THE MINISTER OF CULTURE AND INFORMATION

Pursuant to the Law on Legislative Activities dated November 12, 1996;

BASED ON DECREE NO. 81/CP DATED NOVEMBER 8, 1993 OF THE GOVERNMENT ON THEFUNCTIONS, TASKS, POWERS, AND ORGANIZATIONAL STRUCTURE OF THE MINISTRY OFCULTURE AND INFORMATION.

CONSIDERING THE PROPOSAL OF THE DIRECTOR OF THE LOCAL CULTURE ANDINFORMATION AGENCY.

 

DECISION:

Article 1.ATTACHED TO THIS DECISION ARE THE REGULATIONS ON AWARDS FOR CULTURALFAMILY, HAMLET CULTURE, AND COMMUNITY CULTURE TITLES.

Article 2. THE REGULATIONS ON AWARDS FOR CULTURAL FAMILY, HAMLET CULTURE, ANDCOMMUNITY CULTURE TITLES ISSUED WITH THIS DECISION SHALL TAKE EFFECT 15 DAYSFROM THE DATE OF SIGNATURE.

Article 3.THE CHAIRMEN OF THE PROVINCE AND CITY PEOPLE'S COMMITTEES UNDER THECENTRAL GOVERNMENT, THE DIRECTORS OF THE MINISTRY'S OFFICES, THE DIRECTORSOF THE LOCAL CULTURE AND INFORMATION AGENCIES, THE DIRECTORS OF THEPROVINCE CULTURE AND INFORMATION DEPARTMENTS, THE HEADS OF THE MINISTRY OFCULTURE AND INFORMATION'S SUBORDINATE UNITS, AND OTHER RELATEDORGANIZATIONS, ENTITIES, AND INDIVIDUALS SHALL BE RESPONSIBLE FOR ENFORCINGTHE REGULATIONS ISSUED WITH THIS DECISION./.

 

REGULATIONS

AWARDS FOR CULTURAL FAMILY,

HAMLET CULTURE, COMMUNITY CULTURE

JANUARY 2, 2002 OF THE MINISTER OF CULTURE AND INFORMATION)

PART I

GENERAL PROVISIONS

Article 1.

1.THESE REGULATIONS SET OUT THE AWARDS, CRITERIA, AND PROCEDURES FORAWARDING THE TITLES OF CULTURAL FAMILY, HAMLET CULTURE, AND COMMUNITYCULTURE TO FAMILIES, HAMLETS, AND COMMUNITIES THAT HAVE MADE MANYACHIEVEMENTS IN THE "MOVEMENT FOR THE WHOLE PEOPLE TO JOIN HANDS INBUILDING A CULTURAL LIFESTYLE IN RURAL AREAS."

2.THE FAMILIES, HAMLETS, AND COMMUNITIES REFERRED TO IN CLAUSE 1 OF THISARTICLE INCLUDE:

a) VIETNAMESE FAMILIES RESIDING IN VIETNAM;

b) HAMLETS, VILLAGES, APPTS, BANS, BUONS, SOCS, ETC., COLLECTIVELY REFERREDto AS HAMLETS;

c) COMMUNITIES, BLOCKS, NEIGHBORHOODS, COLLECTIVE HOUSING AREAS, ETC.,COLLECTIVELY REFERRED TO AS COMMUNITIES.

Article 2.

1.THE AWARDS FOR CULTURAL FAMILY, HAMLET CULTURE, AND COMMUNITY CULTURETITLES ARE RECOGNIZED AT TWO LEVELS:

a) CULTURAL FAMILY, HAMLET CULTURE, AND COMMUNITY CULTURE TITLES ARERECOGNIZED BY THE DISTRICT, CITY QUARTER, OR PROVINCE CITY PEOPLE'S COMMITTEE;

b) CULTURAL FAMILY, HAMLET CULTURE, AND COMMUNITY CULTURE TITLES ARERECOGNIZED BY THE PROVINCE OR CITY PEOPLE'S COMMITTEE UNDER THE CENTRALGOVERNMENT.

2.THE MINISTRY OF CULTURE AND INFORMATION SHALL DECIDE TO BESTOW AWARDS ONEXEMPLARY HAMLET CULTURE AND COMMUNITY CULTURE TITLES PROPOSED BY THEPROVINCE OR CITY PEOPLE'S COMMITTEE UNDER THE CENTRAL GOVERNMENT.

Article 3.THE RECOGNITION OF CULTURAL FAMILY, HAMLET CULTURE, AND COMMUNITY CULTURETITLES, AND THE BESTOWAL OF AWARDS ON EXEMPLARY HAMLET CULTURE ANDCOMMUNITY CULTURE TITLES MUST ENSURE TRANSPARENCY, DEMOCRACY, AND ACCORDWITH THE STANDARDS.

Chapter II

CRITERIA AND PROCEDURES FOR RECOGNITION OF CULTURAL FAMILY,

HAMLET CULTURE, COMMUNITY CULTURE AWARDS FOR EXEMPLARY HAMLET CULTURE,

COMMUNITY CULTURE

 

Section 1. CRITERIA AND PROCEDURES FOR RECOGNITION OF CULTURAL FAMILYA

Article 4.CRITERIA FOR RECOGNITION OF CULTURAL FAMILY:

1.A WARM, HARMONIOUS, PROGRESSIVE, HEALTHY, AND HAPPY FAMILY:

a) THE FAMILY HAS A STABLE ECONOMY, IS HARMONIOUS, HAS DISCIPLINE ANDROUTINES, AND DOES NOT HAVE ANYONE INVOLVED IN SOCIAL EVILS;

b) PRACTICES CIVILIZED LIFESTYLES, PRESERVES TRADITIONAL CUSTOMS, AND DOESNOT USE PROHIBITED CULTURAL PRODUCTS;

c) ALL CHILDREN OF SCHOOL AGE ARE ENROLLED IN SCHOOL AND MEET THE UNIVERSALELEMENTARY EDUCATION STANDARDS OR HIGHER;

d) FAMILY MEMBERS CARE FOR THEIR HEALTH, MAINTAIN SANITATION, AND PREVENTILLNESS.

2.COMPLY WITH CITIZEN OBLIGATIONS:

a) FAMILY MEMBERS COMPLY WITH PARTY POLICIES AND STATE LAWS;

b) MAINTAIN NATIONAL SECURITY, POLITICAL STABILITY, PUBLIC ORDER, ENVIRONMENTALHYGIENE, AND CIVILIZED PUBLIC BEHAVIOR;

c) PARTICIPATE IN THE PROTECTION AND PRESERVATION OF LOCAL HISTORICAL ANDCULTURAL HERITAGES AND SCENIC SPOTS.

3.IMPLEMENT FAMILY PLANNING:

a) EACH COUPLE'S CHILDREN DO NOT VIOLATE FAMILY PLANNING POLICIES;

b) HAVE DEVELOPMENT PLANS THAT LEAD TO LEGITIMATE WEALTH;

c) HAVE REASONABLE CONSUMPTION AND SAVING PLANS.

4.PROMOTE MUTUAL SUPPORT IN THE COMMUNITY:

a) WORK TOGETHER WITH THE COMMUNITY AND HELP EACH OTHER IN LABOR ANDPRODUCTION, ESPECIALLY IN TIMES OF DIFFICULTY AND DISASTER;

b) PARTICIPATE IN RESOLVING DISPUTES IN THE COMMUNITY;

c) ENGAGE IN CHARITABLE ACTIVITIES TO BUILD A STABLE AND STRONG COMMUNITYAND ENCOURAGE OTHER FAMILIES TO PARTICIPATE.

Article 5.CULTURAL FAMILY TITLES RECOGNIZED BY THE DISTRICT, CITY QUARTER, OR PROVINCECITY PEOPLE'S COMMITTEE:

1.CRITERIA:

a) MEET THE CRITERIA SET OUT IN ARTICLE 4 OF THESE REGULATIONS;

b) HAVE BEEN CONTINUOUSLY RECOGNIZED AS A CULTURAL FAMILY FOR AT LEAST THREEYEARS BY THE "WHOLE PEOPLE MOVEMENT TO JOIN HANDS IN BUILDING A CULTURALLIFESTYLE IN RURAL AREAS" ADVOCACY COMMITTEE AT THE COMMUNE, WARD, OR TOWNLEVEL.

2.THE APPLICATION DOCUMENTS SHOULD INCLUDE:

a) A LETTER OF REQUEST FROM THE COMMUNE, WARD, OR TOWN PEOPLE'S COMMITTEE;

b) A REPORT ON CONTINUOUS ACHIEVEMENTS OVER THE LAST THREE YEARS, CONFIRMEDBY THE COMMUNE, WARD, OR TOWN PEOPLE'S COMMITTEE; c) A RECORD OF MEETING AND RECOMMENDATION BY THE "WHOLE PEOPLE MOVEMENT TOJOIN HANDS IN BUILDING A CULTURAL LIFESTYLE IN RURAL AREAS" ADVOCACY COMMITTEEOF THE COMMUNE, WARD, OR TOWN.

BASED ON THE REQUEST OF THE COMMUNE, WARD, OR TOWN PEOPLE'S COMMITTEE, THELOCAL CULTURE AND INFORMATION OFFICE SHALL COOPERATE WITH THE LOCAL AWARDSAND RECOGNITION AGENCY TO REVIEW, EVALUATE, AND RECOMMEND TO THEDISTRICT, CITY QUARTER, OR PROVINCE CITY PEOPLE'S COMMITTEE TO DECIDE ONRECOGNIZING THE CULTURAL FAMILY TITLE.

3.CULTURAL FAMILY TITLES RECOGNIZED BY THE PROVINCE OR CITY PEOPLE'S COMMITTEEUNDER THE CENTRAL GOVERNMENT:

Article 6.a) MEET THE CRITERIA SET OUT IN ARTICLE 4 OF THESE REGULATIONS;

1.CRITERIA:

b) HAVE BEEN CONTINUOUSLY RECOGNIZED AS A CULTURAL FAMILY FOR AT LEAST FIVEYEARS BY THE DISTRICT, CITY QUARTER, OR PROVINCE CITY PEOPLE'S COMMITTEE.

a) A LETTER OF REQUEST FROM THE DISTRICT, CITY QUARTER, OR PROVINCE CITYPEOPLE'S COMMITTEE;

2.THE APPLICATION DOCUMENTS SHOULD INCLUDE:

b) A REPORT ON CONTINUOUS ACHIEVEMENTS OVER THE LAST FIVE YEARS, CONFIRMEDBY THE DISTRICT, CITY QUARTER, OR PROVINCE CITY PEOPLE'S COMMITTEE;

c) A RECORD OF MEETING AND RECOMMENDATION BY THE DISTRICT, CITY QUARTER, ORPROVINCE CITY AWARD AND RECOGNITION COMMITTEE.

BASED ON THE REQUEST OF THE DISTRICT, CITY QUARTER, OR PROVINCE CITYPEOPLE'S COMMITTEE, THE PROVINCE CULTURE AND INFORMATION DEPARTMENT SHALLCOOPERATE WITH THE LOCAL AWARD AND RECOGNITION AGENCY TO REVIEW, EVALUATE,AND RECOMMEND TO THE PROVINCE OR CITY PEOPLE'S COMMITTEE UNDER THE CENTRALGOVERNMENT TO DECIDE ON RECOGNIZING THE CULTURAL FAMILY TITLE.

3.CRITERIA AND PROCEDURES FOR RECOGNITION OF HAMLET CULTURE

Section 2. GENERAL CRITERIA FOR RECOGNITION OF HAMLET CULTURE TITLES:

Article 7.STABLE AND DEVELOPING ECONOMIC LIVING CONDITIONS:

1.a) AT LEAST 80% OF HOUSEHOLDS HAVE STABLE ECONOMIC LIVING CONDITIONS; MANYHOUSEHOLDS ARE WEALTHY, LESS THAN 5% ARE POOR, AND THERE ARE NO HOUSEHOLDSIN POVERTY;

b) AT LEAST 80% OF HOUSEHOLDS LIVE IN ROOF-TILED OR PERMANENTLY STABLEHOUSES OF CLASS 1, 2, OR 3 IN URBAN AND SUBURBAN AREAS.

b) At least 80% of households have tiled houses or durable houses of level 1, 2, or 3 in plain areas and suburban zones.

2.Having a healthy and rich spiritual cultural life:

a)Having appropriate cultural, educational, and health institutions, a mass art team; organizing regular cultural, sports, entertainment activities;

b)Implementing civilized living habits in weddings, funerals, festivals, and community activities; no social evils; no storage and use of prohibited cultural products;

c)At least 80% of households being recognized as Cultural Families.

3.Having a clean and beautiful environment:

a)Clean roads, village lanes with many green trees and gradually upgraded;

b)At least 80% of households using clean water and having sanitary bathrooms and latrines;

c)Restoring and protecting historical-cultural relics and scenic spots in the locality.

4.Implementing the Party's policies and state laws:

a)Effectively implementing the Party's guidelines and policies, state laws;

b)Ensuring political security, social order, and safety; effectively implementing the Grassroots Democracy Regulation; building and implementing Village Regulations and Village Agreements according to Directive No. 24/1998/CT-TTg dated June 19, 1998 of the Prime Minister;

c)Social organizations operating effectively;

d)Children of school age all attend school and meet the standard for universal primary education;

đ)Having effective gratitude and charity movements.

Article 8.Cultural Villages are recognized by the People's Committee of districts, towns, cities directly under provinces:

1.CRITERIA:

a)Meeting the standards prescribed in Article 7 of this Regulation;

b)Continuously being evaluated as Cultural Villages by the Mobilization Board for the "All-People Solidarity Movement for Building a Civilized Lifestyle in Residential Areas" at communes, wards, towns for at least three consecutive years;

c)Being proposed for recognition as a Cultural Village by the People's Committee of communes, wards, towns to the People's Committee of districts, towns, cities directly under provinces. Cultural Village.

2.THE APPLICATION DOCUMENTS SHOULD INCLUDE:

a) A LETTER OF REQUEST FROM THE COMMUNE, WARD, OR TOWN PEOPLE'S COMMITTEE;

b)A report on achievements for at least three consecutive years of the Cultural Village confirmed by the People's Committee of communes, wards, towns;

c)Minutes of the meeting to assess the competition organized by the Mobilization Board for the "All-People Solidarity Movement for Building a Civilized Lifestyle in Residential Areas" at communes, wards, towns.

3.Based on the proposal of the People's Committee of communes, wards, towns, the Department of Culture and Information is responsible for coordinating with the reward and commendation agency at the same level to inspect, evaluate, and propose the People's Committee of districts, towns, cities directly under provinces to decide on recognizing the Cultural Village.

Article 9.Cultural Villages recognized by the People's Committee of provinces, centrally-run cities:

1.CRITERIA:

a)Meeting the standards prescribed in Article 7 of this Regulation;

b)Continuously being recognized as Cultural Villages by the People's Committee of districts, towns, cities directly under provinces for at least five consecutive years;

c)Being proposed for recognition as a Cultural Village by the People's Committee of districts, towns, cities directly under provinces to the People's Committee of provinces, centrally-run cities.

2.THE APPLICATION DOCUMENTS SHOULD INCLUDE:

a)The proposal letter of the People's Committee of districts, towns, cities directly under provinces,

b)A report on achievements for at least five consecutive years of being recognized as a Cultural Village confirmed by the People's Committee of districts, towns, cities directly under provinces;

c)Minutes of the meeting to assess the competition organized by the People's Committee of districts, towns, cities directly under provinces.

3.Based on the proposal of the People's Committee of districts, towns, cities directly under provinces, the Department of Culture and Information coordinates with the Reward and Commendation Council at the same level to organize inspections, evaluations, selections, and propose the People's Committee of provinces, centrally-run cities to decide on recognizing the Cultural Village.

Article 10.Recognition criteria for Cultural Villages in mountainous provinces:

1.a) AT LEAST 80% OF HOUSEHOLDS HAVE STABLE ECONOMIC LIVING CONDITIONS; MANYHOUSEHOLDS ARE WEALTHY, LESS THAN 5% ARE POOR, AND THERE ARE NO HOUSEHOLDSIN POVERTY;

a)Settled and stable; at least 60% of households have a stable economic life, the number of poor households is less than 15%, and there are no starving households;

b)At least 60% of households have houses built or maintained stably.

2.Having a healthy and rich spiritual cultural life:

a)Having cultural-sports activity venues, maintaining traditional cultural-sports activities of the ethnic group through a mass art team;

b)Organizing weddings, funerals, festivals according to civilized customs suitable for ethnic traditions;

c)No social evils, no cultivation, trading, or use of opium, drugs; no storage and use of prohibited cultural products;

d)At least 60% of households being recognized as Cultural Families.

3.Having a clean and beautiful environment:

a)Village roads and communal lanes clean;

b)At least 60% of households using clean water and having sanitary bathrooms and latrines.

4.Implementing the Party's policies and state laws:

a)Effectively implementing the Party's guidelines and policies, state laws;

b)Ensuring political security and social order and safety; effectively implementing the Grassroots Democracy Regulation; building and implementing Village Regulations and Village Agreements according to Directive No. 24/1998/CT-TTg dated June 19, 1998 of the Prime Minister;

c)Social organizations operating effectively;

d)Children of school age all attend school and meet the standard for universal primary education.

Article 11.Recognizing Cultural Villages in mountainous provinces:

1.Applying the criteria stipulated in Article 10 of this Regulation;

2.Application procedures Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).y ban nhân dân huyện, quận, thịxã, thành phố trực thuộc tỉnh proposing recognition apply the provisions of point b, c clause 1, clause 2 and clause 3 Article 8 of this Regulation;

PART 3. STANDARDS AND PROCEDURES FOR RECOGNITION OF CULTURAL ALLEY AWARDS

Article 12Article 1. Standards for Recognition of Cultural Alley Awards:

1. Stable and gradually developing economic life:

a) At least 90% of households have stable economic lives; many wealthy households, less than 5% poor households, and no households suffering from hunger;

b) At least 90% of households have durable houses.

2. Healthy and rich cultural and spiritual life:

a) Having cultural, educational, and health institutions; cultural activity venues for entertainment; regular cultural and sports activities;

b) Implementing civilized practices in weddings, funerals, and festivals; no social evils; no possession or use of prohibited cultural products;

c) At least 90% of households recognized as Cultural Families.

3.Having a clean and beautiful environment:

a) Roads are paved with asphalt or concrete; there is a lighting system; streets and public places are clean and beautiful; implementing Decree No. 36/2001/ND-CP dated July 10, 2001 of the Government on urban traffic order and safety;

b) At least 100% of households have access to clean water; environmental hygiene is ensured;

c)Restoring and protecting historical-cultural relics and scenic spots in the locality.

4.Implementing the Party's policies and state laws:

a) Implementing all policies and guidelines of the Party and state laws;

b) Ensuring political security and social order; implementing civilized urban living habits and grassroots democracy regulations;

c)Social organizations operating effectively;

d) All children of school age attend school; achieving universal secondary education standards.

đ)Having effective gratitude and charity movements.

Article 13Cultural alleys are recognized by the People's Committee of the district, town, township, or city directly under the province: Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).y ban nhân dân huyện, quận, thị xã, thành phố trực thuộc tỉnh công nhận:

1. Regarding standards:

a) Meeting the standards stipulated in Article 12 of this Regulation;

b) Having been continuously recognized as a Cultural Alley for at least three years by the Promotion Board of the "All-People Solidarity Movement for Building a Civilized Lifestyle in Residential Areas";

c) Being proposed for recognition by the People's Committee of the town or township. Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).y ban nhân dân phường, thị trấn đề nghị Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).y ban nhân dân huyện, quận, thị xã, thành phố trực thuộc tỉnh công nhận Khu phố văn hóa.

2. The application dossier includes:

a) A proposal letter from the People's Committee of the town or township; Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).b) A report on achievements over three consecutive years recognized as a Cultural Alley, certified by the People's Committee of the town or township;

c) Minutes of the meeting to assess competitive performance of the Promotion Board of the "All-People Solidarity Movement for Building a Civilized Lifestyle in Residential Areas" of the town or township. Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).b) A report on achievements over three consecutive years recognized as a Cultural Alley, certified by the People's Committee of the town or township;

3. Based on the proposal of the People's Committee of the town or township, the Department of Culture - Information has the responsibility to coordinate with the award and commendation agency at the same level to inspect, evaluate, and propose the People's Committee of the district, town, township, or city directly under the province to decide on recognizing the Cultural Alley.

Article 14Cultural alleys are recognized by the People's Committee of the district, town, township, or city directly under the province: Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).y ban nhân dân tỉnh, thành phố trực thuộc Trung ương công nhận Khu phố văn hóa;

1. Regarding standards:

a) Meeting the standards stipulated in Article 12 of this Regulation;

2. The application dossier includes: Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).a) A proposal letter from the People's Committee of the district, town, township, or city directly under the province;

c) Being proposed for recognition by the People's Committee of the town or township. Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).b) A report on achievements over five consecutive years recognized as a Cultural Alley, certified by the People's Committee of the district, town, township, or city directly under the province; Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).c) Minutes of the meeting to assess competitive performance of the Award and Commendation Council of the district, town, township, or city directly under the province.

b) A report of five consecutive years being recognized as a Cultural Ward, with confirmation from Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).y ban nhân dân huyện, quận, thị xã, thành phố trực thuộc tỉnh, Sở Văn hóa - Thông tin phối hợp với Hội đồng Thi đua - Khen thưởng cùng cấp tổ chức kiểm tra, đánh giá xét chọn và đề nghị Ủy ban nhân dân tỉnh, thành phố trực thuộc Trung ương xét quyết định công nhận Khu phố văn hóa.

c) The minutes of the meeting to assess the competition of the Commendation and Award Council of the district, town, city under the province.

y ban nhân dân tỉnh, thành phố trực thuộc Trung ương công nhận: Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).The People's Committee of the district, town, city under the province, in coordination with the Department of Culture and Information and the Commendation and Award Council at the same level, shall organize inspections, evaluations, and recommendations for selection, and propose to the People's Committee of the province, centrally governed city to decide on recognizing a Cultural Ward.

SECTION 4. RECOGNITION OF OUTSTANDING CULTURAL VILLAGE AND CULTURAL WARD

Article 16The Ministry of Culture and Information shall present commendation certificates to outstanding Cultural Villages and Cultural Wards:

1. Regarding standards:

a) A Cultural Village that meets the standards set forth in Article 7 and a Cultural Village in mountainous areas that meets the standards set forth in Article 10; a Cultural Ward that meets the standards set forth in Article 12 of this Regulation;

2. The application dossier includes: Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).b) Recognized as a Cultural Village or Cultural Ward by the People's Committee of the province or centrally governed city;

2. The application dossier includes:

a) A proposal letter from the People's Committee of the town or township; Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).The People's Committee of the province, centrally governed city;

b) A report on five consecutive years of recognition as a Cultural Village or Cultural Ward, confirmed by the People's Committee of the province or centrally governed city;

c) Minutes of the meeting for commendation review by the Commendation and Reward Council of the province or centrally governed city.

y ban nhân dân tỉnh, thành phố trực thuộc Trung ương công nhận: Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).The People's Committee of the province or centrally governed city, the Department of Grassroots Culture and Information under the Ministry of Culture and Information, and the Commendation and Reward Council of the Ministry of Culture and Information shall be responsible for verifying achievements, selecting exemplary units, and preparing a proposal to the Minister of Culture and Information for the decision to award commendation certificates.

Chapter III

IMPLEMENTING PROVISIONS

Article 16Annually, the examination and recognition of Cultural Families, Cultural Villages, and Cultural Wards at all levels, and the commendation of outstanding Cultural Villages and Cultural Wards shall be organized once in the fourth quarter.

Article 17.

Cultural Families, Cultural Villages, and Cultural Wards recognized by The People's Committee of the district, town, city, or centrally governed city within a province shall be awarded a Recognition Decision accompanied by a certificate of recognition;

The People's Committee of the province or centrally governed city shall be awarded a Recognition Decision accompanied by a certificate of recognition;

Article 18Outstanding Cultural Villages and Cultural Wards shall be presented with commendation certificates by the Ministry of Culture and Information, accompanied by a Recognition Decision: Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).Certificates recognizing the title of Cultural Family, Cultural Village, or Cultural Ward, attached to the Recognition Decision of the People's Committee of the province or centrally governed city, shall be printed according to a unified model nationwide.

Article 19Depending on specific conditions, localities may award monetary rewards or commemorative gifts to families, villages, and wards that achieve cultural titles.

Article 20. A Cultural Family, Cultural Village, or Cultural Ward that has been recognized as such and subsequently violates any provisions of this Regulation will not be considered for further recognition or at a higher level.

Article 21This Regulation shall take effect fifteen days from the date of signature./.
