Pursuant to the State Budget Law dated June 25, 2015;
Pursuant to Decree No. 87/2017/NĐ-CP dated July 26, 2017, issued by the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
Implementing Decision No. 59/QD-TTg dated January 16, 2017 of the Prime Minister on providing certain publications for ethnic minority areas and mountainous regions, and particularly difficult areas;
At the proposal of the Director of the Department of Administrative and Public Financial Affairs;
The Minister of Finance issues this Circular to regulate the management and use of funds to implement the policy of providing certain publications for ethnic minority areas and mountainous regions, and particularly difficult areas during the period 2017-2018.
Article 1. Scope of Regulation
This Circular regulates the management and use of funds to implement the policy of providing certain publications (hereinafter referred to as publications) for ethnic minority areas and mountainous regions, and particularly difficult areas pursuant to Decision No. 59/QD-TTg dated January 16, 2017 of the Prime Minister (hereinafter referred to as Decision No. 59/QD-TTg).
Article 2. Applicability
This Circular applies to agencies, units, and individuals related to the management and use of funds to implement the policy of providing certain publications for ethnic minority areas and mountainous regions, and particularly difficult areas pursuant to Decision No. 59/QD-TTg.
1. The funding for the implementation of the policy on exemption and subsidy of tuition fees shall be guaranteed by the state budget in accordance with the provisions of the law on the decentralization of budget management.
Funds to implement the policy of providing certain publications for ethnic minority areas and mountainous regions, and particularly difficult areas shall be guaranteed by the central budget and allocated in the annual budget of the Committee for Ethnic Minorities.
Article 4. Ordering publication and distribution of annual publications
1. Basis for ordering:
a) The budget estimate of the competent authority assigned to the Committee for Ethnic Minorities to implement the policy of providing certain publications for ethnic minority areas and mountainous regions, and particularly difficult areas pursuant to Decision No. 59/QD-TTg;
b) Order price (including publication costs, distribution costs) of publications: Based on the maximum price levels of publications determined and announced by the Ministry of Finance, the Committee for Ethnic Minorities decides specific prices for each publication;
c) Names of newspapers and magazines participating in publishing publications, names of recipients of publications, and number of publication issues according to Decision No. 59/QD-TTg;
d) Number of recipients of publications and number of publications published and distributed announced by the Committee for Ethnic Minorities;
đ) Specifications and quality of publications according to regulations of the Committee for Ethnic Minorities.
2. Contents of the order contract for publishing and distributing publications shall be implemented in accordance with the provisions of Government Decree No. 130/2013/NĐ-CP dated October 16, 2013 on production and supply of public goods and services.
3. The order contract may be adjusted in the following cases:
a) Change in the order price (publication costs, distribution costs) of publications determined and announced by the Ministry of Finance;
b) Change in the number of recipients of publications; number of issues, number of publications published and distributed according to the decision of the competent authority.
Article 5. Payment of the order contract for publishing and distributing publications
1. Based on the budget estimate assigned by the competent authority; the order contract for publishing and distributing certain publications for ethnic minority areas and mountainous regions, and particularly difficult areas between the Committee for Ethnic Minorities and newspapers, magazines, and the Central Press Distribution Company; the Committee for Ethnic Minorities shall perform:
a) Withdraw the budget estimate at the State Treasury where transactions take place to make the first advance payment to newspapers, magazines, and the Central Press Distribution Company immediately after signing the contract, equal to 30% of the value of the annual contract;
b) Advance payments to newspapers, magazines, and the Central Press Distribution Company: The number of advance payments, time of advance payments, and amount of advance payments shall be carried out according to the agreement in the contract based on the progress of implementing the contract but the maximum amount of advance payment shall not exceed 50% of the value of the annual contract and shall not exceed the annual budget approved by the competent authority.
2. Contract settlement:
a) Newspapers, magazines, and the Central Press Distribution Company shall compile the implementation status of the contract before January 10 of the following year and send it to the Committee for Ethnic Minorities. Within 10 working days from the date of receiving complete documents from newspapers, magazines, and the Central Press Distribution Company, the Committee for Ethnic Minorities shall be responsible for organizing the acceptance, settlement, and payment of the remaining value of the contract (if any) to newspapers, magazines, and the Central Press Distribution Company.
b) Payment of the order contract for publishing publications shall be based on:
- The order contract and the amended order contract (if any);
- The printing contract and the settlement of the printing contract between newspapers, magazines, and printing units;
- The acceptance and settlement contract between the Committee for Ethnic Minorities and newspapers, magazines.
c) Payment of the order contract for distributing publications shall be based on:
- The order contract and the amended order contract (if any);
- The confirmation document on the quantity of publications transferred for distribution between the Central Press Distribution Company and newspapers, magazines;
- The acceptance and settlement contract for distributing publications between the Committee for Ethnic Minorities and the Central Press Distribution Company.
3. The Committee for Ethnic Minorities shall be responsible for providing relevant documents and vouchers to the State Treasury where transactions take place when requesting payment in accordance with Circular No. 161/2012/TT-BTC dated October 2, 2012 of the Ministry of Finance on the control and payment of state budget expenditures through the State Treasury and Circular No. 39/2016/TT-BTC dated March 10, 2016 amending and supplementing some articles of Circular No. 161/2012/TT-BTC dated October 2, 2012 of the Ministry of Finance.
4. Relevant documents directly executed and retained by newspapers, magazines, and the Central Press Distribution Company shall comply with current regulations.
Article 6. Establishment, allocation, management, utilization, and settlement of budget estimates
1. The establishment, allocation, assignment, management, use, and settlement of funds to implement the policy of providing certain publications for ethnic minority areas and mountainous regions, and particularly difficult areas shall be carried out in accordance with the laws on the state budget.
2. Based on the number of recipients of publications; number of publications published and distributed; specific order prices of each publication, the Committee for Ethnic Minorities shall prepare the budget estimate for providing certain publications, included in the annual state budget expenditure plan of the Committee for Ethnic Minorities to submit to the Ministry of Finance for consolidation and submission to the Government and the National Assembly for approval.
For the year 2017, the Committee for Ethnic Minorities shall prepare the budget estimate for providing certain publications to submit to the Ministry of Finance for review and submission
3. Annually, based on the budget approved by the competent authority, the Committee for Ethnic Minority Affairs shall enter into contracts with newspapers, magazines, and the Central Press Distribution Company to publish and distribute certain publications for ethnic minority regions and mountainous areas, and particularly difficult regions within the year.
4. The Committee for Ethnic Minority Affairs is responsible for reviewing the final accounts of the funds allocated to implement the policies stipulated in this Circular and consolidating them into the annual state budget expenditure settlement of the Committee for Ethnic Minority Affairs in accordance with regulations.
Article 7. Effective Date
1. This Circular takes effect from November 20, 2017.
2. The provision of certain newspaper and magazine publications for ethnic minority regions and mountainous areas, and particularly difficult regions becomes effective from the date Decision No. 59/QĐ-TTg comes into force (January 16, 2017).
3. In cases where legal normative documents cited in this Circular are amended, supplemented, or replaced by other legal normative documents, the provisions of the amended, supplemented, or replacing document shall apply.
Article 8. Implementation organization
Agencies and units specified in this Circular and related agencies, units, and individuals are responsible for implementing this Circular. Any difficulties encountered during implementation should be promptly reported to the Ministry of Finance for consideration and resolution.
