Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the Education Law dated June 14, 2005;
Pursuant to Decision No. 191/2006/QD-TTg dated August 17, 2006 of the Prime Minister regarding the Program of Action of the Government to implement Resolution No. 54/NQ-TW dated September 14, 2005 of the Politburo;
Pursuant to Resolution No. 31/2007/NQ-CP dated June 31, 2007 of the Government on reviewing and adjusting the land use plan until 2010 and the five-year land use plan (2006-2010) of Hung Yen Province;
Pursuant to Decision No. 121/2007/QD-TTg dated July 27, 2007 of the Prime Minister approving the planning of the network of universities and colleges for the period 2006-2020;
Considering the proposal of the Chairman of the People's Committee of Hung Yen Province and the Minister of Education and Training,
DECISION:
Clause 4 of Article 6Approves the Project on Establishing Pho Hien University City in Hung Yen Province, with the main contents as follows:
1. Location and scale of land use:
- The construction site is located in Hanoi City and Tien Lu District, Hung Yen Province: to the East, it borders Highway 61; to the West, it borders Dien Bien River; to the South, it borders National Highway 39A; to the North, it borders National Highway 38B (formerly National Highway 39B);
- The scale of land use is approximately 1,000 hectares, including about 700 hectares for building higher education institutions, scientific research, and technology development facilities and about 300 hectares for urban construction;
2. Objectives:
- To meet the requirements of expanding the scale and improving the quality of higher education for the Northern Key Economic Region and the Hanoi Capital Region, in line with the strategy for developing education and training and the trend of international integration;
- Establish a new model for organizing the construction and investment in higher education institutions, scientific research, and technology development facilities towards concentration and modernization according to regional and international standards;
- Contribute to the distribution of the network of universities and colleges in the Hanoi Capital Region and the Red River Delta; reduce some universities and colleges from the inner city of Hanoi, creating conditions for expanding, renovating, and constructing new technical infrastructure of universities in accordance with standardization.
3. Requirements:
a) Regarding nature:
- The University City includes a multi-disciplinary and multi-field higher education institution complex, high-quality scientific research and technology development facilities, which is part of the network of universities and colleges;
- The University City comprises various legal entities organized and invested in within a unified planning space, ensuring synchronization, modernity, and strong traditional characteristics; utilizing the common infrastructure and utilities system; attracting investment according to planning and managing according to regulations.
b) Regarding structure:
The University City includes:
- Higher education institutions, scientific research, and technology development facilities relocated from Hanoi or newly established according to regulations;
- Jointly operated higher education institutions, scientific research, and technology development facilities established according to regulations on joint investment and cooperation with foreign countries.
Among them, priority will be given to attracting fields such as high-tech engineering: information technology, electromechanical and automation, new materials technology, biotechnology, urban and industrial environmental technology; economic fields like business management, finance-banking; agricultural machinery, agricultural product preservation and processing, rural industry, and foreign languages.
4. Scale:
a) Approximately 80,000 students and around 500-1,000 staff members of scientific research and technology development facilities;
b) Construction scale:
The area of buildings serving educational activities and research is approximately 1,537,000 square meters; the area of buildings serving student residential activities is approximately 529,000 square meters; the area of construction for administrative offices for staff and lecturers is approximately 34,000 square meters.
5. Capital and sources of investment capital:
a) Land clearance costs, construction of general technical infrastructure (for approximately 1,000 hectares), estimated at 55,300 billion VND, including:
- Compensation, support, land clearance, job creation, and livelihood stabilization for people whose land is expropriated, estimated at 12,500 billion VND;
- Costs for constructing general technical infrastructure, estimated at 42,800 billion VND.
Sources of investment include: revenue from the auction of land use rights for approximately 300 hectares, estimated at 48,000 billion VND; targeted state budget support and other legitimate sources of funding, estimated at 7,300 billion VND.
b) Sources of capital for constructing higher education institutions, scientific research, and technology development facilities include:
- Legitimate capital of public higher education institutions such as: basic construction capital invested from the state budget according to annual plans, revenue from the conversion of part or all assets and land use rights at old school sites when relocated or moved to the University City; preferential domestic credit, official development assistance (ODA); joint venture and cooperative investment both domestically and internationally, and other legitimate sources of capital;
- Self-owned capital of non-public higher education institutions; socialized capital; foreign investment according to state regulations.
c) Sources of capital for constructing social infrastructure and public service projects - mobilized from legitimate investment capital of domestic and foreign investors.
6. Implementation period of the Project: from 2009 to 2020.

1. The Project is divided into three implementation phases as follows:
- Phase I (2009-2011): Detailed planning for the construction of the University City; compensation, support, and land clearance; implementing the project to build technical infrastructure for approximately 650 hectares (including 300 hectares for urban construction; 350 hectares for higher education institutions, scientific research, and technology development facilities) and implementing the project to construct some higher education institutions;
- Phase II (2012-2015): Completing the construction of 350 hectares and the entire technical infrastructure of the University City and constructing some higher education institutions, scientific research, and technology development facilities;
- Phase III (2016-2020): Completing all investment projects, putting higher education and training, scientific research, and technology development facilities in the University City into operation.
2. Management, investment construction, and operation of Phố Hiến University City:
a) The main investor agency: People's Committee of Hưng Yên Province;
b) The project investor: Phố Hiến University City Management Board.
The Phố Hiến University City Management Board is a subordinate agency under the People's Committee of Hưng Yên Province responsible for directly managing state administrative functions related to the University City; organizing and managing administrative public service activities and other supporting services related to the investment construction and operation of the University City.
The Phố Hiến University City Management Board is established and its operational regulations approved by the Prime Minister based on the proposal of the People's Committee of Hưng Yên Province and the Ministry of Education and Training; it has legal personality, a seal with the National Emblem, and a separate account; its administrative management budget, public service activity expenses, and development capital are provided from the state budget annually and other lawful sources.
c) The main tasks of the Phố Hiến University City Management Board include:
- Advising the People's Committee of Hưng Yên Province and relevant ministries and sectors on drafting legal normative documents, policies, and plans related to the investment and development activities of the University City;
- Leading and coordinating with relevant agencies to establish mechanisms for working with specialized agencies under the People's Committee of Hưng Yên Province or other relevant agencies to implement assigned tasks and powers through a single-window mechanism, submitting to the People's Committee of Hưng Yên Province for approval and implementation;
- Receiving investment project registration applications, organizing reviews, issuing and adjusting investment certificates;
- Organizing detailed construction planning for the University City; selecting consulting firms with sufficient capacity, including foreign consultants; submitting to the main investor agency for review and approval based on the agreement of the Ministry of Construction;
- Organizing land auction rights, selecting investors for essential infrastructure construction in the University City; managing, inspecting, and supervising construction according to the approved plan and schedule of infrastructure component projects, managing construction quality and environmental protection in accordance with regulations;
- Establishing a Project Management Board to assist the investor in managing component infrastructure projects funded by state budget nature capital (preferential loans, ODA funds, targeted central support funds, or other lawful sources);
- Implementing social policy, labor, environmental protection, fire prevention, security, and social safety regulations within the University City;
- Establishing criteria and conditions for selecting educational and research institutions to enter the University City, submitting to the People's Committee of Hưng Yên Province for approval based on the unified opinion of the Ministry of Education and Training; organizing the reception, management, construction, and operation of educational and research institutions in accordance with the plan and regulations of the University City;
- Issuing regulations and managing business activities of infrastructure development services and public welfare services provided by economic entities investing in and operating within the University City.
3. Responsibilities of the People's Committee of Hưng Yên Province:
- Fulfilling the responsibilities of the main investor agency as prescribed by law;
- Directing the implementation of compensation, land clearance, job placement, and social policies for households whose land is expropriated, ensuring social security;
- Directing land auctions and investor selection in accordance with regulations;
- Leading and coordinating with the Ministry of Education and Training to submit to the Prime Minister for the establishment of the University City Management Board and approval of its operational regulations;
- Directing the preparation of construction plans, organizing reviews, and approving general and detailed construction plans for the University City based on the opinions of the Ministry of Construction;
- Leading and coordinating with the Ministry of Education and Training to issue criteria and conditions for higher education institutions and scientific research and technological development organizations entering the University City;
- Coordinating with the Ministry of Planning and Investment, the Ministry of Finance, and relevant ministries and sectors to propose plans for balancing capital support for the construction of the University City's infrastructure system in accordance with progress;
- Leading and coordinating with relevant ministries and sectors to develop and issue or submit to competent authorities for issuance of preferential mechanisms and policies to attract investment in the University City, and preferential policies and incentives for staff and lecturers of training and research institutions when working at the University City.
4. Responsibilities of Ministries and Sectors:
a) Ministry of Education and Training:
- Coordinating with the People's Committee of Hưng Yên Province to submit to the Prime Minister for the establishment of the Phố Hiến University City Management Board and its operational regulations; participating in the planning of the University City; issuing criteria and conditions for higher education institutions entering the University City;
- Directing and guiding the implementation of state administrative management of education in the University City within their authority; creating favorable conditions for new universities to be established and relocated to the University City;
- Leading and coordinating with the Ministry of Home Affairs and relevant ministries and sectors to develop and issue necessary regulations and guidelines serving the University City and its development mechanisms and policies;
- Leading the proposal and organization of mobilization of investment capital for public training institutions and coordinating with the People's Committee of Hưng Yên Province to mobilize capital to implement the project.
b) Ministry of Planning and Investment, Ministry of Finance:
- Coordinating with the People's Committee of Hưng Yên Province and relevant ministries and sectors to study policies, mechanisms, and allocation of state budget capital, mobilizing ODA funds, attracting foreign investment to support the construction and development of the Phố Hiến University City.
c) Ministry of Construction:
- Guiding the preparation of construction plans for the University City and providing comments on the general and detailed plans before the main investor agency approves them.
d) Ministry of Natural Resources and Environment:
- Leading and coordinating with relevant ministries and sectors and the People's Committee of Hưng Yên Province to guide the preparation of environmental improvement and protection projects; guiding or issuing additional regulations on land policies, resource management, and environmental protection related to the University City.
đ) Ministry of Home Affairs:
To主持,与教育部、河南省人民委员会和相关部委配合指导实施关于组织机构结构、编制和大学区管理委员会活动的规定。
e) 其他相关部委根据其职能、任务和被授予的权限,配合指导河南省人民委员会实施该方案,确保方案进度和效果。
5. 优惠政策机制:
大学区裴仙可以适用有关高等教育领域的所有优惠政策,依据《投资法》、《建设法》、《教育法》以及关于鼓励社会力量参与教育、职业培训、医疗、文化、体育、环境等领域活动的政策;关于试点投资建设社会基础设施供非公立单位长期租赁的机制;关于为大学生、高等专科生和职业培训学生提供住房租赁的一系列机制和政策。
