JOINT CIRCULAR
Guidelines on the organization for vocational training management at the central level and localities
Implementing Article 4 and Article 5 of Decree No. 33/1998/NĐ-CP dated May 23, 1998 of the Government on the establishment of the General Department of Vocational Training under the Ministry of Labor, Invalids and Social Affairs, the Ministry of Labor, Invalids and Social Affairs and the State Administration of Organization and Civil Servants of the Government provide guidelines on the organization for vocational training management in ministries, agencies equivalent to ministries, and government agencies (collectively referred to as ministries) and in provinces directly under the central government (collectively referred to as provinces) as follows:
A. ORGANIZATION FOR VOCATIONAL TRAINING MANAGEMENT IN MINISTRIES
I. ON OBJECTIVES AND SCOPE
Due to different characteristics and nature of sectoral or field-specific management, the functions and tasks of ministries managing sectors or fields also differ. Therefore, in the vocational training sector, some ministries do not have vocational training institutions. Thus, it is not necessary for all ministries to have specialized organizations responsible for vocational training management.
This joint circular stipulates the organization for vocational training management in ministries that have functions and tasks related to vocational training and possess vocational training institutions.
II. FUNCTIONS AND TASKS OF THE VOCATIONAL TRAINING MANAGEMENT ORGANIZATION
The Department of Organization and Cadres of the Ministry shall assist the Minister in performing the function of vocational training management, including the following tasks.
1. Drafting documents (Decisions, Directives...) within the scope of responsibility of the Ministry regarding vocational training.
Drafting the list of vocational training programs, technical skill levels, objectives, curricula, regulations, and methods of vocational training; concretizing the organizational and operational regulations of vocational training institutions, teacher standards, school standards, examination regulations, and graduation certificate issuance regulations for various types of vocational training institutions under the Ministry in accordance with state regulations and guiding their implementation.
2. Developing the planning system for vocational training institutions, including those under general companies and those directly under the Ministry.
3. Summarizing and developing long-term and annual plans for vocational training (including training quotas, vocational training fields, training funds, training, upgrading, supplementing cadres and teachers, and investment in infrastructure development) for vocational training institutions under the Ministry. Guiding the implementation after the plan is approved.
4. Implementing international cooperation in the vocational training sector under the Ministry when assigned by the Minister or head of the agency.
5. Monitoring and inspecting the implementation of organizational and operational regulations, curricula, and compliance with laws and policies on vocational training for vocational training institutions under the Ministry's management.
6. Periodically compiling reports on the organizational and operational status of vocational training institutions under the Ministry's management.
7. Performing other tasks related to vocational training assigned by the Minister.
III. ORGANIZATION AND STAFFING
Depending on the tasks, workload, and number of vocational training institutions under the management of each ministry, the corresponding organization and staffing should be determined as follows:
Establishing a specialized department responsible for vocational training management within the Department of Organization and Cadres (or an equivalent organization with vocational training management functions).
B. ORGANIZATION FOR VOCATIONAL TRAINING MANAGEMENT IN PROVINCES
I. FUNCTIONS AND TASKS OF THE VOCATIONAL TRAINING MANAGEMENT ORGANIZATION
The Department of Labor, Invalids and Social Affairs shall assist the Provincial People's Committee in performing the state management function of vocational training, including the following main tasks:
1. Drafting documents (Decisions, Directives) within the scope of authority of the Provincial People's Committee regarding vocational training:
Participating in drafting the list of vocational training programs, technical skill levels, objectives, curricula, and training methods; concretizing the organizational and operational regulations of vocational training institutions in the locality, school standards, examination regulations, and graduation certificate issuance regulations for various types of vocational training institutions in the province in accordance with state regulations and guiding their implementation.
2. Developing the planning system for vocational training institutions, including those under departments, bureaus, and industries and those under state-owned enterprises within the province's management.
3. Summarizing and developing long-term and annual plans for vocational training (including training quotas, vocational training fields, training funds, training, upgrading, supplementing cadres and teachers, and investment in infrastructure development) for vocational training institutions in the locality and guiding their implementation after the plan is approved.
4. Implementing international cooperation in the vocational training sector of the locality according to the delegation and authorization of the Provincial People's Committee.
5. Inspecting and supervising the implementation of organizational and operational regulations, curriculum content, and compliance with laws and policies on vocational training for vocational training institutions under the province's management.
6. Periodically compiling reports on the organizational and operational status of vocational training institutions under the province's management.
7. Performing other tasks related to vocational training assigned by the Provincial People's Committee.
II. ORGANIZATION AND STAFFING
Depending on the provincial characteristics, workload, and number of vocational training institutions under the province's management, determine whether to establish a Vocational Training Management Department or a Vocational Training Management Division with the necessary staffing within the Department of Labor, Invalids and Social Affairs to assist the Director of the Department of Labor, Invalids and Social Affairs in implementing the tasks outlined in Section I of Part B of this Joint Circular.
C. ORGANIZATION FOR VOCATIONAL TRAINING MANAGEMENT IN DISTRICTS, QUARTERS, TOWNSHIPS, AND CITIES UNDER PROVINCES
The Department of Labor, Invalids and Social Affairs or the Department of Organization and Labor, Invalids and Social Affairs in districts, quarters, townships, and cities under provinces (collectively referred to as districts) shall assist the District People's Committee in performing the state management function of vocational training according to the delegation of the Provincial People's Committee.
D. IMPLEMENTATION ORGANIZATION
1. The Ministers of the ministries, the heads of government agencies equivalent to ministries, the heads of government agencies, and the Chairpersons of the People's Committees of the provinces and centrally governed cities shall base themselves on Decree No. 33/1998/NĐ-CP dated May 23, 1998 of the Government and this Circular to issue appropriate decisions regarding the organization and staffing for vocational training management within their respective areas of responsibility.
2. This joint Circular shall take effect fifteen days from the date of signature.
During implementation, if there are any difficulties, suggestions for supplementation, or amendments, the ministries and localities are requested to promptly report to the Ministry of Labor - Invalids and Social Affairs and the Civil Service Committee of the Government for consideration and resolution.
