Pursuant to the Ordinance on Fees and Charges No. 38/2001/PL-UBTVQH10 dated August 28, 2001;
Pursuant to Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;
BASED ON DECREE NO. 178/CP DATED OCTOBER 28, 1994 OF THE GOVERNMENT ON THE TASKS, POWERS AND ORGANIZATIONAL STRUCTURE OF THE MINISTRY OF FINANCE;
Pursuant to Decree No. 57/2002/NĐ-CP dated June 3, 2002 of the Government detailing the implementation of the Ordinance on Fees and Charges;
Pursuant to the proposal of the People's Committee of Haiphong city (in document number 3896/CV-UB dated August 21, 2002) and the Director of the Department of Financial Policy.
DECISION:
Article 1. Issued together with this Decision is the table of levels of fee collection for the Ngoc Hai Fish Port, Do Son town, Haiphong city.
The subjects subject to the fee collection levels prescribed in this Decision are fishing vessels, transport vessels docking at the port, and transportation means and goods passing through the Ngoc Hai Fish Port.
Article 2. The revenue from the fees for using the Ngoc Hai Fish Port prescribed in this Decision is a revenue belonging to the state budget, to be managed and used as follows:
1. The entity collecting fees for using the Ngoc Hai Fish Port is allowed to retain 70% of the collected fee revenue to cover expenses for fee collection according to the expenditure items specified in point 4-b, Section C, Part III of Circular No. 63/2002/TT-BTC dated July 24, 2002 of the Ministry of Finance guiding the implementation of laws on fees and charges;
2. The entity collecting fees for using the Ngoc Hai Fish Port is responsible for declaring, paying, and settling accounts for 30% of the collected fee revenue into the state budget in accordance with the current state budget classification and the provisions of Circular No. 63/2002/TT-BTC dated July 24, 2002 of the Ministry of Finance.
Article 3. This Decision takes effect 15 days from the date of signature. Other issues related to the collection, payment, management, and use of fees not mentioned in this Decision shall be implemented in accordance with the guidance provided in Circular No. 63/2002/TT-BTC dated July 24, 2002 of the Ministry of Finance guiding the implementation of laws on fees and charges. All previous regulations contrary to this Decision are hereby abolished.
Article 4. Organizations and individuals subject to the obligation to pay fees, entities assigned the task of organizing the collection of fees for using the Ngoc Hai Fish Port, and relevant agencies are responsible for implementing this Decision.
