaged, and held one of the following positions: Deputy Head of the Party Central Committee, Secretary of the Provincial Party Committee or Municipal Party Committee under the Central Committee, Deputy Minister or equivalent position; Lieutenant General of the People's Armed Forces.

2. Continuously participated in two anti-French colonial and anti-American wars, and held one of the following positions: Head of the Party Central Committee, Minister or equivalent position; Member of the Regional Party Committee, Secretary of the Provincial Party Committee or Municipal Party Committee, Central Party Committee, Member of the Standing Committee of the National Assembly, Head of central political-social organizations for two terms from eight to ten years; Senior General of the People's Armed Forces.

3. Continuously participated in the war against the American imperialists or in the construction and defense of the country, and held one of the following positions:

Permanent member of the Secretariat of the Party Central Committee; Member of the Politburo; Member of the Secretariat; Chairman of the Vietnam Fatherland Front Central Committee; Chief Justice of the Supreme People's Court; Procurator-General of the Supreme People's Procuracy; Vice President; Deputy Prime Minister; Deputy Chairman of the National Assembly for one term from three to five years. Senior General of the People's Armed Forces.

Minister or equivalent position for thirteen to fifteen years; Senior General of the People's Armed Forces for ten years or more.

Article 11. "Independence Order" Second Class

The "Independence Order" Second Class is awarded to individuals, in accordance with point a, Clause 1, Article 37 of the Law on Encouragement of Competition and Rewards, who have made long-term contributions in agencies, organizations, units, or in the People's Armed Forces, and have met one of the following criteria:

1. Recognized as a pre-revolutionary cadre and held one of the following positions: Deputy Head of the Party Central Committee, Deputy Minister or equivalent position, Deputy Secretary of the Provincial Party Committee or Municipal Party Committee, Central Party Committee, Chairperson of the Provincial People's Council or Municipal People's Council under the Central Committee, Deputy Chairman of the Vietnam Fatherland Front Central Committee, Deputy Head of central political-social organizations for one term from three to five years.

2. Continuously participated in two anti-French colonial and anti-American wars, and held one of the following positions:

Head of the Party Central Committee, Minister or equivalent position, Secretary of the Provincial Party Committee or Municipal Party Committee under the Central Committee, Member of the Standing Committee of the National Assembly, Head of central political-social organizations for one term from three to five years.

Deputy Head of the Party Central Committee, Deputy Minister or equivalent position, Deputy Secretary of the Provincial Party Committee or Municipal Party Committee, Central Party Committee, Chairperson of the Provincial People's Council or Municipal People's Council under the Central Committee, Deputy Chairman of the Vietnam Fatherland Front Central Committee, Deputy Head of central political-social organizations for two terms from eight to ten years.

3. Continuously participated in the war against the American imperialists or in the construction and defense of the country, and held one of the following positions: Minister or equivalent position for two terms from eight to ten years; Senior General of the People's Armed Forces for five years or more; Deputy Minister or equivalent position for thirteen to fifteen years.

Article 12. Third Class Independence Medal

The Third Class Independence Medal shall be awarded to individuals in accordance with point a, Clause 1, Article 38 of the Law on Competition and Rewards, who have a long-term dedication period in agencies, organizations, units, or in the People's Armed Forces, and meet one of the following criteria:

1. Participated in the revolution before 1945, continuously engaged in work, and held one of the following positions: Director of a Bureau, Head of a Department, Member of the Provincial Party Committee, Member of the Municipal Party Committee, Head of a Provincial-level Department, or equivalent position.

2. Recognized as a pre-revolutionary cadre and held one of the following positions: Director of a Bureau, Head of a Department, Member of the Provincial Party Committee, Member of the Municipal Party Committee, Head of a Provincial-level Department, or equivalent position, or someone who continuously worked for at least 10 years in the South battlefield before April 30, 1975, and held the position of Member of the District Party Committee or equivalent position.

3. Continuously participated in two anti-French and anti-American wars and held one of the following positions: Deputy Head of a Central Party Organization, Deputy Minister, or equivalent position, Deputy Secretary of a Provincial Party Committee, Municipal Party Committee, Chairman of the Provincial People's Council, Provincial People's Committee, Deputy Chairman of the Central Vietnam Fatherland Front, Deputy Head of Central Political-Social Organizations for one term from three to five years.

4. Continuously participated in the anti-American war or in national construction and defense, and held one of the following positions: Minister or equivalent position for one term from three to five years; Senior General of the People's Armed Forces; Deputy Minister or equivalent position for two terms from eight to ten years.

Article 13. First-Class Military Merit Medal

The First-Class Military Merit Medal shall be awarded to individuals in accordance with point a, Clause 1, Article 39 of the Law on Competition and Rewards, who have served for 35 years or more in the People's Armed Forces, and held one of the following positions: Minister, Deputy Minister, Chief of the General Staff, Director of the Political Department, or equivalent position; Senior General, Senior General of the People's Armed Forces for five years or more.

Article 14. Second-Class Military Merit Medal

The Second-Class Military Merit Medal shall be awarded to individuals in accordance with point a, Clause 1, Article 40 of the Law on Competition and Rewards, who have served for 35 years or more in the People's Armed Forces, and held one of the following positions: Commander of a Military Region or equivalent position for five years or more.

Article 15. Third-Class Military Merit Medal

The Third-Class Military Merit Medal shall be awarded to individuals in accordance with point a, Clause 1, Article 41 of the Law on Competition and Rewards, who have served for 35 years in the People's Armed Forces, and held one of the following positions: Commander of a Military Corps or equivalent position for five years or more.

Article 16. First-Class Labor Medal

1. The First-Class Labor Medal shall be awarded to individuals in accordance with point e, Clause 1, Article 42 of the Law on Competition and Rewards, who have a long-term dedication period in agencies, organizations, units, and meet one of the following criteria:

a) Recognized as a pre-revolutionary cadre and held one of the following positions: Deputy Director of a Bureau, Deputy Head of a Department, Deputy Head of a Provincial-level Department, or equivalent position;

b) Continuously participated in two anti-French and anti-American wars and held one of the following positions:

Deputy Head of a Central Party Organization, Deputy Minister, or equivalent position, Deputy Secretary of a Central Provincial Party Committee, Municipal Party Committee, Chairman of the Central Provincial People's Council, Provincial People's Committee, Deputy Chairman of the Central Vietnam Fatherland Front, Deputy Head of Central Political-Social Organizations.

Head of a Department, Standing Member of a Provincial Party Committee, Municipal Party Committee, Deputy Chairman of the Provincial People's Council, Provincial People's Committee, Chairman of the Provincial Vietnam Fatherland Front Committee from ten years or more;

c) Continuously participated in the anti-American war or in national construction and defense, and held one of the following positions:

Minister or equivalent position;

Deputy Minister or equivalent position for five years or more;

Director of a General Department or equivalent position for eight to less than ten years;

Deputy Director of a General Department or equivalent position for ten to less than fifteen years;

Head of a Department or equivalent position for fifteen years or more.

2. The First-Class Labor Medal shall be awarded to individuals who have performed well according to the Party's policies, state laws, and were dispatched by authorized agencies to participate in cultural, sports, tourism, education and training, science and technology activities, or other fields, and achieved world first place or world gold medal results.

Article 17. "Labor Medal" Second Class

1. The "Labor Medal" Second Class shall be awarded to individuals, in accordance with point e, Clause 1, Article 43 of the Law on Competition and Rewards, who have a long-term dedication process in agencies, organizations, and units and meet one of the following criteria:

a) Participating continuously in two anti-French colonial and anti-American wars and holding one of the following positions:

Deputy Director of the Provincial Party Committee, Deputy Director of the Municipal Party Committee under the Central Government, Deputy Chairman of the Standing Committee of the National Assembly, Deputy Chairman of the People's Council, People's Committee, Chairman of the Vietnam Fatherland Front Committee at provincial and municipal levels under the Central Government for 6 to less than 10 years.

Department Director, Head of a Sector or Department, Deputy Chairman of the Vietnam Fatherland Front Committee at provincial level, Secretary, Chairman of the People's Council, People's Committee at district, county, town, and city levels under provinces and municipalities under the Central Government, Deputy Director of the Department or equivalent position for 10 years or more.

b) Participating continuously in the anti-American war or in national construction and defense, holding one of the following positions:

Deputy Minister and equivalent for 3 to less than 5 years;

Director-General and equivalent for 5 years or more;

Deputy Director-General and equivalent for 8 to less than 10 years;

Department Director and equivalent for 10 to less than 15 years;

Deputy Department Director and equivalent for 15 years or more.

2. The "Labor Medal" Second Class shall be awarded to individuals nominated by authorized agencies to participate in cultural, sports, tourism, education and training, science and technology activities or other fields and achieving World Silver Medal or equivalent, or Continental Gold Medal or equivalent achievements.

Article 18. "Labor Medal" Third Class

1. The "Labor Medal" Third Class shall be awarded to individuals, in accordance with point g, Clause 1, Article 44 of the Law on Competition and Rewards, who have a long-term dedication process in agencies, organizations, and units and meet one of the following criteria:

a) Participating continuously in two anti-French colonial and anti-American wars and holding one of the following positions:

Department Director, Deputy Member of the Provincial Party Committee, Deputy Member of the Municipal Party Committee under the Central Government, Deputy Chairman of the People's Council, People's Committee, Chairman of the Vietnam Fatherland Front Committee at provincial and municipal levels under the Central Government for 5 years.

Department Director, Head of a Sector or Department, Deputy Chairman of the Vietnam Fatherland Front Committee and Head of political-social organizations at provincial level, Secretary, Chairman of the People's Council, People's Committee at district, county, town, and city levels under provinces and municipalities under the Central Government, Deputy Director of the Department or equivalent position for 6 to less than 10 years.

b) Participating continuously in the anti-American war or in national construction and defense, holding one of the following positions:

Director-General and equivalent for 3 to less than 5 years;

Deputy Director-General and equivalent for 5 to less than 8 years;

Department Director and equivalent for 6 to less than 10 years;

Deputy Department Director and equivalent for 10 to less than 15 years.

2. The "Labor Medal" Third Class shall be awarded to individuals nominated by authorized agencies to participate in cultural, sports, tourism, education and training, science and technology activities or other fields and achieving World Bronze Medal or equivalent, or Continental Silver Medal or equivalent achievements.

Article 19. First-Class Order of National Defense

The First-Class Order of National Defense shall be awarded to individuals as prescribed in Point d Clause 1 Article 45 of the Law on Competition and Rewards who have worked for at least 35 years in the People's Armed Forces and have held one of the following positions for at least 10 years: Deputy Commander of Military Corps, Division Commander, Director of Public Security of province or centrally governed city or equivalent position.

Article 20. Second-Class Order of National Defense

The Second-Class Order of National Defense shall be awarded to individuals as prescribed in Point d Clause 1 Article 46 of the Law on Competition and Rewards who have worked for at least 35 years in the People's Armed Forces and have held one of the following positions for at least 10 years: Deputy Division Commander, Regiment Commander, Deputy Director of Public Security of province or centrally governed city or equivalent position.

Section 3. ORDER OF NATIONAL UNITY, ORDER OF FRIENDSHIP

Article 22. Order of National Unity

Section 3. ORDER OF NATIONAL UNITY, ORDER OF FRIENDSHIP

1. The Order of National Unity shall be awarded to individuals who comply well with the Party’s guidelines, State policies and laws and meet one of the following criteria:

a) Individuals meeting the criteria stipulated in Clause 1 Article 51 of the Law on Competition and Rewards;

b) Individuals who have held one of the following positions for at least 5 but less than 10 years: Chairman of the Central Committee of the Vietnam Fatherland Front, Vice-Chairman of the Central Committee of the Vietnam Fatherland Front for at least 10 years, or continuously held a head position in member organizations within the Vietnam Fatherland Front system at provincial level or higher for at least 15 years.

2. Individuals specified in Clause 1 of this Article who have been awarded or posthumously awarded Orders according to Articles 8, 9, 10, 11, 12, 13, 14, 15; 19, 20, 21; Clause 1 of Articles 16, 17, 18 of this Decree shall not be considered for the awarding or posthumous awarding of the Order of National Unity.

Article 23. Order of Friendship

1. The criteria for rewarding the Order of Friendship shall be implemented as prescribed in Clause 1 Article 53 of the Law on Competition and Rewards.

2. The recipients include:

a) Agencies and organizations from foreign States and Governments equivalent to ministries, provinces, cities;

b) Foreign organizations of which Vietnam is a member or has partnership relations;

c) Friendship Associations with Vietnam of various countries;

d) Provincial, state, or city-level Friendship Associations with Vietnam of countries having special partnership, strategic partnership, or comprehensive partnership relations with Vietnam;

đ) Diplomatic missions of foreign countries in Vietnam;

e) Offices and permanent representative offices of international organizations and United Nations system organizations in Vietnam;

g) Foreign non-governmental organizations operating in Vietnam;

h) Other foreign organizations not included in the above categories but with outstanding achievements and meeting the criteria stipulated in Clause 1 Article 53 of the Law on Competition and Rewards recognized and proposed by ministries, sectors, and provinces;

i) Foreign individuals heading agencies and organizations as prescribed in Point a Clause 2 of this Article who have held their positions for at least five consecutive years or have worked in Vietnam for at least one three-year term;

k) Heads of diplomatic missions of foreign countries in Vietnam of countries having special partnership, strategic partnership, or comprehensive partnership relations with Vietnam who have worked in Vietnam for at least one three-year term;

l) Foreign individuals who have been awarded the Medal of Friendship and continue to make positive contributions to building, consolidating, and developing friendly, cooperative, and comprehensive relations with Vietnam over the next five years;

m) Foreign individuals not included in the above categories who meet the criteria stipulated in Point b Clause 1 Article 53 of the Law on Competition and Rewards recognized and proposed by ministries, sectors, and provinces.

AWARDS AND AWARDING CEREMONIES FOR COMPETITION AWARDS, REWARD FORMS

Chapter III

GRANTING AND RECEIVING COMPETITION AWARDS, REWARD FORMS

Article 24. Bestowing Commendation Titles and Honorary Awards

1. The commendation titles and honorary awards prescribed in the Law on Competition and Reward shall be announced, bestowed, and received according to the provisions of this Decree, including:

a) Orders: "Order of Star of the Republic", "Ho Chi Minh Order", "Independence Order", "Military Merit Order", "Labor Order", "National Defense Order", "War Merit Order", "Great Unity Order", "Bravery Order", "Friendship Order";

b) National Honor Titles: "Heroic Province", "Heroic City"; "Mother Heroine of Vietnam"; "People's Armed Forces Hero", "Labor Hero", "People's Teacher", "Outstanding Teacher"; "People's Doctor", "Outstanding Doctor"; "People's Artist", "Outstanding Artist"; "People's Artisan", "Outstanding Artisan";

c) "Ho Chi Minh Prize", "State Prize";

d) Medals: "Victory Banner Medal", "National Security Medal", "Distinguished Soldier Medal", "Friendship Medal"; "Vanguard Youth Medal";

đ) "Prime Minister's Certificate of Merit";

e) "Government Flag of Excellence";

g) "National Model Worker".

2. The bestowal and reception of commendation titles and honorary awards within the jurisdiction of ministries, agencies, provinces shall be carried out according to the provisions of this Decree.

Article 25. Requirements for Bestowing and Receiving Commendation Titles and Honorary Awards

1. The organization of ceremonies for bestowing and receiving commendation titles and honorary awards must have the significance of honoring collectives and individuals, educating patriotic traditions and revolutionary ideals; be linked with patriotic competition movements and the implementation of tasks for economic and social development, national defense, and security at local and national levels; ensure safety, solemnity, economy, effectiveness, without ostentation or formality.

2. Implement civilized customs, preserve cultural values, and ethnic characteristics in ceremonies for bestowing and receiving commendation titles and honorary awards.

3. Do not organize separate ceremonies for bestowing and receiving commendation titles and honorary awards. Only combine them with national major holiday commemorations, founding days, traditional days of ministries, agencies, localities, units, summary conferences according to specific programs and strictly comply with the provisions of this Decree (except for cases of bestowing outstanding and sudden achievements, rewards for wartime merits, and the title "Mother Heroine of Vietnam").

4. Representatives of leadership collectives and households receiving rewards directly receive the commendation titles and honorary awards of their collectives and households. Individuals receiving rewards directly receive their commendation titles and honorary awards. In cases of posthumous bestowal, representatives of the family of the person being posthumously honored receive on their behalf.

5. Bestow commendation titles and honorary awards from higher ranks to lower ranks. In cases of the same honorary award, bestow it to collectives and households first, then to individuals; bestow before posthumous bestowal. If the commendation titles and honorary awards are decided by the same level of authority, bestow the commendation titles first, then the honorary awards; bestow to collectives first, then households and individuals; bestow before posthumous bestowal.

6. During the announcement, bestowal, and reception of commendation titles and honorary awards, those without responsibility shall not present flowers, film, or take photographs on the stage. Do not organize parades or receptions for the bestowal of commendation titles and honorary awards.

Article 26. Rituals for announcing, presenting, and receiving commendation titles and reward forms

1. The person conducting the ceremony shall be a representative of the leadership of the ministry, agency, sector, provincial People's Committee, or the unit organizing the ceremony. The unit hosting the announcement, presentation, and reception of commendation titles and reward forms must develop a script for the ceremony.

2. Announcing the decision to confer commendation titles and reward forms:

a) A representative of the leadership of the agency responsible for commendation and reward work or the unit organizing the announcement ceremony reads out the full text of the commendation decision.

b) Announcing the President’s Reward Decision: Before the announcement, the announcer invites the Traditional Flag Team (if available), representatives from the Party committee, administrative leadership, Vietnam Fatherland Front, Trade Union, Ho Chi Minh Communist Youth Union (or representatives of successive generations of leaders of the rewarded collective) or the individual being rewarded to ascend the stage to hear the announcement of the reward decision.

c) Announcing the Government or Prime Minister’s Reward Decision: After the announcement, the announcer invites representatives of the leadership of the collective or individual named in the reward decision to ascend the stage to receive the commendation title or reward form.

3. Presenting commendation titles and reward forms:

a) The presenter of the commendation title and reward form is the person authorized to decide on the award of the commendation title and reward form, or someone authorized by that person to present the commendation title and reward form, or a representative of higher-level leadership attending the ceremony; the presenter stands at the center of the stage.

b) Presentation follows this order: Attach the Order of Merit (or Medal accompanying the title) first; then present the Certificate and the Heroic Banner (for collectives receiving the Hero title).

c) For collectives with a traditional flag: The presenter attaches the Order of Merit (or Medal accompanying the title) to the upper right corner of the traditional flag. The position of attaching the Order of Merit (or Medal accompanying the title) on the traditional flag is carried out in descending order of rank.

For collectives without a traditional flag: The presenter presents the Certificate already attached with the Order of Merit (or Medal accompanying the title).

d) Presenting to individuals: The presenter attaches the Order of Merit (or Medal, Medal accompanying the title) to the left side of the recipient's chest, then presents the Certificate.

đ) Posthumous presentation: The presenter presents the Certificate already attached with the Order of Merit (or Medal, Medal accompanying the title) to a representative of the family of the posthumously awarded individual.

e) In special cases such as elderly individuals with poor health, disabled individuals, or decisions rewarding multiple recipients, the ceremony host may seek the opinion of the authorized presenter or their delegate or a representative of higher-level leadership attending the ceremony to make a decision.

4. Receiving commendation titles and reward forms:

a) Receiving rewards within the authority of the President: The recipient stands solemnly in a straight line at the center of the stage to listen to the announcement of the reward decision.

b) Receiving commendation titles and reward forms within the authority of the Government or Prime Minister: The recipient is invited to ascend to the center of the stage to receive them.

c) When receiving Certificates (or Banners), the recipient holds the Certificate or Banner high at chest level, maintaining the posture until leaving the stage.

d) If necessary, a representative of the collective (or individual, household) being rewarded may make a statement after receiving the reward.

5. Service personnel for the presentation ritual:

a) Do not turn their back to the audience; stand behind and to the right (dominant hand side) of the presenter when handing over the Order of Merit (or Medal, Medal accompanying the title, Certificate, Banner) to the presenter.

b) Place the Order of Merit (or Medal, Medal accompanying the title, Certificate) in a red-covered tray; the Certificate must be framed; carry the tray, and present the Order of Merit, Certificate, and Banner with both hands to the presenter.

Article 27. Bestowing forms of individual and collective awards for overseas Vietnamese residents; individuals and collectives from foreign countries; foreign agencies, organizations, and international organizations in Vietnam.

The organization of bestowing forms of awards for individuals and collectives of overseas Vietnamese residents; individuals and collectives from foreign countries; foreign agencies, organizations, and international organizations in Vietnam shall be carried out according to the provisions of Article 26 of this Decree and the following regulations:

1. Bestowal ceremonies within the country shall be organized and chaired by the award recommending agency.

2. Bestowal ceremonies outside the country shall be organized and chaired by the head of the Embassy or the head of the diplomatic representative agency of the Socialist Republic of Vietnam abroad authorized to present awards upon the written request of the award recommending agency. The award recommending agency is responsible for transferring the decision, award items, and coordinating with the Embassy or the diplomatic representative agency of the Socialist Republic of Vietnam abroad to ensure solemnity and suitability with actual conditions.

Chapter IV

AUTHORITY TO DECIDE AWARDS AND RECOMMEND AWARDS; AWARD REVIEW FILES AND PROCEDURES

Section 1. AUTHORITY TO DECIDE THE BESTOWAL OF THE "DECISIVE VICTORY UNIT" AND "OUTSTANDING LABOR COLLECTIVE" AWARDS

Article 28. Authority to decide the bestowal of the "Decisive Victory Unit" and "Outstanding Labor Collective" awards in the People's Army and the People's Public Security Force

1. The Minister of National Defense decides or authorizes the decision on bestowing the "Decisive Victory Unit" and "Outstanding Labor Collective" awards in the People's Army.

2. The Minister of Public Security decides or authorizes the decision on bestowing the "Decisive Victory Unit" and "Outstanding Labor Collective" awards in the People's Public Security Force.

Section 2. AUTHORITY TO RECOMMEND AWARDS FOR ENTERPRISES AND OTHER ECONOMIC ORGANIZATIONS

Article 29. Authority to recommend awards for enterprises and other economic organizations

1. The Chairman of the Provincial People's Committee is responsible for awarding and recommending higher-level awards for enterprises and other economic organizations under their management, or for collectives and individuals belonging to such enterprises and organizations not under their management but contributing achievements to the locality outside the main office location, after obtaining the unified opinion of the People's Committee of the province where the enterprise's main office is located and the relevant ministry or sector managing the industry or field of that enterprise or other economic organization.

2. The head of the ministry, department, or sector is responsible for awarding and recommending higher-level awards for enterprises and other economic organizations under their management, or for those not under their management but contributing achievements to the managed field, after obtaining the unified opinion of the People's Committee of the province (if the enterprise is managed by the province) or the ministry managing it (if the enterprise or other economic organization is managed by the ministry).

3. The Chairman of the Provincial People's Committee awards and recommends higher-level awards for industrial zones, economic zones, export processing zones under provincial management. The ministry managing the industry awards and recommends higher-level awards for industrial zones, economic zones, export processing zones under its management.

4. For enterprises, collectives, and individuals in state-owned enterprises:

State-owned Corporations and Companies and joint-stock companies with over 50% state ownership implement the principle that the State Capital Management Corporation or the ministry managing the industry or field awards or recommends higher-level awards for enterprises, collectives, and individuals within their management scope.

The ministry managing the industry or field, the Provincial People's Committee, or the organization entrusted by the Government to perform the rights and responsibilities of the state owner for enterprises awards or recommends higher-level awards for enterprises, collectives, and individuals established or managed by themselves.

Units of enterprises operating and fulfilling obligations in localities where they do not have headquarters are awarded by the enterprise's head within their authority or recommended for higher-level awards.

5. For enterprises, collectives, and individuals in enterprises (including foreign-invested enterprises):

Enterprises, collectives, and individuals operating in the locality where the transaction office is located (including within industrial zones, export processing zones, and outside these zones) are awarded by the enterprise's head or recommended for awards by the Chairman of the Village People's Committee, District People's Committee, or Provincial People's Committee where the transaction office is located or recommended for higher-level awards.

Units of enterprises that operate independently and fulfill obligations in localities where they do not have headquarters, in addition to being awarded by the enterprise's head within their authority, the unit's head also awards within their authority and recommends the Chairman of the District People's Committee or Provincial People's Committee where the unit has headquarters and fulfills obligations to the state for awards or recommends for higher-level awards.

6. For joint-stock enterprises (including those with less than 50% state ownership) in regulated industries, the principle is followed that the ministry or sector managing the regulated industry awards or recommends higher-level awards (except for individuals appointed by other ministries or sectors to represent state ownership, who will be awarded or recommended for higher-level awards by those ministries or sectors).

Mục 3. DOCUMENTS AND PROCEDURES FOR CONSIDERING AWARDS AND RECOGNITIONS FOR COMPETITION AWARDS AND AWARD FORMATS

Article 30. General Provisions on Documents and Procedures for Awards

1. For collectives proposing to be considered for the "Gold Star Order" and the "Ho Chi Minh Order", the Politburo and the Secretariat shall examine and conclude.

2. For individuals proposing to be considered for or posthumously awarded the "Gold Star Order" and the "Ho Chi Minh Order", the Politburo and the Secretariat shall examine and conclude.

For individuals under the management of the Politburo and the Central Committee's Secretariat (including retired cadres and those who have passed away), working in central agencies or local agencies, based on the party member file (or cadre management file if they are not party members) regarding their work history and achievements, the agency responsible for competition and award activities shall cooperate with the Central Organization Department, Provincial Party Committee Organization Departments, Municipal Party Committee Organization Departments, or the Cadre and Civil Servant Organization Departments of central ministries, sectors, and mass organizations to establish files for cases meeting the criteria, report to the Party Committee for examination and confirmation of the work history, forms of awards, and disciplinary measures (if any); on this basis, the Minister, Head of a ministry-level agency, agency under the Government, leaders of central ministries, sectors, agencies, and organizations, Chairmen of provincial People's Committees directly under the Central Government shall submit to the Prime Minister.

3. For individuals under central management, when proposing state-level awards and the title of "National Model Worker", the Central Organization Department, the Central Inspection Commission, and the Party bodies at the central level managing that field shall provide opinions on personnel management matters: work history, position, time holding the position, forms of awards, and disciplinary violations (if any).

4. The Standing Committee of the Provincial Party Committee, Municipal Party Committee, and Central-Level Directly Subordinate Party Committees, the Party Executive Committee, the Party Group, and the leadership collective (where there is no Party Executive Committee or Party Group) of central ministries, sectors, and mass organizations shall examine and provide written opinions before submitting to the Prime Minister:

a) Awards for individuals within their management authority;

b) Competition titles and award formats: "National Model Worker"; "Gold Star Order", "Ho Chi Minh Order", "Independence Order" (all categories), titles of "People's Hero of the Armed Forces", "People's Hero of Labor", "People's Teacher", "People's Doctor", "People's Artist", "National Artisan", "Ho Chi Minh Award", "State Award".

5. The Minister, Head of a ministry-level agency, agency under the Government, President of the Supreme People's Court, Prosecutor of the Supreme People's Procuracy, Director of the Central Party Office, Heads of Party bodies and equivalent bodies at the central level, Chairman of the National Assembly Office, Chairman of the State President's Office, Auditor General, Head of the central-level Vietnam Fatherland Front and other political-social organizations at the central level, political-social-professional organizations having a Party Group or a Party organization under the Central Party Organization of State Agencies, Rectors of national universities, Chairmen of provincial People's Committees shall be responsible for evaluating achievements, confirming achievements, procedures, and contents of documents submitted to the Prime Minister including: documents, procedures, processes, accuracy of achievements, and related contents to the implementation of the Party's guidelines, state policies, and laws.

6. For individuals who have retired and whose units have been dissolved or merged, the unit receiving the tasks of the dissolved or merged unit shall be responsible for considering and proposing awards; for individuals who have retired (or sacrificed, passed away), the cadre management agency before retirement (or sacrifice, passing away) shall consider, complete, and submit the award proposal to the competent authority according to regulations.

In cases where agencies or units have been dissolved, split, or merged, the agency or unit receiving the tasks of the dissolved, split, or merged agency or unit shall be responsible for proposing awards. The award achievements of dissolved, split, or merged agencies or units shall be calculated according to the years or accumulated over the years that such agencies or units achieved to propose awards according to common standards.

7. When examining the titles of "People's Hero of the Armed Forces", "People's Hero of Labor", "National Model Worker", Model Worker of Ministry, Sector, Province, Model Worker at the grassroots level, Flag of Excellence of Ministry, Sector, Province, "Flag of Excellence of the Government", the Competition and Award Council at the level of submission for awards must conduct voting.

For collectives and individuals proposed for awards of the titles of "People's Hero of the Armed Forces", "People's Hero of Labor", "National Model Worker", Model Worker of Ministry, Sector, Province, the agreement rate of the Competition and Award Council of Ministry, Sector, Province must be 90% or more of the total number of Council members (if Council members are absent, their opinions shall be obtained in writing). For the title of "Model Worker at the grassroots level", Flag of Excellence of Ministry, Sector, Province, "Flag of Excellence of the Government", the agreement rate of the Competition and Award Council at the level of submission for awards must be 80% or more of the total number of Council members (if Council members are absent, their opinions shall be obtained in writing and reflected in the Minutes of the assessment meeting for competition titles, Minutes of the award examination).

8. The initiative council and scientific council at all levels shall be established by the head of the agency, organization, or unit. The members of these councils at all levels shall include individuals with expertise in the relevant field related to the content of the initiative, research topic, and other members. These councils have the responsibility to assist the head in recognizing the effectiveness of applying initiatives and their potential for replication; recognizing the effectiveness of applying research topics, scientific projects, and scientific and technological works and their scope of influence to serve as grounds for recommending the awarding of outstanding soldier titles at various levels and recommending forms of commendation according to regulations. Certificates or confirmations from the head of the competent agency or organization regarding the effectiveness of applying initiatives and their potential for replication; recognizing the effectiveness of applying research topics, scientific projects, and scientific and technological works and their scope of influence to serve as grounds for recommending the awarding of outstanding soldier titles at various levels and recommending forms of commendation shall be made in accordance with Model No. 11 attached as Appendix I to this Decree.

9. The time for recommending commendation in the next round shall be calculated based on the period during which achievements were recorded in the previous commendation decision. For decisions that do not specify a time period, the recommendation for commendation in the subsequent round shall be counted from the date of issuance of the previous commendation decision.

10. For individuals (fishermen, ethnic minority people, farmers, workers, vulnerable groups, persons with disabilities), collectives with outstanding achievements in labor, production, and work; dynamic, creative cadres who dare to think, act, and break through for common benefits, discovered by the head of the agency, organization, or unit to commend within their authority or recommend higher-level commendation, the commendation recommendation dossier shall include: A report accompanied by a list of commendation recommendations; a summary report of achievements prepared by the recommending agency, organization, or unit.

11. The achievement reports of individuals, collectives, and households recommended for commendation must be consistent with the form of commendation as prescribed. In the report, specific details such as the number of decisions, date, month, year, or confirmation documents of excellent or good performance issued by the competent authority during the period of commendation achievement (for cases where commendation is recommended based on standards of excellent or good performance); the number of decisions, date, month, year of receiving commendation awards, honors, and forms of commendation (except for simple commendation procedures) must be included. Achievement reports recommending commendation for individuals, collectives, and households, in addition to reflecting achievements meeting the prescribed standards, must also reflect compliance with Party policies and State laws according to the model at Appendix I attached to this Decree.

Achievement reports of individuals, collectives, and households recommended for national commendation awards must be submitted to the Prime Minister six months before the Ministry of Home Affairs presents them. Beyond this deadline, the Ministry of Home Affairs will not accept commendation submission files.

12. Dossiers recommending the awarding of Orders, Medals, National Honorary Titles, "Ho Chi Minh Prize," "State Prize," "Prime Minister's Flag of Excellence," "National Outstanding Soldier," and "Prime Minister's Commendation" shall be submitted to the Prime Minister through the Ministry of Home Affairs. The Ministry of Home Affairs shall submit to the Prime Minister for commendation recommendations. In necessary cases, the Minister of Home Affairs may delegate the Director of the Central Steering Committee for Mobilization and Commendation to sign the report recommending commendation to the Prime Minister and some related documents concerning mobilization and commendation work.

13. Reports from ministries, sectors, provincial authorities, and the Ministry of Home Affairs recommending commendation to the Prime Minister for approval or recommending commendation to the President for approval for individuals, collectives, and households must include the following contents:

a) Legal basis;

b) Content, form, and achievements recommended for commendation;

c) Opinions of related agencies regarding the content for which opinions are sought in cases of commendation recommendations;

d) The Ministry of Home Affairs' assessment opinion on cases of commendation recommendations that are correct in terms of target, conditions, criteria, dossiers, and procedures as prescribed;

Detailed contents of the report recommending commendation shall be implemented in accordance with Model No. 01 attached as Appendix I to this Decree.

14. When submitting to the Prime Minister, ministries, sectors, and provinces shall send the original paper copy of the commendation dossier along with electronic files (Word and PDF) of the dossier to the Ministry of Home Affairs via the "Electronic File Management System for Commendation Dossier of the Mobilization and Commendation Sector," except for documents containing state secrets. The commendation dossier will only be accepted when the Ministry of Home Affairs receives the original paper copy of the dossier and its electronic files in accordance with regulations.

The Ministry of Home Affairs shall send the report recommending commendation accompanied by a list of commendation recommendations and the commendation dossier in electronic file format (Word and PDF) to the Government Office.

15. The Ministry of Home Affairs shall accept dossiers and review them based on the documents and papers contained in the commendation recommendation dossiers established by ministries, sectors, and provinces, including: Procedures, conditions, and criteria as prescribed; and submit to the Prime Minister.

Article 31. Provisions on Soliciting Opinions for Awards

1. Soliciting opinions for awards of commendation titles and State-level award forms prescribed in Clause 3, Article 84 of the Law on Commendation and Rewards and the provisions of the competent authority by ministries, sectors, provincial authorities implementing commendations shall be carried out according to the provisions from Clause 2 to Clause 4 of this Article.

2. For rewarding agencies, organizations, units, and heads of central agencies with legal personality under the direct management of ministries, sectors, mass organizations located within localities, opinions of the People's Committee of the province must be sought regarding the following contents:

a) Compliance with the Party's guidelines, State policies and laws and the results of the operation of the party organization and mass organizations (if the party organization and mass organizations operate at the locality level);

b) Implementation of social insurance for workers and employees; ensuring the environment during production and business operations and labor safety, food safety (for production and business units);

c) Commendation titles and reward forms that require soliciting opinions for awards: "Flag of Government Competition", medals, orders, national honorary titles, "Ho Chi Minh Award", "State Award", "Prime Minister's Certificate of Merit".

3. For rewarding agencies, organizations directly under the People's Committees of provinces and centrally-administered cities and individuals who are heads of the same-level units, opinions of central ministries, sectors, and mass organizations with management functions in the industry and field must be sought regarding the following contents:

a) Results of advising on the implementation of assigned political tasks (for collectives): Leadership and guidance of the agency or unit in implementing assigned political tasks (for individuals) during the period counted towards the achievement being proposed for commendation;

b) Commendation titles and reward forms that require soliciting opinions for awards: "Flag of Government Competition", medals, orders, national honorary titles, "Ho Chi Minh Award", "State Award", "Prime Minister's Certificate of Merit".

4. For external rewards, opinions of the Central Foreign Affairs Board, Ministry of Public Security, and Ministry of Foreign Affairs must be sought.

5. The Ministry of Home Affairs shall seek opinions of the Central Inspection Commission and the Government Inspectorate for rewarding collectives which are ministries, sectors, provincial authorities; seek opinions of the Ministry of Public Security and the Government Inspectorate on compliance with the Party's guidelines, State policies and laws for rewarding economic organizations and individuals who are legal representatives of economic organizations; the procedure for seeking opinions of competent authorities for rewarding cadres under the management of the Politburo and the Secretariat shall be implemented according to the regulations of the Party.

6. Upon receiving a request for opinion on rewarding from ministries, sectors, provincial authorities, or the Ministry of Home Affairs, the authority requested to provide an opinion must respond in writing within 10 working days from the date of receipt of the request (calculated based on the postmark). The head of the authority requested to provide an opinion for rewarding shall be responsible under the law for the time taken to respond to the written request and the content of the opinion sought.

In case the Ministry of Home Affairs seeks opinions but the functional authority does not provide an opinion, the Ministry of Home Affairs shall proceed with the rewarding according to the regulations.

7. Within 10 working days from the date of receiving unified or agreed opinions from functional authorities, the Ministry of Home Affairs shall submit to the competent authority for rewarding according to the regulations.

Article 32. Provisions on the time for receiving files, reviewing, and announcing the results of review and commendation outcomes

1. The time for the Ministry of Home Affairs to receive files proposing commendations shall be as follows:

a) Files submitted by ministries, sectors, provincial-level authorities to the Prime Minister for consideration of awarding the title "National Labor Medal" must be sent to the Ministry of Home Affairs no later than December 31 of the preceding year.

b) Files submitted by ministries, sectors, provincial-level authorities to the Prime Minister for consideration of awarding the "Prime Minister's Flag of Excellence" must be sent to the Ministry of Home Affairs no later than June 30 each year. For the national education system, files must be submitted no later than December 31 each year.

The time for submitting files for the awarding of the "Prime Minister's Flag of Excellence," medals, and the "Prime Minister's Commendation Certificate" to outstanding collectives leading the Prime Minister's campaign for excellence shall be carried out according to the guidelines of the Ministry of Home Affairs.

2. The time for the Ministry of Home Affairs to review commendation files and submit them to the Prime Minister within twenty working days from the date of receipt of complete files as prescribed. The examination of files proposing the awarding or posthumous awarding of titles of Hero, and the awarding of the title "National Labor Medal" shall be implemented in accordance with point b, Clause 4, Article 47 of this Decree and the Regulations on the Operation of the Central Steering Committee for Mobilization and Reward.

3. Time for reviewing proposals for awarding commendation titles and forms at ministries, sectors, provincial-level authorities:

For commendation titles and forms of reward within the authority to decide of ministries, sectors, provincial-level authorities, and reward agencies, they shall review reward files and submit them to the competent authority within twenty-five working days from the date of receipt of complete files as prescribed (except for immediate rewards).

Proposals for awarding commendation titles and forms of reward based on national achievements shall be examined and submitted to the Prime Minister within thirty working days (forty working days for forms of reward: "Independence Order," "Ho Chi Minh Order," "Golden Star Order"; titles of Hero, "Mother Vietnam Heroine") from the date of receipt of complete files as prescribed by ministries, sectors, and provincial-level authorities.

4. Time for reviewing files proposing awarding commendation titles and forms of reward at commune level, district level under provincial-level cities, and at agencies, organizations, units under ministries, sectors, and provincial-level authorities:

For commendation titles and forms of reward within the authority to decide of commune level, district level, and agencies, organizations, units under ministries, sectors, and provincial-level authorities, reward agencies shall review reward files and submit them to the competent authority within twenty working days from the date of receipt of complete files as prescribed (except for immediate rewards).

5. Time for announcing the results of reviews and commendation outcomes:

a) In cases meeting the conditions and criteria for commendation as prescribed, the Ministry of Home Affairs shall implement the submission of commendation to the competent authority. If the review result of the Ministry of Home Affairs differs from the proposal of ministries, sectors, and provincial-level authorities, the Ministry of Home Affairs must reach consensus with these entities before submitting to the Prime Minister for consideration and decision;

b) In cases not meeting the conditions and criteria, within five working days, the Ministry of Home Affairs shall notify in writing the return of the commendation proposal file to ministries, sectors, and provincial-level authorities for commendation;

c) In cases where the Ministry of Home Affairs has submitted to the Prime Minister for a commendation decision or submitted to the Prime Minister for a proposal to the President for a commendation decision but the Prime Minister does not make a commendation decision or does not propose to the President for a commendation decision or the Prime Minister proposes commendation to the President but the President does not commend, then within ten working days from the date of receipt of notification from the Government Office or the President's Office about non-commendation, the Ministry of Home Affairs shall notify the outcome of the commendation proposal file to ministries, sectors, and provincial-level authorities;

d) In cases where commendation is made by the President, after receiving the commendation decision of the President, within ten working days, the Ministry of Home Affairs shall copy and send the decision to ministries, sectors, and provincial-level authorities;

đ) After receiving the commendation decision of the President or the Prime Minister, within ten working days, the Ministry of Home Affairs shall issue physical commendation items to ministries, sectors, and provincial-level authorities for commendation.

Article 33. Documents and Procedures for Awarding the Title "National Model Combatant"

1. The Ministry of Home Affairs shall examine the documents, report to the Standing Committee of the Central Steering Committee on Mobilization and Reward, seek opinions from relevant agencies as prescribed, and based on conditions and criteria, submit to the Prime Minister for consideration and decision to award the title "National Model Combatant".

2. The documents submitted to the Prime Minister consist of one set (original copy), including:

a) A proposal from a ministry, agency, or province;

b) A report on achievements of the individual proposed for the title "National Model Combatant", confirmed by the level submitting to the Prime Minister;

c) Minutes of meetings and voting results of the Steering Committee on Mobilization and Reward at the ministry, agency, or provincial level;

d) Certificates or confirmations from the head of the ministry, agency, or province regarding innovative initiatives effectively applied and replicable nationwide or scientific research topics, scientific projects, scientific and technological works that have been accepted and effectively implemented with national impact; certificates or confirmations from the Minister of National Defense and the Minister of Public Security regarding intelligence and creativity in combat or support operations with national impact;

đ) Related documents as stipulated in Article 30 of this Decree (if applicable).

3. The documents submitted by the Ministry of Home Affairs to the Prime Minister include: A proposal from the Ministry of Home Affairs accompanied by a list of recommended awards and electronic files of the award documents.

Article 34. Documents for Proposing to Award Titles of Model Combatant at the Ministry, Agency, Provincial Level, "Model Combatant at the Grassroots Level", and Other Commendation Titles

1. The titles of Flag of Excellence at the Ministry, Agency, Provincial Level, Model Combatant at the Ministry, Agency, Provincial Level, "Model Combatant at the Grassroots Level", "Advanced Worker", "Advanced Combatant", "Outstanding Labor Collective", "Decisive Victory Unit", "Advanced Labor Collective", and "Advanced Unit" are awarded annually. The procedures for proposing these commendation titles are carried out according to the provisions of Clause 1 of Article 84 of the Law on Mobilization and Reward.

2. The documents for proposing to award commendation titles include:

a) A proposal for awarding a commendation title;

b) The report on achievements of individuals and groups;

c) Minutes of the assessment meeting of the Steering Committee on Mobilization and Reward at the level recommending the award or Minutes of the assessment meeting and voting results of the Steering Committee on Mobilization and Reward at the level recommending the award in cases of proposing the commendation titles "Model Combatant at the Grassroots Level", Model Combatant at the Ministry, Agency, Provincial Level, and Flag of Excellence at the Ministry, Agency, Provincial Level;

d) Certificates or confirmations from competent authorities regarding innovative initiatives or scientific research topics, scientific projects, scientific and technological works or outstanding completion of tasks or intelligence and creativity in combat or support operations in cases of proposing the title "Model Combatant at the Grassroots Level"; Certificates or confirmations from the head of the ministry, agency, or province regarding innovative initiatives effectively applied and replicable within the ministry, agency, or province or scientific research topics, scientific projects, scientific and technological works that have been accepted and effectively implemented with impact within the ministry, agency, or province or intelligence and creativity in combat or support operations with impact throughout the entire military force or the entire People's Public Security force in cases of proposing the title Model Combatant at the Ministry, Agency, Provincial Level.

3. Proposals to award Flags of Excellence to leading collectives in thematic mobilization campaigns initiated by ministries, agencies, or provinces, which have been implemented for three years or more, shall be conducted according to the guidelines of the ministries, agencies, or provinces when summarizing the campaign.

Article 35. Documents and Procedures for Awarding the "Prime Minister's Flag"

1. The Government delegates to the Prime Minister the authority to examine and decide on awarding the "Prime Minister's Flag". The Ministry of Home Affairs will review the documents, procedures, and achievements before submitting them to the Prime Minister.

2. The application documents for the Prime Minister to consider awarding the "Prime Minister's Flag" consist of 01 set (original copy) including:

a) A proposal from a ministry, agency, or province;

b) A report on the achievements of the collective being proposed for the "Prime Minister's Flag", confirmed by the level submitting to the Prime Minister;

c) Minutes of the assessment meeting and voting results of the Competition and Reward Council of the ministry, department, agency, or province;

d) Related documents as stipulated in Article 30 of this Decree (if applicable).

3. Proposals for awarding the "Prime Minister's Flag" to leading collectives in Competition Clusters or Groups shall be carried out according to the guidelines of the Central Competition and Reward Council.

4. The documents submitted by the Ministry of Home Affairs to the Prime Minister include: the proposal from the Ministry of Home Affairs along with the list of proposed rewards and electronic files of the reward documents.

Article 36. Documents and Procedures for Awarding or Posthumously Awarding Various Orders (except the Friendship Order)

1. The Ministry of Home Affairs will review the documents and submit them to the Prime Minister for examination and then to the President for decision.

2. The process of awarding or posthumously awarding the "Golden Star Order" and the "Ho Chi Minh Order" shall be implemented based on the opinions of the Politburo regarding the awarding of high-level Orders.

3. Application documents for awarding or posthumously awarding various Orders, each type consisting of 01 set (original copy) including:

a) A proposal from a ministry, agency, or province;

b) A report on the achievements of the cases proposed for commendation, confirmed by the level submitting to the Prime Minister;

c) Minutes of the commendation assessment of the Competition and Reward Council of the ministry, department, agency, or province;

d) In cases where individuals or collectives are proposed for commendation due to outstanding and exceptional achievements in labor, work, production, business, study, scientific research, or other fields; significant contributions to economic and social development, ensuring social welfare, humanitarian activities; inventions, innovations, applications of scientific and technological progress, or scientific and technological works and projects, there must be certification or confirmation by competent authorities regarding the achievements proposed for commendation;

đ) Related documents as stipulated in Article 30 of this Decree (if applicable).

4. Application documents for rewarding foreign individuals or collectives and overseas Vietnamese individuals or collectives consist of 01 set (original copy) including: the proposal from the ministry, department, agency, or province; a summary report on individual or collective achievements conducted by the proposing agency, and a document confirming the fulfillment of obligations to the Vietnamese State as required by law (if applicable).

5. The documents submitted by the Ministry of Home Affairs to the Prime Minister include: the proposal from the Ministry of Home Affairs along with the list of proposed rewards and electronic files of the reward documents (excluding documents containing state secrets).

Article 37. Procedures for Awarding or Posthumously Awarding the "National Solidarity Order"

1. The "National Solidarity Order" is awarded annually on National Day, September 2nd, and on the day marking the establishment of the National Front for the Liberation of Vietnam, November 18th.

2. The Provincial Vietnam Fatherland Front is responsible for examining and recommending individuals who meet the criteria, which are reviewed by the Provincial Competition and Reward Council; for central ministries, departments, agencies, and mass organizations, the Competition and Reward Council of the ministry, department, agency, or central political-social organization reviews. The Chairperson of the People's Committee of the province or centrally-administered city, the Minister, Head of the department, or leader of the central agency of political-social organizations shall submit to the Prime Minister.

The Ministry of Home Affairs will review and seek the opinion of the Central Vietnam Fatherland Front before submitting to the Prime Minister.

Article 38. Documents and procedures for awarding or posthumously awarding various types of Medals (except Friendship Medal)

1. The application dossier for awarding or posthumously awarding Medals consists of 01 set (original copy) including:

a) A proposal from a ministry, agency, or province;

b) A list of the cases proposed for Medal awards.

2. The dossier submitted by the Ministry of Home Affairs to the Prime Minister includes: The Ministry of Home Affairs's report along with the list of proposed awards and electronic files of the award dossier.

Article 39. Dossier for awarding Commemorative Medals by the Standing Committee of the National Assembly; Commemorative Medals by ministries, agencies, sectors, provinces, political organizations, political-social organizations, political-social-professional organizations, social organizations, social-professional organizations having party groups or party organizations under the Party Central Committee’s Agencies Sector

The application dossier for awarding Commemorative Medals includes:

1. A proposal report for awarding Commemorative Medals.

2. A list of the cases proposed for Commemorative Medal awards, summarizing achievements.

Article 40. Awards through simplified procedures

1. Cases of commendation examination through simplified procedures shall be carried out in accordance with the provisions of Article 85 of the Law on Competition and Commendation.

2. The application dossier for commendation through simplified procedures consists of 01 set (original copy), including:

a) A proposal for commendation;

b) A summary report on the achievements of individuals, groups who have achieved outstanding results or directly managing agencies, organizations, units, clearly stating actions, achievements, merits, work process or summarizing achievement results for awards with top-secret content to propose awards through simplified procedures.

3. Heads of ministries, agencies, sectors, provinces; heads of awarding agencies and proposing awards immediately after individuals, groups achieve outstanding, unexpected results as stipulated in point b, Clause 1, Article 85 of the Law on Competition and Rewards.

4. The time for reviewing and submitting awards for cases proposed for awards as stipulated in points a, c, d, đ, Clause 1, Article 85 of the Law on Competition and Rewards shall be carried out in accordance with Article 32 of this Decree.

5. The documents submitted by the Ministry of Home Affairs to the Prime Minister include: the proposal from the Ministry of Home Affairs along with the list of proposed rewards and electronic files of the reward documents (excluding documents containing state secrets).

Article 41. Dossiers and procedures for awarding or posthumously awarding titles "Heroic Province", "Heroic City", "People's Armed Forces Hero", "Labor Hero"

1. Based on the proposals of ministries, agencies, sectors, provinces, the Ministry of Home Affairs reviews the dossiers and solicits opinions from relevant competent authorities, based on conditions, criteria, and opinions of the Central Steering Committee for Competition and Rewards, the Ministry of Home Affairs submits to the Prime Minister.

2. The dossier for awarding or posthumously awarding Hero titles consists of 01 set (original copy) including:

a) A proposal from a ministry, agency, or province;

b) Achievement reports of the collective or individual proposed for Hero title awards, confirmed by the level submitting to the Prime Minister;

c) Minutes of meetings and voting results of the Steering Committee on Mobilization and Reward at the ministry, agency, or provincial level;

d) Related documents as stipulated in Article 30 of this Decree (if applicable).

3. The dossier submitted by the Ministry of Home Affairs to the Prime Minister includes: The Ministry of Home Affairs's report along with the list of proposed awards and electronic files of the award dossier (excluding award dossiers containing state secrets).

Article 42. Dossiers and procedures for awarding or posthumously awarding "Prime Minister's Certificate of Merit"

1. The dossier for awarding or posthumously awarding "Prime Minister's Certificate of Merit" consists of 01 set (original copy) including:

a) A proposal from a ministry, agency, or province;

b) A report on the achievements of the cases proposed for commendation, confirmed by the level submitting to the Prime Minister;

c) Minutes of the commendation assessment of the Competition and Reward Council of the ministry, department, agency, or province;

d) In cases where individuals or groups are proposed for awards due to achieving outstanding results with impact within ministries, agencies, sectors, provinces or regional awards, contributing to national socio-economic development, applying scientific and technological progress, social work, humanitarian activities, there must be certification or confirmation from competent authorities regarding the achievements proposed for awards;

đ) Related documents as stipulated in Article 30 of this Decree (if applicable).

2. The dossier for awarding individuals or groups from foreign countries and overseas Vietnamese citizens consists of 01 set (original copy) including: The proposal report of ministries, agencies, sectors, provinces; a summary report on the achievements of individuals or groups prepared by the awarding agency and a confirmation document from the competent authority regarding the obligations to be fulfilled towards the Socialist Republic of Vietnam as prescribed by law (if applicable).

3. The dossier submitted by the Ministry of Home Affairs to the Prime Minister includes: The Ministry of Home Affairs's report along with the list of proposed awards and electronic files of the award dossier (excluding award dossiers containing state secrets).

Article 43. Documents and procedures for awarding or posthumously awarding Certificates of Merit by ministries, agencies, provincial authorities; presenting Commendation Letters

1. The documents for proposing to award or posthumously award Certificates of Merit by ministries, agencies, provincial authorities; presenting Commendation Letters include:

a) A proposal for commendation;

b) Reports on achievements of the cases proposed for commendation, confirmed by the commendation-proposing level;

c) Minutes of the commendation examination by the Competition and Reward Council at the commendation-proposing level;

d) In cases where individuals or groups are proposed for Certificates of Merit by ministries, agencies, provincial authorities due to outstanding or sudden outstanding achievements with significant impact within their respective fields of management or contributions to national economic and social development, application of scientific and technological progress, social work, charity, humanitarianism, there must be certification or confirmation from competent authorities regarding the achievements proposed for commendation.

2. The number of documents for proposing to award or posthumously award Certificates of Merit by ministries, agencies, provincial authorities; presenting Commendation Letters shall be implemented according to the regulations of ministries, agencies, provincial authorities.

Article 44. Procedures for proposing to award Orders, Medals, titles, awards of Vietnam for Vietnamese individuals and groups residing abroad; foreign individuals and groups; documents, procedures, responsibilities of Vietnamese individuals and organizations when receiving Orders, Medals, titles, awards granted by foreign countries and international organizations

1. Procedures for proposing to award Orders, Medals, titles, awards of Vietnam for Vietnamese individuals and groups residing abroad; foreign individuals and groups; procedures and documents for receiving Orders, Medals, titles, awards granted by foreign countries and international organizations shall be carried out according to the Party's regulations on unified management of external activities and the provisions of this Decree.

Soliciting opinions on foreign commendations shall be conducted in accordance with Clause 4, Article 31 of this Decree.

2. Vietnamese individuals and organizations when receiving forms of commendation from foreign individuals and organizations, in addition to implementing the provisions of Clause 1, Article 14 of the Law on Competition and Reward, also have the responsibility to use the awarded items in accordance with the customs and morals of the Vietnamese people, Vietnamese societal ethics, not to use the awarded commendation form to negatively influence or affect the political and social system of Vietnam, nor to promote anti-state propaganda.

Section 4. RECOGNITION OF THE LEVEL OF TASK COMPLETION BY INDIVIDUALS AND GROUPS; PUBLICIZING INDIVIDUALS AND GROUPS PROPOSED FOR COMMENDATION

Article 45. Recognition of the level of task completion by individuals and groups

1. The recognition of the level of task completion for individuals shall be carried out in accordance with the Civil Servants Law, the Public Servants Law, and related regulations.

2. The recognition of the level of outstanding task completion for groups shall be carried out in accordance with the Party's regulations on annual self-examination and quality assessment of groups and individuals in the political system and the regulations of ministries, agencies, provincial authorities.

Article 46. Publicizing individuals and groups proposed for commendation

1. The Ministry of Home Affairs solicits public opinion on the title "National Model Worker" through the Central Competition and Reward Board's Electronic Information Portal, the Ministry of Home Affairs' Electronic Information Portal; solicits public opinion on the titles "People's Armed Forces Hero", "Labor Hero" through the Central Competition and Reward Board's Electronic Information Portal, the Ministry of Home Affairs' Electronic Information Portal, the Government's Electronic Information Portal, the People's Army Newspaper, the Labor Newspaper within ten working days (except in cases of commendation for particularly outstanding sudden achievements).

2. Individuals with authority to propose for awarding commendation forms of Orders and state honor titles as stipulated in Clause 5, Article 84 of the Law on Competition and Reward have the responsibility to publicly announce the list of individuals and groups on media channels under ministries, agencies, provincial authorities (Newspapers, Electronic Information Portals, Radio and Television Stations...) at least ten working days before convening the Competition and Reward Council meeting of ministries, agencies, provincial authorities (except in cases of simple commendation procedures). The results of soliciting public opinion through media channels and handling information (including complaints and denunciations if any) must be reported in writing to the Competition and Reward Council of ministries, agencies, provincial authorities before submitting to higher levels for commendation and must be noted in the Minutes of the Competition and Reward Council of ministries, agencies, provincial authorities.

Chapter V

ORGANIZATION AND ACTIVITIES OF COMPETITION AND REWARD COUNCILS AT ALL LEVELS

Article 47. Central Council for Competitions and Awards

1. The Central Council for Competitions and Awards is an advisory body to the Party and State on competition and award work, with duties and powers as prescribed in Clause 3 of Article 90 of the Law on Competitions and Awards.

2. The composition of the Central Council for Competitions and Awards includes:

a) The Chairman of the Council is the Prime Minister;

b) The Vice Chairmen of the Council include: the First Deputy Chairman being the Deputy President; the Permanent Vice Chairman being the Minister of Home Affairs; the Vice Chairmen of the Council being the Chairman of the Vietnam Fatherland Front Central Committee, the Deputy Chairman of the National Assembly, and the Chairman of the Vietnam General Confederation of Labor;

c) Members of the Council.

3. The Chairman of the Central Council for Competitions and Awards decides on the composition, number, duties, and powers of the Chairman, Vice Chairmen, Standing Members of the Council, the Standing Council, Council members, and the permanent office assisting the Council; promulgates the operational regulations of the Council.

4. Activities of the Central Council for Competitions and Awards:

a) The Council operates under the principle of centralization, democracy, majority voting, and all opinions of Council members regarding proposals on policies on competitions and awards are reported to the Prime Minister and the Chairman of the Council for consideration and decision;

b) The Council convenes regularly every six months to evaluate its work, compile the situation of competition movements and award work nationwide, deploy tasks for the next six months, and provide opinions on necessary issues. The Council may convene extraordinary meetings convened by the Chairman of the Council.

The Chairman chairs the meeting or authorizes the First Vice Chairman of the Council to chair the session.

The Council convenes when at least two-thirds of the total number of members are present. For sessions involving the consideration of proposals to confer or posthumously confer the title of Hero, at least ninety percent of the total number of Council members must be present. Proposals to confer the title of Hero must receive at least ninety percent approval from the members of the Council (if a member is absent, their opinion is obtained in writing).

The Standing Council convenes regularly every three months. The First Vice Chairman and Permanent Vice Chairman of the Council continuously review and inspect the progress of implementing Council tasks; the Standing Council is responsible for advising and providing opinions on conferring the title of "National Model Worker" based on the proposal of the permanent office assisting the Council. Proposals to confer the title of "National Model Worker" must receive at least ninety percent approval from the members of the Standing Council (if a member is absent, their opinion is obtained in writing);

c) Establishing, guiding the organization and operation of competition clusters and groups organized by the Central Council for Competitions and Awards;

d) The Council monitors, urges, and supervises the implementation of competition and award work and competition movements in ministries, sectors, and provinces;

đ) The working relationship between the Central Council for Competitions and Awards and the Councils for Competitions and Awards at the ministry, sector, and provincial levels is a directive and cooperative relationship. Based on the functions and responsibilities of the Central Council for Competitions and Awards, Councils for Competitions and Awards at all levels and sectors have the responsibility to cooperate in implementation.

5. The Ministry of Home Affairs is the permanent office of the Central Council for Competitions and Awards.

Article 48. The Ministry-level Commendation Council

1. The Ministry-level Commendation Council is an agency established by the head of the ministry, department, central mass organization, responsible for advising and consulting the Minister, Head of an equivalent ministry-level agency, agency under the Government, head of department, central mass organization on matters related to commendation and reward work.

2. Composition of the Board includes:

a) The Chairman of the Council is the Minister, Head of an equivalent ministry-level agency, agency under the Government, head of department, central mass organization;

b) The Council shall have no more than four Vice Chairmen. The head of the unit responsible for commendation and reward work at the ministry level shall be the permanent Vice Chairman. The Chairman decides the structure and membership of the Council's members; promulgates the operational regulations of the Council.

The membership of the commendation and reward Council of the Ministry of National Defense and the Ministry of Public Security shall be decided by the Minister of National Defense and the Minister of Public Security respectively.

3. The Council has the following tasks and powers:

a) Advising the Minister, Head of an equivalent ministry-level agency, agency under the Government, head of department, central mass organization to launch commendation movements within their authority;

b) Regularly evaluating the results of commendation movements and reward work; advising on the mid-term and final reviews of commendation and reward work; proposing initiatives and measures to promote patriotic commendation movements each year and during each phase; organizing commendation activities in accordance with the law on commendation and reward;

c) Advising the Minister, Head of an equivalent ministry-level agency, agency under the Government, head of department, central mass organization to inspect commendation movements and implement policies and laws on commendation and reward;

d) Advising and consulting the Minister, Head of an equivalent ministry-level agency, agency under the Government, head of department, central mass organization to decide on commendation titles and reward forms within their authority or to submit to the competent authority for rewards.

4. The unit responsible for commendation and reward work of the ministry, department, central mass organization is the permanent body of the Ministry-level Commendation Council.

5. The head of the agency, organization, entity with legal personality at the ministry level is responsible for establishing, defining functions, tasks, powers, composition, organization, and operation of the Commendation Council of their agency, organization, entity to advise and consult on commendation and reward work within their management scope.

Article 49. The Provincial-level Commendation Council

1. The Provincial-level Commendation Council is an agency established by the Chairman of the People's Committee of the province, responsible for advising and consulting the provincial Party committee and administration on local commendation and reward work.

2. Composition of the Board includes:

a) The Chairman of the Council is the Chairman of the People's Committee of the province;

b) The Council shall have no more than four Vice Chairmen. The Director of the Department of Home Affairs serves as the permanent Vice Chairman. The Chairman decides the structure and membership of the Council's members; promulgates the operational regulations of the Council.

3. The Council has the following tasks and powers:

a) Advising the Chairman of the People's Committee of the province to launch commendation movements within their authority;

b) Regularly evaluating the results of commendation movements and reward work; advising on the mid-term and final reviews of commendation and reward work; proposing initiatives and measures to promote patriotic commendation movements each year and during each phase; organizing commendation activities in accordance with the law on commendation and reward;

c) Advising the Chairman of the People's Committee of the province to inspect commendation movements and implement policies, laws on commendation and reward;

d) Advising and consulting the Chairman of the People's Committee of the province to decide on awarding commendation titles and reward forms within their authority or to submit to the competent authority for rewards.

4. The Department of Home Affairs' Office (Department) for Commendation and Reward of the province, centrally-administered city is the permanent body of the Provincial-level Commendation Council.

5. The head of the People's Committee of the district, department, agency under the province, and units with legal personality directly under the province; the head of the People's Committee of the commune, head of agencies, organizations, units, legal representative of enterprises, other economic organizations is responsible for establishing, defining functions, tasks, powers, composition, organization, and operation of the Commendation Council of their level to advise and consult on implementing commendation and reward work within their management scope.

Chapter VI

FUND FOR COMPETITION AND REWARD

Mục 1. ESTABLISHMENT, MANAGEMENT AND USE OF THE COMPETITION AND REWARD FUNDS

Article 50. Establishment of competition and reward funds

1. The competition and reward funds of ministries, agencies at the ministerial level, government agencies, the Supreme People's Court, the Supreme People's Procuracy, the Central Party Office, central Party Committees and equivalent bodies; the National Assembly Office; the President's Office; the State Audit Agency shall be established:

a) From the state budget with a maximum of 20% of the total salary fund according to rank and grade of officials, civil servants, public employees within the establishment and approved annual wages, and from contributions of individuals and organizations both domestically and internationally;

b) From the state budget for spending on awarding national honorary titles and "Ho Chi Minh Award", "State Award", which shall be allocated to ministries, sectors responsible for organizing the awarding process in each round.

2. The competition and reward funds of public service units directly under ministries, agencies at the ministerial level, government agencies, central committees, sectors, mass organizations that self-finance less than 70% of regular expenses shall be established from the state budget annually with a maximum of 20% of the total salary fund according to rank and grade of public employees within the establishment and approved annual wages, and from contributions of individuals and organizations both domestically and internationally; Competition and reward funds of public service units directly under ministries, agencies at the ministerial level, government agencies, central committees, sectors, mass organizations that self-finance from 70% to less than 100% of regular expenses shall be implemented in accordance with the provisions of the law.

3. The competition and reward funds of provincial, district, and commune levels shall be established from the state budget annually within the total regular budget expenditure for each level of budget in provinces and cities and shall be allocated at the beginning of the year according to the following ratio:

a) The competition and reward funds of provincial departments, agencies, public service units guaranteed regular funding or partially guaranteed regular funding by the state shall be established from the state budget annually with a maximum of 20% of the total salary fund according to rank and grade of officials, civil servants, public employees within the establishment and approved annual wages, and from contributions of individuals and organizations both domestically and internationally;

b) The competition and reward funds of provincial, district, and commune levels shall be established from the state budget annually with a maximum of 1.0% of regular budget expenditure for each level of budget in plains provinces and centrally-administered cities, and a maximum of 1.5% of regular budget expenditure for each level of budget in mountainous, midland, Central Highlands, remote, border areas, and island regions, and from contributions of individuals and organizations both domestically and internationally. For units that are no longer budget levels but perform budgetary unit tasks, they shall be allocated by centrally-administered cities.

4. The competition and reward funds of political organizations, the Vietnam Fatherland Front Central Committee, and political-social organizations shall be provided from the state budget (based on the nature of activities of each organization, the Ministry of Finance will unify the annual allocation ratio) and from contributions of individuals and organizations both domestically and internationally.

5. The competition and reward funds of political-social-professional organizations, social and professional organizations, public service units that self-finance regular expenses or partially finance regular expenses and investment costs shall be decided by these organizations from their own financial capacity and from contributions of individuals and organizations both domestically and internationally.

6. State-owned enterprises may use the reward and welfare fund established in accordance with the laws on management and use of state capital invested in production and business operations, labor laws, wages, remuneration, and bonuses for companies with controlling state shares to fund competition and reward activities as stipulated by the laws on competition and rewards.

7. The establishment, management, and use of competition and reward funds of foreign-invested enterprises, enterprises belonging to various economic sectors (except state-owned enterprises specified in Clause 6 of this Article) shall be decided by the enterprises themselves, who bear full responsibility after fulfilling all obligations prescribed by the state.

8. The competition and reward funds of agricultural, forestry, fishery cooperatives, small-scale industrial cooperatives, transport cooperatives, construction cooperatives, fishing cooperatives, salt-making cooperatives, and other fields shall be extracted from the undivided cooperative fund (the extraction rate is determined by the cooperative) and from contributions of individuals and organizations both domestically and internationally.

9. The competition and reward funds of private and privately-run educational institutions shall be decided by themselves, bearing full responsibility after fulfilling all obligations prescribed by the state.

Article 51. Management of the Competition and Reward Fund

1. The Competition and Reward Fund at each level shall be decided upon and managed by the head of the agency at that level. For provincial level, the funds for competition and reward activities shall be managed and utilized by the agency responsible for advising on such activities in coordination with the provincial financial department based on the budget estimate, and the settlement shall be based on actual expenditures in accordance with established regulations.

2. The person making the decision to award rewards as stipulated in Clause 4, Article 11 of the Law on Competition and Rewards shall be responsible for disbursing prize money to collectives and individuals under their own management and accounting for the expenditure according to regulations.

Collectives and individuals at the ministry, sector, and provincial levels who are awarded rewards by the Prime Minister, President of the State shall have the responsibility to disburse the rewards from their own state budget and account for it separately.

Ministries and sectors assigned the main task of organizing the granting of national honorary titles and "Ho Chi Minh Award," "State Award" shall be responsible for disbursing prize money to rewarded individuals and accounting for it separately.

Article 52. Utilization of the Competition and Reward Fund

1. The Competition and Reward Fund shall be used to cover expenses for implementing competition and reward activities:

a) Prize money for competition honors and reward forms for achievements in building and defending the country (excluding the title of Heroic Mother Vietnam); costs for printing, producing reward items or commemorative gifts for individuals, groups, and households. Twenty percent of the total Competition and Reward Fund at each level shall be allocated to organize the promotion, implementation, supervision, interim review, and final assessment of competition movements; propaganda, dissemination of exemplary models, learning and exchange of experiences in competition and reward activities; inspection of competition and reward work by the Competition and Reward Council; meetings to confer competition honors and reward forms; and implementation of legal provisions on competition and reward work. Specific expenditure levels shall be implemented according to guidelines issued by the Ministry of Finance;

b) Expenses for organizing the granting of national honorary titles and "Ho Chi Minh Award," "State Award," which shall be independently accounted for during each grant cycle according to legal provisions.

2. The Ministry of Home Affairs shall allocate funds from the annual state budget for printing and purchasing reward items to accompany competition honors and reward forms decided by the President, Government, and Prime Minister.

3. Individuals, groups, and households receiving awards, in addition to being granted competition honors, Competition Flags, national honorary titles, "Ho Chi Minh Award," "State Award"; awarded or posthumously awarded Orders, Medals, Certificates of Merit, Commemorative Plaques, Letters of Commendation accompanied by reward items, shall also receive monetary rewards or commemorative gifts of equivalent value as stipulated in Articles 54, 55, 56, 57, 58, and 59 of this Decree.

4. Vietnamese individuals and groups residing abroad; foreign individuals and groups; foreign agencies and organizations, and international organizations in Vietnam who are awarded shall receive reward items and accompanying commemorative gifts of equivalent value as stipulated in Articles 54, 55, 56, 57, 58, and 59 of this Decree.

5. The amount of monetary reward for certificates of merit issued by political organizations and political-social organizations at the provincial level shall be determined by the central agencies of these organizations, ensuring parity with the amounts specified for competition honors and reward forms in this Decree.

Section 2. AMOUNT OF CASH AWARDS

Article 53. Principles for Calculating Cash Awards

1. The cash award for individuals, groups, and households receiving commendations shall be calculated based on the basic salary level prescribed by the Government that is currently in effect at the time of issuing the decision recognizing the title of excellence or the form of commendation.

2. After multiplying the cash award with the basic salary level, the amount shall be rounded up to the nearest ten thousand Vietnamese dong.

3. Higher titles of excellence or forms of commendation will have higher cash awards.

4. Within the same form of commendation and the same level of commendation, the cash award for groups shall be higher than that for individuals.

5. At the same time, if an individual achieves multiple titles of excellence at different times, they shall receive the corresponding cash awards for each title.

6. At the same time, if an individual receives multiple forms of commendation at different times with varying achievements, they shall receive the corresponding cash awards for each form of commendation.

7. At the same time, if an individual is recognized with a title of excellence and also receives a form of commendation, they shall receive the cash award for the title of excellence and the cash award for the form of commendation.

8. In cases where salary reform policies are implemented, the Government shall stipulate the budget for excellence and commendation activities and the cash awards for various titles of excellence and forms of commendation given to individuals, groups, and households.

Article 54. Amount of Cash Awards for Titles of Excellence

1. For individuals:

a) The title "National Model Worker" shall be awarded a Certificate of Recognition, frame, Medal, medal case, and a cash award of 4.5 times the basic salary level;

b) The title "Model Worker of Ministries, Agencies, and Provinces" shall be awarded a Certificate of Recognition, frame, Medal, medal case, and a cash award of 3.0 times the basic salary level;

c) The title "Local Model Worker" shall be awarded a Certificate of Recognition, frame, and a cash award of 1.0 times the basic salary level;

d) The title "Advanced Worker," "Advanced Soldier" shall be awarded a cash award of 0.3 times the basic salary level.

2. For groups:

a) The title "Outstanding Labor Collective," "Victory Unit" shall be awarded a Certificate of Recognition, frame, and a cash award of 1.5 times the basic salary level;

b) The title "Advanced Labor Collective," "Advanced Unit" shall be awarded a cash award of 0.8 times the basic salary level;

c) The title "Outstanding Commune, Ward, Town" shall be awarded a Certificate of Recognition, frame, and a cash award of 2.0 times the basic salary level;

d) The title "Cultural Village, Neighborhood" shall be awarded a Certificate of Recognition, frame, and a cash award of 1.5 times the basic salary level;

đ) The title "Prime Minister's Flag of Excellence" shall be awarded a flag and a cash award of 12.0 times the basic salary level;

e) The title "Flag of Excellence of Ministries, Agencies, and Provinces" shall be awarded a flag and a cash award of 8.0 times the basic salary level;

g) The title "Flag of Excellence of Military Regions, Corps, Services, Arms, General Departments and Equivalent Units under the Ministry of National Defense, State Cryptographic Agency; Flag of Excellence of National University" shall be awarded a flag and a cash award of 6.0 times the basic salary level.

Article 55. Amount of Cash Awards for Orders of Merit

1. Individuals who are awarded or posthumously awarded Orders of Merit shall be presented with a Certificate, frame, Order of Merit, and the following cash awards:

a) "Golden Star Order": 46.0 times the basic salary level;

b) "Ho Chi Minh Order": 30.5 times the basic salary level;

c) "Independence Order" First Class, "Military Merit Order" First Class: 15.0 times the basic salary level;

d) "Independence Order" Second Class, "Military Merit Order" Second Class: 12.5 times the basic salary level;

đ) "Independence Order" Third Class, "Military Merit Order" Third Class: 10.5 times the basic salary level;

e) "Labor Order" First Class, "Military Service Order" First Class, "National Defense Order" First Class: 9.0 times the basic salary level;

g) "Labor Order" Second Class, "Military Service Order" Second Class, "National Defense Order" Second Class, "Great Unity Order": 7.5 times the basic salary level;

h) "Labor Order" Third Class, "Military Service Order" Third Class, "National Defense Order" Third Class, and "Bravery Order": 4.5 times the basic salary level.

2. Groups awarded Orders of Merit shall be presented with a Certificate, frame, Order of Merit, and a cash award twice the amount specified in Clause 1 of this Article for individuals.

Article 56. Amount of monetary award for national honorary titles

1. A mother awarded or posthumously awarded the title "Heroic Mother Vietnam" shall be presented with a Medal, a Medal Case, a Certificate of Title, a frame, and shall also receive a monetary amount equivalent to 15.5 times the base salary level.

2. An individual awarded or posthumously awarded the title "People's Armed Forces Hero", "Labor Hero" shall be presented with a Certificate, a frame, a Medal, a Medal Case, and shall receive a monetary award equivalent to 15.5 times the base salary level.

A collective awarded the title "People's Armed Forces Hero", "Labor Hero" shall be presented with a Flag, a Certificate, a frame, a Medal, a Medal Case, and shall receive a monetary award twice the amount given to an individual.

3. An individual awarded the title: "National Teacher", "Outstanding Teacher", "National Doctor", "Outstanding Doctor", "National Artist", "Outstanding Artist", "National Artisan", "Outstanding Artisan" shall be presented with a Medal, a Medal Case, a Commendation Certificate, a frame, and a monetary award for the title "national" being 12.5 times the base salary level; the title "outstanding" being 9.0 times the base salary level.

Article 57. Amount of monetary award for "Ho Chi Minh Award" and "State Award"

1. The "Ho Chi Minh Award" for science and technology and the "Ho Chi Minh Award" for literature and art shall be granted a Certificate, a frame, and a monetary award equivalent to 270.0 times the base salary level.

2. The "State Award" for science and technology and the "State Award" for literature and art shall be granted a Certificate, a frame, and a monetary award equivalent to 170.0 times the base salary level.

Article 58. Amount of monetary award for Commendation Certificates, Letters of Praise, and Commemorative Medals

1. For individuals:

a) An individual awarded or posthumously awarded the "Prime Minister's Commendation Certificate" shall be presented with a Certificate, a frame, and shall receive a monetary award equivalent to 3.5 times the base salary level;

b) An individual awarded or posthumously awarded a Commendation Certificate from a ministry, agency, sector, province shall be presented with a Certificate, a frame, and shall receive a monetary award equivalent to 1.5 times the base salary level;

c) An individual awarded a Commemorative Medal from the Standing Committee of the National Assembly shall be presented with a Certificate, a frame, a Commemorative Medal, a Commemorative Medal Case, and shall receive a monetary award not exceeding 0.8 times the base salary level;

d) An individual awarded a Commemorative Medal from a ministry, agency, sector, province, political organization, political-social organization, political-social-professional organization, social organization, social-professional organization having a party group or belonging to the Party Central Committee of State Agencies shall be presented with a Certificate, a frame, a Commemorative Medal, a Commemorative Medal Case, and shall receive a monetary award not exceeding 0.6 times the base salary level;

đ) An individual awarded a Commendation Certificate from a military region, corps, service, arm, general department, and equivalent under the Ministry of National Defense, Government Cryptographic Service; a Commendation Certificate from the National University shall be presented with a Certificate, a frame, and shall receive a monetary award equivalent to 1.0 times the base salary level;

e) An individual awarded a Letter of Praise as stipulated at points a, b, c, and d Clause 1 Article 75 of the Law on Competition and Rewards shall be presented with a Certificate, a frame, and shall receive a monetary award equivalent to 0.3 times the base salary level;

g) An individual awarded a Letter of Praise from the Chairman of the People's Committee of a commune shall be presented with a Certificate, a frame, and shall receive a monetary award equivalent to 0.15 times the base salary level.

2. For groups:

a) A collective awarded the "Prime Minister's Commendation Certificate", a Commendation Certificate from a ministry, agency, sector, province shall be presented with a Certificate, a frame, and shall receive a monetary award twice the amount given to an individual as stipulated at points a and b Clause 1 of this Article;

b) A collective awarded a Commendation Certificate from a military region, corps, service, arm, general department, and equivalent under the Ministry of National Defense, Government Cryptographic Service; a Commendation Certificate from the National University shall be presented with a Certificate, a frame, and shall receive a monetary award twice the amount given to an individual as stipulated at point đ Clause 1 of this Article;

c) A collective awarded Letters of Praise at various levels shall be presented with a Certificate, a frame, and shall receive a monetary award twice the amount given to an individual as stipulated at point e Clause 1 of this Article.

3. A family household awarded various forms of commendation shall receive a Certificate, a frame, and a monetary award equivalent to 1.5 times the monetary award corresponding to the various forms of commendation given to individuals.

Article 59. Amount of Monetary Award for Medal

Individuals who are awarded or posthumously awarded Medals as specified in Clause 2 of Article 54 of the Law on Competition and Rewards shall be presented with a Certificate, Frame, Medal, and Medal Case, and shall receive a monetary award equivalent to 1.5 times the base salary level.

Chapter VII

AWARDS AND RECOGNITION OF BUSINESS PERSONS, BUSINESSES, AND OTHER ECONOMIC ORGANIZATIONS

Section 1. OBJECTS, PRINCIPLES, SCOPE, TIME PERIOD, AUTHORITY TO CONSIDER AND BESTOW AWARDS AND REWARDS ON BUSINESS PERSONS, BUSINESSES, AND OTHER ECONOMIC ORGANIZATIONS

Article 60. Objects for Consideration and Bestowal of Awards and Rewards

1. Authorities with the right to organize awards and recognition for business persons, businesses, and other economic organizations include:

a) Ministries, ministerial-level agencies, government agencies; central agencies of political-social organizations, the Vietnam Chamber of Commerce and Industry (hereinafter referred to as ministries, sectors, and central mass organizations);

b) People's Committees of provinces and centrally-administered cities (hereinafter referred to as provincial People's Committees).

2. Objects eligible for awards and recognition:

a) Business persons are Vietnamese or foreign nationals engaged in production and business activities within the territory of Vietnam in accordance with the law;

b) Businesses belonging to various economic sectors and other economic organizations.

Article 61. Principles for Organizing Consideration and Bestowal of Awards and Rewards

1. The principles for organizing awards and recognition shall be implemented in accordance with Clause 2 of Article 81 of the Law on Competition and Rewards.

2. The awards and rewards given to business persons, businesses, and other economic organizations as stipulated in this Decree are not forms of rewards as defined in the Law on Competition and Rewards and shall not serve as grounds for calculating achievements when bestowing state-level rewards.

Article 62. Scope and Time Period

1. Scope of organization

a) The scope of organizing consideration and bestowal of national awards and rewards is for awards and rewards organized by ministries, central mass organizations, or inter-ministerial, inter-sectoral, or inter-provincial bodies; the participants are business persons, businesses, and other economic organizations nationwide;

b) The scope of organizing consideration and bestowal of provincial awards and rewards is for awards and rewards organized by the People's Committee of the province; the participants are business persons, businesses, and other economic organizations registered within the management jurisdiction of the province.

2. Time period for organization

a) The time period for organizing consideration and bestowal of national awards and rewards is once every five years;

b) The time period for organizing consideration and bestowal of provincial awards and rewards is once every three years;

c) The next organization period starts from the date of the award ceremony of the previous organization period.

Article 63. Authority to Decide on Organization of Consideration and Bestowal of Awards and Rewards

1. The head of ministries, central mass organizations decides on the organization of bestowal of awards and rewards for business persons, businesses, and other economic organizations under their sector, field, or management jurisdiction.

2. The Chairman of the People's Committee of the province decides on the organization of bestowal of awards and rewards for business persons, businesses, and other economic organizations registered within the management jurisdiction of the province.

Section 2. RIGHTS AND OBLIGATIONS OF BUSINESS PERSONS, BUSINESSES; EXPENSES FOR CONSIDERATION AND BESTOWAL OF AWARDS AND REWARDS FOR BUSINESS PERSONS, BUSINESSES, AND OTHER ECONOMIC ORGANIZATIONS

Article 64. Rights and Obligations of Business Persons, Businesses, and Other Economic Organizations Receiving Awards and Rewards

1. They have the right to receive Cups, Certificates, and monetary awards (if applicable) as prescribed and certified by the agency or unit organizing the consideration and bestowal of awards and rewards. They may use and commercially exploit the emblem of the award or reward.

2. They must maintain and enhance their achievements. They must not abuse the awarded title or reward to engage in acts that violate the law.

Article 65. Expenses for Organization

1. The expenses for organizing the consideration and bestowal of awards and rewards and the amount of monetary awards (if applicable) for business persons, businesses, and other economic organizations shall be borne by the agency or unit organizing the awards and rewards.

The source of funds for organizing the consideration and bestowal of awards and rewards and for providing monetary awards shall be formed from voluntary contributions by business persons, businesses, organizations, and individuals both domestically and internationally in accordance with the provisions of the law.

2. The management and use of funds as stipulated in Clause 1 of this Article shall be carried out in accordance with the provisions of the law and used publicly for the organization of the awarding of titles and prizes.

Section 3. PARTICIPATION CONDITIONS; DOCUMENTS, PROCEDURES AND ORGANIZATION FOR AWARDS AND BESTOWAL OF AWARDS AND PRIZES TO BUSINESS PERSONS, BUSINESSES AND OTHER ECONOMIC ORGANIZATIONS

Article 66. Participation Conditions for Business Persons

1. Possess good moral qualities, strictly implement the Party's guidelines and policies, state laws, internal regulations, and rules of the agency, organization, and place of residence.

2. Holding management positions in businesses and other economic organizations steadily and continuously for seven years or more when participating in awards and prizes organized by ministries, central-level mass organizations, social-professional organizations, and five years or more when participating in awards and prizes organized by provincial-level authorities (as of the date of submitting the application dossier). In cases where business persons manage multiple different businesses or change jobs, the time spent managing these businesses and other economic organizations can be accumulated to meet the participation conditions for awards and prizes.

3. Actively study to improve their business management skills and capabilities.

4. Having innovative initiatives, management measures, or the application of new technologies that contribute to improving productivity, product quality, and competitive capacity of businesses and other economic organizations.

5. Paying attention to training and enhancing the skills and qualifications of workers, thereby improving the quality of human resources for businesses and other economic organizations. Fully implementing all regulations concerning workers as stipulated by law.

6. Actively participating in competition movements, contributing support, and fulfilling corporate social responsibilities in local communities; paying attention to developing Party organizations, trade unions, and mass organizations (if any) within businesses and other economic organizations.

7. Businesses and other economic organizations managed by business persons must comply with all legal provisions; have stable and growing revenue, profits, state budget contributions, and worker incomes; not be subject to complaints, accusations, lawsuits, strikes, or collective work stoppages.

Article 67. Participation Conditions for Businesses and Other Economic Organizations

1. Complying with industry and profession registration conditions or investment permits, enterprise laws, investment laws, labor laws, land laws, construction laws, environmental protection laws, intellectual property laws, product quality laws, and other relevant laws governing production and business activities.

2. Engaging in production and business activities that generate stable and growing profits and state budget contributions.

3. Implementing technical innovations, new scientific and technological applications effectively in production and business activities; making many changes and innovations in production and business operations, creating positive values for the common development of society and the country.

4. Fully complying with financial obligations, taxes, and other state budget revenues as prescribed by law.

5. Ensuring stable employment and increasing income for workers; fully and promptly implementing social insurance, health insurance, unemployment insurance, and other policies and laws related to workers.

6. Effectively implementing social welfare programs, actively participating in competition movements initiated by ministries, sectors, localities, or the central government; actively developing Party organizations, trade unions, and mass organizations (if any) within businesses and other economic organizations.

7. Not being subject to complaints, accusations, lawsuits, strikes, or collective work stoppages.

Article 68. Documents and procedures for organizing nationwide events

1. Documents

a) Proposing documents from agencies, organizations, and units under ministries, sectors, and central mass organizations;

b) The organizational proposal, which includes the following contents: Name of title, name of award and organizational content; purpose and requirements for organization; proposed time and location for organization (the location must ensure fire prevention and explosion protection and security and public order); scope and form of organization; number and structure of titles and awards; composition of the Organizing Committee and the Awarding Council, including specific provisions on the number, structure, components, functions, and tasks of the Organizing Committee and the Awarding Council. The Head of the Organizing Committee and the Chairman of the Awarding Council shall be leaders from central ministries, sectors, mass organizations, social-professional organizations, or provincial-level city leaders. Members of the Awarding Council include representatives of relevant agencies, experts knowledgeable and qualified in the field and content of the titles and awards; financial plan, clearly stating sources of income, revenue principles, expenditure principles, and expenditure items; responsibility for financial management and implementation organization. The organizer's commitment to not collecting fees from businesspeople or enterprises participating in titles and awards in any form;

c) Quy chế xét tặng danh hiệu, giải thưởng trong đó quy định: Ngành nghề, đối tượng tham dự, tiêu chí xét tặng (các tiêu chí phải phù hợp với tên gọi, nội dung của danh hiệu, giải thưởng và phù hợp với điều kiện quy định tại Điều 66 và Điều 67 của Nghị định này), cách thức tổ chức xét tặng danh hiệu, giải thưởng.

2. Thủ tục

a) Hồ sơ trình Thủ trưởng bộ, ngành, đoàn thể trung ương gửi qua cơ quan tham mưu thực hiện công tác thi đua, khen thưởng cấp bộ;

b) Trong thời hạn 10 ngày làm việc kể từ ngày nhận đủ hồ sơ theo quy định, cơ quan tham mưu thực hiện công tác thi đua, khen thưởng cấp bộ thẩm định, trình Thủ trưởng bộ, ngành, đoàn thể trung ương quyết định.

3. Trường hợp bộ, ngành, đoàn thể trung ương đã có Quyết định ban hành Quy chế về tổ chức xét tôn vinh và trao tặng danh hiệu, giải thưởng cho doanh nhân, doanh nghiệp, phù hợp với các quy định của Nghị định này thì việc tổ chức xét tôn vinh và trao tặng danh hiệu, giải thưởng được thực hiện theo quy định của bộ, ngành, đoàn thể trung ương.

4. Thủ trưởng bộ, ngành, đoàn thể trung ương quyết định tổ chức và chịu trách nhiệm về việc tổ chức xét tôn vinh và trao tặng danh hiệu, giải thưởng cho doanh nhân, doanh nghiệp và tổ chức kinh tế khác thuộc phạm vi quản lý.

Điều 69. Hồ sơ, thủ tục tổ chức phạm vi cấp tỉnh

1. Hồ sơ

a) Văn bản đề nghị của sở, ban, ngành thuộc tỉnh, thành phố trực thuộc trung ương;

b) Đề án tổ chức theo quy định tại điểm b khoản 1 Điều 68 của Nghị định này. Trong đó nêu rõ: Ngành nghề, đối tượng tham dự, tiêu chí xét tặng, cách thức, quy trình xét tặng danh hiệu, giải thưởng.

2. Thủ tục

a) Hồ sơ trình Chủ tịch Ủy ban nhân dân cấp tỉnh gửi qua cơ quan chuyên trách công tác thi đua, khen thưởng cấp tỉnh;

b) Trong thời hạn 10 ngày làm việc kể từ ngày nhận đủ hồ sơ theo quy định, cơ quan chuyên trách công tác thi đua, khen thưởng cấp tỉnh thẩm định, trình Chủ tịch Ủy ban nhân dân cấp tỉnh quyết định.

3. Trường hợp Ủy ban nhân dân cấp tỉnh đã có Quyết định ban hành Quy chế về tổ chức xét tôn vinh và trao tặng danh hiệu, giải thưởng cho doanh nhân, doanh nghiệp, phù hợp với các quy định của Nghị định này thì việc tổ chức xét tôn vinh và trao tặng danh hiệu, giải thưởng được thực hiện theo quy định của Ủy ban nhân dân cấp tỉnh.

4. Chủ tịch Ủy ban nhân dân cấp tỉnh quyết định tổ chức và chịu trách nhiệm về việc tổ chức xét tôn vinh và trao tặng danh hiệu, giải thưởng cho doanh nhân, doanh nghiệp và tổ chức kinh tế khác thuộc phạm vi quản lý.

Điều 70. Tổ chức xét tôn vinh và trao tặng danh hiệu, giải thưởng

1. Sau khi có quyết định tổ chức tôn vinh và trao tặng danh hiệu, giải thưởng cho doanh nhân, doanh nghiệp và tổ chức kinh tế khác, các cơ quan, đơn vị và cơ quan thông tin, truyền thông thực hiện công tác tuyên truyền và tổ chức các hoạt động liên quan đến việc xét tặng danh hiệu, giải thưởng.

2. Cơ quan, đơn vị tổ chức xét tôn vinh và trao tặng danh hiệu, giải thưởng cho doanh nhân, doanh nghiệp và tổ chức kinh tế khác theo đúng quy định của pháp luật, đề án tổ chức và quy chế xét tặng; lấy ý kiến các cơ quan liên quan và ý kiến nhân dân trên các phương tiện thông tin đại chúng đối với các doanh nhân, doanh nghiệp và tổ chức kinh tế khác tham gia.

3. Việc tôn vinh và trao tặng danh hiệu, giải thưởng của bộ, ngành, đoàn thể trung ương cho doanh nhân, doanh nghiệp và tổ chức kinh tế khác do lãnh đạo bộ, ngành, đoàn thể trung ương trao tặng; danh hiệu, giải thưởng của tỉnh, thành phố trực thuộc trung ương do lãnh đạo tỉnh, thành phố trực thuộc trung ương trao tặng.

Điều 71. Đình chỉ việc tổ chức xét tôn vinh và trao tặng danh hiệu, giải thưởng

1. Cơ quan, đơn vị bị đình chỉ việc tổ chức xét tôn vinh và trao tặng danh hiệu, giải thưởng cho doanh nhân, doanh nghiệp và tổ chức kinh tế khác khi có một trong những hành vi sau:

a) Tổ chức xét tôn vinh và trao tặng danh hiệu, giải thưởng khi chưa được cấp có thẩm quyền cho phép;

b) Lập hồ sơ không trung thực để đề nghị cấp có thẩm quyền cho phép tổ chức xét tôn vinh và trao tặng danh hiệu, giải thưởng;

c) Tổ chức không đúng với Đề án và Quy chế xét tôn vinh và trao tặng danh hiệu, giải thưởng cho doanh nhân, doanh nghiệp và tổ chức kinh tế khác đã được cơ quan có thẩm quyền phê duyệt;

d) Có hành vi lừa dối, ép buộc doanh nhân, doanh nghiệp và tổ chức kinh tế khác tham dự xét tôn vinh và trao tặng danh hiệu, giải thưởng;

đ) Huy động kinh phí dưới các hình thức đối với cá nhân, tổ chức tham gia bình chọn xét tôn vinh và trao tặng danh hiệu, giải thưởng.

2. Căn cứ kết luận của cơ quan có thẩm quyền, cơ quan tham mưu thực hiện công tác thi đua, khen thưởng cấp bộ trình Thủ trưởng cấp bộ đình chỉ việc tổ chức danh hiệu, giải thưởng phạm vi toàn quốc; cơ quan tham mưu thực hiện công tác thi đua, khen thưởng cấp tỉnh trình Chủ tịch Ủy ban nhân dân cấp tỉnh đình chỉ việc tổ chức danh hiệu, giải thưởng phạm vi cấp tỉnh.

3. Hồ sơ đề nghị đình chỉ gồm:

a) Tờ trình của cơ quan làm công tác thi đua, khen thưởng cấp tỉnh;

b) Kết luận của cơ quan có thẩm quyền về sai phạm của cơ quan, đơn vị tổ chức xét tôn vinh danh hiệu và trao tặng danh hiệu, giải thưởng cho doanh nhân, doanh nghiệp và tổ chức kinh tế khác.

4. Thủ tục đình chỉ:

a) Không quá 15 ngày làm việc kể từ ngày có kết luận về việc vi phạm pháp luật trong việc tổ chức danh hiệu, giải thưởng cho doanh nhân, doanh nghiệp và tổ chức kinh tế khác, đoàn kiểm tra hoặc cơ quan có thẩm quyền gửi kết luận đến cơ quan chuyên trách công tác thi đua, khen thưởng cấp bộ hoặc cấp tỉnh;

b) Trong thời hạn 10 ngày làm việc kể từ ngày nhận được kết luận về việc vi phạm pháp luật, cơ quan chuyên trách công tác thi đua, khen thưởng cấp bộ hoặc cấp tỉnh trình Thủ trưởng bộ, ngành, đoàn thể trung ương hoặc Chủ tịch Ủy ban nhân dân cấp tỉnh quyết định đình chỉ việc tổ chức tôn vinh và trao tặng danh hiệu, giải thưởng cho doanh nhân, doanh nghiệp và tổ chức kinh tế khác.

5. Sau khi bị đình chỉ, cơ quan, đơn vị phải dừng ngay việc tổ chức xét tôn vinh và trao tặng danh hiệu, giải thưởng và hủy bỏ kết quả trao tặng danh hiệu, giải thưởng đã thực hiện và bồi thường thiệt hại (nếu có) đối với các tổ chức, cá nhân có liên quan theo quy định của pháp luật.

Điều 72. Hủy bỏ kết quả xét tôn vinh và trao tặng danh hiệu, giải thưởng

1. Doanh nhân, doanh nghiệp, tổ chức kinh tế khác bị hủy bỏ kết quả xét tôn vinh và trao tặng danh hiệu, giải thưởng khi có một trong những hành vi sau:

a) Kê khai gian dối thành tích để tham gia xét tôn vinh và trao tặng danh hiệu, giải thưởng;

b) Lợi dụng danh hiệu, giải thưởng đã được trao tặng để có hành vi vi phạm pháp luật;

c) Có hành vi vi phạm pháp luật trong thời gian tính thành tích để xét tôn vinh và trao tặng danh hiệu, giải thưởng đến mức bị truy cứu trách nhiệm hình sự.

2. Căn cứ kết luận của cơ quan có thẩm quyền về việc kê khai gian dối thành tích hoặc hành vi vi phạm pháp luật của doanh nhân, doanh nghiệp, tổ chức kinh tế khác; cơ quan, đơn vị tổ chức xét tặng danh hiệu, giải thưởng quyết định hủy bỏ kết quả xét tặng, thu hồi Cúp, Giấy chứng nhận, tiền thưởng (nếu có) đã tặng cho doanh nhân, doanh nghiệp, tổ chức kinh tế khác và công bố công khai với cơ quan truyền thông.

Điều 73. Trách nhiệm của bộ, ban, ngành, tỉnh, cơ quan, tổ chức liên quan trong việc xét tôn vinh và trao tặng danh hiệu, giải thưởng cho doanh nhân, doanh nghiệp, tổ chức kinh tế khác

1. Bộ Nội vụ giúp Chính phủ quản lý nhà nước về công tác xét tôn vinh và trao tặng danh hiệu, giải thưởng cho doanh nhân, doanh nghiệp, tổ chức kinh tế khác.

2. Bộ, cơ quan ngang bộ, Ủy ban nhân dân tỉnh, thành phố trực thuộc trung ương trong phạm vi nhiệm vụ, quyền hạn của mình thực hiện quản lý nhà nước về công tác xét tôn vinh và trao tặng danh hiệu, giải thưởng cho doanh nhân, doanh nghiệp, tổ chức kinh tế khác. Thực hiện việc xét tôn vinh và trao tặng danh hiệu, giải thưởng cho doanh nhân, doanh nghiệp, tổ chức kinh tế khác theo quy định tại Nghị định này.

3. Cơ quan trung ương của tổ chức chính trị - xã hội trong phạm vi nhiệm vụ, quyền hạn của mình thực hiện các quy định về việc tổ chức xét xét tôn vinh và trao tặng danh hiệu, giải thưởng cho doanh nhân, doanh nghiệp và tổ chức kinh tế khác theo quy định tại Nghị định này.

4. Cơ quan thông tin đại chúng trách nhiệm tuyên truyền, phổ biến quy định của pháp luật về xét tôn vinh và trao tặng danh hiệu, giải thưởng cho doanh nhân, doanh nghiệp và tổ chức kinh tế khác; phát hiện, tuyên truyền các điển hình tiên tiến là doanh nhân, doanh nghiệp và tổ chức kinh tế khác. Không tổ chức truyền hình, đưa tin các trường hợp xét tôn vinh và trao tặng danh hiệu, giải thưởng cho doanh nhân, doanh nghiệp và tổ chức kinh tế khác trái quy định của pháp luật.

Chương VIII

THỦ TỤC HỦY BỎ QUYẾT ĐỊNH TẶNG DANH HIỆU THI ĐUA, HÌNH THỨC KHEN THƯỞNG; THỦ TỤC TƯỚC, PHỤC HỒI VÀ TRAO LẠI DANH HIỆU VINH DỰ NHÀ NƯỚC; THU HỒI HIỆN VẬT KHEN THƯỞNG VÀ TIỀN THƯỞNG

Điều 74. Hồ sơ, thủ tục hủy bỏ quyết định tặng danh hiệu thi đua, hình thức khen thưởng

1. Tập thể, cá nhân, hộ gia đình có hành vi thuộc các trường hợp quy định tại khoản 2 Điều 93 của Luật Thi đua, khen thưởng bị hủy bỏ quyết định tặng danh hiệu thi đua, hình thức khen thưởng và bị thu hồi hiện vật, tiền thưởng đã nhận.

2. Căn cứ vào kết luận của cơ quan có thẩm quyền xác định việc tập thể, cá nhân có hành vi vi phạm thuộc các trường hợp quy định tại khoản 2 Điều 93 của Luật Thi đua, khen thưởng thì cơ quan trình khen thưởng có trách nhiệm đề nghị cấp có thẩm quyền khen thưởng ban hành quyết định hủy bỏ quyết định tặng danh hiệu thi đua, hình thức khen thưởng và thu hồi hiện vật, tiền thưởng.

3. Hồ sơ đề nghị hủy bỏ quyết định tặng danh hiệu thi đua, hình thức khen thưởng có 01 bộ (bản chính) gồm:

a) Tờ trình của bộ, ban, ngành, tỉnh đề nghị thu hồi đối với từng danh hiệu thi đua, loại hình khen thưởng của cá nhân, tập thể, hộ gia đình;

b) Báo cáo tóm tắt của cơ quan trực tiếp trình khen thưởng về lý do trình cấp có thẩm quyền hủy bỏ quyết định tặng danh hiệu thi đua, hình thức khen thưởng (kèm theo Quyết định khen thưởng).

4. Bộ Nội vụ tổng hợp hồ sơ trình Thủ tướng Chính phủ trong thời gian 10 ngày làm việc kể từ ngày nhận đủ hồ sơ theo quy định.

5. Hồ sơ Bộ Nội vụ trình Thủ tướng Chính phủ gồm: Tờ trình của Bộ Nội vụ kèm theo hồ sơ được quy định tại khoản 3 Điều này.

Điều 75. Hồ sơ, thủ tục tước, phục hồi và trao lại danh hiệu vinh dự nhà nước

1. Cá nhân, pháp nhân thương mại được tặng thưởng danh hiệu vinh dự nhà nước có hành vi vi phạm thuộc các khoản 3, khoản 4 và khoản 5 Điều 93 của Luật Thi đua, khen thưởng thì bị tước danh hiệu vinh dự nhà nước.

2. Trong thời hạn 30 ngày, kể từ ngày bản án có hiệu lực pháp luật, cơ quan trình khen thưởng có trách nhiệm trình Thủ tướng Chính phủ đề nghị Chủ tịch nước quyết định việc tước danh hiệu vinh dự nhà nước.

3. Cá nhân, pháp nhân thương mại bị tước danh hiệu vinh dự nhà nước mà sau đó có bản án, quyết định của Tòa án có hiệu lực pháp luật tuyên không có tội, miễn trách nhiệm hình sự hoặc không thuộc trường hợp quy định tại các khoản 3, khoản 4 và khoản 5 Điều 93 của Luật Thi đua, khen thưởng thì được phục hồi và trao lại danh hiệu vinh dự nhà nước.

4. Hồ sơ đề nghị tước, đề nghị phục hồi và trao lại danh hiệu vinh dự nhà nước có 01 bộ (bản chính) gồm:

a) Tờ trình của bộ, ban, ngành, tỉnh;

b) Báo cáo tóm tắt của cơ quan trực tiếp trình khen thưởng trong đó nêu rõ nội dung hoặc giải trình lý do đề nghị và ý kiến của cấp có thẩm quyền.

5. Bộ Nội vụ tổng hợp hồ sơ trình Thủ tướng Chính phủ trong thời gian 10 ngày làm việc kể từ ngày nhận đủ hồ sơ theo quy định.

6. Hồ sơ Bộ Nội vụ trình Thủ tướng Chính phủ gồm: Tờ trình của Bộ Nội vụ kèm theo hồ sơ được quy định tại khoản 4 Điều này.

Điều 76. Thu hồi hiện vật khen thưởng và tiền thưởng

1. Thu hồi hiện vật khen thưởng và tiền thưởng cấp Nhà nước

a) Trong thời hạn 15 ngày làm việc kể từ khi nhận được quyết định: Tước danh hiệu vinh dự nhà nước, hủy bỏ quyết định khen thưởng của Chủ tịch nước, quyết định tặng danh hiệu thi đua, hình thức khen thưởng của Chính phủ và Thủ tướng Chính phủ, tập thể, cá nhân có trách nhiệm nộp lại đầy đủ hiện vật khen thưởng và tiền thưởng đã nhận cho bộ, ban, ngành, tỉnh nơi đã trình khen và chi tiền thưởng cho cá nhân, tập thể, hộ gia đình;

b) Bộ, ban, ngành, tỉnh có trách nhiệm đôn đốc cá nhân, tập thể, hộ gia đình nộp lại hiện vật khen thưởng đã nhận đúng thời hạn và gửi về Bộ Nội vụ trong vòng 15 ngày làm việc kể từ ngày nhận được hiện vật thu hồi; tiền thưởng bị thu hồi được nộp vào ngân sách nhà nước hoặc quỹ thi đua, khen thưởng theo quy định;

c) Bộ Nội vụ có trách nhiệm đôn đốc bộ, ban, ngành, tỉnh, tổ chức thu hồi hiện vật khen thưởng đã nhận.

2. Thu hồi hiện vật và tiền thưởng đối với danh hiệu thi đua, hình thức khen thưởng khác

a) Trong thời hạn 15 ngày làm việc kể từ khi nhận được quyết định hủy bỏ danh hiệu thi đua, hình thức khen thưởng của cấp có thẩm quyền, cá nhân, tập thể, hộ gia đình có trách nhiệm nộp lại đầy đủ hiện vật khen thưởng và tiền thưởng đã nhận cho cơ quan có thẩm quyền ra quyết định khen thưởng;

b) Cơ quan có thẩm quyền ra quyết định tặng danh hiệu thi đua, hình thức khen thưởng có trách nhiệm đôn đốc cá nhân, tập thể, hộ gia đình nộp lại hiện vật khen thưởng và tiền thưởng đã nhận đúng thời hạn và tổ chức thu hồi theo quy định.

Mục 1. MẪU HUÂN CHƯƠNG, HUY CHƯƠNG, KỶ NIỆM CHƯƠNG; MẪU BẰNG, KHUNG, HỘP, CỜ CỦA CÁC DANH HIỆU THI ĐUA VÀ HÌNH THỨC KHEN THƯỞNG

Điều 77. Mẫu Huân chương

1. Huân chương theo Điều 33 của Luật Thi đua, khen thưởng có 10 loại, trong đó 05 loại không chia hạng và 05 loại có chia hạng. Loại có chia hạng được chia làm ba hạng và được phân biệt bằng số sao gắn trên cuống, trên dải Huân chương (hạng Nhất ba sao, hạng Nhì hai sao, hạng Ba một sao).

2. Kết cấu của Huân chương gồm 03 phần: Cuống Huân chương, dải Huân chương và thân Huân chương.

Mẫu Huân chương được minh họa tại Phụ lục II.1 kèm theo Nghị định này.

Điều 78. Mẫu Huy chương

1. Huy chương theo Điều 54 của Luật Thi đua, khen thưởng có 04 loại, trong đó 01 loại có chia hạng và 03 loại không chia hạng. Loại có chia hạng được chia làm ba hạng và được phân biệt bằng số vạch trên cuống, trên dải Huy chương (hạng Nhất ba vạch, hạng Nhì hai vạch, hạng Ba một vạch).

2. Kết cấu của Huy chương gồm 03 phần: Cuống Huy chương, dải Huy chương và thân Huy chương.

Mẫu Huy chương được minh họa tại Phụ lục II.1 kèm theo Nghị định này.

Điều 79. Mẫu huy hiệu của danh hiệu Chiến sĩ thi đua toàn quốc, Chiến sĩ thi đua bộ, ban, ngành, tỉnh và danh hiệu vinh dự nhà nước; mẫu kỷ niệm chương

1. Huy hiệu danh hiệu vinh dự nhà nước, huy hiệu “Chiến sĩ thi đua toàn quốc”, huy hiệu chiến sĩ thi đua bộ, ban, ngành, tỉnh có kết cấu chia làm 02 phần: Cuống huy hiệu và thân huy hiệu.

Mẫu huy hiệu chiến sĩ thi đua bộ, ban, ngành, tỉnh do bộ, ban, ngành, tỉnh quy định cho phù hợp, mang nội dung ý nghĩa của từng lĩnh vực, ngành nghề, địa phương; kích thước nhỏ hơn kích thước của huy hiệu danh hiệu vinh dự nhà nước.

Huy hiệu danh hiệu vinh dự nhà nước và huy hiệu “Chiến sĩ thi đua toàn quốc” được minh họa tại Phụ lục II kèm theo Nghị định này.

2. Kỷ niệm chương của Ủy ban Thường vụ Quốc hội, bộ, ban, ngành, tỉnh, tổ chức chính trị, tổ chức chính trị - xã hội, tổ chức chính trị xã hội - nghề nghiệp, tổ chức xã hội, tổ chức xã hội - nghề nghiệp có tổ chức đảng đoàn hoặc có tổ chức đảng thuộc Đảng bộ khối các cơ quan Trung ương.

a) Kết cấu của Kỷ niệm chương gồm 02 phần: Cuống Kỷ niệm chương và thân Kỷ niệm chương;

b) Mẫu kỷ niệm chương do Ủy ban Thường vụ Quốc hội, bộ, ban, ngành, tỉnh, tổ chức chính trị, tổ chức chính trị - xã hội, tổ chức chính trị xã hội - nghề nghiệp, tổ chức xã hội, tổ chức xã hội - nghề nghiệp có tổ chức đảng đoàn hoặc có tổ chức đảng thuộc Đảng bộ khối các cơ quan Trung ương quy định cho phù hợp, mang nội dung ý nghĩa của từng lĩnh vực, ngành nghề, địa phương.

Điều 80. Mẫu “Huân chương Sao vàng”

1. Cuống Huân chương: Cốt bằng đồng đỏ mạ vàng hợp kim Ni-Co; kích thước 28 mm x 14 mm; viền ngoài màu vàng, trong bọc vải dệt bằng sợi polyester hoặc chất liệu tương đương, đảm bảo chắc chắn, bền đẹp có hai màu: 1/2 bên trái màu đỏ cờ, 1/2 bên phải màu vàng.

2. Dải Huân chương: Hình chữ A cách điệu, cốt bằng inox mạ vàng hợp kim Ni-Co, bọc vải dệt bằng sợi polyester hoặc chất liệu tương đương, đảm bảo chắc chắn, bền đẹp có hai màu: 1/2 bên trái màu đỏ cờ, 1/2 bên phải màu vàng; kích thước 28 mm x 51 mm x 41 mm x 51 mm.

3. Thân Huân chương: Hình sao vàng năm cánh dập nổi, đường kính đường tròn ngoại tiếp năm đỉnh sao bằng 55 mm, chính giữa hình tròn nền vàng có ngôi sao vàng năm cánh, xung quanh là dòng chữ “Huân chương Sao vàng”, “Việt Nam” màu đỏ; chất liệu bằng đồng đỏ mạ vàng hợp kim Ni-Co.

Điều 81. Mẫu “Huân chương Hồ Chí Minh”

1. Cuống Huân chương: Cốt bằng đồng đỏ mạ vàng hợp kim Ni-Co; kích thước 28 mm x 14 mm; viền ngoài màu vàng, trong bọc vải dệt bằng sợi polyester hoặc chất liệu tương đương, đảm bảo chắc chắn, bền đẹp màu đỏ cờ, có hai vạch vàng.

2. Dải Huân chương: Hình chữ A cách điệu, cốt bằng inox mạ vàng hợp kim Ni-Co, bọc vải dệt bằng sợi polyester hoặc chất liệu tương đương, đảm bảo chắc chắn, bền đẹp màu đỏ cờ có hai vạch vàng; kích thước 28 mm x 51 mm x 41 mm x 51 mm.

3. Thân Huân chương: Hình tròn đường kính bằng 40 mm, giữa là chân dung Chủ tịch Hồ Chí Minh nghiêng đặt trên nền họa tiết hoa sen cổ màu vàng, phía trên có dòng chữ “Huân chương Hồ Chí Minh”, phía dưới có dòng chữ “Việt Nam” màu đỏ; chất liệu bằng đồng đỏ mạ vàng hợp kim Ni-Co.

Điều 82. Mẫu “Huân chương Độc lập” hạng Nhất, hạng Nhì, hạng Ba

1. Cuống Huân chương: Cốt bằng đồng đỏ mạ vàng hợp kim Ni-Co; kích thước 28 mm x 14 mm; viên ngoài màu vàng, trong bọc vải dệt bằng sợi polyester hoặc chất liệu tương đương, đảm bảo chắc chắn, bền đẹp màu đỏ cờ, có bốn vạch vàng hai bên, gắn sao theo hạng huân chương.

2. Dải Huân chương: Hình chữ A cách điệu, cốt bằng inox mạ vàng hợp kim Ni-Co, bọc vải dệt bằng sợi polyester hoặc chất liệu tương đương, đảm bảo chắc chắn, bền đẹp màu đỏ cờ, có bốn vạch vàng hai bên, gắn sao theo hạng huân chương; kích thước 28 mm x 51 mm x 41 mm x 51 mm.

3. Thân Huân chương hình tròn đường kính bằng 40 mm, viền ngoài màu vàng, chính giữa có ngôi sao vàng năm cánh nổi trên nền xanh hòa bình, phía trên là dòng chữ “Huân chương Độc lập” màu đỏ, phía dưới có hai cành tùng, hai hàng cờ đỏ cách điệu và dải lụa đỏ mang dòng chữ “Việt Nam” màu vàng; chất liệu bằng đồng đỏ mạ vàng hợp kim Ni-Co.

Điều 83. Mẫu “Huân chương Quân công” hạng Nhất, hạng Nhì, hạng Ba

1. Cuống Huân chương: Cốt bằng đồng đỏ mạ vàng hợp kim Ni-Co; kích thước 28 mm x 14 mm; viền ngoài màu vàng, trong bọc vải dệt bằng sợi polyester hoặc chất liệu tương đương, đảm bảo chắc chắn, bền đẹp màu đỏ cờ, có bốn vạch màu xanh lá cây hai bên, gắn sao theo hạng Huân chương.

2. Dải Huân chương: Hình chữ A cách điệu, cốt bằng inox mạ vàng hợp kim Ni-Co, bọc vải dệt bằng sợi polyester hoặc chất liệu tương đương, đảm bảo chắc chắn, bền đẹp màu đỏ cờ, có bốn vạch màu xanh lá cây hai bên, gắn sao theo hạng huân chương; kích thước 28 mm x 51 mm x 41 mm x 51 mm.

3. Thân huân chương: Hình sao vàng năm cánh cách điệu dập nổi, đường kính đường tròn ngoại tiếp năm đỉnh sao bằng 50 mm, chính giữa có ngôi sao vàng năm cánh nổi trên nền đỏ; xung quanh ngôi sao có dòng chữ “Huân chương Quân công”, “Việt Nam” màu vàng trên nền đỏ; chất liệu bằng đồng đỏ mạ vàng hợp kim Ni-Co.

Điều 84. Mẫu “Huân chương Lao động” hạng Nhất, hạng Nhì, hạng Ba

1. Cuống Huân chương: cốt bằng đồng đỏ mạ vàng hợp kim Ni-Co; kích thước 28 mm x 14 mm; viền ngoài màu vàng, trong bọc vải dệt bằng sợi polyester hoặc chất liệu tương đương, đảm bảo chắc chắn, bền đẹp màu đỏ cờ, có hai vạch màu xanh dương đậm hai bên, gắn sao theo hạng Huân chương.

2. Dải Huân chương: Hình chữ A cách điệu, cốt bằng inox mạ vàng hợp kim Ni-Co, bọc vải dệt bằng sợi polyester hoặc chất liệu tương đương, đảm bảo chắc chắn, bền đẹp màu đỏ cờ có hai vạch màu xanh dương đậm hai bên, gắn sao theo hạng huân chương; kích thước 28 mm x 51 mm x 41 mm x 51 mm.

3. Thân Huân chương: Hình tròn đường kính bằng 40 mm, nền vàng, chính giữa là ngôi sao vàng năm cánh dập nổi trên nền đỏ, xung quanh bên trái là bông lúa, bên phải là bánh xe lịch sử, phía dưới là quyên sách dải lụa đỏ có dòng chữ “Việt Nam” màu vàng, trên cùng là dòng chữ “Huân chương Lao động” màu đỏ; tất cả các chi tiết đặt trong khung viền màu xanh dương đậm; chất liệu bằng đồng đỏ mạ vàng hợp kim Ni-Co.

Điều 85. Mẫu “Huân chương Chiến công” hạng Nhất, hạng Nhì, hạng Ba

1. Cuống huân chương: cốt bằng đồng đỏ mạ vàng hợp kim Ni-Co; kích thước 28 mm x 14 mm; viên ngoài màu vàng, trong bọc vải dệt bằng sợi polyester hoặc chất liệu tương đương, đảm bảo chắc chắn, bền đẹp màu đỏ cờ, có hai vạch xanh lá cây, gắn sao theo hạng huân chương.

2. Dải huân chương: Hình chữ A cách điệu, cốt bằng inox mạ vàng hợp kim Ni-Co, bọc vải dệt bằng sợi polyester hoặc chất liệu tương đương, đảm bảo chắc chắn, bền đẹp màu đỏ cờ, có hai vạch màu xanh lá cây, gắn sao theo hạng huân chương; kích thước 28 mm x 51 mm x 41 mm x 51 mm.

3. Thân huân chương: Hình sao vàng năm cánh dập nổi trên hình khẩu súng, thanh gươm và lá chắn, đường kính đường tròn ngoại tiếp năm đỉnh sao bằng 50 mm, chính giữa là ngôi sao vàng năm cánh nổi trên nền đỏ, xung quanh là dòng chữ “Huân chương Chiến công”, “Việt Nam” màu vàng, chất liệu bằng đồng đỏ mạ vàng hợp kim Ni-Co.

Điều 86. Mẫu “Huân chương Bảo vệ Tổ quốc” hạng Nhất, hạng Nhì, hạng Ba

1. Cuống Huân chương: Cốt bằng đồng đỏ mạ vàng hợp kim Ni-Co; kích thước 28 mm x 14 mm; viền ngoài màu vàng, trong bọc vải dệt bằng sợi polyester hoặc chất liệu tương đương, đảm bảo chắc chắn, bền đẹp có hai màu: 1/2 bên trái màu xanh lá cây, 1/2 bên phải màu đỏ cờ; gắn sao theo hạng Huân chương.

2. Dải Huân chương: Hình chữ A cách điệu, cốt bằng inox mạ vàng hợp kim Ni-Co, bọc vải dệt bằng sợi polyester hoặc chất liệu tương đương, đảm bảo chắc chắn, bền đẹp có hai màu: 1/2 bên trái màu xanh lá cây, 1/2 bên phải màu đỏ cờ; gắn sao theo hạng Huân chương; kích thước 28 mm x 51 mm x 41 mm x 5 mm.

3. Thân Huân chương: Hình sao mười cánh cách điệu, đường kính đường tròn ngoại tiếp mười đỉnh sao bằng 40 mm, chính giữa có biểu tượng khẩu súng và thanh gươm đặt chéo nhau, phía trên có ngôi sao vàng năm cánh nổi trên nền đỏ, xung quanh có dòng chữ “Huân chương Bảo vệ Tổ quốc” “Việt Nam” màu đỏ trên nền vàng; chất liệu bằng đồng đỏ mạ vàng hợp kim Ni-Co.

Điều 87. Mẫu “Huân chương Dũng cảm”

1. Cuống Huân chương: Cốt bằng đồng đỏ mạ vàng hợp kim Ni-Co; kích thước 28 mm x 14 mm; viền ngoài màu vàng, trong bọc vải dệt bằng sợi polyester hoặc chất liệu tương đương, đảm bảo chắc chắn, bền đẹp màu đỏ cờ, có hai vạch màu xanh dương đậm.

2. Dải Huân chương: Hình chữ A cách điệu, cốt bằng inox đỏ mạ vàng hợp kim Ni-Co, bọc vải dệt bằng sợi polyester hoặc chất liệu tương đương, đảm bảo chắc chắn, bền đẹp màu đỏ cờ, có hai vạch màu xanh dương đậm; kích thước 28 mm x 51 mm x 41 mm x 51 mm.

3. Thân Huân chương: Hình sao tám cánh cách điệu, đường kính đường tròn ngoại tiếp tám đỉnh sao bằng 40 mm, hai bên là cành tùng, chính giữa là sao vàng năm cánh nổi trên nền đỏ, xung quanh là dòng chữ “Huân chương Dũng cảm”, “Việt Nam” màu đỏ trên nền vàng; chất liệu bằng đồng đỏ mạ vàng hợp kim Ni-Co.

Điều 88. Mẫu “Huân chương Đại đoàn kết dân tộc”

1. Cuống Huân chương: Cốt bằng đồng đỏ mạ vàng hợp kim Ni-Co; kích thước 28 mm x 14 mm; viền ngoài màu vàng, trong bọc vải dệt bằng sợi polyester hoặc chất liệu tương đương, đảm bảo chắc chắn, bền đẹp có hai màu: 1/2 bên trái màu xanh dương đậm, 1/2 bên phải màu đỏ cờ.

2. Dải Huân chương: Hình chữ A cách điệu, cốt bằng inox mạ vàng hợp kim Ni-Co, bọc vải dệt bằng sợi polyester hoặc chất liệu tương đương, đảm bảo chắc chắn, bền đẹp có hai màu: 1/2 bên trái màu xanh dương đậm, 1/2 bên phải màu đỏ cờ; kích thước 28 mm x 51 mm x 41 mm x 51 mm.

3. Thân Huân chương: Hình sao vàng cách điệu, có đường kính đường tròn ngoại tiếp các đỉnh sao bằng 40 mm, chính giữa là chân dung Chủ tịch Hồ Chí Minh đặt nghiêng trên đài sen tỏa sáng, hai bên là cành tùng, phía trên là dòng chữ “Huân chương Đại đoàn kết dân tộc” màu đỏ, phía dưới là dải lụa đỏ mang dòng chữ “Việt Nam” màu vàng; chất liệu bằng đồng đỏ mạ vàng hợp kim Ni-Co.

Điều 89. Mẫu “Huân chương Hữu nghị”

1. Cuống Huân chương: Cốt bằng đồng đỏ mạ vàng hợp kim Ni-Co; kích thước 28 mm x 14 mm; viền ngoài màu vàng, trong bọc vải dệt bằng sợi polyester hoặc chất liệu tương đương, đảm bảo chắc chắn, bền đẹp màu đỏ cờ, có hai vạch màu xanh hòa bình.

2. Dải Huân chương: Hình chữ A cách điệu, cốt bằng inox mạ vàng hợp kim Ni-Co, bọc vải dệt bằng sợi polyester hoặc chất liệu tương đương, đảm bảo chắc chắn, bền đẹp màu đỏ cờ, có hai vạch màu xanh hòa bình; kích thước 28 mm x 51 mm x 41 mm x 51 mm.

3. Thân Huân chương: Hình sao vàng năm cánh cách điệu, đường kính ngoại tiếp năm đỉnh sao bằng 48 mm, có cành tùng hai bên, chính giữa là hai bàn tay bắt tay nhau trên hình quả địa cầu nền màu xanh hòa bình, xung quanh có dòng chữ “Huân chương Hữu nghị” màu đỏ, chữ “Việt Nam” màu vàng trên dải lụa đỏ; chất liệu bằng đồng đỏ mạ vàng hợp kim Ni-Co.

Điều 90. Mẫu “Huy chương Quân kỳ quyết thắng”

1. Cuống Huy chương: Cốt bằng đồng đỏ mạ vàng hợp kim Ni-Co; kích thước 28 mm x 14 mm; trong bọc vải dệt bằng sợi polyester hoặc chất liệu tương đương, bảo đảm chắc chắn, bền đẹp màu đỏ cờ, có hai vạch màu vàng ở hai đầu cuống Huy chương.

2. Dải Huy chương: Hình ngũ giác, cốt bằng inox mạ vàng hợp kim Ni-Co, bọc vải dệt bằng sợi polyester màu đỏ cờ, có hai vạch màu xanh lá cây; kích thước 38 mm x 27 mm x 40 mm.

3. Thân Huy chương: Hình sao vàng năm cánh dập nổi, đường kính đường tròn ngoại tiếp năm đỉnh sao bằng 48 mm, có cành tùng hai bên, ở giữa có lá cờ quyết thắng trên nền vàng, phía trên có dòng chữ “Huy chương Quân kỳ quyết thắng” màu đỏ trên nền vàng, phía dưới là dải lụa vàng mang dòng chữ “Việt Nam” màu đỏ; chất liệu bằng đồng đỏ mạ vàng hợp kim Ni-Co.

Điều 91. Mẫu “Huy chương Vì an ninh Tổ quốc”

1. Cuống Huy chương: cốt bằng đồng đỏ mạ vàng hợp kim Ni - Co; kích thước 28 mm x 14 mm; trong bọc vải dệt bằng sợi polyester hoặc chất liệu tương đương, bảo đảm chắc chắn, bền đẹp màu đỏ cờ, có hai vạch màu vàng ở hai đầu cuống Huy chương.

2. Dải Huy chương: Hình ngũ giác, cốt bằng inox mạ vàng hợp kim Ni-Co, bọc vải dệt bằng sợi polyester màu đỏ cờ, có hai vạch xanh lá cây; kích thước 38 mm x 27 mm x 40 mm.

3. Thân Huy chương: Hình ngôi sao năm cánh cách điệu dập nổi, đường kính đường tròn ngoại tiếp năm đỉnh sao bằng 48 mm, chính giữa có ngôi sao vàng năm cánh dập nổi và thanh gươm đặt trên lá chắn màu đỏ trên nền màu xanh lá cây, xung quanh là dòng chữ “Huy chương Vì an ninh Tổ quốc” màu vàng và hai cành tùng hai bên, phía dưới là dải lụa đỏ mang dòng chữ “Việt Nam” màu vàng; chất liệu bằng đồng đỏ mạ vàng hợp kim Ni-Co.

Điều 92. Mẫu “Huy chương Chiến sĩ vẻ vang” hạng Nhất, hạng Nhì, hạng Ba

1. Cuống Huy chương: Cốt bằng đồng đỏ mạ vàng hợp kim Ni-Co; kích thước 28 mm x 14 mm; trong bọc vải dệt bằng sợi polyester hoặc chất liệu tương đương, bảo đảm chắc chắn, bền đẹp màu đỏ cờ, có vạch màu vàng theo hạng Huy chương.

2. Dải Huy chương: Hình ngũ giác, cốt bằng inox mạ vàng hợp kim Ni-Co, bọc vải dệt bằng sợi polyester màu đỏ cờ, vạch màu xanh lá cây (phân hạng theo vạch); kích thước 38 mm x 27 mm x 40 mm.

3. Thân Huy chương: Hình sao vàng năm cánh cách điệu dập nổi, màu vàng, đường kính đường tròn ngoại tiếp năm đỉnh sao bằng 48 mm, ở giữa là ngôi sao vàng năm cánh trên nền đỏ, có cành tùng hai bên, xung quanh là dòng chữ “Huy chương Chiến sĩ vẻ vang”, “Việt Nam” màu đỏ trên nền vàng; chất liệu bằng đồng mạ vàng hợp kim Ni-Co.

Điều 93. Mẫu “Huy chương Hữu nghị”

1. Cuống Huy chương: Cốt bằng đồng đỏ mạ vàng hợp kim Ni-Co; kích thước 28 mm x 14 mm; viền ngoài màu vàng, trong bọc vải dệt bằng sợi polyester hoặc chất liệu tương đương, đảm bảo chắc chắn, bền đẹp màu đỏ cờ, có hai vạch màu xanh hòa bình.

2. Dải Huy chương: Hình ngũ giác, cốt bằng inox mạ vàng hợp kim Ni-Co, bọc vải dệt bằng sợi polyester màu đỏ cờ có hai vạch màu xanh hòa bình; kích thước 38 mm x 27 mm x 40 mm.

3. Thân Huy chương: Hình tròn đường kính bằng 40 mm, phía trong là sao vàng năm cánh cách điệu dập nổi, có cành tùng hai bên, chính giữa là hai bàn tay bắt tay nhau trên hình quả địa cầu nền màu xanh hòa bình, phía trên có dòng chữ “Huy chương Hữu nghị” màu đỏ, phía dưới là dải lụa đỏ mang dòng chữ “Việt Nam” màu vàng; chất liệu bằng đồng đỏ mạ vàng hợp kim Ni-Co.

Điều 94. Mẫu huy hiệu “Bà mẹ Việt Nam anh hùng”

1. Cuống huy hiệu: Chất liệu bằng đồng đỏ mạ vàng hợp kim Ni-Co, kích thước 28 mm x 14 mm; sơn màu đỏ cờ, viền ngoài màu vàng.

2. Thân huy hiệu: Hình sao vàng năm cánh dập nổi, đường kính đường tròn ngoại tiếp năm đỉnh sao bằng 50 mm, bên trong là hình ảnh chân dung Mẹ Việt Nam anh hùng, phía dưới là dòng chữ “Bà mẹ Việt Nam anh hùng” màu đỏ; chất liệu bằng đồng đỏ mạ vàng hợp kim Ni-Co.

Điều 95. Mẫu huy hiệu “Anh hùng Lực lượng vũ trang nhân dân”

1. Cuống huy hiệu: Chất liệu bằng đồng đỏ mạ vàng hợp kim Ni-Co, kích thước 28 mm x 14 mm; sơn màu đỏ cờ, viền ngoài màu vàng.

2. Thân huy hiệu: Hình sao vàng năm cánh cách điệu dập nổi, đường kính đường tròn ngoại tiếp năm đỉnh sao bằng 50 mm, phía trong có lá cờ quyết thắng màu đỏ, phía dưới là hai cành tùng, xung quanh có dòng chữ “Anh hùng Lực lượng vũ trang nhân dân”, “Việt Nam” màu đỏ; chất liệu bằng đồng đỏ mạ vàng hợp kim Ni-Co.

Điều 96. Mẫu huy hiệu “Anh hùng Lao động”, “Tỉnh Anh hùng”, “Thành phố Anh hùng”

1. Cuống huy hiệu: Chất liệu bằng đồng đỏ mạ vàng hợp kim Ni-Co, kích thước 28 mm x 14 mm; sơn màu đỏ cờ, viền ngoài màu vàng.

2. Thân huy hiệu: Hình sao vàng năm cánh cách điệu dập nổi, đường kính đường tròn ngoại tiếp năm đỉnh sao bằng 50 mm, có cành tùng hai bên, bên trong là bánh xe lịch sử và vòng tròn khoa học đặt trên quyển sách, xung quanh có dòng chữ “Anh hùng Lao động” hoặc “Tỉnh Anh hùng” hoặc “Thành phố Anh hùng” màu đỏ, dưới là dải lụa vàng mang dòng chữ “Việt Nam” màu đỏ; chất liệu bằng đồng đỏ mạ vàng hợp kim Ni-Co.

Điều 97. Mẫu huy hiệu “Nhà giáo nhân dân”, “Nhà giáo ưu tú”

1. Cuống huy hiệu: Chất liệu bằng đồng đỏ mạ vàng hợp kim Ni-Co, kích thước 28 mm x 15 mm; sơn màu đỏ cờ đối với huy hiệu “Nhà giáo nhân dân”, màu vàng đối với huy hiệu “Nhà giáo ưu tú”, viền ngoài màu vàng.

2. Thân huy hiệu: Hình tròn đường kính bằng 35 mm, ở giữa là cây bút và quyển vở trên nền màu xanh lá cây, hai bên có bông lúa vàng, phía trên có dòng chữ “Nhà giáo nhân dân” hoặc “Nhà giáo ưu tú” màu đỏ, phía dưới là dải lụa đỏ mang dòng chữ “Việt Nam” màu vàng; chất liệu bằng đồng đỏ mạ vàng hợp kim Ni-Co.

Điều 98. Mẫu huy hiệu “Thầy thuốc nhân dân”, “Thầy thuốc ưu tú”

1. Cuống huy hiệu: Chất liệu bằng đồng đỏ mạ vàng hợp kim Ni-Co, kích thước 28 mm x 15 mm; sơn màu đỏ cờ đối với huy hiệu “Thầy thuốc nhân dân”, màu vàng đối với huy hiệu “Thầy thuốc ưu tú”, viền ngoài màu vàng.

2. Thân huy hiệu: Hình hoa hướng dương, đường kính bằng 35 mm; ở giữa là biểu tượng ngành y và ngôi sao màu đỏ, hai bên là cành nguyệt quế, phía trên là dòng chữ “Thầy thuốc nhân dân” hoặc “Thầy thuốc ưu tú” màu đỏ, phía dưới là dải lụa đỏ mang dòng chữ “Việt Nam” màu vàng; chất liệu bằng đồng đỏ mạ vàng hợp kim Ni-Co.

Điều 99. Mẫu huy hiệu “Nghệ sĩ nhân dân”, “Nghệ sĩ ưu tú”

1. Cuống huy hiệu: Chất liệu bằng đồng đỏ mạ vàng hợp kim Ni-Co, kích thước 28 mm x 15 mm; sơn màu đỏ cờ đối với huy hiệu “Nghệ sĩ nhân dân”, màu vàng đối với huy hiệu “Nghệ sĩ ưu tú”, viền ngoài màu vàng.

2. Thân huy hiệu: Hình sao tám cánh cách điệu, đường kính bằng 35 mm, ở giữa là hình mặt nạ và hoa sen cách điệu, phía trên có dòng chữ “Nghệ sĩ nhân dân” hoặc “Nghệ sĩ ưu tú” màu đỏ, phía dưới là dải lụa đỏ mang dòng chữ “Việt Nam” màu vàng; chất liệu bằng đồng đỏ mạ vàng hợp kim Ni-Co.

Điều 100. Mẫu huy hiệu “Nghệ nhân nhân dân”, “Nghệ nhân ưu tú”

1. Cuống huy hiệu: Chất liệu bằng đồng đỏ mạ vàng hợp kim Ni-Co, kích thước 28 mm x 15 mm; sơn màu đỏ cờ đối với huy hiệu “Nghệ nhân nhân dân”, màu vàng đối với huy hiệu “Nghệ nhân ưu tú”, viền ngoài màu vàng.

2. Thân huy hiệu: Hình cánh hoa cách điệu, đường kính bằng 35 mm, ở giữa là hai bàn tay nâng bản đồ Việt Nam trên nền đỏ, xung quanh có bánh xe lịch sử, phía trên là dòng chữ “Nghệ nhân nhân dân” hoặc “Nghệ nhân ưu tú” màu đỏ, phía dưới là dải lụa đỏ mang dòng chữ “Việt Nam” màu vàng; chất liệu bằng đồng đỏ mạ vàng hợp kim Ni-Co.

Điều 101. Mẫu huy hiệu “Chiến sĩ thi đua toàn quốc”

1. Cuống huy hiệu: Chất liệu bằng đồng đỏ mạ vàng hợp kim Ni-Co, kích thước 26 mm x 14 mm; sơn nền và viền ngoài màu vàng.

2. Thân huy hiệu: Hình sao vàng năm cánh cách điệu dập nổi, đường kính đường tròn ngoại tiếp năm đỉnh sao bằng 42 mm, phía trong có hai bông lúa vàng, trang sách và bánh xe lịch sử, xung quanh có dòng chữ “Chiến sĩ thi đua toàn quốc” màu đỏ; chất liệu bằng đồng đỏ mạ vàng hợp kim Ni-Co.

Điều 102. Mẫu bằng của các hình thức khen thưởng và danh hiệu thi đua thuộc thẩm quyền quyết định của Chủ tịch nước, Chính phủ, Thủ tướng Chính phủ

1. Hình thức:

a) Kích thước bằng được in trên khổ giấy A3 (kích thước 420 mm x 297 mm); kích thước bên ngoài đường diềm hoa văn là 360 mm x 237 mm;

b) Họa tiết hoa văn trang trí xung quanh:

Đường diềm và bốn góc bên ngoài đường diềm được trang trí bằng các họa tiết hoa văn. Riêng đối với các bằng huy chương và bằng danh hiệu vinh dự nhà nước “ưu tú”, “Bằng khen của Thủ tướng Chính phủ”, bằng “Chiến sĩ thi đua toàn quốc” không có hoa văn bốn góc bên ngoài đường diềm.

Chính giữa phía trên là Quốc huy Nước Cộng hòa xã hội chủ nghĩa Việt Nam, hai bên có các khối hoa văn chuyển tiếp giữa Quốc huy và đường diềm trang trí. Riêng bằng chứng nhận “Chiến sĩ thi đua toàn quốc” thay khối hoa văn chuyển tiếp bằng hàng cờ đỏ hai bên.

Hình ảnh của thân huân chương, huy chương, huy hiệu được đặt ở giữa phía dưới đường diềm trang trí. Riêng bằng “Huân chương Hồ Chí Minh” dùng hình bông sen thay cho hình ảnh thân của Huân chương;

c) Hình nền:

Bằng “Huân chương Sao vàng” sử dụng họa tiết trống đồng và hình ngôi sao ở giữa.

Bằng “Huân chương Hồ Chí Minh” sử dụng họa tiết hoa sen.

Bằng: “Huân chương Quân công”, “Huân chương Chiến công”, “Huy chương Chiến sĩ vẻ vang”, “Huy chương Vì an ninh Tổ quốc”, “Huy chương Quân kỳ quyết thắng”, “Anh hùng Lực lượng vũ trang nhân dân” sử dụng hình ngôi sao có ánh hào quang tỏa sáng.

Bằng “Huân chương Bảo vệ Tổ quốc” sử dụng họa tiết trống đồng và bản đồ Việt Nam ở giữa.

Bằng: “Huân chương Độc lập”, “Huân chương Lao động”, “Huân chương Dũng cảm”, “Huân chương Đại đoàn kết dân tộc”, “Huân chương Hữu nghị”, “Huy chương Hữu nghị”, danh hiệu vinh dự nhà nước sử dụng họa tiết trống đồng.

“Bằng khen của Thủ tướng Chính phủ” sử dụng họa tiết vân mây.

Bằng chứng nhận “Chiến sĩ thi đua toàn quốc” sử dụng biểu tượng Đại hội thi đua yêu nước toàn quốc.

2. Nội dung:

a) Quốc hiệu: “CỘNG HÒA XÃ HỘI CHỦ NGHĨA VIỆT NAM” được trình bày bằng chữ in hoa, phông chữ “Times New Roman”, cỡ chữ 15, kiểu chữ đứng, đậm, màu đen;

b) Tiêu ngữ: “Độc lập - Tự do - Hạnh phúc” được trình bày bằng chữ in thường, phông chữ “Times New Roman”, cỡ chữ 16, kiểu chữ đứng, đậm, màu đen và ở liền phía dưới Quốc hiệu; chữ cái đầu của các cụm từ được viết hoa, giữa các cụm từ có gạch nối, có cách chữ; phía dưới có đường kẻ ngang, nét liền, có độ dài bằng độ dài của dòng chữ;

c) Thẩm quyền quyết định khen thưởng:

Ghi tách làm 2 dòng “CHỦ TỊCH” và “NƯỚC CỘNG HÒA XÃ HỘI CHỦ NGHĨA VIỆT NAM” đối với bằng của các hình thức khen thưởng của Chủ tịch nước hoặc “THỦ TƯỚNG” và “CHÍNH PHỦ NƯỚC CỘNG HÒA XÃ HỘI CHỦ NGHĨA VIỆT NAM” đối với bằng của các hình thức khen thưởng của Thủ tướng Chính phủ; chữ in hoa, phông chữ “Times New Roman”, cỡ chữ 26 cho dòng trên và cỡ chữ 20 cho dòng dưới, kiểu chữ đứng, đậm, màu đỏ;

d) Tính chất tặng thưởng:

Ghi là “TẶNG” hoặc “TRUY TẶNG” đối với các bằng: Huân, huy chương, “Giải thưởng Hồ Chí Minh”, “Giải thưởng Nhà nước”, “Bằng khen của Thủ tướng Chính phủ”; “TẶNG DANH HIỆU” hoặc “TRUY TẶNG DANH HIỆU” đối với các bằng danh hiệu vinh dự nhà nước và “TẶNG DANH HIỆU” đối với bằng “Chiến sĩ thi đua toàn quốc”; chữ in hoa, phông chữ “Times New Roman”, cỡ chữ 24, kiểu chữ đứng, đậm, màu đen;

đ) Tên hình thức khen thưởng hoặc danh hiệu thi đua: Chữ in hoa, phông chữ “Times New Roman”, cỡ chữ 42, kiểu chữ đứng, đậm, màu đỏ;

e) Hạng của các hình thức khen thưởng (nếu có), tên của đơn vị, cá nhân được khen thưởng: Chữ in hoa kiểu chữ đứng, đậm, màu đen; địa chỉ (hoặc chức vụ, đơn vị công tác đối với cá nhân đang công tác ở các cơ quan đơn vị hoặc cơ quan chủ quản đối với tập thể), thành tích của tập thể, cá nhân được khen thưởng; chữ in thường, phông chữ “Times New Roman”, cỡ chữ căn chỉnh cho phù hợp, kiểu chữ nghiêng, đậm, màu đen;

g) Số quyết định, ngày, tháng, năm của quyết định ghi theo số, ngày, tháng, năm ban hành quyết định; “Số sổ vàng” ghi số thứ tự của đối tượng được khen thưởng trong quyết định; chữ của hai dòng in thường; phông chữ “Times New Roman”, cỡ chữ 14, kiểu chữ nghiêng, đậm, màu đen;

h) Địa danh, ngày, tháng, năm: Chữ in thường, phông chữ “Times New Roman”, cỡ chữ 15, kiểu chữ nghiêng, đậm, màu đen;

i) Chức vụ của người có thẩm quyền quyết định khen thưởng: Ghi là “CHỦ TỊCH” đối với các quyết định khen thưởng thuộc thẩm quyền của Chủ tịch nước hoặc “THỦ TƯỚNG” đối với các quyết định khen thưởng thuộc thẩm quyền của Thủ tướng Chính phủ; chữ in hoa, phông chữ “Times New Roman”, cỡ chữ 14, kiểu chữ đứng, đậm, màu đen;

k) Khoảng trống để ký tên, đóng dấu, ghi họ và tên người có thẩm quyền quyết định khen thưởng.

Mẫu bằng được minh họa tại Phụ lục II.2 kèm theo Nghị định này.

Điều 103. Mẫu bằng khen của bộ, ban, ngành, tỉnh, bằng khen của tổ chức chính trị, tổ chức chính trị-xã hội ở cấp tỉnh; bằng khen cấp quân khu, quân chủng, quân đoàn, binh chủng, tổng cục và tương đương thuộc Bộ Quốc phòng, bằng khen của Ban Cơ yếu Chính phủ; bằng khen của Đại học Quốc gia; bằng chứng nhận chiến sĩ thi đua bộ, ban, ngành, tỉnh

1. Hình thức:

a) Kích thước: Bằng được in trên khổ giấy kích thước là 360 mm x 237 mm;

b) Họa tiết trang trí xung quanh:

Đường diềm được trang trí bằng các họa tiết hoa văn nhưng không được giống hoặc tương tự với các bằng khen cấp nhà nước.

Chính giữa phía trên là Quốc huy Nước Cộng hòa xã hội chủ nghĩa Việt Nam; là biểu tượng của các cơ quan tổ chức thay cho Quốc huy đối với bằng khen, bằng chiến sĩ thi đua của các ban của Đảng, đoàn thể Trung ương, bằng khen của tổ chức chính trị, tổ chức chính trị - xã hội ở cấp tỉnh. Không có hoa văn bốn góc bên ngoài đường diềm trang trí và khối hoa văn chuyển tiếp giữa Quốc huy và đường diềm trang trí. Đối với bằng chứng nhận chiến sĩ thi đua có thêm hàng cờ đỏ hai bên Quốc huy hoặc biểu tượng của cơ quan, tổ chức;

c) Hình nền bằng do cơ quan có thẩm quyền ban hành quyết định quy định đảm bảo không được giống với hình nền các bằng do Chủ tịch nước và Thủ tướng Chính phủ tặng hoặc truy tặng.

2. Nội dung:

Nội dung, bố cục, phông chữ, cỡ chữ do các cơ quan, đơn vị có thẩm quyền khen thưởng quy định đảm bảo đẹp, trang trọng và có các nội dung chủ yếu sau:

a) Dòng thứ nhất, dòng thứ hai ghi:

Quốc hiệu “CỘNG HÒA XÃ HỘI CHỦ NGHĨA VIỆT NAM” được trình bày bằng chữ in hoa, kiểu chữ đứng, đậm màu đen.

Tiêu ngữ “Độc lập - Tự do - Hạnh phúc” được trình bày bằng chữ in thường, kiểu chữ đứng, đậm, màu đen và ở liền phía dưới Quốc hiệu; chữ cái đầu của các cụm từ được viết hoa, giữa các cụm từ có gạch nối, có cách chữ; phía dưới có đường kẻ ngang, nét liền, có độ dài bằng độ dài của dòng chữ.

Đối với các bằng khen, bằng chiến sĩ thi đua của các cơ quan Đảng thay dòng Quốc hiệu bằng dòng chữ “ĐẢNG CỘNG SẢN VIỆT NAM” chữ in hoa, kiểu chữ đứng, đậm, màu đen;

b) Dòng thứ ba: Ghi “chức vụ của người có thẩm quyền quyết định khen thưởng”; chữ in hoa, kiểu chữ đứng, đậm, màu đỏ;

c) Dòng thứ tư: Ghi tính chất tặng thưởng.

Ghi là “TẶNG” đối với bằng khen hoặc “TẶNG DANH HIỆU” đối với bằng chứng nhận chiến sĩ thi đua; chữ in hoa, kiểu chữ đứng, đậm, màu đen;

d) Dòng thứ năm: Ghi tên hình thức khen thưởng hoặc danh hiệu thi đua; chữ in hoa, kiểu chữ đứng, đậm, màu đỏ;

đ) Các dòng tiếp theo: Dùng để ghi tên của tập thể, cá nhân, hộ gia đình được khen thưởng; địa chỉ hoặc chức danh đơn vị công tác đối với cá nhân đang công tác ở các cơ quan đơn vị hoặc cơ quan chủ quản đối với tập thể, thành tích của tập thể, cá nhân, hộ gia đình được khen thưởng; chữ màu đen;

e) Ở phía dưới bên trái: Là “Số quyết định, ngày, tháng, năm” ghi theo số, ngày, tháng, năm ban hành quyết định; “Số sổ vàng” đặt dưới dòng số quyết định ghi số thứ tự của đối tượng được khen thưởng trong quyết định; chữ của hai dòng in thường, kiểu chữ nghiêng, đậm, màu đen;

g) Phía dưới bên phải: Ghi địa danh, ngày, tháng, năm; chữ in thường, kiểu chữ nghiêng, đậm, màu đen.

Dưới dòng địa danh là dòng chữ ghi chức vụ của người có thẩm quyền quyết định khen thưởng, chữ in hoa, kiểu chữ đứng, đậm, màu đen;

h) Khoảng trống để ký tên, đóng dấu, ghi họ và tên người có thẩm quyền quyết định khen thưởng.

Điều 104. Mẫu giấy khen, bằng “Chiến sĩ thi đua cơ sở”

1. Hình thức:

a) Kích thước: Bằng được in trên khổ giấy A4, kích thước là 297 mm x 210 mm;

b) Họa tiết hoa văn trang trí xung quanh:

Đường diềm được trang trí bằng các họa tiết hoa văn nhưng không được giống hoặc tương tự với hoa văn trên các bằng khen cấp Nhà nước.

Chính giữa phía trên là:

Quốc huy Nước Cộng hòa xã hội chủ nghĩa Việt Nam đối với “Giấy khen” và bằng chứng nhận “Chiến sĩ thi đua cơ sở” của Thủ trưởng cơ quan, đơn vị thuộc bộ, ngành, cơ quan ngang bộ, cơ quan thuộc Chính phủ, Thủ trưởng cơ quan chuyên môn và tương đương thuộc Ủy ban nhân dân cấp tỉnh, Chủ tịch Ủy ban nhân dân cấp huyện, “Giấy khen” của Chủ tịch Ủy ban nhân dân cấp xã.

Biểu tượng của các cơ quan, tổ chức đối với “Giấy khen”, bằng chứng nhận “Chiến sĩ thi đua cơ sở” của tổ chức chính trị, tổ chức chính trị xã hội, tổ chức xã hội, “Giấy khen” của Chủ tịch Hội đồng quản trị, Chủ tịch Hội đồng thành viên, Tổng Giám đốc, Giám đốc doanh nghiệp, hợp tác xã.

Đối với bằng chứng nhận “Chiến sĩ thi đua cơ sở” có thêm hàng cờ đỏ hai bên Quốc huy hoặc biểu tượng của các cơ quan đoàn thể.

Không có hoa văn bốn góc bên ngoài đường diềm và khối hoa văn chuyển tiếp giữa Quốc huy và đường diềm trang trí;

c) Hình nền bằng để trắng.

2. Nội dung:

Nội dung do các cơ quan, đơn vị có thẩm quyền khen thưởng quy định, về bố cục, phông chữ, cỡ chữ đảm bảo tính thẩm mỹ và có các nội dung chủ yếu sau:

a) Dòng thứ nhất, dòng thứ hai ghi:

Quốc hiệu “CỘNG HÒA XÃ HỘI CHỦ NGHĨA VIỆT NAM” được trình bày bằng chữ in hoa, kiểu chữ đứng, đậm, màu đen.

Tiêu ngữ “Độc lập - Tự do - Hạnh phúc” được trình bày bằng chữ in thường, kiểu chữ đứng, đậm, màu đen và ở liên phía dưới Quốc hiệu; chữ cái đầu của các cụm từ được viết hoa, giữa các cụm từ có gạch nối, có cách chữ; phía dưới có đường kẻ ngang, nét liền, có độ dài bằng độ dài của dòng chữ. Đối với “Giấy khen”, bằng chứng nhận “Chiến sĩ thi đua cơ sở” của các cơ quan Đảng thay dòng Quốc hiệu bằng dòng chữ “ĐẢNG CỘNG SẢN VIỆT NAM” chữ in hoa, kiểu chữ đứng, đậm, màu đen;

b) Dòng thứ ba: Ghi “chức vụ của người có thẩm quyền quyết định khen thưởng”; chữ in hoa, kiểu chữ đứng, đậm, màu đỏ;

c) Dòng thứ tư: Ghi là “TẶNG” đối với giấy khen, “TẶNG DANH HIỆU” đối với bằng chiến sĩ thi đua cơ sở; chữ in hoa, kiểu chữ đứng, đậm, màu đen;

d) Dòng thứ năm: Ghi tên hình thức khen thưởng hoặc danh hiệu thi đua; chữ in hoa, kiểu chữ đứng, đậm, màu đỏ;

đ) Các dòng tiếp theo: Ghi tên của đơn vị, cá nhân được khen thưởng; địa chỉ (hoặc chức danh, đơn vị công tác đối với cá nhân đang công tác ở các cơ quan đơn vị hoặc cơ quan chủ quản đối với tập thể), thành tích của tập thể, cá nhân được khen thưởng; chữ màu đen;

e) Ở phía dưới bên trái: Là “Số quyết định, ngày, tháng, năm” ghi theo số, ngày, tháng, năm ban hành quyết định; “Số sổ vàng” đặt dưới dòng số quyết định ghi số thứ tự của đối tượng được khen thưởng trong quyết định; chữ của hai dòng in thường, kiểu chữ nghiêng, đậm, màu đen;

g) Phía dưới bên phải: Ghi địa danh, ngày, tháng, năm; chữ in thường, kiểu chữ nghiêng, đậm, màu đen.

Dưới dòng địa danh là dòng chữ ghi chức vụ của người có thẩm quyền quyết định khen thưởng; chữ in hoa, kiểu chữ đứng, đậm, màu đen;

h) Khoảng trống để ký tên, đóng dấu, ghi họ và tên người có thẩm quyền quyết định khen thưởng.

Điều 105. Mẫu Bằng kỷ niệm chương của Ủy ban Thường vụ Quốc hội, Kỷ niệm chương của bộ, ban, ngành, tỉnh; bằng chứng nhận “Gia đình văn hóa”

Kích thước được in trên khổ giấy A5, kích thước 210 mm x 148 mm.

Nội dung, họa tiết hoa văn trang trí trên bằng do Ủy ban Thường vụ Quốc hội, bộ, ban, ngành, tỉnh quy định.

Điều 106. Mẫu Bằng danh hiệu “Tập thể lao động xuất sắc”, “Đơn vị quyết thắng”; xã, phường, thị trấn tiêu biểu; thôn, tổ dân phố văn hóa

1. Hình thức:

a) Kích thước: Bằng được in trên khổ giấy A4, kích thước 297 mm x 210 mm;

b) Họa tiết hoa văn trang trí xung quanh:

Đường diềm được trang trí bằng các họa tiết hoa văn không được giống hoặc tương tự với các bằng khen cấp nhà nước.

Chính giữa phía trên là Quốc huy Nước Cộng hòa xã hội chủ nghĩa Việt Nam và hàng cờ đỏ hai bên (đối với các bằng chứng nhận thuộc thẩm quyền của Bộ trưởng, Thủ trưởng cơ quan ngang bộ, cơ quan thuộc Chính phủ, Chánh án Tòa án nhân dân tối cao, Viện trưởng Viện kiểm sát nhân dân tối cao, Chủ nhiệm Văn phòng Quốc hội, Chủ nhiệm Văn phòng Chủ tịch nước, Tổng Kiểm toán nhà nước, Chủ tịch Ủy ban nhân dân cấp tỉnh, cấp huyện và Thủ trưởng các cơ quan đơn vị có thẩm quyền thuộc Bộ Quốc phòng); là biểu tượng của các cơ quan, tổ chức và hàng cờ đỏ hai bên (đối với các bằng chứng nhận thuộc thẩm quyền Trưởng các Ban của Đảng và tương đương ở trung ương, Chánh Văn phòng Trung ương Đảng, lãnh đạo cơ quan trung ương Mặt trận Tổ quốc Việt Nam và các đoàn thể);

c) Hình nền bằng để trắng.

2. Nội dung:

Nội dung do các cơ quan, đơn vị có thẩm quyền khen thưởng quy định. Bố cục, phông chữ, cỡ chữ đảm bảo tính thẩm mỹ và có các nội dung chủ yếu sau:

a) Dòng thứ nhất, dòng thứ hai ghi:

Quốc hiệu “CỘNG HÒA XÃ HỘI CHỦ NGHĨA VIỆT NAM” được trình bày bằng chữ in hoa, kiểu chữ đứng, đậm, màu đen.

Tiêu ngữ “Độc lập - Tự do - Hạnh phúc” được trình bày bằng chữ in thường, kiểu chữ đứng, đậm, màu đen và ở liền phía dưới Quốc hiệu; chữ cái đầu của các cụm từ được viết hoa, giữa các cụm từ có gạch nối, có cách chữ; phía dưới có đường kẻ ngang, nét liền, có độ dài bằng độ dài của dòng chữ.

Đối với các danh hiệu thuộc thẩm quyền Trưởng các Ban của Đảng, Chánh Văn phòng Trung ương Đảng thay dòng Quốc hiệu và tiêu ngữ bằng dòng chữ “ĐẢNG CỘNG SẢN VIỆT NAM” chữ in hoa, kiểu chữ đứng, đậm, màu đen;

b) Dòng thứ ba: Ghi “chức vụ của người có thẩm quyền quyết định khen thưởng”; chữ in hoa, kiểu chữ đứng, đậm, màu đỏ;

c) Dòng thứ tư: Ghi tính chất tặng thưởng: Ghi là “TẶNG DANH HIỆU” chữ in hoa, kiểu chữ đứng, đậm, màu đen;

d) Dòng thứ năm: Ghi tên danh hiệu thi đua; chữ in hoa, kiểu chữ đứng, đậm, màu đỏ;

đ) Các dòng tiếp theo ghi tên của đơn vị được tặng danh hiệu thi đua; địa chỉ (hoặc cơ quan chủ quản đối với tập thể), thành tích của tập thể được khen thưởng; chữ màu đen;

e) Ở phía dưới bên trái: Là “Số quyết định, ngày, tháng, năm” ghi theo số, ngày tháng năm ban hành quyết định; “Số sổ vàng” đặt dưới dòng số quyết định ghi số thứ tự của đối tượng được khen thưởng trong quyết định; chữ của hai dòng in thường, kiểu chữ nghiêng, đậm, màu đen;

g) Phía dưới bên phải: Ghi địa danh, ngày, tháng, năm; chữ in thường, kiểu chữ nghiêng, đậm, màu đen.

Ngay dưới dòng địa danh là dòng chữ ghi chức vụ của người có thẩm quyền quyết định khen thưởng, chữ in hoa, kiểu chữ đứng, đậm, màu đen;

h) Khoảng trống để ký tên, đóng dấu, ghi họ và tên người có thẩm quyền quyết định khen thưởng.

Điều 107. Mẫu cờ “Tỉnh Anh hùng”, cờ “Thành phố Anh hùng”, cờ “Anh hùng Lực lượng vũ trang nhân dân”, cờ “Anh hùng Lao động”

1. Hình thức: Cờ có kích thước (850 mm x 650 mm); chất liệu: Vải sa tanh hai lớp màu đỏ cờ.

2. Nội dung thêu: Cờ được thêu bằng chỉ màu vàng, chữ in hoa, kiểu chữ đứng, đậm, phông chữ và cỡ chữ tùy theo nội dung của cờ để căn chỉnh cho phù hợp đảm bảo đẹp, trang trọng và có các nội dung chính sau:

a) Dòng thứ nhất: “CHỦ TỊCH NƯỚC CỘNG HÒA XÃ HỘI CHỦ NGHĨA VIỆT NAM”; chữ in hoa, kiểu chữ đứng đậm;

b) Dòng thứ hai: “TẶNG DANH HIỆU” chữ in hoa, kiểu chữ đứng đậm;

c) Phía dưới dòng thứ 2, chính giữa là ngôi sao vàng năm cánh;

d) Dưới ngôi sao ghi tên danh hiệu thi đua (“ANH HÙNG LAO ĐỘNG” hoặc “ANH HÙNG LỰC LƯỢNG VŨ TRANG NHÂN DÂN” hoặc “TỈNH ANH HÙNG” “THÀNH PHỐ ANH HÙNG”) chữ in hoa, kiểu chữ đứng đậm và cuối cùng là dòng ghi “(tên đơn vị được khen thưởng)”.

Mẫu cờ được minh họa tại Phụ lục II.3 kèm theo Nghị định này.

Điều 108. Mẫu “Cờ thi đua của Chính phủ”

1. Hình thức: Cờ có kích thước (850 mm x 650 mm); chất liệu: Vải sa tanh hai lớp màu đỏ cờ.

2. Nội dung thêu: Cờ được thêu bằng chỉ màu vàng, chữ in hoa, kiểu chữ đứng, đậm, phông chữ và cỡ chữ tùy theo nội dung của cờ để căn chỉnh cho phù hợp đảm bảo đẹp, trang trọng và có các nội dung chính sau:

a) Dòng thứ nhất: “CHÍNH PHỦ NƯỚC CỘNG HÒA XÃ HỘI CHỦ NGHĨA VIỆT NAM”; chữ in hoa, kiểu chữ đứng, đậm;

b) Dòng thứ hai: “TẶNG”; chữ in hoa, kiểu chữ đứng, đậm;

c) Phía dưới dòng thứ 2, chính giữa là ngôi sao vàng năm cánh;

d) Dưới ngôi sao là “(tên đơn vị được tặng thưởng Cờ thi đua của Chính phủ)” và dòng “ĐƠN VỊ XUẤT SẮC TRONG PHONG TRÀO THI ĐUA NĂM HOẶC PHONG TRÀO THI ĐUA”; năm được ghi là năm đơn vị có thành tích được xét tặng danh hiệu, phong trào thi đua được ghi là phong trào thi đua do Thủ tướng Chính phủ phát động; chữ in hoa, kiểu chữ đứng, đậm.

Mẫu cờ được minh họa tại Phụ lục II.3 kèm theo Nghị định này.

Điều 109. Mẫu Cờ thi đua của bộ, ban, ngành, tỉnh

1. Hình thức: Cờ có kích thước (800 mm x 600 mm); chất liệu: Vải sa tanh hai lớp màu đỏ cờ.

2. Nội dung thêu: Cờ được thêu bằng chỉ màu vàng, chữ in hoa, kiểu chữ đứng, đậm, phông chữ và cỡ chữ tùy theo nội dung của cờ để căn chỉnh cho phù hợp đảm bảo đẹp, trang trọng và có các nội dung chính sau:

a) Dòng thứ nhất: “(ghi tên bộ, ngành, đoàn thể trung ương, tỉnh, thành phố trực thuộc trung ương)”; chữ in hoa, kiểu chữ đứng, đậm;

b) Dòng thứ hai: “TẶNG”; chữ in hoa, kiểu chữ đứng, đậm;

c) Dưới dòng thứ 2, chính giữa là ngôi sao vàng năm cánh;

d) Dưới ngôi sao là dòng chữ “(tên đơn vị được tặng thưởng Cờ thi đua)” và dòng “ĐƠN VỊ DẪN ĐẦU PHONG TRÀO THI ĐUA NĂM HOẶC PHONG TRÀO THI ĐUA”, năm được ghi là năm đơn vị có thành tích được xét tặng danh hiệu, phong trào thi đua được ghi là phong trào thi đua do bộ, ban, ngành, tỉnh phát động; chữ in hoa, kiểu chữ đứng, đậm.

Điều 110. Mẫu Cờ thi đua của quân khu, quân chủng, quân đoàn, binh chủng, tổng cục và tương đương thuộc Bộ Quốc phòng, cờ thi đua của Ban Cơ yếu Chính phủ, cờ thi đua của Đại học Quốc gia

1. Hình thức: Cờ có kích thước (750 mm x 550 mm); chất liệu: Vải sa tanh hai lớp màu đỏ cờ.

2. Nội dung thêu: Do Bộ Quốc phòng, Bộ Giáo dục và Đào tạo quy định.

Điều 111. Mẫu khung Bằng danh hiệu thi đua, hình thức khen thưởng

Khung được cấp cùng với bằng của các hình thức khen thưởng và danh hiệu thi đua. Việc quy định mẫu khung như sau:

1. Mẫu khung bằng của các hình thức khen thưởng và danh hiệu thi đua thuộc thẩm quyền của Chủ tịch nước và Thủ tướng Chính phủ có kích thước, chất liệu đảm bảo đẹp, trang trọng phù hợp với kích thước của bằng, hình thức khen thưởng.

2. Khung bằng của các hình thức khen thưởng và danh hiệu thi đua khác do cơ quan có thẩm quyền ban hành quyết định khen thưởng quy định kích thước, chất liệu đảm bảo đẹp, trang trọng phù hợp với từng hình thức khen thưởng.

Điều 112. Hộp đựng huân chương, huy chương, huy hiệu danh hiệu vinh dự nhà nước, huy hiệu “Chiến sĩ thi đua toàn quốc”, Kỷ niệm chương; Hộp đựng khung bằng của các danh hiệu thi đua và hình thức khen thưởng thuộc thẩm quyền quyết định của Chủ tịch nước, Chính phủ, Thủ tướng Chính phủ

1. Hộp đựng huân chương, huy chương, huy hiệu danh hiệu vinh dự nhà nước, huy hiệu “Chiến sĩ thi đua toàn quốc” có kích thước, chất liệu đảm bảo đẹp, trang trọng phù hợp với từng hình thức khen thưởng. Nắp phía trên bên ngoài hộp có in hình Quốc huy.

2. Hộp đựng Kỷ niệm chương quy định tại Điều 71 của Luật Thi đua, khen thưởng do cơ quan có thẩm quyền ban hành quyết định tặng Kỷ niệm chương quy định mẫu, kích thước, chất liệu Kỷ niệm chương đảm bảo đẹp, trang trọng.

3. Hộp đựng khung bằng của các danh hiệu thi đua và hình thức khen thưởng thuộc thẩm quyền quyết định của Chủ tịch nước, Chính phủ, Thủ tướng Chính phủ có mẫu, kích thước, chất liệu đảm bảo đẹp, trang trọng phù hợp với kích thước khung bằng các danh hiệu thi đua, hình thức khen thưởng thuộc thẩm quyền quyết định của Chủ tịch nước, Chính phủ, Thủ tướng Chính phủ.

Mục 2. THỦ TỤC CẤP ĐỔI, CẤP LẠI HIỆN VẬT KHEN THƯỞNG

Điều 113. Quản lý, cấp phát hiện vật khen thưởng

1. Bộ Nội vụ có trách nhiệm mua sắm, bảo quản và cấp phát hiện vật khen thưởng cấp Nhà nước cho các bộ, ban, ngành, tỉnh có cá nhân, tập thể, hộ gia đình được khen thưởng; quản lý, hướng dẫn, kiểm tra việc cấp phát hiện vật khen thưởng cấp Nhà nước của các bộ, ban, ngành, tỉnh cho các cá nhân, tập thể, hộ gia đình được khen thưởng.

2. Bộ, ban, ngành, tỉnh tổ chức trao tặng các danh hiệu thi đua, hình thức khen thưởng của Chủ tịch nước, Chính phủ và Thủ tướng Chính phủ kèm theo hiện vật khen thưởng cho cá nhân, tập thể, hộ gia đình được khen thưởng.

3. Đối với các danh hiệu thi đua, hình thức khen thưởng khác do cơ quan có thẩm quyền quyết định khen thưởng tổ chức mua sắm, bảo quản, trao tặng và cấp phát hiện vật khen thưởng.

4. Cá nhân, tập thể, hộ gia đình được tặng danh hiệu thi đua, hình thức khen thưởng có quyền lưu giữ, trưng bày, bảo quản và sử dụng hiện vật khen thưởng lâu dài, đúng mục đích và ý nghĩa. Tập thể được sử dụng biểu tượng của các hiện vật khen thưởng đã được tặng thưởng để tuyên truyền trên các văn bản, tài liệu chính thức của tập thể.

Điều 114. Cấp đổi hiện vật khen thưởng

1. Hồ sơ đề nghị cấp đổi hiện vật khen thưởng cấp Nhà nước có 01 bộ (bản chính) gồm:

a) Công văn đề nghị cấp đổi của tập thể hoặc đơn đề nghị cấp đổi của cá nhân, hộ gia đình khi có hiện vật khen thưởng bị hư hỏng không còn giá trị sử dụng và hư hỏng vì lý do khách quan như thiên tai, lũ lụt, hỏa hoạn hoặc do in sai bằng kèm theo hiện vật khen thưởng đề nghị cấp đổi;

b) Công văn đề nghị cấp đổi của bộ, ban, ngành, tỉnh kèm danh sách theo Mẫu 4.5 Phụ lục II.4 gửi Bộ Nội vụ đề nghị cấp đổi hiện vật khen thưởng cấp Nhà nước.

2. Thủ tục cấp đổi hiện vật khen thưởng cấp Nhà nước:

a) Tập thể có công văn, cá nhân, hộ gia đình có đơn đề nghị cấp đổi (Mẫu 4.1 và 4.2 Phụ lục II.4) gửi bộ, ban, ngành, tỉnh (nơi đang công tác hoặc nơi cư trú) kèm theo hiện vật khen thưởng đề nghị cấp đổi;

b) Bộ, ban, ngành, tỉnh tổng hợp và gửi công văn đề nghị cấp đổi kèm theo danh sách (Mẫu số 4.5 Phụ lục II.4) và hiện vật khen thưởng cũ, hư hỏng gửi Bộ Nội vụ xem xét, cấp đổi;

c) Xác nhận khen thưởng và thực hiện cấp đổi hiện vật khen thưởng:

Căn cứ công văn đề nghị cấp đổi hiện vật khen thưởng của bộ, ban, ngành, tỉnh, Bộ Nội vụ tra cứu, xác nhận khen thưởng và thực hiện cấp đổi hiện vật khen thưởng đồng thời thu lại hiện vật khen thưởng cũ hỏng.

Hiện vật khen thưởng cấp đổi do Bộ Nội vụ chịu trách nhiệm mua sắm, in ấn theo mẫu quy định. Riêng các hình thức khen thưởng cấp Nhà nước trước đây (hiện nay không quy định trong Luật Thi đua, khen thưởng) thì cấp theo mẫu tại thời điểm tập thể, cá nhân được quyết định khen thưởng.

Mẫu bằng cấp đổi in theo thiết kế tại thời điểm tập thể, cá nhân được khen thưởng, trong đó phía dưới bên phải bằng in sẵn mẫu con dấu và chữ ký của người có thẩm quyền khen thưởng tại thời điểm đó; phía dưới bên trái bằng ghi “Quyết định khen thưởng số, ngày, tháng, năm, số sổ vàng” và ghi “chứng nhận cấp đổi bằng số, ngày, tháng, năm” của Bộ Nội vụ”. Tập thể, cá nhân khi được cấp đổi bằng sẽ được nhận kèm theo giấy chứng nhận cấp đổi (Mẫu 4.7, Phụ lục II.4)”.

3. Thời gian giải quyết cấp đổi hiện vật khen thưởng cấp Nhà nước:

Bộ, ban, ngành, tỉnh trong thời hạn 15 ngày kể từ ngày nhận được đề nghị cấp đổi của tập thể, cá nhân gửi hồ sơ tới Bộ Nội vụ.

Bộ Nội vụ trong thời hạn 30 ngày kể từ ngày nhận được hồ sơ trả kết quả cấp đổi cho bộ, ban, ngành, tỉnh.

Hàng năm, Bộ Nội vụ có trách nhiệm báo cáo Văn phòng Chủ tịch nước, Văn phòng Chính phủ tình hình cấp đổi hiện vật khen thưởng cấp Nhà nước để theo dõi, phối hợp thực hiện.

4. Hồ sơ, thủ tục, thời gian giải quyết cấp đổi hiện vật khen thưởng khác:

Cơ quan có thẩm quyền quyết định khen thưởng giải quyết cấp đổi hiện vật khen thưởng trong 15 ngày làm việc kể từ ngày nhận được đề nghị cấp đổi.

5. Hiện vật khen thưởng thu lại do cấp đổi, cơ quan có thẩm quyền cấp đổi có trách nhiệm thực hiện thanh lý hoặc xử lý, tiêu hủy theo quy định hiện hành.

Điều 115. Cấp lại hiện vật khen thưởng

1. Hồ sơ đề nghị cấp lại hiện vật khen thưởng cấp Nhà nước có 01 bộ (bản chính) gồm:

a) Công văn đề nghị cấp lại của tập thể hoặc đơn đề nghị cấp lại của cá nhân, hộ gia đình khi có hiện vật khen thưởng bị thất lạc, bị mất do khách quan như thiên tai, lũ lụt, hỏa hoạn hoặc do in sai bằng gửi bộ, ban, ngành, tỉnh đã trình khen thưởng cho cá nhân, tập thể, hộ gia đình;

b) Công văn đề nghị cấp lại hiện vật khen thưởng cấp nhà nước của bộ, ban, ngành, tỉnh kèm theo danh sách (Mẫu 4.6, Phụ lục II.4) gửi Bộ Nội vụ.

2. Thủ tục cấp lại hiện vật khen thưởng cấp Nhà nước.

a) Tập thể có công văn, cá nhân, hộ gia đình có đơn đề nghị cấp lại (Mẫu 4.3 và 4.4, Phụ lục II.4) gửi bộ, ban, ngành, tỉnh đã trình khen cho cá nhân, tập thể, hộ gia đình;

b) Bộ, ban, ngành, tỉnh đối chiếu với hồ sơ lưu, xác nhận, tổng hợp và gửi công văn kèm theo danh sách (Mẫu số 4.6, Phụ lục II.4) đến Bộ Nội vụ;

c) Xác nhận khen thưởng và thực hiện cấp lại hiện vật khen thưởng;

Căn cứ công văn đề nghị cấp lại hiện vật khen thưởng của bộ, ban, ngành, tỉnh, Bộ Nội vụ tra cứu hồ sơ, xác nhận khen thưởng và thực hiện cấp lại hiện vật khen thưởng.

Hiện vật khen thưởng cấp lại do Bộ Nội vụ chịu trách nhiệm mua sắm, in ấn theo mẫu quy định như sau:

Mẫu Huân chương, Huy chương, huy hiệu theo quy định tại Nghị định này. Riêng các hình thức khen thưởng cấp nhà nước trước đây (hiện nay không quy định trong Luật Thi đua, khen thưởng) thì cấp theo mẫu tại thời điểm cá nhân, tập thể, hộ gia đình được quyết định khen thưởng.

Mẫu bằng cấp lại in theo thiết kế tại thời điểm cá nhân, tập thể, hộ gia đình được khen thưởng, trong đó phía dưới bên phải bằng in sẵn mẫu con dấu và chữ ký của người có thẩm quyền khen thưởng tại thời điểm đó; phía dưới bên trái bằng ghi “Quyết định khen thưởng số, ngày, tháng, năm, số sổ vàng” và ghi “chứng nhận cấp lại bằng số, ngày, tháng, năm” của Bộ Nội vụ. Tập thể, cá nhân khi được cấp lại bằng sẽ được nhận kèm theo giấy chứng nhận cấp lại (Mẫu 4.8, Phụ lục II.4).

3. Thời gian giải quyết cấp lại hiện vật khen thưởng cấp Nhà nước

Bộ, ban, ngành, tỉnh trong thời hạn 15 ngày kể từ ngày nhận được đề nghị cấp lại của cá nhân, tập thể, hộ gia đình phải xác nhận khen thưởng và gửi hồ sơ tới Bộ Nội vụ.

Bộ Nội vụ trong thời hạn 30 ngày kể từ ngày nhận được hồ sơ trả kết quả cấp lại cho bộ, ban, ngành, tỉnh.

Hằng năm, Bộ Nội vụ có trách nhiệm báo cáo Văn phòng Chủ tịch nước, Văn phòng Chính phủ tình hình cấp lại hiện vật khen thưởng cấp Nhà nước để theo dõi, phối hợp thực hiện.

4. Thời gian giải quyết cấp lại hiện vật khen thưởng khác

Cơ quan có thẩm quyền quyết định khen thưởng giải quyết cấp lại hiện vật khen thưởng trong vòng 15 ngày làm việc kể từ ngày nhận được đề nghị cấp lại.

ĐIỀU KHOẢN THI HÀNH

Điều 116. Hiệu lực thi hành

1. Nghị định này có hiệu lực thi hành từ ngày 01 tháng 01 năm 2024.

2. Nghị định số 91/2017/NĐ-CP ngày 31 tháng 7 năm 2017 của Chính phủ quy định chi tiết thi hành một số điều của Luật Thi đua, khen thưởng; Nghị định số 85/2014/NĐ-CP ngày 10 tháng 9 năm 2014 của Chính phủ, Nghị định số 101/2018/NĐ-CP ngày 20 tháng 7 năm 2018 của Chính phủ sửa đổi, bổ sung một số điều của Nghị định số 85/2014/NĐ-CP ngày 10 tháng 9 năm 2014 của Chính phủ quy định mẫu huân chương, huy chương, huy hiệu, kỷ niệm chương; mẫu bằng, khung, hộp, cờ của các hình thức khen thưởng và danh hiệu thi đua; quản lý, cấp phát, cấp đổi, cấp lại, thu hồi hiện vật khen thưởng; khoản 1, khoản 2, khoản 3 Điều 2 và các Điều 25, Điều 26, Điều 27, Điều 28 của Nghị định số 145/2013/NĐ-CP ngày 29 tháng 10 năm 2013 của Chính phủ quy định về tổ chức ngày kỷ niệm; nghi thức trao tặng, đón nhận hình thức khen thưởng, danh hiệu thi đua; nghi lễ đối ngoại và đón, tiếp khách nước ngoài; Quyết định số 51/2010/QĐ-TTg ngày 28 tháng 7 năm 2010 của Thủ tướng Chính phủ ban hành Quy chế quản lý tổ chức xét tôn vinh danh hiệu và trao giải thưởng cho doanh nhân và doanh nghiệp hết hiệu lực kể từ ngày Nghị định này có hiệu lực thi hành.

Điều 117. Trách nhiệm thi hành

Bộ trưởng, Thủ trưởng cơ quan ngang bộ, cơ quan thuộc Chính phủ, Chủ tịch Ủy ban nhân dân tỉnh, thành phố trực thuộc trung ương, các cơ quan, tổ chức, đơn vị và cá nhân có liên quan chịu trách nhiệm thi hành Nghị định này./
