Regarding the approval of the Pilot Program for Enclosure, Cultivation, and Protection of Very Critical Protective Forests in 21 Border Communes in Lai Chau Province
PRIME MINISTER
Pursuant to the Law on Organization of the Government dated December 25, 2001;
The Government issues this Decree on mechanisms and policies to encourage forest protection, encirclement and regeneration of forests, afforestation, development of non-timber forest products, and increased income in connection with policies to quickly reduce poverty, sustainably and to support ethnic minority groups during the period 2015-2020.
Based on the Land Law dated November 26, 2003;
Pursuant to Decree No. 23/2006/NĐ-CP dated March 3, 2006 of the Government on implementing the Law on Forest Protection and Development;
Considering the proposal of the People's Committee of Lai Chau Province (report No. 732/TTr-UBND dated December 19, 2005), opinions of the Ministries of Agriculture and Rural Development (document No. 141/BNN-LN dated January 18, 2006); Planning and Investment (document No. 516/BKH-KTNN dated January 24, 2006); Finance (document No. 1470/BTC-NSNN dated February 6, 2006).

Article 1. Approve the Pilot Program for Enclosure, Cultivation, and Protection of Very Critical Protective Forests in 21 Border Communes in Lai Chau Province according to the following purposes and requirements:
1. To protect and develop the area of very critical protective forests at the headwaters of major rivers and for key national hydropower projects.
2. To create jobs, establish permanent settlements, stabilize production, improve living standards for ethnic minorities in the region, and reduce poverty rates among people in the 21 communes.
The implementation area is in 21 border communes in Lai Chau Province.
Article 2Direct the People's Committee of Lai Chau Province to guide the planning, project development, land allocation, and long-term stable forest allocation to households, communities, and village residents in the 21 border communes of Lai Chau Province, submit for approval, and organize implementation in accordance with current regulations.
1. The pilot investment for enclosure and protection of forests increases from 50,000 VND/ha/year to 200,000 VND/ha/year. Other costs (surveying, design, project development, provincial-level inspection and guidance fees, grassroots-level inspection and guidance fees...) shall be implemented in accordance with current regulations.
2. The pilot implementation period runs from January 1, 2006 to December 31, 2010. The People's Committee of Lai Chau Province is responsible for summarizing and reporting to the Prime Minister upon completion.
3. Regarding investment capital:
a) Total investment capital (estimated): 132,879,000,000 VND.
b) Source of investment capital: utilize funds from the Program for Planting Five Million Hectares of New Forests, specifically using 2007 funds to implement in 2006.
Article 3. Entrust the Ministry of Agriculture and Rural Development to lead, coordinate with relevant ministries and sectors to provide guidance, supervision, and inspection to ensure that the aforementioned pilot program is carried out in accordance with current regulations and this decision.
Article 4. The Ministry of Planning and Investment and the Ministry of Finance shall adjust and supplement capital to ensure funding for the implementation of the contents of this Decision.
Article 5. This Decision takes effect 15 days after its publication in the Official Gazette.
The Ministers of Agriculture and Rural Development, Planning and Investment, Finance, Natural Resources and Environment, heads of related agencies, and the Chairman of the People's Committee of Lai Chau Province are responsible for implementing this Decision./.
