On the basis of the Constitution of the Socialist Republic of Vietnam;
Pursuant to the Law on Supervision Activities of the National Assembly and People's Councils No. 87/2015/QH13;
Pursuant to Resolution No. 59/2018/QH14 June 12, 2018, Resolution No. 59/2018/QH14 of the National Assembly on the Supervision Program of the National Assembly in 2019 and Resolution No. 62/2018/QH14 of the National Assembly dated June 15, 2018 on the establishment of the Supervision Delegation "Implementation of Policies and Laws on Fire Prevention and Fighting during the 2014-2018 Period";
Based on reviewing Report No. 41/BC-ĐGS dated October 17, 2019 of the National Assembly's Supervision Delegation on the results of supervising the implementation of policies and laws on fire prevention and fighting during the 2014-2018 period and the opinions of National Assembly deputies;
RESOLUTION:
Article 1
Approving Report No. 41/BC-ĐGS dated October 17, 2019 of the National Assembly's Supervision Delegation on the results of supervising the implementation of policies and laws on fire prevention and fighting during the 2014-2018 period with the achievements made, limitations and inadequacies in fire prevention and fighting work during the 2014-2018 period, and the recommendations proposed by the Supervision Delegation.
Article 2
To enhance the effectiveness and efficiency of implementing policies and laws on fire prevention and fighting. The National Assembly requests the Government to direct ministries, sectors, and localities to study existing shortcomings and limitations, consider adopting and effectively implementing the recommendations proposed in the National Assembly's Supervision Delegation report, while focusing on implementing the following tasks and solutions: fire. National Assembly requests the Government to direct ministries, sectors, localities to study existing shortcomings, consider adopting and effectively implementing proposals and recommendations stated in the Report of the National Assembly's Supervision Team, while focusing on carrying out the following tasks and solutions:
1. Continuing to effectively implement Directive No. 47-CT/TW June 25, 2015 of the Central Committee of the Communist Party of Vietnam on strengthening the leadership of the Party over fire prevention and fighting work, mobilizing the comprehensive strength of the entire political system and the whole people to fulfill fire prevention and firefighting and rescue tasks.
Summarize, review, and research to submit to the National Assembly for amending and supplementing the Law on Fire Prevention and Fighting and related legal provisions; proactively review and amend legal normative documents within their authority to promptly meet practical requirements for economic and social development, ensuring consistency and unity in the legal system.
Direct ministries, sectors, and localities to timely advise on building, amending, supplementing, and promulgating new technical standards and regulations related to fire prevention and fighting; local technical regulations on fire prevention and fighting for certain special types of facilities in each locality; regulations on support policies for personnel engaged in fire prevention and fighting and rescue work commensurate with the nature and requirements of the tasks; specific policies to encourage and motivate all layers of the population to participate in fire prevention and fighting activities.
Urge localities to build and promulgate regulations on handling facilities on their territory that do not meet fire prevention and fighting requirements before the Law on Fire Prevention and Fighting No. 27/2001/QH10 took effect, to be completed by 2021.
2. Develop measures to create significant changes in fire prevention and fighting propaganda, dissemination, and education. Innovate the content, form, methods, and approaches of propaganda to raise awareness of laws, knowledge, and skills in fire prevention and fighting; equip citizens with truly necessary knowledge and skills, especially knowledge about fire prevention and escape techniques, and the use of initial firefighting equipment and devices. Increase broadcasting time and prioritize scheduling broadcasts on fire prevention and fighting work and knowledge and skills in fire prevention and escape. Urgently complete training courses and lectures on fire prevention and fighting knowledge and skills, incorporate them into school curricula and extracurricular activities in educational institutions according to the provisions of the Law on Fire Prevention and Fighting starting from the 2021-2022 academic year.
3. In fire prevention and fighting work, focus on prevention; concentrate on directing the extensive participation of the whole people in fire prevention and fighting activities with the principle of "four at the scene" (local forces, local means, local command, and local logistics), with the core being civilian defense forces, local fire prevention and fighting forces, and specialized fire prevention and fighting forces. Study pilot programs to assign some fire prevention and fighting tasks to neighborhood watch forces and personnel responsible for maintaining public security and order at the grassroots level in accordance with the provisions of the Law on Fire Prevention and Fighting and other relevant laws.
Strengthen the fire prevention and fighting and rescue steering committees at ministries, sectors, and localities to suit practical needs. Clearly define the coordination mechanism between local authorities and agencies and organizations in implementing the "four at the scene" principle in fire prevention and fighting.
Focus on building and promoting exemplary models towards self-protection and self-management in fire prevention and fighting safety at residential clusters and industrial zones; promptly resolve and fairly address benefits and policies for those injured, killed, or suffered property losses when participating in firefighting and rescue operations; promptly encourage and reward collectives and individuals with outstanding achievements in fire prevention and fighting work.
4. Direct the construction of strategies, plans, and scenarios for fire prevention and fighting, focusing on national key areas, projects, urban areas, industrial zones, commercial areas with high fire and explosion risks, protective forests, and special-use forests. Implement integrated planning for economic and social development of localities linked to fire prevention and firefighting infrastructure planning, focusing on building transportation networks and water supply systems to meet firefighting service requirements. Promptly implement the relocation of production and business establishments dealing with hazardous chemicals and goods with high fire and explosion risks out of residential areas and densely populated places as stipulated by law.
4. Direct the development of strategies, plans, and schemes for fire prevention and firefighting, with emphasis on national key areas, projects, industrial zones, commercial areas with high risk of fire and explosion, protective forests, and special-use forests. Implement comprehensive socio-economic development planning at the local level in conjunction with infrastructure planning for fire prevention and firefighting, prioritizing the construction of transportation networks and water supply systems to meet firefighting requirements. Promptly implement the relocation of production and business facilities dealing with hazardous and dangerous goods with high risk of fire and explosion away from residential areas and densely populated places as prescribed by law.
5. Enhance the effectiveness of fire prevention and fighting inspection and supervision work; take measures to thoroughly address construction projects currently violating laws on fire prevention and fighting. Publicize fire prevention and fighting regulation-violating projects and constructions through mass media. Resolutely suspend or halt ongoing projects and constructions that violate fire prevention and fighting laws until all violations are fully rectified; end the practice of newly constructed facilities being put into use without fire prevention and fighting acceptance inspections. Strictly handle organizations and individuals violating fire prevention and fighting laws and consider the responsibility of heads of agencies and organizations involved according to the law.
Study and develop management mechanisms to ensure electrical safety, especially in the installation and use of electrical equipment at premises and households in accordance with the Electricity Law, meeting requirements for fire prevention and fighting.
6. Enhance the effectiveness of firefighting, rescue, and emergency response operations of fire prevention and fighting forces. Regularly organize training, drills, and practical exercises for fire and explosion incident handling plans and scenarios. Research comprehensive solutions to minimize fire and explosion incidents, particularly large fires causing significant casualties and property damage.
Strengthen the development of fire prevention and fighting police forces to meet mission requirements, focusing on expanding networks of fire prevention and fighting police units in key areas and regions. Allocate land for building offices, barracks, and training centers for fire prevention and fighting police units in locations suitable for fire prevention and fighting and rescue operations. Accelerate the implementation of decentralization and delegation of certain fire prevention and fighting tasks to local police forces and village police.
Review, adjust, and supplement the master plan proposal for the overall system of fire prevention and fighting police force facilities up to 2020 and vision to 2030. Develop and promulgate infrastructure planning for fire prevention and fighting in accordance with the law.
7. Ensure state budget allocation for fire prevention and fighting activities and fire prevention and fighting police forces at various levels to meet mission requirements. Implement regulations on regular support for civilian defense team leaders and deputy leaders and non-professional fire prevention and fighting teams.
8. Promote socialization in fire prevention and fighting, encouraging organizations and individuals to participate in building and developing technical infrastructure for fire prevention and fighting, researching and transferring technology, producing fire prevention and fighting equipment and rescue tools. Strictly implement the provisions of the Fire Prevention and Fighting Law regarding mandatory fire and explosion insurance.
9. Expand international cooperation, enhance information exchange, share experiences, transfer advanced technology, and improve professional expertise in fire prevention and fighting. Study the application of technology and advanced scientific and technological solutions related to fire prevention and fighting.
Article 3
1. The Government, the Prime Minister, Ministries, ministerial-level agencies, agencies under the Government, the Supreme People's Court, the Supreme People's Procuracy, the State Audit Office, Provincial People's Councils, and Municipal People's Councils directly under the Central Government within their respective duties and authorities shall direct the organization and implementation of this Resolution and supervise its implementation.
Annually, the Government shall report to the National Assembly on the results of implementing this Resolution at the final session of the year.
2. The Standing Committee of the National Assembly, the National Ethnic Council, the Committees of the National Assembly, Delegations of the National Assembly, National Assembly deputies, People's Councils at all levels, the Vietnam Fatherland Front, and its member organizations within their respective duties and authorities shall oversee the implementation of this Resolution.
