CIRCULAR
Regarding the amendment of point a, Clause 6 of the Joint Circular No. 04/1998/TTLT-TS-KHĐT-TC-NHNNVN dated December 17, 1998 issued by the Ministry of Fisheries, the Ministry of Planning and Investment, the Ministry of Finance, and the State Bank of Vietnam guiding the management and use of credit capital for investment according to the state plan for projects constructing new, modifying fishing vessels and service vessels for distant-water fisheries On December 17, 1998, the Joint Ministries of Fisheries - Planning and Investment - Finance - State Bank of Vietnam issued Joint Circular No. 04/1998/TTLT-TS-KHĐT-TC-NHNNVN guiding the management and use of credit capital for investment according to the state plan for projects constructing new, modifying fishing vessels and service vessels for distant-water fisheries to implement Decree No. 393/TTg dated June 9, 1997 of the Prime Minister on the regulations for managing and using credit capital for investment according to the state plan for projects constructing new, modifying fishing vessels and service vessels for distant-water fisheries; and Decree No. 159/1998/QĐ-TTg dated September 3, 1998 of the Prime Minister amending and supplementing certain provisions of Decree No. 393/TTg dated June 9, 1997 of the Prime Minister. After four years of implementing Decree No. 393/TTg dated June 9, 1997 of the Prime Minister, the Ministry of Fisheries has summarized and evaluated the situation regarding the use of marine engines by the distant-water fishing vessel fleet in the fisheries sector. To implement the guidance of Deputy Prime Minister Nguyen Manh Cam in Official Letter No. 966/VPCP-KTTH dated March 14, 2001 of the Government Office on the importation of used marine engines.
In order to create favorable conditions for localities to effectively implement investment development programs to make the distant-water fishing program effective, the Ministry of Fisheries has drafted the content to amend point a, Clause 6 of the aforementioned Joint Circular No. 04/1998/TTLT-TS-KHĐT-TC-NHNNVN. After receiving comments from the Ministry of Planning and Investment in Document No. 1569/BKH-NN dated March 20, 2001; the State Bank of Vietnam in Document No. 285/NHNN-TD dated March 28, 2001; and the Ministry of Finance in Document No. 3375/TC-ĐT dated April 12, 2001, the Ministry of Fisheries guides the amendment and supplementation of point a, Clause 6 of Joint Circular No. 04/1998/TTLT-TS-KHĐT-TC-NHNNVN dated December 17, 1998 as follows:
- At point a, Clause 6, the sentence: "It is necessary to comply with the general directive, not to use used marine engines or substitute engines to construct or install distant-water fishing vessels" is now amended to read:
For projects of organizations and individuals who have many years of experience using used marine engines, having spare parts available, operating effectively, ensuring safety, it may temporarily use used marine engines that still meet current quality standards to install on distant-water fishing vessels. The project evaluation committee of the locality shall examine specifically and decide.
During the implementation process, if there are difficulties or obstacles, please report them promptly to the Ministry of Fisheries so that the Ministry can seek opinions from relevant ministries and sectors for consideration, supplementation, and amendment.

For projects of organizations and individuals with many years of experience using second-hand water pumps that have spare parts available, operate effectively, and ensure safety, it may temporarily be permissible to install second-hand water pumps that still meet current quality standards on distant fishing vessels. The local project evaluation board shall consider and decide specifically.
This Circular takes effect fifteen days from the date of signature.
During implementation, if there are difficulties or obstacles, they are requested to promptly reflect them to the Ministry of Fisheries so that the Ministry can seek opinions from relevant ministries and sectors for consideration, supplementation, and amendment.
